A. INTRODLICTInN
This matter having come before the Zoning Hearing Examiner Committee on June
2, 1988, and the members of the Committee present being Jim Schurra, Chairman,
Verona Southern and Don Neraas.
B. PROPOSAL
The sponsor, Tom Wilson, is requesting approval of a zone reclassificat2oa, File No
ZE-12-88, RESIDENTIAL OFFICE to REGIONAL BUSINESS (B-3) Zone, for the
purpose of contmued use as an auto sales lot. C. FINDIN GS OF FA _T
1. That the existing land use in the area is auto sales office, sales lot and auto
cleanup building, veterinary clinic, insurance office, single family restdence,
apartment complex, outbuildings, retail, and vacant.
2. Thai the Comprehensive Plan designates this area as appropriate for
MAJOR COMMERCIAL development.
3 That the existing zoaing of the property descnbed in the application is
Residential Office
4 That the provisions of RCW 43.21C (The State Environmental Policy Act) have
been complied with, and the Committee concurs with the Determination of
Non-Significance.
5. That the proper legal requirements for advertzsement of the Agenda Item have
been fulfilled.
6 That the land use io this area is suitable for the proposed use, or uses within
the proposed Zone Classification.

7 That the applicant has demonstrated that conditions have substantially
changed since the onginal zoning of ihis area and accordingly, the proposed
rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed disapproval of the proposed use
10 The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detnmental to the public
health, safety, and welfare.
11. The following are additional fiodings of fact considered by the Heanng
Examiner Committee:
a. That the applicant's representative indicated that they could easily comply
with all the conditions of approval by September 30, 1988.

(All Conditions imposed by the Zoning Hearing Examiaer Committee shall be
binding on the "Applicant", which term shall include the owner or owners of the
property, heirs, assigns, and successors.)
HEARIN . EXAMINER COMMITTEE
l. That the structure (desigaatcd as the "storage%lean-up building) on the _
site plan shall be soundproofed to comply with noise standards for a
commercial noise sourcc as identified by WAC-173-60-040.
2. That tall landscaping along the west property line shall be provided to
screen the view from the apartments that are located to the west.
3. That existing trees on site shall remain until such time as the existing
structures are removed and new structures are placed on site
4. That the area between the residence (used as an office and at the southeast
corner of the site) and Piaes Road shall be completely landscaped.
S That a public hearing shall be held no later than November 3, 1988, if full
compliance with all conditions of approval have not been complied with by
September 30, 1988 The Zoning Administrator may waive this public
hearing requirement if compliance has been demonstrated. The purpose of
the public heanng shall be to consider reverting the zoning back to the
Residential Office Zone

Standard:
1. The Zoning Administrator shall approve a specific extenor lighting plan
for the approved area prior to installation of such lighting (Such plan
shall attempt to confine illumination to the area with full consideration to
adjacent properties)
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning Administrator shall
be submitted with a performance bond for the project pnor, to release of
building pcrmits. Landscaping shall be installed and maintained such that
sight distance at access points is not obscured or impaired
3. The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee.
Variations when approved by the Zooing Administrator will be permitted,
including, but not limited to the following changes: Buiiding location,
landscape plans, and general allowable uses of the permitted zone. All
vanations must conform to regulations set forth in the ZONING CODE FOR
SPOKANE COUNTY Thc onginal intent of the development plans shall be
maintained.
4. Direct light from any extenor area ligbting fixture shall not extead over
the property boundary
5 The specific development plan will be submitted for Planning Department
review and approval pnor to issuance of building permits.
6. All current standards of the Regional Business (B-3) Zone, as amended,
shall be complied with in the development of this site
7 That the project is subject to Section 7.06, the Aquifer Sensitive Area
averlay Zone of the ZONING CODE FOR SPOKANE COUNTY, whicb sets forth
vanous measures for Aquifer protection; specifically, measures dealing
with wastewater disposal, spiil protection measures, and stormwater runoff
8 Applicant shall comply with '208' recommendations conceming
stormwater runoff and provide necessary landscaping for runoff.
9 Any division of land for the purpose of sale, lease or transfer, shall comply
with RCW 58-17 and the Spokane County Plattiog Ordinances pnor to
issuance of building permits
Special:
10 That fencing, laadscaping, and hard surfacing of parking areas as
indicated on the site plan or as approved by the Zoning Administrator shall
be provided prior to issuance of occupancy permits or September 30, 1988,
whichever comes first

Prior To The Issuance Of A Building Permit Or Use Of The PropertTv As_ Prolposed
Standard:
1. Access permits and improvements to SR-27 (Pines Road) must be approved
by the Washington State Department of Transportatioo (WSDOT).
2. The applicant shall submit for approval by the Spokane County Engineer
and the Spokane County Health District a detailed combined on-site sewage
system plau and surface water disposal plan for the entire project or any
portion thereof, if the development is to be phased
3. A parkiag plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. Tbe design, location, and
arrangement of parking stalls shall be in accordance with standard traffic
engineering practices. Paving or surfacing as approvcd by the County
Engineer, will be required for any portion of the project which is to be
occupied or traveled by vehicles.
4. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge Construction, and
other applicable County standards and/or adopted resolutions pertaining to
Road Standards and Stormwater Management in effect at the dato of
construction, unless otherwise approved by the County Engineer.

5. Roadway standards, typical roadway sections and drainage plan
rcquirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this proposal.

1. Sewage disposal method shall be as authonzed by the Director of Utilities,

Spokane County.
3. Water service shall be by an existing public water supply.
4. Use of private wells and water systems is prohibited.

cubic yards or greater shall not be stored or placed within five feet of
combustible walls, openings or combustible roof eave lines.
4. The applicant shall provide verification from the Fire Distnct to the
Department of Building and Safety that provisions have been made for
adequate fire protection prior to the release of building permits

Residential Office to Regional Business (B-3) Zone for the purpose of

The site is generally located west of and adjacent to Pines Road,
approximately 100 feet south of Fourth Avenue in Section 21-25-44 Tax

The Major Commercial Category is designed to prvvide opportunities for
a vanety of retail and office uses Specific Decision Guidelines suggest
that projects be sensitive to adjoining land uses, be served by
commercial utilities and coniain aesthetic qualities Land use
compatibility can be achieved through buffering such as landscaping,
fencing, open spacc or change in land use.

Pines Road frontages have been upgraded to Multiple Family Suburban,
Residentiai Office, and Local Business since the 1970's Recent zone
changes have been to Commercial and B-2 zoning. This request is
consistent with this trend.

The site is being operated as an auto sales lot in the Residential Office
Zone. This zone change is needed to alIow continuance of this
operation. Full compliance with Regional Business (B-3) Zone standards
ls required, which will upgtade the site in appearance to be more
compatible with surrounding land uses.
Land uses along Pines Road have been changing from vacant and older
single family residences to apartments, offices and retail Landscaping

Praaosed Buffering Techniqjues• The site plan submitted for this zone
change indicates a six (6) foot wood fence for the western 1/2 of the site
with landscaping along Pines Road and all other property lines. A
condition recommended by the Planning Department will require
installation of fencing and landscaping prior to the issuance of
occupancy permits or by Septeffiber 30, 1988, whichever comes first.
Other Site Plan Considerations. The Regional Business (B-3) Zone
requires all areas travelled on by vehicles to be hard surfaced before a
certificate of occupancy is issued. This may result in a minor redesign
of the site.

- The site plan submitted for review by the Zoning Hearing Examiner
Committee is general in nature. Detailed review to determine
compliance with all Ordinance regulations and conditions of approval
is recommended to be administrative and to occur at the Building
Permit stage.
III.SIT . DEVELOPMENT RECOMMENDATIONS
Design. As mentioned earlier, minor redesign of the site may be required
as hard surfacing, '208' standards and landscaping are incorporated.

Electric Water Company but arrangements have not been made.

Critical Materials/Use Activity: Compliance with the Aquifer
Sensitive Area Overlay Zone is required
IV.SEPA .NYIROrIMENTAL REVIEW
An Enviroamental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department The review considered the
specifics of the proposal, other available information, County ordinances,
other regulations and laws, possible standard Conditions of Approval, the
Generalized Comprehensive Plan, and other County policies and guidelines
The Zoning Administrator has determined that "No probable significant
adverse impacts" would result from the proposal being developed and has
issucd a Dete ination of Non-Significance ("DNS").
The "DNS" was circulated to nine other agencies of jurisdiction and other
agencies/departments affected by the future development for review and
comment. The "DNS" comment period ends June 1, 1988, and was advertised
15 calendar days before sud date in the newspaper, by letter to adjacent
property owners within 400 feet of the proposal, and by notica on a sign
posted on the proposal site. The Hearing Examiner may consider additional
environmental related testimony and the "DNS" at the public heanng.
V. PL.ANNINC SUMMARY
The Regional Business (B-3) Zone implements the Major Commerclal
Category of the Comprehensive Plan. Development standards as
recommended for landscaping, fencing and Regional Business (B-3)
standards will enhance the projects compatibility with the trends along
Pines Road. Therefore, the Planning Department recommends approval as
conditioned.

Committee shall be binding on the "Applicant", which term
shall include the owner or owners of the property, heirs,
assigns, and successors.)
a ) COUNTY PLANNINC DEPARTMENT
Standard:
1. The Zoning Administrator shall approve a specific exterior lighting
plan for the approved area prior to installation of such lighting.
(Such plan shall attempt to confine illumination to the area with full
consideration to adjacent properties)
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall be
installed and maintained such that sight distance at access points is
not obscured or impaired
3 The applicant shall develop subject property generally ia
accordance within the concept presented to the Heanng Examiner
Committee. Vanations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
• changes: Building location, landscape plans, and general allowable
uses of the permitted zone. All vanations must conform to
regulations set forth in the ZONING CODE FOR SPOKANE COUNTY. The
' onginal intent of the development plans shall be maintained.
4. Direct light from any exterior area lighting fixture shall not extend
over the property boundary.
5. The specific development plan will be submitted for Planniog
Department review and approval prior to issuance of building
• permits
6. All current standards of the Regional Business (B-3) Zone, as
amended, shall be complied with in the development of this site.
7 That the project is subject to Section 706, the Aquifer Sensitive Area
Overlay Zone of the ZONING CODE FOR SPOKANE COUNTY, which sets
forth vanous measures for Aquifer protection, specifically,
measures dealing with wastewater disposal, spill protection
measures, and stormwater runoff
8 Applicant shall comply with '208' recommendations concerning
slormwater runoff and provide necessary landscaping for runoff.

2 Measures must be taken to avoid the deposition of dirt and mud from
