Gentlemen:
On February 6, 1986, the Zoning Heari.ng Exami.ner Committee met at 9:00 A.M., to
consider eight new zone reclassification applications, two change of conditions
applications, two variance requests, and one preliminary subdivision with accompany-
ing zone reclassification. Members present:- Mrs. Carstens, Chairperson; Mrs. Myers
and Mr. Odell.
Following are the applications in sequence and the action taken by the Committee.
If not appealed, these decisions will become final on February 18, 1986. All Find-
ings and Order for this hearing were signed on February 6, 1986.

The Hearing Examiner Committee found that the proposed density would
be excessive with adjoining properties in the area and that the
proposed 50-foot stall widths would be inconsistent with existing
lot frontages of the neighborhood.

Residential Office: Arger
ZE-57A-839 Chan4e of Conditions in the Local Business and Residential Office Zone
VE-164-85, Variance to Allow Off-Street Parkinq Area to Occupy Front Yard Setback
. Location: Generally located south of and adjacent to Main Avenue, between Mullan
Road and Willow Road in Section 17-25-44.

February 6, 1986,, and the members of the Committee present being
Kathleen M. Carstens, Chairperson, Jane E. Myers and Ron Odell.
B. PROPOSAL
The sponsor, James Harkin, is requesting-approval of a zone

le Approval by the Zoning Administrator of a specific li,ghting and
signing plan for the described property prior to the release of
any building permits.
2. A specific landscape plan, planting schedule and prodisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or lmpaired.
3. Direct light from any exterior area lighting flxture shall not
extend over the property bounda ry.
4. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permi ts.
5. All current standards of the Commercial Zone, as amended, shall
..be complied with in the development of this site.
. 6. :---That the,project i s subject to Section 4e 16A.0509 the Aquifer
Sensi ti de Area Overl ay Zone of the Spokane County Zoni ng
Ordinance, which sets forth various measures for Aquifer

7. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay
Zone) of the Spokane County Zoning Ordinance. Accordingly, as a
condition of approval, the sponsor/applicant shall be required
to file w1th the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
material as follows:

lo Access permits for approaches to the County Road System shall be
obtai roed from the Spokane County Engi neer.
2. Applicant shall construct Spokane County Standard, Portland
cement concrete sidewalk along lOth Avenue.
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any

4. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
- or surfaci-ng as approved by the County Engi neer, wi 11 be - - required for any portion of the project which is to be occupied
or traveled by vehicles.
5. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwi se approved by the County Engi neer.
6. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
c) COUNTY UTILITIES DEPARTMEtdT

d) COUNTY HEALTH DISTRICT
l. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and the Spokane
County Health District prior to the issuance of any building
permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of permits
by the Heal th Officer, the use of on-si te sewage di-sposal
systems may be authorized.
4. Water service shall be coordinated through the Director of
Utilities, Spokane County.
5. Water serdice shall be by an existi,ng public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited. .

5. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
6. Building permits will be required for each structure.

7. A plan for emergency equipment access is required to be
submitted prior to any land development.
8. Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifyinq the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uni form Fi re Code i s requi red pr1 or to
constructi ore of the water service. Al l requi red fi re protectfon
facilities shall be installed and made serviceable prior to and
during the time of construction.
f) WATER PURYEYOR
1. Water Purveyor is Modern Electric Water Company, and they will
supply the si te wi th adequate water for domestic, fi re and
irrigation uses once arrangements have been ma'de by the owner.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY

spills occur on paved surfaces, measures must be taken
inenediately to clean these surfaces.
3. All travelled surfaces (ingresso egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the
construction phase of the project and from motor vehicles using
the site following, completion of the project and from occupants
of the proposed project.
5. SCAPCA Regulation I. Article IV requires registration with this
Agency.

6. SCAPCA Regulation I, Article V requires that a Notice of
Construction and ApplicAtion for Approval be submitted to and
approved by our Agency prior to the construction, installation
or establishment of an air pollution source.
7. SCAPCA Regulation I. Artic-le VI and SCAPCA Regulation II,
Article IV addresses emission standards. A11 emission standards
must be met.
8. All air pollution regulations must be met.
9. Additional Comments. We request that our agency be included in
the site plan review.

Residential Office by a block rezone in 1960. That propasal called
for conversion of existing houses to offices or further public '
hearing review of new construction projects. Buffering was required
along west pro,perty lines adjacent-to other residences.
Since adoption of the Comprehensive Plan, various Pines Road
frontages, primarily along the east side, have been upgraded to
Commercial and Local Business Zones.

III. SITE DEVELOPMENT RECOMMENDATIONS
Oesi2n:. Orientation of outside activity, such as parking or display
areas, should be away f rom adjoining residential uses on the west. Dense
landscaping or screening al'ong west property line may mitigate that
activity. •
Bufferi ng.: A 15-foot wi de 1 andscape screen, consi sti ng of.a dense
fi ghjl,ow planting mix, is necessary along the westerly property lines to
serve as a buffer to adjoining residential property. Additionally, a
sight-obscuring residential type fence should be placed on the west
property 1 i'ne.
Landscaping.: A minimum 5-foot landscape strip should be required adjacent
to all other property lines. For additional aesthetic purposes,
landscaping should be placed within 60-feet of every parking stall.
Review and approval to be by the Zoning Administrator. °
Sipage: To minimize sign competition along Pines Road, suggest that
Local-Business.sign standards be placed on this site.
Circulation/Access: Sidewalks will be required along lOth Avenue.
Critical Materials/Use Activit.y: Notice shall be filed on the property to
notify tuture buyers ofi the Aquifer Sensitive Area Overlay Zone
requirements relative to protection of the Aquifer from critical materials
use and handling.
IV. SEPA ENVIRONMENTAL REVIEW
An Environme'ntal Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The rev.iew considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws,.possible standard Conditions
of Approval, the Generalized Comprehensiv.e Plan, and other County
policies and guidelines. The Zoning Admi-nistrator has determined
that "No probable significant adverse impacts" would result from the
proposa] being developed and has issued a Determination of
Non-Significance ("DNS"). '

IV. SEPA ENVIRONMENTAL REVIEW (continued)
The "DNS" vras circulated to nine other agencies of jurisdiction and
other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends February 5, 1986,
and was advertised 15 calendar days before said date in the .
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site.
The Hearing Examiner Committee may consider additional environmental'
related testimony and the "DNS" at the public hearing.
V. PLANNING SUMMARY
The proposed Commercial Zone can serve to implement the Major
Commercial category of the Comprehensive Plan, if appropriate
development measures are required to meet the Plan's goals and
objectives. The suggested conditions for site improvements,
landscaping, fencing, and sign controls are generally consistent with
the zoning trend along °Pines Road south of Sprague Avenue.
VI. CONDITIONS OF APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, hei rs, assigns, and,successors. )a) COUNTY PLANNING DEPAR114ENT
1. Approval by the Zoning Administrator of a specific lighting and
signing plan fo"r the described property prior to the release of
any building permits.
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obs`cured or impaired.
3. Direct light from any exterior area lighting fixture shall not
extend over the property boundary.
4. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permi ts.
5e All current standards of the Commercial Zone, as amended, shall
be complied with in the development of this site.

6: That the project is subject to Section 4.16A..050, the Aquifer
Sensitive Area Overlay Zone of the Spoicane County Zoning
Ordinance, which sets forth various measures for Aquifer
protecti on; speci fi cal 1y, ,measures deal'i ng wi th wastewater
,disposal, spill protection measures, and stormwater runoff.
1. That the present proposal is not detailed enough to determine `
whether or not the use of or materials stored on the site are in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overl,ay
Zone) of the Spokane County Zoning Ordinance. Accordingly, as a
condition of approval, the sponsor/applicant shall be required
to file with the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the final decision in
• this matter, a"Notice to the Public" which shall provide in
material as follows:
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE
ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT
SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIOUS.
OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4.16A
(AQUIFER SENSITIVE AREA OVERLAY ZONE). THE PROPERTY
WHICH IS THE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY
DESCRIBED AS FOLLOWS:....".
o 8. Signs for this project shall conform to standards as set forth
in Section 4.09.125 Signs.
9. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
10. Any division of land for the purpose of sale, l,ease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
11. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners' Resolution #77-1392 be initiated by the project
appli.cant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.
12. That outside activity, such as parking, display, or storage
areas, be ori ented as much as possi bl e away from any adj oi ni ng
resi denti al use to the west.
13. That a 15-foot wide landscape screen, consisting of a dense
high/low planting mix, be installed and maintained along all
westerly situated property lines.

b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
l. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. Applicant shall construct Spokane County Standard, Portland
cement concrete si de►val k al ong l Oth Av,enue.
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Heal.th District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
building permit on the property.
4. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The desi.gn,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
requi red for any porti on of the proj ect whi ch i s to be occupi ed
or traveled by vehicles.
5. Al1 required improvements shall conform to the current State of
Washingt'on Standard Specifications for Road and Bridge
Construction, and oth*er applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
6. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.

c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Commissioner-s' Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Sp.okane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
Di-stri ct. ~ 2. The owner(s) or Successor(s) in interest agree to authorize-the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to
object by the signing of a, protest petition against the
formation of a ULID by resolution,method pursuant to RCW Chapter
36.94 which inc-ludes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) f rom
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each unit shall be double-plumbed for connection to future
areawi de col 1 ecti on systems,
d) COUNTY NEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and the Spokane
County Health District prior to the issuance of any building
permit for thi s project.
2. Sewage di-sposal method shall be as authorized by the Director of
Utilities, Spokane County. 3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of on-site sewage disposal
systems may be authorized.
4. Water service shall be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.

2. Approved numbers-or addresses shall be placed on all new and
existing buildings in such*a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
3. Reclassification of an existing building shall require an
application for change of occupancy permi-t and subsequent
inspection for approval.
, 4./ Due to the sensitive storage requirements over tne Aquifer, and
~ this site lies withifn the Waste Water P~anagement area, we feel
-that some language should address the possible storage of
flammable or critical materialswithin these structures.
5. Trash enclosures shall no.t be located ad,jacent to combustible
construction or underneath windows or nonprotected eaves.
6. Building permits will be required for each structure.
7. A plan for emergency equipment access is required to be
submitted prior to.any land development.
8. Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
tiie hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uniform Fire Code is required prior to
construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction.
f) WATER PURVEYOR
1. Water Purveyor is Modern Electric Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses once arrangements have been made by the owner.

g) COUNTY AIR POLLUTION CONTROL AU.THORITY
1. Air poll.ution regulations require that dust emissions during
demol'ition, excavation and construction projects be controlled.
This may require use of water spray s, tarps, sprinklers, or
suspensi on of acti vi ty duri ng certai n weather condi ti ons. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled a's well as emissions f rom
all other construction related activi'ties. 2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. All travelled surfaces (ingress, egress,, parking areas, access
roads).must be paved and kept clean.
4. Some objectionable od'ors will likely result during the
construction phase of tlie project and from motor vehicles using
the. si te fol l owi ng compl eti on of the project and *from occupants
of the proposed project.
5, SCAPCA Regulation I. Article IU r-equires registration with this
Agency.
6. SCAPCA Regulation I. Article V requires that a Notice of
Construction and Application for Approval be submitted to and
approved by our Agency prior to the construction, installation
or establishment of an air pollution source.
7. SCAP,CA Regulation I, Article VI and SCAPCA Regulation II,
Article IV addresses emission standards. All emission standards
must be met.
8. All air pollution regulations must b.e.met.
9. Additional Comments. We request that our agency be included in
the site plan review.
