FINDINGS OF FACT, CONCLUSIONS AND QRDER ta*
INTRODUCTION
Ttus matter has come before the Hearing Exarruner Comrruttee on February 22,
1996 The members of the Committee present are Frank Yuse, Chair, Michael
Schrader and Brenda Bodenstein
PROPOSAL
The sponsor, Iva Burget, requests approval of a Zone Reclassification, ZE-1-96,
froin Urban Residential-3 5(UR-3 5) to Urban Residential-7 (UR-7) for those uses
allowed in the Urban Residentlal-7 (UR-7) zone
TINDINGS OF FACT AND CONCLUSIONS
1 The property is generally located south of and adjacent to 9th Avenue and
approximately 200 feet east of University Road in the SW 1/4 of Section 21,
Township 25 North, Range 44 EWM, Spokane County, Washington
2 The Committee adopts the Planning Department Report as a part of thls record
3 The existing land uses in the area are predominantly single famlly residences with
some duplexes
4 The proposed use is compatible with existing uses in the area
5 The Comprehensive Plan designates this site as Urban The Urban (U) category is
intended to provide the opportunity for development of a"ciry-like" environinent
which includes various land uses, intensive residential development and public
facilities and services The pioposal can be defined as tnfill development in an aiea
with existing services and utilities and is generally consistent with the Goals,
Objectives and Decision Guidelines of the Comprehensive Plan
6 The proposed zoning does implement and conform to the Comprehensive Plan
7 The proposal is located adjacent to 9th Avenue which is designated as a local access
street by the Spokane County Arterial Road Plan
8 The existing zoning of the property described in the application is Urban
Residential-3 5(UR-3 5), previously established as Agricultural (A) in 1950
(181-50) and redesignated to Urban Residential-3 5(UR-3 5) on January 1, 1991
pursuant to the Program to Implement the Spokane County Zoning Code The
proposal does conform to the requirements of the proposed 7one
9 The provisions of RCW 43 21C (The State Environmental Policy Act) have been
complied with and a Determination of Nonsignificance (DNS) was issued The
Committee, after independent review, hereby adopts the DNS

10 The legal iequirements foi public notice have been fulfilled
11 The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use
12 The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified Specifically, changed conditions include the installation of a pub-lic sewer
system and the continued residential growth in the area
13 The proposed use will not be detrimental to the publlc health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing
agencies
14 The Comrruttee additionally finds/concludes
a The applicant agrees with and accepts all the recommended conditions of
approval
b The Urban Residential-7 (UR-7) zone is compatible with surrounding uses
which include single famlly residences and duplexes
c The proposed density is sirrular to density allowed in the Urban Residential-3 5
(UR-3 5) zone
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1 All Conditions imposed by the Hearing Exairuner Committee shall be binding on
the "Applicant," whlch term shall include the owner or owners of the property,
heirs, assigns, and successors-in-interest
2 The Zone Reclassification and Conditions of Approval apply to the real property
descnbed below
The East 2/5 of the SW 1/4 of the NW 1/4 of the NW 1/4 of the SW 1/4, Section 21, T
25N , R 44E W M, except the South 120 feet
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
1 The proposal shall comply with the Urban Residential-7 (UR-7) zone, as amended
2 The Division of Building and Planning shall prepare and record with the Spokane
Counry Auditor a Title Notice noting that the property in question is subject to a
variety of special conditions imposed as a result of approval of a land use actlon
This Title Notice shall serve as publlc notice of the conditions of approval affecting
the property in question The Title Notice should be recorded wittun the same time
fi ame as al lowed for an appeal and shall only be released, in full oi in part, by the
Division of Building and Planning The Title Notice shall generally piovide as
follows

subject of a land use action by a Spokane County Hearing Body or
Administrative Official on [ imposing a variety of special
development conditions. File No. [ ] is available for
inspection and copying in the Spokane Division of Building and
Planning.
3 The applicant shall contact the Division of Building and Planning at the earliest possible
stage in order to be informed of code requirements adm in i stered/en forced as authorized
by the State Building Code Act Design/development conceins include Addressing,
fire apparatus access roads, fire hydrant/flow, approved water systems, building
accessibility, construction type, occupancy classification, exiting, exterior wall
protection, and energy code regulations (Note The Division of Building and
Planning reserves the nght to confirm the actual address at the time of building permit )
4 Subsequent segregation of subject property requires compliance with the Spokane
County Short Plat Ordinance
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior to release of a building pernvt or use of the property as proposed
1 Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer
2 To construct the roadway improvements stated herein, the applicant may, with the
appcoval of the County Engineer, join in and be willing to participate in any
petition or resolution which purpose is the formation of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36 88, as amended
Spokane County will not participate in the cost of these improvements This is
applicable to 9th Avenue
3 As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Pioject
(CRP) to the extent of the required improvement Spokane County will not
participate in the cost of these improvements This is applicable to 9th Avenue
4 The County Engineer has designated a Local Access Roadway Section for the
improvement of 9th Avenue which is adjacent to the pcoposed development This
will require the addition of approximately 5- 7 feet of asphalt along the frontage of
the development The construction of curbing and sidewalk is also required
5 Roadway standards, rypical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolutlon No 95-0498 as
amended and are applicable to thas proposal
6 Apnlicant shall sign and record Spokane County Notice to the Public No 6 which
specifies the following
The owner(s) or successor(s) in interest agree that in consideration of Mutual
Benefits now or to be hereafter deiived, do for themselves, their heiis, grantees,
assigns and successor(s) in interest hereby request and authorize Spokane County
to include the above descnbed property in a Road bnprovement District (RID) and
HEC Order for ZE-1-96 Page 3

support the formatlon of a RID pursuant to RCW 36 88 050, or by requesting and
authorizing Spokane County to cast their ballot in favor of a RID being formed
under the resolution method pursuant to RCW 36 88 030, and/or by not filing a
protest against the formation of a RID being formed under the alternative resolution
method provided for in RCW 36 88 065 and Chapter 35 43 RCW
If a RID is proposed for improvement of the road(s) described below, said
owner(s) and successor(s) further agree
(a) that the improvement or construction contemplated within the proposed RID is
feasible,
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceeds the cost and expense of formation of the RID, and
(c) that the property withln the proposed RID is sufficiently developed
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36 88 090, to object to any assessment on the property as a
result of the improvements called for in conjunction with the formatlon of the RID
by either petition or resolution method under Chapter 36 88 RCW and to appeal to
the Superior Court the decision of the Board of County Comrrussioners confirrrung
the final assessment roll, provided further, it is recognized that actual assessments
may vary from assessment estimate so long as they do not exceed a figure equal to
the increased true and fair value improvement(s) add(s) to the property
It is further acl:nowledged and agreed that at such time as a RID is created or any
County Road Improvement project is authorized by Spokane County, the
improvements required shall be at the sole expense of the owner(s) of property
within the RID or served by the improvements without any monetary participation
by Spokane County
The RID waiver contained in thls agieement shall expire after ten (10) years from
the date of execution below This requirement applies to 9th Avenue
SPOKANE COUNTY DIVISION OF UTILITIES
l. A wet (live) sewer connection to the area wide Public Sewer System is to be
constructed Sewer connection permlt is required
2 Applicant shall submit expressly to Spokane County Utilities Department "under
separate cover" only those plan sheets showing sewer plans and specifications for
public sewer connections for revlew and approval by the Utilities Department prioi to
issuance of permlt to connect
3 Arrangements for payments of additional sewer charges must be made for prior to
issuance of sewer connection perm.it
4 Any water service for this project shall be provided in accordance with the Cooidinated
Water System Plan for Spokane County, as amended

SPOKANE COUNTY HEALTH DISTRICT
1 Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County
2 Water service shall be coordinated through the Director of Utilities, Spokane
County
3 Water service shall be by an existing public water supply when approved by the
Regional Engineei (Spokane), State Department of Health
4 A public sewer system will be made available foi the project and individual seivice
will be provided to each building Use of individual on-site sewage disposal
systems shall not be authorized
5 Use of private wells and water systems is prohibited
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1 All air pollution regulations must be met
2 Air pollution regulatlons requare that dust emissions dunng demolition, construction
and excavation projects be controlled This inay require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions Haul roads
should be tieated, and emissions from the transfer of earthen material must be
controlled, as well as errussions from all other construction-related activities
3 SCAPCA strongly recommends that all traveled surfaces (i e, ingress, egress,
parlang areas, access roads) be paved and kept clean to m.inimsze dust emissions
4 Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces
5 Debris generated as a result of thls project must be disposed of by means other than
burning (i e, construction waste, etc )
6 Demolitlon and renovation projects must comply with the requirements of CFR 40,
Part 61, Subpart M and of SCAPCA Regulation I Article IX, both of which address
asbestos abatement issues Intent to Demolish forms are available at the SCAPCA
office
7 All solid fuel burning devices (wood stoves, pellet stoves, etc ) must comply with
local, state, and federal rules and regulations

The Heanng Examiner Commlttee, pursuant to the above Findings of Fact and
Conclusion, APPROVES the appLcation of Iva Burger for the Zone Reclassification
from Urban Residential-3 5(UR-3 5) to Urban Residential-7 (UR-7) for those uses
allowed in the Urban Residential-7 (UR-7) zone as described in the application ZE-1-9G
Motion by Brenda Bodenstein Seconded by Michael Schrader
Vote (3-0) UNANIMOUS TO APPROVE THE ZONE RECLASSIFICATION

other County policies and guidelines The Division of Building and Planning has
deternuned that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Deterrxunation of Nonsigruficance ("DNS")
The "DNS" was circulated to 13 other agencies of jurisdiction and other agencies/
departments affected by the future development for review and cominent The
"DNS" comment period ends February 20, 1996 and was advertssed 15 calendar days
before said date in the newspaper, by letter to adjacent property owners withln 400
feet of the proposal, and by notice on a sign posted on the proposal site The Hearing

The following "Conditions of Approval" for the above referenced zone change
are submitted to the Spokane County Planning Department for inclusion in the
Design Review Meeting scheduled December 20, 1995.
Prior to release of a building permit or use of property as proposed:
E40 Access permits for approaches to the County Road System shall be obtained from the
County Engineer.
E46 To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, Join in and be willing to participate in any
petition or resolution which purpose is the formation of a Road Improvement District
(RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will
not participate in the cost of these improvements. This provision is applicable to
9th Avenue.
E47 As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CRP) to the extent of the required improvement. Spokane County will not participate
in the cost of these improvements. This provision is applicable to 9th Avenue.
E50 The County Engineer has designated a Local Access Roadway Section for the
improvement of 9th Avenue which is adjacent to the proposed development. This will
require the addition of approximately 5-7 feet of asphalt along the frontage of the
development. Curbing and sidewalk on one side also be constructed.
E55 Roadway standards, typical roadway sections and drainage plan requirements are found
in Spokane Board of County Commissioners resolution 95-0498 as amended and are
applicable to this proposal.
E60 Applicant shall sign "Spokane County Notice to the Public Number 6" which specifies
the following:
The owner(s) or successor(s) in interest agree that in consideration of Mutual
Benefits now or to be hereafter derived, do for themselves, their heirs, grantees,
assigns and successor(s) in interest hereby request and authorize Spokane County to
include the above described property in a Road Improvement District (RID) and to
support the formation of a Road Irnprovement District for improvement of the road(s)
described below by requesting and authorizing Spokane County to place their name(s)
on a petition for the formation of a Road Improvement District pursuant to RCW
36.88.050, or by requesting and authorizing Spokane County to cast their ballot in
favor of a RID being formed under the resolution method pursuant to RCW 36.88.030,
and/or by not filing a protest against the formation of a RID being formed under the
alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s)
and successor(s)further agree: (1) that the improvements or construction
contemplated within the proposed RID are feasible and (2) that the benefits to be
derived from the formation of the RID by the property included therein, together
with the amount of any County participation, exceeds the cost and expense of
formation of the RID, and (3) that the property within the proposed RID is
sufficiently developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090, to object
to any assessment(s) on the property as a result of the improvements called for in
conjunction with the formation of a RID by either the petition or resolution method
under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the
Board of County Commissioners confirming the final assessment roll; provided

further, it is recognized that actual assessments may vary from assessment estimate
so long as they do not exceed a figure equal to the increased true and fair value
improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any
County Road Improvement project is authorized by Spokane County, the improvements
required shall be at the sole expense of the owner(s) of property within the RID or
served by the improvements without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from
the date of execution below. This provision is applicable to 9th Avenue.
