GENERAL. INFORMATION Applicant/Owner: PINES BAPTIST CHURCH Agent: Bobbie J. Swanson Proposal: A request to rezone an approximate 45,000 square foot site from Agricultural Suburban to Community Business (B-2) Zone for the purpose of increased signage for an existing church. Location: The site is generally located at the northwest corner of Pines Road and Eighth Avenuc in Section 21-25-44. Tax Parcel Number: A portion of 21541-2311. II.SITE ANALYSIS Comprehensive Plan: MAJOR COMMERCIAL Category Inside General Scwer Service Arca (GSSA) Boundary Inside Priority Sewer Scrvice Area (PSSA) Boundary Insidc Urban Impact Area (UTA) Boundary 17 . , II.SITE ANALYSIS ZE-47-88 Arterial Road Plan: Pines Road (SR-27), is a State Highway. Future right of way planning is the responsibility of the Washington State Department of Transportation. Eighth Avenue is planned to be a Minor Arterial with future right of way needs at 80 feet. The Planning Department recommends this additional right of way be accomplished through a future acquisition area designation for eventual County consideration. Zoning: Existing on SITE: AGRICULTURAL SUBURBAN (established 1955) and within: Aquifer Sensitive Area Overlay Zone To the NORTH: Residential Office (established 1979) To the SOUTH: Residential Office (established 1979) Agricultural Suburban (established 1955) To the EA5T: Residential Office (established 1977) To the WEST: Agricultural Suburban (established 1955) This area has been changing since the adoption of the Comprehensive Plan in 1980, and the Commercial Category being designated along Pines Road. Zone chaoges to Commercial and Regional Business (B-3) Zones have been approved and replacing older housing stock. Land Use: ExistinQ on SITE: Church (Pines Baptist Church) To the NORTH: Vacant and office To the SOUTH: Single family residential and vacant To the EAST: Single family residential and office To t-h e W EU: Church (Pines Baptist Church) Site Characteristics: Site Size: Approx. 45,000 square feet Existing BuildinQS: A portion of the Pines Baptist Church Topographx: Relatively flat ; Vegetation: Natural/landscaped Agricultural m The Major Connmercial Category of the Comprehensive Plan is not intended for agricultural protection. AdjoininQ Streets: Pines Road to the east of the site is a 70 foot County right of way improved with four paved lanes, curbs, and sidewalks. Eighth Avenue to the south of the sitc is a 60 foot County right of way improved with two paved lancs and curbs. 18 II.SITE ANALYSIS ZE-47-88 Proposed Site Plan: Existing church (proposed increased signage) Proposed BuildinEs: None Other Site Plan Considerations: The proposed sign location appears to comply with the Community Business (B-2) Zone standards and the Clear View Triangle. note: , - The site plan submitted for review by the Zoning Hearing Examiner Committee is general in nature. Detailed review to determine compliance with all Ordinance regulations and conditions of approval is recommended to be administrative and to occur at the Building Permit stage. III.SITE DEVELOPMENT RECOMMENDATIONS . S i g n a g e: As allowed by the Community Business (B-2) Zone sign standards. IV.SEPA ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Zoning Administrator has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Non-Significance ("DNS"). The "DNS" was circulated to nine other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends February 1, 1989, and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner may consider additional environmental related testimony and the "DNS" at the public hearing. V. PLANNING SUMMARY The proposed Community Business (B-2) zoning is consistent with the Comprehensive Plan and zoning trends for the arca. This zone change is for the purpose of increasing advcnising sign surface area and height than was allowed in the existing Agricultural Suburban Zone. Thc Planning Department rccommends approval. 19 VI.CONDITIONS OF APPRQYAL ZE-47-88 (All Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicani", which term shall include the owner or owners of the property, heirs, assigns, and successors.) a ) COLINTY PLANNING DEPARTMENT Special: 1. The following conditions shall apply to the subject property at the time of a change of occupancy permit or new construction permits. 2. The following conditions shall apply to the subject property upon signing the Findings and Order approving this zone change. Standard: - 3. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any• building permits. . 4. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. 5. Direct light from any exterior area Iighting fixture shall not extend over the property boundary. 6. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permits. 7. All current standards of the Community Business (B-2) Zone, as amended, shall be complied with in the development of this site. 8. That the project is subject to Section 7.06, the Aquifer Sensitive Area • Overlay Zone of, the ZONING CODE FOR SPOKANE COUNTY, which sets fonh various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and stormwater runoff. 9. That the present proposal is not detailed enough to determine whether or not the use of or matcrials stored on thc site are in compliance with Section 7.06 (Aquifer Sensitive Area Overlay Zone) of the ZONING CODE FOR SPOKANE COUNTY. Accordingly, as a condition of approval, the sponsor/applicant shall be required to file with the Spokane County Auditor, within thirty (30) days of thc 20 VI.('QNDITIQNS OF APPROVAL ZE-47-88 a) CQ INTY PLANNING DEPARTMENT signing of Findings and Order of thc final decision in this matter, a "Notice to the Public" which shall provide in material as follows: PRIOR TO THE ISSUANC'E OF ANY BUILDING PERMIT OR CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY DESOUBED HEREINAFIER, THE APPLICANT SHALL BE RESPONSIBLE FOR COMPL.YING WITH THE PROVISIONS OF THE ZONING CODE FOR SPOKANE COUNTY SECTION 7.06 (AQUIFER SENSITNE AREA OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS NOTTCE IS MORE PARTICULARLY DESCRIBED AS FOLLOWS:....". 10. If any of the above improyements are made within this area, they shall be relocated at the applicant's expense when roadway improyements are made. - c. The future acquisition area, until acquired by Spokane County, shall be private property and may be used as allowed in the zone except any improvements (such as landscaping, parking, surface drainage, drainfields, signs, or others) shall be considered "interim" uses. d.
