A. INTRODUCTION
This matter haviog come before the Zoning Hearing Examincr Committee
on April 6, 1989, and the rnembers of the Committee present being John
Skadan, Chairman, and Phillip D. Harris.
B.PROPOSAL
The sponsor, FRAME FACTORY, is r+equesting approval of a zone
reclassification, File No. ZE-S 1-88, RESIDENTIAL OFFICE to REGIONAL
BUSINESS (B-3) Zone, for the purpose of increasing signage for a retail
optical shop.
, C. FINDINGS OF FACT
1. That the existing land use in the area is single family residential,
apartment, convenience store, retail optical shop, accessory buildings,
fenced storage yard, retaiI and office.
2. That the Comprehensive Plan designates this area as appropriate for
MAJOR COMMERCIAL development.
3. That the existing zoning of the property described in the application is
Residential Office.
4. That the provisions of RCW 43.21 C(The State Environmental Policy Act) .
have been complied with, and the Committee concurs with the
, Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land use in this area is suitable for the proposed use, or uses
within the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substantially
changed since the originai zoning of this area and accordingly, the
proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands neither approval nor disapproval of
the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfarc. ,

APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall
be binding on the "Applicant", which term shail include the owner or
owners of the property, heirs, assigns, and successors.)
a ) COUNTY PLANNING DEPARTMENT Standard:
The following conditions shall be complied with in future development,
or redevelopment of the site.
1. The Zoning Administrator shall approve a specific exterior lighting
plan for the approved area prior to installation of such lighting.
(Such plan shall attempt to confine illumination to the area with full
consideration to adjacent properties).
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall be
installed and maintained such that sight distance at access points is
not obscured or impaired.
2. Direct light from any exterior area lighting fixture shall not extend
over the property boundary.
4. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
5. All current standards of the Regional Business (B-3) Zone, as
amended, shall be complied with in the development of this site.
6. That the project is subject to Section 14.706, the Aquifer Sensitive
Area Overlay Zone of tho ZOMNG CODE FOR SPOKANE COUNTY, which
sets forth various measures for Aquifer protection; specifically,
measures dealing with wastewater disposal, spill protection
measures, and storrnwater runoff.
7. That tbe present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay
Zone) of the SPOKANE COUNTY ZOIVING ORDINANCE. Accordingly, as a
condition of approval, the sponsor/applicant shall be required to file
with the Spokane County Auditor, within thirty (30) days of the
signing of Findings and Order of the final decision in this matter, a
"Notice to the Public" which shall provide in material as follows:

PRIOR TO THE 1SSUANCE OF ANY BUILDING PERMIT OR CERTIFICATE OF
OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY
DFSCRIBED HEREINAF'IER, THE APPLICANT SHALL BE RESPONSIBLE
FOR COMPLYING WITH THE PROVISIONS OF SFOKANE COUNTY ZONING
ORDINANCE CH[APT'ER 4.16A (AQUIFER SENSITIVE AREA OVERLAY
ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS NOTICE IS MORE
PARTICULARLY DESCRIBED AS FOLLOWS:....".
8. Applicant shall comply with '208' recommendations conceming
stormwater runoff and provide necessary la.ndscaping for runoff.
9. Any division of land for the purpose of sale, lease or transfer, shall
comply with RCW 58-17 and ihe Spokane County Platting Ordinances
- prior to issuance of building permits.
Special:
10. The Spokane County Planning Department shall prepare and record
with the Spokane County Auditor a"Tiile Notice" noting that the
property in question is subject to a variety of special conditions
imposed as a result of approval of a land use action. This "Title
Notice" shall serve as official public notice regarding conditions of
approval affecting the property in question. The "Title Notice" shall
be recorded withio fifteen (15) days of final disposition of the
y:• approved land use action and shall only be extinquisbed by the
Spokane County Planning Department. The "Title Notice" shall
generally provide as follows:
The parcel of property legally described as (1 e g a l
description and tax parcel number) is the subject of a land
use action, imposing a variety of special development
conditions, by a Spokane County Hearing Body or
Administrative Official on (date). File No. (Planning
Department File Number) is available for inspection and
copying in the Spokane County Planning Department.
The following conditions shall apply to addition of new signs.
11. All current standards of the Regional Business (B-3) Zone shall be
complied with in development of new signs for this site (including
existing sign).
12. Approval by the Zoning Administrator of a specific signing plan
prior to release of any building permits for new signs.

b) rOL1NTY EN GINEERING DEPARTMENT
Prior To The Issuance Of A Building Perrnit:
Standard:
1. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed combined
on-site sewage system plan and surface water disposal plan for the
entire project or any portion thereof, if the development is to be
phased.
3. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location, and
arraagement of parking stalls shall be in accordance with standard
traffic engineering practices. Paving or surfacing as approved by
the County Engineer, will be required for any portion of the project
which is to be occupied or traveled by vehicles.
4. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, aad other applicable County standards and/or adopted .
- resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
5. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
c ) COUNTY UTILITIES DEPARTMENT
. 1. Pursuant to Board of County Commissioners Resolution No. 80-0418,
tbe use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance witb all rules and
regulations of ttie Spokane County Health District aad is further
conditioned and subject to specific application approval and issuancc
of permits by the Health District. .
2. The Owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of a
ULID by petition method pursuant to RCW 36.94 which the petition
includes the Owner(s) property and further not to object by the
signing of a protest petitioo against the fomnation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the
Owner(s) property. PROVIDED, this condition shall not prohibit the
Owner(s) or Successor(s) from objection to any assessment(s) on the

property as a result of improvements called for in conjunction with
the formation of a ULID by either petition or resolution method
under RCW Chapter 36.94.
3. Any water service for this project shall be provided in accordance
with the Coordinated Water System Plan for Spokane County, as
amended.
4. Each dwelling unit shall be double-plumbed for connection to future
areawide collection systems.
d ) (_OCTNTY HEALTH IDISTRIGT
Standard:
1. Sewage disposal metbod shall be as authorized by the Director of
Utilities, Spokane County.
2. Water service shall be coordinated through the Director of Utilities,
Spokane County.
3. Water service shall be by an existing public water supply wben
approved by the Regional Engineer (Spokane), State Department of Social and Health Services.
4. A public sewer system will be made available for the project and
individual service will be provided to each lot prior to sale. Use of
individual on-site sewage disposal systems shall not be authorized.
5. Use of private wells and water systems is probibited.
e) COLINTY BCTIL-DIN G AND SAFETY DEPARTMENT
Standard:
1. The site is located in Fire Discrict #1.

2. The applicant sball contact the Department of Building and Safety at
the earliest possible stage of design/development in order to be
informed of code requirements administered/enforced by the
department; e.g., State Building Code Act regulations such as
requirements for fire hydrant/flow, fire apparatus access roads,
private road designation/naming, stret address assignment, building
demolition permits and general coordination with other aspects of
project implementation. '

f ) WATER PURVEYOR
1. Water Purveyor is Modern Electric Water Company and they will
supply the site with adequate water for domestic, firc and irrigation
uses.
g) SPOKANE .OLTNTY AIR POLLUTION CONTROL AUTHORITY
All air 12ollution regulations must be met. This includes but is not
limited to the following-L
Standard:
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled. This
•may require use of water sprays, tarps, sprinklers, or suspension of
activity during certain weather conditions. Haul roads should be
treated and emissions from the transfer of earthen material must be
controlled as well as emissions from all other construction related '
activities. '
2. Measures must be taken to avoid the deposition of dirt and mud from
unpaved surfaces onto paved surfaces. If tracking or spills occur on
- paved surfaces, measures must be taken immediately to clean these
surfaces. , 3. All travelled surfaces (ingress, egress, parking areas, access roads)
must be paved and kept clean.
4. Some objectionable odors will likely result during the coastruction
phase of the project and from motor vehicles using the site
following completion of the project and from occupants of the
proposed project.
5. SCAPCA Regulation I, Article VI and SCAPCA Regulation II, Article IV •
addresses emission standards. All emission standards must be met.
6. Demolition and renovation projects must comply with the
requirements of CFR 40 Part 61, Subpart M. Intent to Demolish and
Renovate forms are available at the SCAPCA office.

7. Waste must be disposed of by means other than buming.

An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered the

other regulations and laws, possible standard Conditions of Approval, the
Generalized Comprehensive Plan, and other County policies and guidelines.
The Zoning Administrator has determined that "No probable significant
adverse impacts" would result from the proposal being developed and has
- issued a peterminUiQn Qf Non-Signifiqance ("DNS").
The "DNS" was circulated to nine othcr agencies of jurisdiction and othcr
t agencies/departments affected by the future devclopment for review and
comment. r The "DNS" comment period ends April 5, 1989, and was advertised
15 calendar days before said date in thc newspaper, by letter to adjacent
~ property owners within 400 feet of the proposal, and by notice on a sign
' posted on the proposal site. The Hearing Examiner may consider additional
-environmental related testimony and the "DNS" at the public hearing.

V. PLANNING SUMMARY ZE-51-88
The proposed Regional Business (B-3) Zone is consistent with the Major
Commercial Category of the Comprehensive Plan and recent zoning trends
for the area. This zone change request is for the purpose of permitting
additional signage other than ihat allowed in the existing Residential Office
Zone. The Planning Department recommends approval.
VI.CONDITIONS OF APPROVAL

Standard:
In addition to the above, the following conditions shall be complied with

1. The Zoning Administrator shall approve a specific exterior lighting
plan for the approved area prior to installation of such lighting.
(Such plan shall attempt to confine illumination to the area with full ,
consideration to adjacent properties).
2. A specific landscape plan, planting schedule and provisions for -
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall be
installed and maintained such that sight distance at access points is
not obscured or impaircd.
2. Direct light from any exterior area lighting fixture shall not extend
over the property boundary.
4. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building '
permits.
5. All current standards of the Regional Business (B-3) Zone, as
` amended, shall be complied with in the devclopment of this site.
6. That the project is subject to Section 14.706, the Aquifer Sensitive
Area Overlay Zone of the ZONING CODE FOR SPOKANE COUNTY, which
sets forth various measures for Aquifer protection; specifically,
measures dealing with wastewater disposal, spill protection
mcasures, and stormwater runoff.
7. That thc present proposal is not detailed enough to determine

• 8. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
9. Any division 'of land for the purpose of sale, lease or transfer, shall
comply with RCW 58-17 and the Spokane County Platting Ordinances
prior to issuance of building permits.

10. The Spokane County Planning Department shall prepare and record
with the Spokane County Auditor a"Title Notice" noting that the
property in question is subject to a variety of special conditions
imposed as a result of approval of a land use action. This "Title
Notice" shall serve as official public notice regarding conditions of
approval affecting the property in question. The "Title Notice" shall
be recorded within fifteen (15) days of final disposition of the
approved land use action and shall only be extinquished by the
Spokane County Planning Department. The "Title Notice" shall
generally provide as follows:

use action, imposing a variety of special development
conditions, by a Spokane County Hearing Body or

11. All current standards of the Regional Business (B-3) Zone shall be
complied with in development of new signs for this site (including
existing sign).

b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A BuildinE Penmit Or Use Of The Prop&,W Aa
Standard:
1. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. The applicant shall submit for approval by the Spokane County
. Engineer and the Spokane County Health District a detailed combined
on-site sewage system plan and surface water disposal plan for the
entire project or any portion thereof, if the development is to be
phased.
3. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location, and .
arrangement of parking stalls shall be in accordance with standard
traffic engineering practices. Paving or surfacing as approved by
the County Engineer, will be required for any portion of the project _
which is to be occupied or traveled by vehicles.
4. All required improvements sball conform to the cunent State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or adopted
resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
5. Roadway staadards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
c ) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Commissioners Resolution No. 80-0418,
the use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all rules and
regulations of the Spokane County Health District and is further
conditioned and subject to specific application approval and issuancc
of permits by the Health District.

2. The Owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of a
ULID by petition method pursuant to RCW 36.94 which the petition
includes tbe Owner(s) property and further not to object by the
signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the
Owner(s) property. PRO.VIDED, this condition shall not prohibit the _
Owner(s) or Successor(s) from objection to any assessment(s) on the
property as a result of improvements called for in conjunction with
the formation of a ULID by either petition or resolution method
under RCW Chapter 36.94.
3. Any -water service for this project -shall be provided in accordance
with the Coordinated Water Sy"stem Plan for Spokane County, as
amended.
4. Each dwelling unit shall be double-plumbed for eonnection to future
areawide collection systems. d ) COLINTY HEALTH DISTRICT
Standard:
1. Sewage disposal method shall be as authorized by the Director of
, . Utilities, Spokane County.
2. Water service shall be coordinated through the Director of Utilities,
Spokane County.
. 3. Water service shall • be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
4. A public sewer system will be made available for the project and
individual service will be provided to each lot prior to sale. Use of
individual on-site sewage disposal systems shall not be authorized.
5. Use of private wells and water systems is prohibited.
e)('OCINTY BUILDING AND SAFETY DEPARTMENT
Standard:
1. The site is located in Fire District #1.

Special:
2. The applicant shall contact the Department of Building and Safety at
the earliest possible stage of design/development in order to be
informed of code requirements administered/enforced by the
department; e.g., State Building Code Act regulations such as
requirements for fire hydrant/flow, fire apparatus access roads,
private road designation/naming, stret address assignment, building
demolition permits and general coordination with other aspects of
project implementation.
f ) WATER PURVEYOR
1. Water Purveyor is Modern Electric Water Company and they will
supply the site with adequate water for domestic, fire and irrigation
uses.
g) SPOKANE _OLINTY AIR POLLUTION CONTROL AUTHORITY All 4ir nollution regulations must be mej. This includes but is not
limited to the followingi
Standard:
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled. This
may require use of water sprays, tarps, sprinklers, or suspension of
activity during certain weather conditions. Haul roads should be
treated and emissions from the transfer of earthen material must be
controlled as well as emissions from all other construction related
activities.
2. Measures must be taken to avoid the deposition of dirt and mud from
unpaved surfaces onto paved surfaces. If tracking or spills occur on
paved surfaces, measures must be taken immediately to clean these
surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access roads)
must be paved and kept clean.
4. Some objectionable odors will likely result during the construction
phase of the project and from motor vehicles using the site
following completion of the project and from occupants of the
proposed project.
5. SCAPCA Regulation I, Article VI and SCAPCA Regulation II, Article IV
addresses emission standards. All emission standards must be met.
