CONDITIONAL USE
CUE -46-79, MOBILE HOME FOR DEPENDENT RELATIVE
ZONING ADJUSTOR DECISION: After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request for a temporary
conditional use permit.
A. FINDINGS: Pursuant to Section 4.25.030 of the Spokane County Zoning
Ordinance, the Zoning Adjustor has the responsibility of determining that the
granting of this application will not be detrimental to the surrounding
properties. In assuring compatibility, the Zoning Adjustor based his decision
on the testimony presented at the above noted Zoning Adjustor Hearing as well
as criteria set forth in the Spokane County Zoning Ordinance for review of this
application. The Zoning Adjustor hereby finds the following:
1 The Zoning Adjustor notes that this action is requested in the Agricultural
zone of Spokane County where mobile homes are outright permitted uses.
The Spokane County Zoning Adjustor is thus unable to apply similar tests
for this permit approval as are done in the Town of Millwood and noted in
their letter regarding this application where mobile homes require special
permits.
2. The applicant was able to demonstrate to the satisfaction of the Zoning
Adjustor by means of a letter from a practicing physician, that there is,
in fact, a dependency which is medical in nature.
3. The described property meets the requirements as set forth in the Spokane
County Zoning Ordinance, for a Conditional Use Permit. Further,
applicant's parcel is of sufficient size to accommodate the temporary
structure without endangering the health, safety or welfare of adjoining
properties.
4. No adverse comments to this application were received from either the
Spokane County Engineers of Spokane County Health Department regarding
any traffic or sewerage problems associated with this proposal.
B. ORDER:
Applicant's request is hereby approved and with the following stipulations;
1. This approval is granted for six (6) months, at which time the permit will
be reviewed administratively to extend the time period granted with this
permit.
2. This approval is granted for the use of a mobile home as a residence for a
dependent relative of the applicant, Sylvia Simon, and sha_ ll immediately
terminate upon the dependent relative no longer residing' in the mobile
home.', Upon this occurrence, the applicant shall removeethe mobile home
from the site within thirty (30) days. r
The mobile home shall have an ownership title and be listed as personal
property with the Countye=Assessor.

4. The applicant shall maintain his site design in substantial conformance with
the''°plot plan" on file with this application, and in any case, shall observe
all setback requirements as prescribed by the Spokane County Zoning
Ordinance.
The mobile home shall not be mounted on a permanent foundation in such a
manner as to constitute a permanent residence.
