Situate in the County of Spokane, State of Washington.
The City of Spokane Valley ("City") received a request for partial satisfaction of the Mitigation
Agreement SR27 (Pines Road)/Mansfield Road Construction Project (the "Project") between the
City and Thomas Hamilton, Hamilton Apartments entered into on February 10, 2005 (the
"Mitigation Agreement"), and recorded under Recording Number 5194557 on March 24,2005.
After reviewing the conditions set forth in the Mitigation Agreement and the actions taken by
Developer, the City has determined that the Developer has complied with the following
conditions, and all such conditions are deemed to be satisfied by the City:
Section 3 - Mitigation Fee: Paid in full
Section 4 -Payment: Paid in full
Section 6 - Compliance with RCW 82.02.020: City has expended the mitigation fee on
design, right-of-way acquisition, and construction of the Project and did so within 5 years
of receipt of funds.

All other conditions, requirements and provisions of the Mitigation Agreement remain in full
force and effect as provided by the Mitigation Agreement and as intended by the Parties.
