ZE-42-90 ~ r SPOKANE COUNTY , HEARING EXAMINER COMMITTEE FINDINGS OF FA T, ONCLUSION AND ORD .R INTRODUCTION This matter has come before the Heanng Examiner Committee on November 29, 1990. The members of the Committee present are Phil Hams, Chairperson, Verona Southern and Bud Skadan. PROPOSAL The sgonsor, Merle Haffner, requests approval of a zone reclassification, File No ZE-42-90, Multiple Family Suburban (MFS) to Urban Residential-22 (UR-22) to allow development of an office complex FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located south of I-90 and south of and adjacent to Nora Avenue The site is approxlmately 1/4 mile east of Pines Road in Section 10, Township 25 N., Range 44 EWM, Spokane County, Washington. 2. The committee adopts the Planning Deparnnent Report as a part of this record. 3. The exisang land uses m the area include single family residences, offices and retirement aparanents. 4. The Comprehensive Plan designates ttus site as Urban The Urban category is intended to provide for a vanety of land uses in an intensive "city lilce" environment. 5. The Artenal Road Plan designates Nora Avenue as a local access street, with a recommended right of way width of 60 feet. 6. The existing zoning of the propeity described in the application is Multiple Family Suburban, previously estabhshed in 1979. 7. The provisions of RCW 43.21C (The State Environmental Pohcy Act) have been ` comphed with and a Determmaaon of Nonsignificance was issued. 8. The legal requuements for pubhc notice have been fulfilled. 9. The owners of adjacent lands expressed neither approval or disapproval of the proposed use. 10. The proposed use is compatible with exisang uses in the area. 11. The proposed zoning dces implement and confarm to the Comprehensive Plan 12. The apphcant has demonstrated that conchtions have substannally changed since the original zoning of thus area and accordzngly, the proposed zone reclassification is jusnfied. All Conditions unposed by the Heanng Exanuner Committee shall be binding on the "Applicant," which tenn shall include the owner or owners of the property, heus, assigns, and successors-in-uiterest. 2. The following Conditions of Approval apply to the real pnoperty described below: that pornon of tracts 11 and 12, Assessof s Plat #6lying southerly of Nora Avenue within the SW 1/4 of Secaon 10, Township 25 N., Range 44 EWM. HEARING EXAMINER COMMITTEE 1. The Spokane County Heanng Examiner ComrYUttee added Spokane County Au Pollunon Control Authority Condltion of Approval 1 through 4 as contained herein. COUNTY PLANNING DEPARTMENT 1. A specific development plan shall be submitted for Planning Deparnnent review and approval pnor to issuance of build.ing pemuts. Construcuon must be judged as proceeduig accorduig to the plan or constitute a zoning violation. 2. Approval is required by the Plammmg Dffwor/designee of a specific hghting and signing plan for the described property pnor to the release of any building pemuts. 3. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building peniuts. Landscaping shall be installed and maintamed so that sight d.istance at access points is not obscured or o impamed. 4. The existing residence on the site may be converted to office use. Existing landscaping may be utihzed to saasfy landscaping requuements unul such time that a bufldulg permit is requested to enlarge or construct additional office space. At that time, a site development plan and landscape plan will be requined and all reqwnements of the Urban Residential-22 (UR-22) Zone shall be met. 5. The Planning Depanment shall file with the Spokane County Aud.itar, within the same nme frame as allowed for an appeal from the final disposition, includtng lapsing of appeal penod, a Title Nonce, which shall generally provide as follows• "Prior to the issuance of any building pernut for any building or any use on the property descnbed herein, the apphcant shall be responsible for complying with the provisions of the Zoning Code for Spokane County, Secnon 14.706 (Aquifer Sensiuve Area Overlay Zone). The Planning Departrnent shall prepare and record wlth the Spokane County Auditor a Title Noace nonng that the property in question is subject to a vanety of special conditions imposed as a result of approval of a land use acaon. This Title Nonce shall serve as pubhc nouce of the condiuons of approval affecring the property in quesuon. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. The Title Notice shall generally provide as follows: The parcel of property legally described as that portion of tracts 11 and 12, Assessor's Plat #6, lying southerty of Nora Avenue within the SW1/4 of Section 10, Township 25 North, Range 44 EWM, Spokane County, Washington, is the subject of a land use action by a Spokane County Hearing Body or Administrative Official on November 29, 1990, imposing a variety of special development conditions. File No. ZE-42-90 is available for inspection and copying in the Spokane County Planning Department. COUNTY ENGINEER'S OFFICE ~ Prior To The Issuance Of A BuildlnLy Permit Or Use Of The Pronertv As ProDosed: 1. Apphcant shall dedicate 10 feet on Nora Avenue for nght-of-way. 2. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 3. Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer. 4. The apphcant shall subrrut for approval by the Spokane County Engineer road, drainage and access plans. 5. The apphcant shall submit for approval by the Spokane County Engineer and the Spokane County Health Distnct a detailed combined on-site sewage system plan and surface water disposal plan for the entire project, or pornon thereof, if the development is to be phased . 6. A parlang plan and naffc cuculation plan shall be subnutted and approved by the Spokane County Engineer. The design, location and arrangement of parlang stalls shall be in aocordance wnth standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 7. To construct the roadway improvements stated hereui, the apphcant may, with the approval of the County Engineer, join in and be willing to participate in any petihon or resolution which purpose is the formation of a Road Improvement Dismct (RID) for said unprovement, pursuant to RCW 36.88, as amended. H EC Order for ZE-42-90 Page 4 Spokane County wnll not participate in the cost of these improvements. This is apphcable to Nora Avenue. 8. As an alternative method of constructing the road unprovements stated herein, the apphcant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and parucipating in a County Road Project (CR.P) to the extent of the requued unprovement. Spokane County will not parncipate in the cost of these unprovements. This is apphcable to Nora Avenue 9. The construction of the road unprovements stated herein shall be accomplished as approved by the Spokane County Engineer. 10 The County Englneer has designated Typical Roadway Section Number One, Local Access standard for the unprovement of Nora Avenue, whuch is adjacent to the proposed development. This will require the addition of approximately 8- 10 feet of asphalt along the frontage of the development. The construcnon of curbing and sidewalk is also required. 11. All requued unprovements shall conform to the cunent State of Washington Standard Specifications for Road and Bndge Constructlon and other applicable County standards and/or adopted resolunons pertaining to Road Stand.ards and Stormwater Management in effect at the date of construction, unless otherwnse approved by the County Engineer. 12. Apphcant shall construct a paved and delineated approach(es) to meet the existing pavement on Nora Avenue. 13. Roadway standards, typical roadway sections and drainage plan requumments are , found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are apphcable to this proposal. 14. This subdivision or development proposal is located within a drauiage basin which - has been idenafied by the Spokane County Enguieer's office as havuig stormwater " runoff problems. Since thls plat or development proposal is affected by or is a contributor to stormwater flows, property owners should parncipate in the planning and unplementation of a future basinwide stormwater management system. The o followmg statement shall be plaoed in the plat dedicanon: "The owner(s) or successor(s) in interest agree to join in any County-approved stormwater management program and to pay such rates and charges as may be fixed through public heanngs for service or benefit obtained by the planning, design, constructing, maultairung or operation of stomlwater control faciliaes." . 15. No construction work shall be performed withui the existing or proposed pubhc nght-of-way until a permit has been issued by the County Engineer. All work within the pubhc road right-of-way is subject to inspection and approval by the County Engineer. 16. All required construction within the existmg or proposed public nght-of-way is to be completed prior to the release of a builduig pernut, or a bond in an amount estimated by the County Engineer to cover the cost of construction of improvements shall be filed with the County Enguieer. r H EC Order for ZE-42-90 Page 5 17. Applicant shall sign and record Spokane County Notice to the Public No. 6 which specif'ies the following: 'The owner(s) or successor(s) in interest agree to authonze the County to place their name(s) on a petinon for the fonnauon of a Road Improvement Dismct (RID) by the petition method pursuant to Chapter 36.88 RCW, which pention includes the owner(s) property, and further not to object, by the signing of a ballot, the formation of a RID by the resoludon method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s) property. If an RID is formed by either the petiaon or resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the unprovement or construction contemplated within the proposed RID is feasible; (b) that the benefits to be denved from the formaaon of the RID by the property included therein, together with the amount of any County parncipauon, exceeds the cost and expense of fonnation of the RID, and (c) that the property vvithln the proposed RID is sufficiently developed. _ Provided further that the owner(s) or successor(s) shall retain the nght, as authonzed under RCW 36.88.090, to object to any assessment on the property as a result of the irnprovements called for m conjuncuon with the fomiation of the RID by either petition or resolution method under Chapter 36.88 RCW. This requirement applies to Nora Avenue, from which the subject parcel takes access. COUNTY UTILTTIES DEPARTMENT 1. Applicant shall make connection to pubhc sewer system. Sewer connection penrut is requred. Plans and specifications are to be reviewed and approved by the Utihaes Department COUNTY HEALTH DISTRICT - 1. Sewage disposal method shall be as authonzed by the Duector of Utflities, Spokane County. . 2. Water service shall be cooidinated through the Dmctor of Uahaes, Spokane County. 3. Water service shall be by an exisang public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. A pubhc sewer system will be made available for the project, and individual servlce will be provided to each lodtrwt pnor to sale. Use of indivldual on-site sewage disposal systenis shall not be authonzed. HEC Order for ZE-42-90 Page 6 5. Use of pnvate wells and water systems is prohibited. COUNTY BUILDING AND SAFETY DEPARTMENT 1 The apphcant shall contact the Department of Building and Safety at the earhest possible stage of design/development in order to be infonned of code requuements admirustered/enforced by the deparanent, e.g., State Buildmg Code Act regularions, such as requirements for fire hydrant/flow, fire apparatus access roads, street address assignment, bamer-free regulations, energy code regulaaons and general coordmation with other aspects of project implementaaon. 2. Requuements of Fm Ihstnct No. 1 need to be satisfied dunng the buildmg pernut process. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. Au pollunon regulations requu-e that dust emissions during demohtion, construction and excavation projects be controlled This may require use of water sprays, tarps, spnnklers or suspension of acuvity dunng certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen matenal must be controlled, as well as emissions from all other construcnon-related activities. 2. All traveled surfaces (ingress, egress, paridng areas, access roads) must be paved and kept clean. 3. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If traclang or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 4.
