RE: Early Dawn Addition(s)

As a follow-up to our August meeting, and as I understand from
recent conversations you have had with members of this department,
you are now requesting a written response regarding your Early Dawn
Addition(s) concerns.
Specifically, you have requested information regarding: 1) how many
homes in the Early Dawn Addition(s) did or did not receive final
inspections; and, 2) what recourse home owner's might have should
their residence not have received a final inspection.
With regards to the first issue, of the 220 Early Dawn First and
Second address files reviewed, 78 do not indicate that a final
inspection was completed. Codes in effect at the time required
that the building official, upon notification from the permit
holder or his agent, shall make certain inspections. Among these
is the final, which is "to be made after the building is completed
and ready for occupancy."
With regards to recourse, a final inspection can be requested by
the property owner for those buildings which have not been
finalized. This final inspection would include the review of the
existing structure, including any alterations which had taken place
since initial construction. Once the final inspection is
completed, the property owner would be responsible for bringing any
hazardous violations into conformance with code requirements and
the county would work with them towards this end. The county would
probably also require that outstanding minor violations be
acknowledged by the property owner if not corrected. It is of note
that some of the problems you have alluded to may or may not be
actual code violations - the code sets forth certain minimum
construction standards, however does not "guarantee" the resulting
structure or its components.

This department will continue to investigate any complaints we
might receive regarding a lack of final inspection and will require
corrections, if necessary. These will, of necessity, need to be
handled on a case-by-case basis, researched for codes in effect at
the time, determinations made as to the extent of "hazardous" code
violations, etc.
You have indicated an involvement with some of the property owners
in the subdivision on this matter and I would encourage you to
convey the necessity to have final inspections performed so that
any potentially substandard conditions may be identified and
abated.
We, too, share your concerns regarding a lack of code compliance
and should you desire a final inspection or have any further
