CONCILUSIONS A,ND OhZi)lER I1VTitODUC'TION This matter has come before the Heanng Examiner Comnuttee on June 27, 1991 The members of the Committee present are Phd Hams, Chairperson, Verona Southern and Jane Myers PROPOSAL The sponsor, Mark Pinch, requests approval of a Zone Reclassification, ZE-20-91, from Urban Residential-22 (UR-22) and Commuruty Business (B-2) to Reglonal Business (B-3) The proposal is within the Aquifer Sensinve Area (ASA) Overlay Zone FINDINGS OF FACT AND CONCLUSIOIVS 1 The property is generally located north of I-90 in the northeast quadrant of the 1Vlullan/Argonne - I-90 interchange adjacent and east of Argonne Road in Section 8, Township 25 North, Range 44 EWM, Spokane County, Washington 2 The comnuttee adopts the Plannuig Deparnnent Report as a part of tius record , 3 The existing land use(s) in the area are restaurants, motel, retail and professional office 4 The Comprehensive Plan designates this site as Major Commercial The Major Commercial category is intended for development of commercial uses, specif'ically commuruty and regional shopping centers and commercial uses directly related to major throughways 5 The Artenal Road Plan designates Argonne Road as a pnncipal artenal, with a recommended nght of way width of 100 feet 6 The existing zorung of the property descnbed in the apphcaaon is Urban Residential-22 (UR-22) and Community Business (B-2), previously established in 1956 (UR-22) and 1946 (B-2) 7 The provisions of RCW 43 21C ('The State Envuonmental Pohcy Act) have been comphed with and a Deternunaaon of Nonsigmficance was issued 8 The legal requuements for public notice have been fulfilled 9 The owners of adjacent lands expressed concern of the proposed use due to the high volume of conflicting traffic movements and the location of the dnveway to the north of the proposal which is not indicated on the site plan 10 The proposed use is companble with existing uses in the area r ts . which is to be occupied or traveled by vehicles 7 To construct the roadway improvements stated herein, the apphcant may, with the approval of the County Engineer, join in and be wflhng to participate in any petinon or resoluhon which purpose is the formation of a Road Improvement Distnct (RID) for said unprovement, pursuant to RCW 36 88, as amended Spokane County wfll not parncipate in the cost of these improvements 8 As an alternative method of constructing the road unprovements stated herein, the apphcant may, vvith the approval of the County Engineer, accomplish the road unprovements stated herein by joining and pamcipating ui a County Road Project (CRP) to the extent of the required unprovement Spokane County will not parncipate in the cost of these unprovements. 9 The construcnon of the road improvements stated herein shall be accomphshed as approved by the Spokane County Engineer 10 The County Engineer has designated Typical Roadway Secaon Number One, Major Artenal standard for the unprovement of Argonne Road, which is adjacent to the proposed development This will requue the addition of approximately 6- 8 feet of asphalt along the frontage of the development The construction of curbing and sidewalk is also requued 11 All reqtured unprovements shall conform to the current State of Washuigton Standard Specifications for Road and Bndge Construction and other apphcable County standards and/or adopted resolutions pertairung to Road Standards and Stormwater 1Vlanagement in effect at the date of construcaon, unless otherwise approved by the County Engineer 12 Applicant shall construct a paved and deluieated approach(es) to meet the existing pavement on Argonne Road 13 Roadway standards, typical roadway sections and drainage plan requirements are found ui Spokane Board of County Commissioners Resoluuon No 80-1592 as amended and are apphcable to this proposal 14 This subdivision or development proposal is located within a drauiage basin which has been identified by the Spokane County Englneer's office as having stormwater runoff problems Since this plat or development proposal is affected by or is a contnbutor to stormwater flows, property owners should parncipate in the planmng and unplementanon of a future basinwide stormwater management system The followulg statement shall be placed in the plat dedication "The owner(s) or successor(s) in interest agree to join in any County-approved storniwater management prograrri and to pay such rates and charges as may be fixed through pubhc heanngs for service or benefit obtained by the planning, agree to authonze the County to place theu name(s) on a petition for the fonnation of a Road Improvement Distnct (RID) by the petiuon method pursuant to Chapter 36 88 RCW, which peanon includes the owner(s) property, and further not to object, by the signing of a ballot, the formation of a RID by the resoluaon method pursuant to Chapter 36 88 RCW, which resolution includes the owner(s) property If an RID is formed by either the petition or resolution method, as provrded for in Chapter 36 88 RCW, the owner(s) or successar(s) further agree (a) that the unprovement or construction contemplated withui the proposed RID is feasible, (b) that the benefits to be denved from the formaaon of the RID by the property uicluded therein, together with the amount of any County parncipation, exceeds the cost and expense of formabon of the RID, and (c) that the property within the proposed RID is sufficiendy developed Provided furttier that the owner(s) or successor(s) shall retain the nght, as under Chapter 36 88 RCW 18 The County Artenal Road Plan identifies Argonne Road as a Pnncipal artenal The existing nght-of-way width of 63 feet is not consistent with that specified in the Plan In order to implement the Artenal Road Plan, in addinon to the requlred nght-of-way dedication, a stnp of property 10 feet in width along the Argonne Road frontage shall be set aside in reserve This property may be acquued by Spokane Counry at the time when artenal unprovements are made to Argonne Road. 19 There may exist utdities, either underground or overhead, affecting the subject property, including property to be dedlcated or set aside for future acquisition Spokane County assumes no financial obhgation for adjustments or relocaaon regarding these utihties Apphcant(s) should check with the applicable utihty purveyor and the Spokane County Engineer to determine whether apphcant(s) or the utlhty is responsible for adjustment or relocation costs and to make arrangements for any necessary work 20 Applicant shall only be pernutted nght-in and/or nght-out turiung movements on Argonne Road Apphcant shall be financially responsible for construcnon of H EC Order for ZE-20-91 Page 6 approved traffic control facihties which would alleviate the possibility of left turns into the site from Argonne Road These traffic control facflities shall be approved by the County Engineer. 21 In conjunchon with the approved Short Plat 88-532 the apphcant shall provide for and sign a Tract "X" agreement and the corresponding requumd documents to ded.icate for future nght of way 25 feet along the proposals' east property luie This future public nght of way will eventually connect to Knox Avenue and provide for access on a signalized intersection SPOKANE COUN'TY U'I'II.ITIES DEPAIZ'II'MENT CONDI'I'gOIVS 1 Pursuant to the Board of County Com.missioners Resolution No 80-0418, the use of on-site sewer disposal systems is hereby authonzed This authonzanon is conditioned on compliance with all rules and regulaaons of the Spokane County Health Distnct and is further conditioned and subject to specific application approval and issuance of pernuts by the Health Dismct. 2 The dedicanon shall state "The owner(s) or successor(s) in interest agree to authonze the County to place theu name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36 94, which petition includes the owner(s)' property, and further not to object by the sigrung of a protest petition against the formaaon of a ULID by resolunon method pursuant to RCW Chapter 36 94 which includes the owner(s)' property PROVIDED, this concliaon shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of unprovements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36 94." 3 Any water service for this project shall be provided in accordance with the Coordinated any on-site sewage disposal pernut or building pemut for this project 2 Sewage disposal method shall be as authonzed by the Duector of Utilities, Spokane County 3 Water service shall be coordinated tanks must be registered with the Department of Ecol_ogy on a state notlf`ication form 3 All firms provlding tank-tnstallation services must be hcensed by the Department of Ecology The supervisor on-site dunng installation must be hcensed by passing a state exam 4 New tanks and any connected piping must be protected from corrosion by either a cathodic protecuon system, or by being constructed or coated with a noncorrosive matenal such as fiberglass An acceptable method of leak detecnon must be employed, and the tanks must be equipped wlth spill prevention and overfill protection equipment 5 State I vapor recovery equipment is required on new underground storage tank _ installanons with an aggregate volume greater than 10,000 gallons In the near future, Stage II vapor recovery equipment vvill also be requued in VVestern Washington counties The applicant may wish to consider installing Stage II equipment during initial construction of new tank systems 6 Under the Uniform Fue Code,
