FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
February 6, 1986, and the members of the Corranittee present being
Kathleen M. Carstens, Chairperson, Jane E. Myers and Ron Odell.
B. PROPOSAL
The sponsors, Shopko and William Tombari, are requesting approval of a
zone reclassification, File No. ZE-99-85, Local Business to Commercial,
for the purpose of developing a retail sales center. Also, a Change of
Conditions request for the purpose of reviewing a new site development
plan to accomnodate a total project of a 19-Acre retail sales center in
existing Commercial Zones.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, office,
commercial and undeveloped.
2. That the Comprehensive Plan designates this area as appropriate for
Major Commercial development.
3. That the existing zoning of the property described in the application
is Local Business and Conmercial.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or
uses within the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone and change of conditions are
justified.
8. That the proposed use is compatible with existing uses in the
area.

C. FINDINGS OF FACT (continued)
9, That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Neari ng Exami ner Corrnni ttee:
a) That the Zoning Hearing Examiner Committee wishes to extend a
courteous welcome to the two out-of-state retail stores that are
desirous of locating in Spokane County.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
1. Delete Health District Condition #1 which reads as follows:
"A combined surface water and sewage disposal detailed plan shall be
approved by the Spokane County Engineer and the Spokane County Health
District prior to the issuance of any building permit for this
proj ect. "
2. Delete Building and Safety Department Condition #4 which reads as
follows:
"Due to the sensitive storage requirements over the Aquifer, and this
site lies within the Waste Water Management area, we feel that some
language should address the possible storage of flammable or critical
materials within these structures."

a) COUNTY PLANNING DEPARTMENT
1. That the following conditions recommended by the reviewing
agencies shall be binding upon all that property as described
within the zone change and change of conditions applications.
2. That only on-premise advertising signs be allowed and limited to
five (5) along Sprague Avenue and five (5) adjacent to the sewer
trunk line right of way when the roadway improvements thereto
are made. Said signs shall be limited to 40-feet in height and
250-square feet in surface area. No roof top signs shall be
allowed.
3. That should Second Avenue not be vacated by the Board of County
Commissioners, then the front yard setback of 35-feet shall be
complied with for structures along the south boundary.
4. That the landscaping proposed within the property deeded to
Spokane County shall remain and be maintained, if agreed to by
the County Engineer when the roadway improvements are made.
5. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumination
to the area wi th ful l consi derati on to adj acent properti es
6. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.
7. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be mai ntai ned.

8. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
9. All current standards of the Comnercial Zone, as amended, shall
be complied with in the development of this site.
10. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site a re in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay
Zone) of the Spokane County Zoning Ordinance. Accordingly, as a
condition of approval, the sponsor/applicant shall be required
to file with the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
material as follows:
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE
ON THE PROPERTY DESCRIBED HEREINAFTER, TNE APPLICANT SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS
OF SPOKANE COUNTY ZONING ORDINANCE CNAPTER 4.16A
(AQUIFER SENSITIVE AREA OVERLAY ZONE). THE PROPERTY
WHICH IS TNE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY
DESCRIBED AS FOLLOWS:....".
11. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
12. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
13. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Corr~nissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.
. b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Applicant shall dedicate a 30 foot radius on Blake Road and
Sprague Avenue prior to any use of the property.
2. Applicant shall dedicate 5 feet on McDonald Road and a 30 foot
radius on Sprague Avenue and McDonald Road for right-of-way
prior to any use of the property. -

b) COUNTY ENGINEERING DEPARTMENT (continued)
3. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
4. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
5. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Nealth District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
building permit on the property.
6. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
7. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
8. As an alternative method of constructing the road improvement
stated herein, the applicant may, with the approval of the
County Engineer, accomplish the road improvements stated herein
by joining and participating in a County Road Project (CRP) to
the extent of the required road improvement. Spokane County
will not participate in the cost of these improvements. The
cost of roadway improvements, signal installation, and signal
upgrading shall be borne by the applicant who shall pay a
proportionate share based upon the traffic volumes generated by
the development.
9. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
10. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
11. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane 6oard of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal. _

12. That the applicant shall construct a two-way left turn lane on
McDonald Road and a left turn channel on McDonald Road at
Sprague Avenue. The applicant shall upgrade the traffic signal
system at the McDonald-Sprague intersection (this is to include
Spokane County Standard curb and sidewalk).
13. That Blake Road shall be improved to a four lane facility as
specified by the Spokane County Engineer (this is to include
Spokane County Standard curb and sidewalk.
c) COUNTY UTILITIES DEPARTMENT
l. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements cal 1 ed for i n con j uncti on wi th the formati on of a
ULID by either petition or resolution method under RCW Chapter
36.94.
2. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
3. A sewer connecti on to the Val l ey Sewerage System i s to be
constructed. Plans and specifications for the sewer connection
are to be reviewed and approved by the Utilities Department
prior to building permit issuance.
d) COUNTY HEALTH DISTRICT
l. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and the Spokane
County Nealth District prior to the issuance of any building
permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.

3. A public sewer system will be made available for the project and
individual service will be provided to each structrure. Use of
individual on-site sewage systems shall not be authorized.
4. Water service shall be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
6. Use of private wells and water systems is prohibited.
7. Upon connection of any /all structures to the Spokane County
sewer system, any/all existing on-site sewage systems located
within the boundaries of the project shall be abandoned in
accordance with current Spokane County Health District
requirements.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
l. The site is located in Fire District # 1.
2. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible f rom the street or road fronting the property. Said
numbers shall contrast with their background.
3. Reclassification of an existing building shall require an ,
application for change of occupancy permit and subsequent
inspection for approval.
4. Due to the sensitive storage requirements over the Aquifer, and
this site lies within the Waste Water Management area, we feel
that some language should address the possible storage of
flammable or critical materialswithin these structures.
5. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
6. A plan for emergency equipment access is required to be
submitted prior to any land development.

e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued)
7. Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uniform Fire Code is required prior to
construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction.
8. Cornnents: It appears f rom a preliminary review of the proposed
site plan that five (5) new fire hydrants will be required for
the si te.
f) WATER PURVEYOR
1. Water Purveyor is Modern Electric Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses. Satisfactory arrangements have been made to
serve thi s proposal.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions f rom the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
fram unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. Al1 travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the
construction phase of the project and f rom motor vehicles using
the site following completion of the project and from occupants
of the proposed project.

BTU/hour must meet SCAPCA requirements. Applicant must file an
Intent to Demolish for structures removed.
ORDER
The Zoning Hearing Examiner Comnittee, pursuant to the aforementioned,
finds that the application of Shopko and William Tombari for a zone
reclassification should be APPROYED to the COMMERCIAL ZONE and also the
change of conditions request as described in the application.

Dear Ms. McCurdy:
You have requested information concerning Spokane County zone change ZE
99-85. The zone change proposed a shopping center to be located south of
Sprague Avenue between McDonald Road and Blake Road in the Spokane Valley. I
will be referring to this zone change as the Shopko Proposal.
During our conversation you also referenced ZE 80-85 which was a proposed
zone change which was approved by the Spokane County Hearing Examineer
Committee in November 1985. This property has frontage on McDonald Road and
is located due west of the Shopko zone change. The applicant for this zone
change was Robert Gould.
The Shopko zone change is bordered on the south by a 50 foot wide public
road right-of-way. This is the Second Avenue alignment. This right-of-way
(except adjacent to McDonald Road) abutts the abandoned C.M.S.P.&P. Railroad
right-of-way. Mr. Gould's property is bordered on the south by the abandoned
railroad right-of-way. The abandoned railroad is the property of Spokane
County.
One of the "conditions of approval" of Mr. Gould's zone change requires
that a 40 foot wide setback from the abandoned railroad right-of-way. You
have asked if the same requirement was placed upon the Shopko application. It
is our opinion that the Shopko zone change was not afforded special privilege
and that the setback requirements are the same as those which were required of
the Gould zone change.
Attached is a copy of the Spokane County Engineer's section map for
Section 22, Township 25 North, Range 44 E.W.M. I will be referring to this .
map in my discussion of each of the zone changes. The abandoned railroad
right-of-way has been highlighted on the map.
The abandoned railroad right-of-way was purchased by Spokane County as
general County property. The Road Department has been making annual payments
to the County and has been purchasing the property for road right-of-way. The
final payment will be paid to Spokane County this year. Once purchased the
property is declared County road right-of-way and access controls are
initiated.

The width of the abandoned right-of-way varies throughout the Spokane
Valley. In Section 22, ttie width ranges between 60 feet and 130 feet. It is
60 feet wide adjacent to both of the zone changes.
Spokane County has not determined how the abandoned right-of-way will be
utilized. The County has considered alternative uses which range from a major
arterial roadway to a corridor which will be utilized by a Light Rail Rapid
Transit System. A minimum right-of-way width of 100 feet will be needed in
the future in order to accomodate any of the uses we have considered to date.
It is for this reason that the 40 foot wide setback was made a requirement of
this Gould zone change. This setback will facilitate future acquisition of
right-of-way which will be needed in order to widen the right-of-way.
A future acquisition of 20 feet by Spokane County for road right-of-way
is anticipated. Any proposed building or any building which might exist at
the time of right-of-way acquisition would then set back 20 feet from the new
right-of-way. This 20 foot separation would provide the following:
1. The integrity of the arterial would be protected.
2. On-site traffic circulation would be enhanced.
3. Adequate area will be provided to facilitate emergency vehicle and ,
firefighting.
The Shopko Zone Change was not required to adhere to the 40 foot wide
setback. The site is bordered along the south property line by a County road
right-of-way which is depicted on the Engineer's section map as Second Avenue.
The Shopko site plan anticipated the vacation of this CounCy right-of-way.
The applicant proposed the reconveyance to Spokane County as general County
property of a 20 foot strip of land which would abutt and parallel the
abandoned rai.lroad right-of -way from McDonald Road to Blake Road.
The Spokane Caunty Board of Commissioners vacated the Second Avenue
right-of-way February 25, 1986. Attached is a copy of the vacation
resolution. One of the conditions of the vacation is that the applicant
"transter to Spokane County [he fee title to a strip of land 20 feet wide
adjacent to the north line of the abandoned C.M.S.P.&P. Railroad right-of-way,
now County property, between Blake and McDonald Road." To date this has not
been done.
The County Engineer will not release or approve any building permits until
the conveyance of the 20 foot strip takes place. The vacation of the Second
Avenue right-of-way will not become final un[i1 the conditions of the vacation
have been met.

The site plan for the Shopko zone change provides a 25 foot setback from a
strip which is to be deeded to the County for the Mervyn's Building and a 20
foot setback for the Shopko building. Since the site plan was approved by the
Spokane County Hearing Examineer Committee we are of the opinion that the
applicant is bound to comply with the setbacks as they are depicted on the
plan. I have attached a copy of my memorandum of March 11, 1986 to the
Spokane County Zoning Administrator notifying him of our position. The County
Engineer will not release or approve building permits for any structure which
does not comply with the setbacks depicted on the site plan of record.
By taking the above action, we have required the applicants for zone
change 99-85 to construct any proposed buildings a minimum distance of 40 feet
from the north line of the abandoned C.M.S.P.bP. righ[-of-way. While the
means of achieving the setback differs from the condition imposed at Mr.
Gould's zone change, the net result is [he same.

Second Avenue road right-of-way between McDonald ztid Blake Road in the Spokane
Valley. This action was based on the approved Shopko site plan. A[tached is a copy
of Resolution Number 86-0172 which sets focth two "conditions" which must be met
prioc to the vacation of the road right-of-way becoming final. One of those
conditions cequires tha[ the applicants (Tombari et. al.) provide to Spokane County
the fee title to a strip of land 20 feet in width Which paral.lels the abandoned
C.M.S.P.b.P. railroad right-of-way.
The site plan For the above-referenced zone cttange depicts a"deciicated" 20 fuot

plan provides a 25-foot setback from the dedicated strip for ttie Mervyn's building
and a 20-foot setback for the Shopko's buiLding. This site plan was presented to the
Spokane County Hearing Examiner Committee February 6, 1986 at the public hearing for
the zone change.

The site plan which was circulated for departmental review proposes development
of the subject property from Sprague Avenue Southward to the County's Milwaukee Road
property. Attached is a copy of a Spokane County Engineer's section map showing the
existing 50 ft. road right-of-way which parallels the abandoned railroad property and
connects Blake Road with McDonald Road. Before the property can be developed as
proposed, a portion of the Second Avenue right-of-way would have to be vacated by
the Board of County Commissioners.
A minimum unobstructed lane 20 feet in width along the southern boundary of the
site should be maintained from Blake Road to McDonald Road for emergency vehicle
access to the site.
The commercial development of the site wi11 generate approximately 11,000
weekday vehicle trip ends (A.W.V.T.E). About 9,000 trips (82 percent) may be
attributed to the Shopko and Mervyn's stores.
It is anticipated that the traffic generated from the development of the •
properties will have an impact upon existing traffic volumes, traffic movement and
access to the site. Forty percent (4,400 trips) of the projected traffic vol wne
generated by the-site are projected to use McDonald Road, and twenty-five percent
(2,750 trips) are projected to use Blake Road. The remaining thirty-five percent
(3,850 trips) would access and leave the site via Sprague Avenue.
Existing improvements on Sprague Avenue will be able to accommodate the
projected traffic volumes. The location of specific driveway access to the site from
Sprague will be determined by the County Engineer.
In order to accommmodate southbound left turn movements into the site from
McDonald Road, it will be necessary to construct a left turn lane. It is for this
reason that five feet of additional right-of-way is being requested. The additional
traffic on McDonald will also cause increased congestion a[ the interesection of
Sprague and McDonald. The principal cause for the congestion wi11 be vehicles
attempting left turn moyements onto Sprague Avenue. This added congestion has the
potential for creating traffic problems at the intersection. The construction of a
left turn lane at the intersection will enhance the movement of traffic and reduce
traff ic problems. Traffic signals at the intersection must be upgraded in order to
accommodate the additional turning movements at the intersection.
Likewise, Blake Road will not be able to accommodate the projected traffic from
this development unless the roadway is upgraded to a four lane f acility.'
The attached "Conditions of Approval" are submitted for inclusion in the
"Finding and Order" f or the proposed zone change. Please contact us if you have any

Dear Sir:
I would like to take a moment of your time to introduce
our company. We are a chain of full-line general merchandise
discount department stores. Our corgorate headquarters are
located in Green Bay, Wisconsin. We are a wholly-owned .
subsidiary of Super Valu Stores, Inc. of Minneapolis, Minnesota.
Super Valu Stores is the largest food wholesaler in the
United States.
We have 65 ShopKo Stores operating in a nine state area and
are currently planning two stores in the Spokane area, which
will begin construction in the summer of 1986. One of the
two sites, which is under Spokane County's jurisdiction, is on
the southwest corner of Sprague Avenue and Blake Road.
I have met on several occasions with County Representatives,
Ken ,7effrey, Jeff Forry and Art Erickson. We have discussed
our project and we have submitted the "Building Permit
Application Worksheet". This submittal enables us to construct
our project under the existing "208" drainage requirements, which
allows rooftops to discharge storm water into drywells. It also
allows the sizing of our swale areas, to only use impervious areas
excluding the roof-top square footage. -
In our meetings it was also agreed our building could be
designed and constructed based on the 1982 edition of the Uniform
Building Code.

The entire proposal lies within the Major Commercial category of the
Comprehensive Plan. Directly adjacent to the south property line of the
site lies the Urban category. The southern portion of the site is guided,
by the "Transitional Area" policy of the Comprehensive Plan, which
provides for, and requires, buffering techniques. Special consideration
shall be required for planned land uses along the southern boundary of the
site because of the 80 - 100 foot sewer right of way and the planned
transportation corridor within that right of way. Landscaping and/or
spatial setbacks for buildings is recommended along Second Avenue, or the
sewer right of way, if Second Avenue is vacated. The requested zone
change is consistent with the "Fill-In" policy of the Comprehensive Plan.

The subject property contains five past zoning actions; two of which
were zoned Local Business and three zoned Commercial. A rezone on
the Local Business sites to Commercial and two of the old Commercial
Zones requesting the Change in Condition for a new site plan are
needed to accommodate the retail shopping center proposed.
Commercial zone changes along Sprague within the Major Commercial
category of the Comprehensive Plan have been routinely approved.
Past zone changes adjacent to the sewer right of way have been
required to dedicate 50-feet for extension of Second Avenue. More
recent zone changes nave been required to provide, in lieu of the
dedication, a 40-foot building setback to the sewer right of way.
This is for emergency vehicle access and prevent encroachment along
the sewer right of way; i.e., Transportation Corridor. The
Commercial zone change to the immediate west (File #ZE-80-85-C,
Gould) and the Commercial Zone change approximately 1/8 mile to the
east (File #ZE-53-83-C, Fred Meyer Properties) have been required to
have the 40-foot structure setback.

Land uses along Sprague, McDonald and Blake Roads are predominately
commercial with intermittent vacancies. To the south of the sewer
trunk line, large lot residential and undeveloped lands are found.
Dense landscaping and fencing should be required tiere to serve as a
buffer to the established and potential future uses. This will serve
as a deterrent to uncontrolled foot traffic and litter associated
with the shopping center.

50-foot County right of way unimproved and is to
be vacated.
McDonald Road to the west of the site is a
60-foot County right of way with two lanes paved.
County Engineer is recommending 5-foot dedication on McDonald and a
30-foot radius on Blake. County Engineer requiring 2-way left turn
lane and left turn channel on McDonald with upgrade of traffic signal
system with curbs and sidewalks. Blake to be improved to four lanes,
curb and sidewalks.

ProposedoBuffering Techniques: Substantial landscaping is proposed
along McDonald, Sprague and Blake Road and is to double as the '208'
stormwater drainage. Three major parking isles are landscaped, but
the remaining 13 isles are not. No landscaping is proposed adjacent
to the retail buildings. Along the southern boundary of the site the
County Engineer is apparently willing to vacate the 50-feet of Second
Avenue in exchange for a 20-foot deed to be acquired as County
property and an additional 20-foot setback for emergency access.
This southern boundary is adjacent to the 60-foot right of way for
the sewer trunk line and the Urban category of the Comprehensive Plan
which is anticipated to be developed in medium to high density
residential. Special buffering techniques should be provided here in
anticipation of the future residential uses.
The site plan shows landscape islands separated by 120'-200' of
parking spaces. In addition, these landscape islands may be
eliminated when the County constructs tnis right of way as an
arterial. The applicant indicates these landscape islands could
remain if the County were to use them as '208' stormwater drainage
areas. The County Engineer at this time is uncertain as to the type
and width of right of way improvements; and, therefore, cannot assure
that the landscaping here will remain.
If removal of the landscaping is a probability, the Nearing Examiner
Committee may desire to now require more area for landscaping. If
this is required, it is very likely that some of the two areas
designated as future building sites on the site plan will be
eliminated as redesign occurs.

III. SITE DEVELOPMENT RECOMMENDATIONS

Desiqn: Building, landscaping and parking orientation is to Sprague
Avenue. Minimum setbacks and landscaping is being provided along the
future transportation corridor; i.e., sewer trunk line.
Signage: Applicant is requesting five business identification signs at
250 square feet (12x20') and 40-feet in height along Sprague, with five
more signs planned along the south property line when the sewer trunk line
is improved for vehicular traffic.
Circulation/Access: Two access points to McDonald, four to Sprague and
three to Blalce Road. A 20-foot driveway is provided south of the
buildings. Specific approach permits are to be approved by County
Engineer.
Stormwater Drainaqe: Compliance with '208' regulations and double as
landscape requirements.
Sewage Disposal: Sewer connection to the Valley Sewerage System is
required.
Water Supply: Modern Electric Water Company.

IV. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered
the specifics of the proposal, other available info rnation, County
ordinances, other regulations and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other County '
policies and guidelines. The Zoning Administrator has determined
tnat "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of
Non-Siqnificance ("DNS").
The "DNS" was circulated to nine other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and comment. The "DNS" comment period ends February 5, 1986,
and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site.
The Hearing Examiner Conmittee may consider additional environmental
related testimony and the "DNS" at the public hearing.
V. PLANNING SUMMARY
The proposal is consistent with past zone changes in the area and tne
Major Commercial category of the Comprehensive Plan. The Hearing
Examiner Committee should give special consideration to the adequacy
of the proposed buffer along the south boundary next to the Urban
category and as identified as the "Transition Area". This is of
concern should the County Engineer require removal as roadway
improvements are made. Circulation policies, especially with regard
to the Transportation Corridor along the sewer trunk right of way,
need to be developed to provide consistency with past and future
decisions.
Based upon resolution of the above concerns by the Hearing Examiner
Committee, the Planning Department recommends approval of the zone
change and change of conditions.
VI. CONDITIONS OF APPROVAL
(Al1 Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)

five (5) along Sprague Avenue and five (5) adjacent to the sewer
trunk line right of way «hen the roadway improvements thereto
are made. Said signs shall be limited to 40-feet in height and
250-square feet in surface area. No roof top signs shall be allowed.
3. That should Second Avenue not be vacated by the Board of County
~ Commissioners, then the front yard setback of 35-feet shall be
complied with for structures along the south boundary.
4. That the landscaping proposed within the property deeded to
Spokane County shall remain and be maintained, if agreed to by
the County Engineer when the roadway improvements are made.
5. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumination
. to the area with full consideration to adjacent properties).
6. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.
I-PY 7. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. Al1 variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.
8. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.

9. All current standards of the Commercial Zone, as amended, shall
be complied with in the development of this site.

10. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay
Zone) of the Spokane County Zoning Ordinance. Accordingly, as a
condition of approval, the sponsor/applicant shall be required •
to file with the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
material as follows:

11. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
12. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
13. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the projeCt
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Applicant shall dedicate a 30 foot radius on Blake Road and
Sprague Avenue prior to any use of the property.
2. Applicant shall dedicate 5 feet on McDonald Road and a 30 foot
radius on Sprague Avenue and McDonald Road for right-of-way
prior to any use of the property.
3. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.

b) COUNTY ENGINEERING DEPARTMENT (continued)
4. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
5. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed'
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
building permit on the property.
6. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
7. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
8. As an alternative method of constructing the road improvement
stated herein, the applicant may, with the approval of the
County Engineer, accomplish the road improvements stated herein
by joining and participating in a County Road Project (CRP) to
the extent of the required road improvement. Spokane County
will not participate in the cost of these improvements. The
cost of roadway improvements, signal installation, and signal
upgrading shall be borne by the applicant who shall pay a
proportionate share based upon the traffic volumes generated by
the development.
9. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
10. Al1 required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
11. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.

c) COUNTY UTILITIES DEPARTMENT
l. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Cnapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) f rom
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
2. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
3. A sewer connection to the Valley Sewerage System is to be
constructed. Plans and specifications for the sewer connection
are to be reviewed and approved by the Utilities Department
prior to building permit issuance.
d) COUNTY HEALTH DISTRICT
l. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and the Spokane
County Health District prior to the issuance of any building
permit for this project. 2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.

e) COUNTY BUILDING AND SAFETY DEPARTMENT

2. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible f rom the street or road fronting the property. Said
numbers shall contrast with their background.
3. Reclassification of an existing buiiding shail require an
application for change of occupancy permit and subsequent
inspection for approval.
4. Due to the sensitive storage requirements over the Aquifer, and
this site lies within tlie Waste Water Management area, we feel
that some language should address the possible storage of
flammable or critical materialswithin these structures.
5. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
6. A plan for emergency equipment access is required to be
submitted prior to any land development.

e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued)
7. Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A •
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uniform Fire Code is required prior to
construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction.
8. Comments: It appears from a preliminary review of the proposed
site plan that five (5) new fire hydrants will be required for
the site.
f) WATER PURYEYOR
l. Water Purveyor is Modern Electric Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses. Satisfactory arrangements have been made to
serve this proposal.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.

under Zone Changes ZE 99-85, ZE 42A-71 and ZE 35A-78
ISSUE
Please be informed that the Spokane County Engineer has made an administrative determina-
tion regarding the responsibility for road construction improvements required under ZE
99-85, ZE 42A-71 and ZE 35A-78.
At the hearing for these zone changes, the proponent indicated that the entire site would
be developed at the same time. In approving the zone change f or the entire site, certain
conditions were attached requiring road improvements on McDonald Road and on Blake Road.
Now the proponent has indicated that at this time the site will not be developed in its
entirety and wishes to proceed with developing only a portion of the site. The proponent
has requested the Engineer's Office to apportion the responsibility for the road improve-
ments.
DETERMINATION
The site plan for the zone change indicated that the total building area to be developed
would be 192,587 square feet. The developed building area as shown on the site plan was
divided as follows:

The Engineer's Office total estimate to complete the road improvements required to miti-
gate traffic impacts resulting from the approved zone changes is approximately $110,000.
Included in the total estimate was 1) the widening of McDonald Road from the Milwaukee
Railroad property north through the Sprague Avenue intersection, and the reconstruction
of the McDonald Road and Sprague Avenue traffic signal to accommodate the widened McDon-
ald Road section ($72,000); and 2) the widening and construction of curbs and sidewalks
on Blake Road from the Milwaukee Railroad property north to Sprague Avenue ($38,000). At
the time of building permit application to develop the property, each property included
in the zone change is required to participate in a proportionate share of the total cost
of the required improvements.
The County Engineer has therefore determined 1) that each property's proportionate share
of the total cost be based on the amount of building square footage constructed with each
building permit phase relative to the total square footage of the approved site plan; and
2) that based on that proportionate share either the required improvement, bonds, other
suitable guarantees or combinations thereof be provided to Spokane County prior to build-
ing permit approval of each phase of development.

mary street access to Sprague Avenue and Blake Road was for developing appraximate3y
117,730 square feet of building fIoor space, ar 61.13% of the tota1 192,587 square feet

tionate share coneept as ouGlined above, this building permit for develaping the SHOPKO/
Tombari Properties is responsible for 61.131 ($67,250) of the total require-d nff-site
rnad impravements. The remaining $42,750 ($110,000 -$67,250) is the resgonsibility of
the Major Properties at such time as their properties are deve1oped in the future. Esti-
mates of construction will be upc3ated at the time of development. Responsi6ility is to
provide Ghe road improvements contemplated at the time the zone change was approved.
When the site is fully developed the~~ ful.l impresvements must have been provided.
SHOPK+D/Tombari has requested to p~oceed with Phase 1 of the development and have provided
a Roadway Improvement Bond in the amount of $67,250. They have also requested appraval
tv in,itzally construct the reqe~~red B1ake Rvad improvements as part of their overall
roadway improvement obligation. Their remaining obligation wauld be appll+ed, along with
the Major Properties obligatian, toward the required McDanald Road and Sprague Avenue
signal imgrovements; at such time as the Major Properties ownership is developed in the
future, consistent with the presently appraved site plan ot rec4xd and accarding to the

Second Avenue road right-of-way between McDonald and Blake Road in the Spokane
Valley. This action was based on the approved Shopko site plan. Attached is a copy
of Resolution Number 86-0172 which sets forth tWO "conditions" which must be met
prior to the vacation of the road right-of-way becoming final. One of those
condi[ions requirea that the applicants (Tombari et. al.) provide to Spokane County
the fee title to a strip of land 20 feet in wicith which parallels the abandoned
C.M.S.P.b.P. railroad rightrof-way.
The eite plan for the above-referenced zone change depicts a"dedicated" 20 foot
strip of land adjacent to and paralleling the abandoned railroad right-of -way. The
plan provides a 25-foot setback from the dedicated strip for [he Mervyn's building
and a 20-foot setback for the Shopko's building. This site plan Wae preseated to the
Spokane County Hearing Examiner Committee February 6, 1986 at the public hearing for
the zone change.
Based upon the site plan submittal by the applicant, approval of the zone change
and site plan, and by the H.E.C. the subsequent Board of County Commissioners
Resolution to vacate the road right-of-way, the County Engineer considers the aite
plan to be binding upon the applicaat. We are ceques[ing that the Zoning
