INTRODUCTION
This matter has come before the Heanng Exarniner Comnuttee on October 24, 1991
The members of the Committee present are Harry Glbbons, Chairperson, Frank Yuse
and Bud Skadan
PROPOSAL
The sponsor, Don A HennchsBruce Hitchcock, requests approval of a Zone
Reclassificaaon File No ZE-38-91, from Urban Residential-3.5 (UR-3 5) to Urban
Resldential-22 (UR-22)
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located 170 feet west of Bowdish Road between Fourth
Avenue and the abandoned 1Vlilwaukee Road Rail Road nght of way in the northeast
1/4 of Secnon 21, Township 25 N, Range 44 EWM, Spokane County, Washulgton.
2. The comn-nttee adopts the Plannung Department Report as a part of this record.
3. The exisnng land use(s) in the area are single family dwellings, multiple farruly
dwellings, and undeveloped parcels
4. The Comprehensive Plan designates this site as Urban The Urban category is for the
purpose of residential development, includulg densities of 1 to 17 dwellulg units per
acre, or 13 63 dwelling units per acre for this proposal
5 The Artenal Road Plan deslgnates 4th Avenue as a Collector Artenal, with a
recommended nght of way width of 70 feet and also designates the old Niilwaukee
road railroad nght of way as a Pnncipal Artenal with a recommended nght of way
width of 160 feet.
6. The existing zoning of the property descnbed in the application is Urban Resldential-
3 5(tJR-3 5), previously established in 1991.
7 The provisions of RCW 43 21C (1'he State Envuonmental Policy Act) have been
complied with and a Deternunanon of Nonsignif'icance was issued
8. The legal requirements for public notice have been fulf'illed
9. The owners of adjacent lands expressed dhsapproval of the proposed use, and
objected to increased traffic and noise generated by the proposal, impacts to adjacent
single family dwellings, and potential impacts upon property values.
10 The proposed use is compatible with existing uses in the area.

propernes, and unplements the specific goals, objectives, and decision guidelines
of the Urban Comprehensive Plan category
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Cond.inons unposed by the Heanng Examiner Committee shall be binciing on the
"Appllcant," which term shall mclude the owner or owners of the property, heus,
assigns, and successors-in-uzterest
2. The following Condhtions of Approval apply to the real property descnbed below:
The West 141.73 feet of the East 31173 feet of Tract 176, Opporturuty,
according to plat recorded in Volume K of plats, p 20, in Spokane County,
Washington, except the nght of way 100 ft wide conveyed to the Idaho and
Western Railroad Company.
HEARING EXAMINER COMMITTEE
1 That the unpaved (gravel) cul-de-sac (with 50 foot radlus), as shown on the
proposed site plan, is a turn around area for emergency vehicles only, and shall not
be used for requued or extra off-street parlang, or for outdoor storage of
recreational vehicles or other uses
SPOKANE COUNTY PLANNING DEPARTMENT CONDITIONS
1 The proposal shall comply with the Urban Residennal-22 (UR-22) zone as
amended with the following linutations The proposal shall be restncted to a 34
- foot height lsnut and no more than 24 uruts on the site, also landscaping along the
east and west property hne shall be 10 feet wide with a 6 foot high fence where
pernutted.
2. The applicant shall develop subject property generally in accordance wnthin the
concept presented to the Heanng Body Vanations, when approved by the
Planning Duector/designee, may be pemutted, including, but not luYUted to buflding
location, landscape plans and general allowable uses of the pernutted zone. All

vanations must conform to regulahons set forth in the Spokane County Zorung
Code, and the ongznal intent of the development plans shall be maintained.
3. Approval is requued by the Planning Duector/designee of a specific hghting and
signing plan for the descnbed property pnor to the release of any building permits
4 A specif'ic landscape plan, planting schedule and provlsions for ma.intenance
acceptable to the Planning Director/designee shall be subnutted with a performance
bond for the project pnor to release of building pernuts Landscaping shall be
uzstalled and maintained so that sight distance at access pouits is not obscured or
impaired
5 Duect light from any exterior area hghting fixture shall not extend over the property
boundary.
6. The Spokane County Planning Department shall prepare and record with the
County Audltor a Title Notice specifying a future land acquisition area for road
nght-of-way and utiliaes. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the P1anning Department The notice should be
recorded within the same t1me frame as an appeal and shall provide the follovving•
a. At least 5 feet of reserved future acquisition area for road nght-of-way and
utihties, in addition to the existing and/or newly dechcated nght-of-way along
4th Avenue.
b. At least 30 feet of reserved future acquisition area for road nght-of-way and
utihties, in addition to the exisnng and/or newly dedicated nght-of-way along
South Valley Artenal
c. Future bwlding and other setbacks requued by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area
d. No requued landscaping, parlang, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road nght-of-way and
utilities If any of the above unprovements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made
e. The future acquisition area, until acquired, shall be pnvate property and may
be used as allowed in the zone, except that any unprovements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered lnterun uses

Pnor to issuance of a building pernut or at the request of the County Engineer in conjuncnon
with a County Road Project/Road Improvement Distnct, whichever action comes first•

2. Access permits for approaches to the county road system shall be obtauied from the
Spokane County Engineer
3. The apphcant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
4. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health Distnct a detailed combined on-site sewage system plan
and surface water d.isposal plan for the enn.re project, or pornon thereof, if the
development is to be phased.
5. A parking plan and traffic circulanon plan shall be subn-utted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard tra.ffic englneenng pracnces. Paving or
surfacing as approved by the County Englneer, will be requued for any portion of
the project which is to be occupied or traveled by vehicles.
7. The construction of the road unprovements stated herein shall be accomplished as
approved by the Spokane County Engineer
8. The County Eng-ineer has designated Typical Roadway Section Number One,
Collector Artenal standard for the improvement of Fourth Avenue, which is
adjacent to the proposed development This vvill require the addltion of
approxunately 10-12 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required
9. All required unprovements shall conform to the current State of Washington
Standard Specif'ications for Road and Bndge Construcaon and other applicable
County standards and/or adopted resolunons pertauung to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the Counry Engineer
10. Applicant shall construct a paved and deluieated approach(es) to meet the existing
pavement on Fourth Avenue.
11. Access to Proposed South Valley Artenal shall be prohibited until such time as
specifically authonzed by the Spokane County Engineer.
12. Roadway standards, typical roadway secnons and drainage plan requirements are
found in Spokane Board of Counry Comnussioners Resoluaon No. 80-1592 as
amended and are applicable to tlus proposal.
13. This subdivision or development proposal is located within a drauiage basin which
has been identif'ied by the Spokane Counry Enguneer's office as havmg stormwater
runoff problems Since this plat or development proposal is affected by or is a
contnbutor to stormwater flows, property owners should participate in the planning
and unplementation of a future basinwide stormwater management system. The
following statement shall be placed in the plat dedication
"The owner(s) or successor(s) ui interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed

constructing, maintaimng or operation of stormwater control facilities "
14. No construction work shall be performed within the existing or proposed pubhc
nght-of-way untll a permit has been issued by the County Engineer All work
within the public road nght-of-way is subject to inspecaon and approval by the
County Engineer.
15. All required construction vvithin the existing or proposed public nght-of-way is to
be completed pnor to the release of a buildulg pernut, or a bond i.n an amount
estimated by the County Enguieer to cover the cost of construcaon of improvements
shall be filed with the County Enguieer.
16 The County Artenal Road Plan identrf'ies The South Valley Artenal as a Prulcipal
artenal. The exisring nght-of-way width of 100 feet is not consistent wnth that
specified in the Plan In order to Lmplement the Artenal Road Plan, in add.ition to
the requued nght-of-way dedicanon, a stnp of property 30 feet in width along the
South Valley Artenal frontage shall be set aside in reserve. This property may be
acquued by Spokane County at the nme when artenal improvements are made to
South Valley Artenal
17 The County Artenal Road Plan identifies Fourth Avenue as a Collector Artenal.
The existuig nght-of-way width of 40 feet is not consistent with that specified in the
Plan. In order to implement the Artenal Road Plan, in addiaon to the required
nght-of-way dedication, a smp of property 5 feet in width along the Fourth Avenue
frontage shall be set aside in reserve Thus property may be acquued by Spokane
County at the b.n1e when artenal unprovements are made to Fourth Avenue
18. There may exist utllines, either underground or overhead, affecting the subject
property, includuig property to be dedicated or set aside for future acquislaon
Spokane County assumes no financial obhgation for adjustments or relocanon
regarding these utLhnes Apphcant(s) should check wnth the applicable utlhty
purveyor and the Spokane County Englneer to deternune whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make

A. Site Size: 1.76 acres
Net Density: 13.63 dwelling units per acre
B. Comprehensive Plan
1. Land Use Plan. The Category is Urban, and the site is located inside the
Pnonty Sewer Service Area (PSSA) Boundary. The Urban category
encourages a vanety of residennal types and densities to reflect a"city-lilce"

upon site specific consideratton such as adjacent land use and zomng
pattern, locaaon, proxunity to artenals, and development trends. Goa1s,
objectives, and decision guidelines of the Urban category recogruze that
multi-famfly development will usually be a transitional use between single
family residenaal and more uitensive development; that multi-family
development should be located vvith direct or near duect access to
designated artenals, and that careful consideration must be given to the
density and design of mulnple family development to protect the amenities
of adjacent single fa.mily dwelluigs Compatiblhty between mulnple farruly
and single farmly uses may be aclueved by use of landscaping, physical
separation, height brrutahon, access restnctions, screening, or modification `
in intensity of the proposed land use. The proposed density of 13 63
dwelling units per acre is withui the density range of 1 to 17 units per acre
suggested by the Urban Comprehensive Plan category However, the
planned 34 foot structure height should be addressed when reviewing this
proposal.
2. Arterial Road Plan• The Spokane County Arterial Road Plan designates
4th Avenue as a Collector Artenal, with a recommended nght of way width
of 70 feet, and idennfies the Old 1Vhlwaukee Road Railroad nght of way as a
future Pnncipal Artenal (Controlled Access High Capacity) with a
recommended nght of way width of 160 feet This future Principal Artenal
is also known as the South Valley Artenal. The existing nght of way width
of 4th Avenue and the South Valley Artenal are madequate to unplement the
Artenal Road Plan Therefore, dedicanon of add.itionai nghts of way and
provision of future acquisltion areas would be necessary to fu11y unplement
the Artenal Road Plan.
C. Site Characteristics. The sublect property is occupied by a single family
dwellulg and an accessory structure, both of which would be removed if the Zone
Reclassification is approved. The parcel is relaavely flat and has residential
vegetation.
D. Neighborhood Characteristics• The pnmary land use of the neighborhood
cansists of single fanuly dwellings withui an established area Multiple family
dwellings and commercial uses are found north of the subject property between
the future South Valley Artenai and Sprague Avenue

Plan, and other County policies and guidelines The Planrung Deparament has
deterrmned that "No probable significant adverse unpacts" would result from the
proposal being developed and has 2ssued a Deternunation of NonsiQnifiicance

The "DNS" was circulated to 9 other agencies of junsdhcnon and other
agencies/deparnnents affected by the future development for review and comment.
The "DNS" cominent penod ends October 22, 1991 and was advernsed 15 calendar
days befor+e said date in the newspaper, by letter to adjacent property owners withln
400 feet of the proposal, and by nonce on a sign posted on the proposal site. The
Heanrig Examiner may consider add.inonal envlronmental related testunony at the
pubhc heanng.
I V. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposed development and Urban Reszdential-22 (UR-22) zone is consistent with
the decision guideline of the Urban Comprehensive Plan category which encourages
multifamuly development vvith direct access to a designated artenal. Additionally, the
proposed density of 13 63 dwelhng units per acre is withul the density range of 1 to 17
uruts per acre suggested by the Urban category and the 24 dwelhngs proposed are
substantially fewer dwellulg units than the maxunum number of dwelling units (37)
allowed on 176 acres in the Urban Residential-22 (UR-22) zone The proposal is not
entirely consistent vvith land use and zomng trends in the area, however, development
of the South Valley artenal will alter the existing neighborhood character Use of
addlaonal landscaping or greater setbacks to nuagate potenrial unpacts upon adjacent
propemes is somewhat difficult due to the narrow chmension of the lot (142 feet wide)
and the proposed design. The apphcant has voluntanly unposed a maxunum buzlding
height of 34 feet to make the proposal more compatible with adjacent single family

dwellings, and the Planning Department recommends that the 5 feet Type III L.andscape
buffer required on the east and west property lines be mcreased to 10 feet of Type I
Landscaping. This landscape buffer, combined with a 6 foot sight obscunng fence
along the east and west properry hnes wdl provide an aesthetic buffer hetween the
proposal and adjacent single fanuly uses and enhance the amenitles of the single family
neighborhood. The Planrung Department recommends approval of the proposed zone
reclassification as conditioned.
V. CONDITIONS OF APPROVAL
i. All conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant", which terms shall include the
owner or owners of the property, heirs, assigns and successors.

1 The proposal shall compiy with the Urban Residential-22 (UR-22) zone as

foot height limit and no more than 24 uruts on the site, also Iandscaping along the
east and west property hne shall be 10 feet wide with a 6 foot lugh fence where
pemutted.
2. The apphcant shall develop subject property generally in accordance wnthin the
concept presented to the Heanng Body Vanations, when approved by the
Plannuig Du-ector/designee, may be pernutted, including, but not lirruted to budding
location, landscape plans and general allowable uses of the pernutted zone. All
vanaaons must conform to regulations set forth ui the Spokane County Zorung
Code, and the onginal intent of the development plans shall be maintained.
3. Approval is required by the Plannuig Duector/designee of a specific lighting and
sigmng plan for the descnbed property prior to the release of any building pernuts
4. A specif'ic landscape plan, planting schedule and prov2sions for mainienance
acceptable to the Planmng Ihrector/designee shall be submitted with a performance
bond for the project pnor to release of building perrruts Landscaping shall be

6. The Spokane Courity Planiung Department shall prepare and record with the

c. Future building and other setbacks requued by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
d. No requued landscaping, parking, '208' areas, drainfield or allowed signs
should be located unthui the future acquisition area for road nght-of-way and
utihties. If any of the above unprovements are made vvithin thls area, they
shall be relocated at the apphcant's expense when roadway improvements are
made
e. The future acquisition area, until acquired, shall be pnvate property and may
be used as allowed in the zone, except that any unprovements (such as
landscaping, parking, surface drainage, drasnfield, signs or others) shall be
considered interun uses.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Pnor to issuance of a buildmg pernut or at the request of the County Engi.neer in conjunction
with a County Road Project/Road Improvement Ihsmct, whichever action comes first:
1. Apphcant shall dedicate 10 feet on Fourch Avenue for nght-of-way

Spokane County Engineer The design, location and arrangement of parking stalls
shall be ui accordance with standard traffic engi.neenng practices. Paving or
surfacing as approved by the County Engineer, wrll be requued for any portion of
the project which is to be occupied or traveled by velucles

7. The construction of the road unprovements stated herein shall be accomphshed as
approved by the Spokane County EngLneer.
8. The County EngYneer has designated Typical Roadway Secaon Number One,
Collector Artenal standard for the unpmvement of Fourth Avenue, wtuch is
adjacent to the proposed development. This wnll requu-e the addltion of
approxunately 10-12 feet of asphalt along the frontage of the development. The
construction of curbing and sldewalk 1s also requued.
9. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bndge Construcaon and other applicable "
County standards and/or adopted resolutions pertai.mng to Road Stand.ards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer,
10. Applicant shall construct a paved and delineated approach(es) to meet the existYng
pavement on Fourth Avenue.
11. Access to Proposed South Valley Artenal shall be prohibited untYl such nme as
specifically authonzed by the Spokane County Engine,er.
12 Roadway standards, typical roadway sections and drainage plan requuements are
found in Spokane Board of County Commissioners Resolution No 80-1592 as
amended and are applicable to this proposal.
13 1'his subdhvislon or development proposal is located within a drainage basin which
_ has been identlfied by the Spokane County Engmeer's affice as having stormwater
runoff problems Since this plat or development proposal is affected by or is a
contributor to stormwater flows, property owners should parncipate in the planning

nght-of-way dedication, a stnp of property 5 feet m width along the Fourth Avenue
frontage shall be set aside m reserve. This property may be acquued by Spokane
County at the time when artenal unprovements are made to Fourth Avenue.
18. There may exist utilities, either underground or overhead, affecting the subject '
property, including property to be dedicated or set aside for future acquisinon.
Spokane County assumes no financial obhgation for adjustments or relocation
regarding these utihaes. Apphcant(s) should check vcnth the applicable utihty
purveyor and the Spokane County Engineer to deternune whether applicant(s) or
the utihty is responsible for adjusmlent or relocation costs and to make
arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES CONDITIONS
