This matter coming on for pubhc heanng on March 6, 2002, the Heanng Examiner, after
review of the change of condihons application and the enhre record, and finduig good cause
therefore, hereby makes the followmg findmgs of fact, conclusions of law and decision
I FINDINGS OF FACT
1 The apphcation requests a change of condinons to a pnor zone reclassificanon, in the Light
Industrial(I-2) zone, to delete the requirement for public heanng review of a specific site plan for
the westerly 245 feet of the srte, mod.ify the reqiurement for a 10-foot lugh landscaping berm,
and allow the development of warehouse uses on the site
2 The site is generally located at the southeast corner of the intersechon of Woodruff Road
and Knox Avenue, in the SE `/a of Section 8, Townslup 25 North, Range 44 EWM, Spokane
County, Washington
3 The site is currently designated as County Assessor's taac parcel no 45084 0227 The site
is legally descnbed as that portion of the north half of Tract 266 of Opportuiuty, according to the
plat recorded m Volume "K" of Plats, page 20, records of Spokane County Aud.rtor, lying south
of Knox Avenue and east of Woodruff Road, excluding the South 54 feet of the north half of
said Tract 266

existing paved dnveway vvith adjacent retauung wa11 extends through the east porhon of the site
from Knox Avenue to adjouung properly to the east, a dnveway and exishng landscaping extend
along the west border of the site, existuig landscapmg is found along the north border of the site,
and a block retauung wa11 and exishng landscaping are found along the south border of the site
The westerly dnveway serves adjacent property to the south, and accesses Knox Avenue at the
northwest corner of the subject property The srte is generally flat, except for an eight (8)-foot
nse in elevahon between the driveway and Woodruff Road
12 On Apn114, 1980, 7 5 acres of land, consistuig of the site and the adjacent parcel to the
south, were rezoned from the Agncultural (A) zone of the now expued County Zoiung
Ordmance to the Restncted Industnal (RI) zone The rezone decision adopted the condihons of
approval recommended by the Planrung Department, m rts staff report dated 4-10-80, except for
two of the County Engineeruig condihons The decision also added some new condlhons to
protect the residenhal neighborhood to the west See County Heazing Examiner decision adopted
on Apnl 14, 1980 in File No ZE-222-79, (erroneously attested to on "3-14-80")
13 The srte plan for the 1980 rezone illustrated development of the easterly 390 feet of the
onguial7 5 acres for sales, service, engineeruig and repatr of diesel enguies (Cunnmins
Northwest Diesel) This included a 1-story building of 43,681 square feet, wrth a maxunum
height of 40 feet, and with areas for trailer pazkulg illustrated along the east property lule and
also west of the building The site plan showed the westerly 245 feet of such parcel as
undeveloped
14 The cond.itions of approval for the 1980 rezone provided that future development on the
westerly 245 feet of the property between Knox Avenue and I-90 " by any future building will
be for an office business pazk" Such conditions also required the developer to subnut a specific
site development plan for the review and approval of the heanng body, pnor to issuance of a
buildmg permrt for development of the westerly 245 feet of the subject parcel The conditions
further prohibited access to Woodruff Road, required a 6-foot high fence at the southwest edge of
the building, and requued a 10-foot berm and 6-foot high plantmgs to be installed 130 feet west
of such building

15 Effective January 1, 1991, the zoYUng of the 7 5 acres rezoned in 1980 was reclassified to
the Light Industnal (I-2) zone, pursuant to the Program to Implement the Spokane County
Zorung Code The Program to Implement specifically preserved, as a condition of the new I-2
zorung, the conditions of approval of the 1980 rezone that were more specific or stnct than the
development standards of the new zone See County Resolution No 85-0900, Program to
Implement
16 On February 16, 2000, the Heanrig Exarruner approved a change of cond.ihons to the 1980
rezone for the adjacent parcel to the south The decision authonzed the development of an
office/warehouse use on such parcel, changed the configurahon of the building and other
improvements shown on the srte plan for the 1980 rezone, and authonzed the installahon of 10
feet of Type I landscaping along the west boundary of the parcel m heu of the required berm and
plantuigs The decision reqtured pnmary access to such parcel from Knox Avenue, with an
allowance for restncted access along Woodruff Road See Heanrig Exa.miner decision m File

17 On I)ecember 21, 2001, the apphcant subnutted a complete applicanon for a change of
condinons to the 1980 rezone for the current srte The applicahon is appropnate u.nder the
change of cond.ihons process set forth in Section 14 504 040 of the County Zorung Code
18 The site plan of record for the change of conditions subnutted dated May 25, 2001
illustrates phased development of the srte and adjouung properiy to the south and east, vvith the
site developed last The site plan shows a 24,112 square foot, single-story buzlding for
office/warehouse use on the site, associated parlang, landscaped banks, existing monument sign,
and also shows the existuig landscaping, dnveways and retasning walls The dnveway entrance
in the norkbeast portion of the site is indicated as the main entry point to the jomt development,
and the dnveway in the northwest corner of the site is mdicated as a secondary entry The srte
plan illustrates existing office/warehouse uses and parkmg on the adjouung parcels to the south
and east, and a future parking area on land located further to the east along Knox Avenue
19 The change of condrtions would retaui the existing landscaping on the srte and extend an
existing, 6-foot high, sight-obscu.rmg, cha.m lmk fence along the west boundary of the site from
the adjacent property to the south The proposed building would have a maximum height of 20
feet
20 Effective January 15, 2002, the County adopted County Resolution No 2-0037 Such
resolution implemented a new Comprehensive Plan ("GMA Comprehensive Plan"), a Capital
Facilities Plan, County Urban Growth Area (UGA) boundanes, and Phase I Development
Regulanons, all pursuant to the State Growth Management Act Such resolution also repealed
the uztenm development regulahons previously adopted by the County under the State Growth
Management Act
21 The Phase I Development Regulations designate the land lying north of Interstate 90 in the
area, east of Woodruff Road, including the site, in the Light Industnal category of the
Comprehensive Plan, and retauied the I-2 zorung of the site and such land Such regulations
designated the land 1}nng west and southwest of the site, which is developed for single-fanuly
homes, in the Low Density Residential category of the GMA Comprehensive Plan, and

reclassified the zoiung of such land from the Urban Residenhal-3 5(LTR-3 5) zone to the Urban
Residential-7 (UR-7) zone An office/industnal park is located north of the site
22 Section 13 300 110 of County Resolution No 1-0700 provides that absent statute or
ordinance to the contrary, the regulations in effect on the date a complete apphcation is subnutted
and fees are paid will be the standard of review for a project pernut apphcation
23 Within the UGA, the Phase I Development Regulations provide linuted "vested nghts" for
rezone, condirional use pernut, vanance and special pernut applications that were complete pnor
to January 15, 2002 Such regulahons do not reference change of condrtion applications, in tlus
regard
24 Waslungton case law provides that subnuttal of a condihonal use permit apphcation vests
the nght to use and develop the property in the manner dlsclosed in the applicanon according to
the land use laws and regulations in effect on the date the application was filed See
Weyerhaeuser v Pierce Couniy, 95 Wn App 883, 976 P 2d 1279 (1999), review denied 139
Wn 2d 1001 (1999) The holduig u1 the Weyerhaeuser case regazduig vested nghts is broad
enough to include the current change of conditions apphcahon Accordingly, the current
apphcahon is subject to review under the County Generahzed Comprehensive Plan and the
development regulahons in place on December 21, 2001, the day the apphcahon was complete
25 The Interstate 90 freeway is located directly south of the adjacent parcel to the south, with
its lravel lanes located well below the grade of the current site The County Artenal Road Plan
in the Comprehensive Plan designates Montgomery Avenue, located approxunately 1,000 feet
north of the site, as aMnor Artenal All other roads m the vicuuty are considered Local Access
roads, inclucung Woodruff Road, Shannon Avenue and Knox Avenue
26 The srte is designated m the Industnal category of the County Generahzed Comprehensive
Plan The subject property also hes inside the Aquifer Sensihve Area, Pnonty Sewer Service
Area and Urban Impact Area designated by the Generalized Comprehensive Plan
27 Pnor to January 15, 2002, the site was located inside the intenm urban growth area
boundanes designated by the County pursuant to the State Growth Management Act
28 The Staff Report adequately analyzes the consistency of the project with the
Comprehensive Plan, the development standards of the I-2 zone, and the cntena for approvmg a
change of condihons Such analysis is hereby adopted and incorporated by reference as findings
of fact herein
29 Neighbonng property owners or the conunentmg public agencies did not express any
opposition toward the project
30 The adjoining property to the south has been attractively developed wnth office/warehouse
uses The office/warehouse use proposed for the site is of lower profile, and the site srts eight (8)
feet below Woodruff Road to the west
31 At the pubhc heanng, the applicant requested that the Exanuner not requue the extension of
the sight-obscunng fence along the west property line of the site The Examiner re~ ects such

request, because the apphcation proceeded to heanrig vcnth the understanduig that such fencing
would be extended The exisnng buffenng along the west property line, with the addihon of the
sight-obscunng fence, adequately buffers the neighbonng residences to the west from the
indusmaUwarehouse uses developed on the site
32 The I-2 zone permits development of all uses permitted in the Regional Business (B-3)
zone, provided the development standards of the B-3 zone are met The B-3 zone reqwres
frontage along a pubhc road of the Principal Artenal classification or higher Since the site is
located along Local Access roads, B-3 zone uses not otherwise pernutted m the I-2 zone cannot
be developed on the srte County Planrung condinons of approval for the proposal prohibit the
development of B-3 zone uses on the site
33 Changed condittons m the area since the site was last zoned include the add.ition of
unprovements to the srte, inclusion of the site in the County's IUGA boundanes, the
development of light industnal and commercial uses in the vicuuty of the site, the change of
condltions approved in File No ZE-222A-79, the adoption of a the GMA Comprehensive Plan
and Phase I Development Regulations, and increased populahon growth and traffic in the area
34 The proposal, as condinoned, will not have a significant unpact on the environment or
adversely unpact neighboruig properhes
35 The updated condinons of approval for the project recommended by County Engmeering,
Spokane Regional Health Distnct and County Utihties replace the cond.ihons of approval for
such agencies attached to the 1980 rezone of the site Other conditions of approval of the 1980
rezone are also made apphcable
Based on the above findmgs of fact, the Heanng Examiner enters the following
II CONCLUSIONS OF I,AW
1 The proposed change of conditions, as conditioned, generally conforms to the
Comprehensive Plan
2 The applicant has estabhshed that the proposal bears a substanhal relahonslup to, andlor
will not be detnmental to, the pubhc health, safety or welfaze
3 Condihons in the area have sigruficantly changed since the site was rezoned to the
Restncted Industtial zone in 1980, and smce the zontng of the site was reclassified to the I-2
zone on January 1, 1991
4 The procedural requuements of the State Environmental Policy Act and the County's Local
Envuonmental Ordmance have been met
5 The proposal, as conditioned, complies with the I-2 zone, the County Zorung Code, and
other apphcable development regulahons

of Tract 266 of Opportunity, according to the plat recorded in Volume "K" of Plats, page 20,
records of Spokane County Auditor, lying south of Knox Avenue and east of Woodruff Road,

3 The proposal shall comply wnth the Light Industnal (I-2), the Aquifer Sensitive Overlay
zone, and all other applicable provlsions of the Spokane County Zorung Code, as amended

Nohce, noting that the property in question is subject to a vanety of special condihons unposed
as a result of approval of a land use achon Tlus Title Notice shall serve as public nohce of the

1 The applicant shall dedicate the apphcable radius on Knox Avenue and Woodruff Road
2 Access permits for approaches to the County Road System shall be obtained from the
County Engineer
3 A professional eng7neer (P E), licensed in the state of Waslungton, shall subnut road and
storm drainage construchon plans and a drauiage report that conform to the versions of the
Spokane County Standazds for Road and Sewer Const,ruucnon, the Guidehnes for Stormwater
Management, and all apphcable federal, state and local regulahons and laws that are in effect at
the time of the plan submittal or at the tune of the development pernut apphcahon(s) The final
road and storm drauiage plans and dramage report shall receive the County Enguleer's
acceptance pnor to release of any gradmg, building, or nght of way permrt
4 The applicant shall subnut for approval by the Spokane County Englneer and the Spokane

10 The County Engmeer has designated a Local Access Roadway section for the improvement
of Woodruff Road that is adjacent to the proposed development Tlus will reqLUre the addition of
varying amounts of asphalt to equa120 feet of asphalt measured from the centerlule, along the
frontage of the development Curbmg and sidewalk must also be constructed
11 All required unprovements shall conform to the current State of Washington Standard
Specificahons for Road and Bndge construction and other applicable County standards andlor
adopted resolutions pertaiiung to Road Standards and Stormwater Management in effect at the
date of construchon, unless otherwise approved by the County Engmeer
12 Access to Woodruff Road shall be protubited until such time as specifically authonzed by
the Spokane Cowaty Engmeer
Note Any access to Woodruff Road will require the applicant to construct fu11 frontage
improvements
13 Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane County Resolution No 1-0298 as amended and are applicable to tlus proposal
14 No construchon work is to be performed within the existing or proposed nght of way unhl
the County Engmeer has issued a permit All work witlvn the public road nght of way is subject
to inspection and approval by the County Enguieer
15 All required construction withul the existing or proposed pubhc nght of way is to be
completed pnor to the release of a buildmg permit or a bond in an amount estumated by the
County Engmeer to cover the cost of construchon or improvements shall be filed wnth the
County Engmeer
16 Apphcant shall sign "Spokane County Notice to the Public Number 6" which specifies the
following
"The owner(s) or successor(s) in interest agree that in considerahon of Mutual Benefits
now or to be hereafter denved, do for themselves, theu heirs, grantees, assigns and successor(s)
in interest hereby request and authonze Spokane County to include the above descnbed property
in a Road Improvement Distnct (RID) and to support the formation of a Road Improvement
Distnct for unprovement of the road(s) descnbed below, by requestmg and authonzing Spokane
County to place theu name(s) on a petihon for the formation of a Road Improvement Distnct
pursuant to RCW 36 88 050, or by requesting and authonzing Spokane County to cast theu
ballot in favor of a RID beuig formed under the resolution method pursuant to RCW 36 88 030,
and/or by not filmg a protest agaulst the formation of a RID being formed under the alternative
resolution method provided for in RCW 36 88 065 and Chapter 35 43 RCW

If an RID is proposed for improvement of the road(s) descnbed below, said owner(s) and
successor(s) further agree (1) that the unprovements or construction contemplated vcitlun the
proposed RID are feasible and (2) that the benefits to be denved from the formation of the RID
by the property included therein, together with the amount of any County participation, exceeds
the cost and expense of formation of the RID, and (3) that the property withn the proposed RID
is sufficiently developed, provided, they, theu heus, grantees, assigns and successor(s) shall
retain the nght, as authonzed under RCW 36 88 090, to object to any assessment(s) on the
property as a result of the unprovements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36 88 RCW and to appeal to the Supenor
Court the decision of the Board of County Commissioners confirming the final assessment roll,
provided further, it is recogruzed that actual assessments may vaty from assessment estunate so
long as they do not exceed a figure equal to the increased true and fau value unprovement(s)
add(s) to the property
It is further acknowledged and agreed that at such tune as a RID is created or any County
Road Improvement project is authonzed by Spokane County, the improvements reqwred sha11 be
at the sole expense of the owner(s) of property witlun the RID or served by the improvements
without any monetary participahon by Spokane County "
The RII) waiver contauled in this agreement shall expue after ten (10) years from the date
of execution below Tlus provision is apphcable to Woodruff Road
17 The apphcant is advised that there may exist uhliries either underground or overhead

The applccation for the proposed Change of Conditions was submitted on December 21 2001 A Technical
Review meeting was held on January 17 2002 and the Notice of Application was issued on January 11
2002 with a comment period ending on January 23 2002
A Zone Reclassification ZE-222-79 from Agricultural (A) to Res#ricted Industrial on approximately ? 5
acres which includes the subJect site for the sales service and repair of diesel engmes was approved by
the Heanng Examiner Committee on April 11 1980 with specific conditions of approval limi#ing
development of the site The original site plan of record i1fus#rated development of a 48 000 square foot
office/indusfrial/warehouse building with a maximum height of 40 feet
A previous Change of Conditions ZE-222A-79 for 3 75 acres lvcated directly south of the subject site to
comply with public hearmg site plan review requirements to allow direct access to Wovdruff Road to delete
a condition requinng a 10-foot high landscaping berm along the west property line and to allow
uses in addition to office/business uses was approved in part by the Hearing Examiner on February 16
2000 The request for direct access from Woodruff Road was denied

On August 24 2001 the Board of County Commissioners adopted a Comprehensive Plan consistent with
the Growth Management Act RCW 36 70A however the Comprehensive Plan was nvt impfemented until
January 15 2002 when the Board of County Commissioners adopted the Phase I Deveiopment
Regulations Resolution #2-0037 The subJect parcel is subJect to Section I of the Phase I Deveiopment

Regulations Pursuant to Section I of the Phase I Development Regulations the subject application was
reviewed under the Industrial category of the Spokane County Comprehensive Plan The following
Comprehensive Plan discussion analyzes the proposed Change of Conditions application with the Goals
Policies and Decision Guidelines of the previous industrial designation as specified by the transitional
provisions of the Phase I Development Regulations The new Comprehensive Plan designates the subject
site as Light Industrial which continues to be implemented by the existing Light Industrial (I-2) zone
Comprehensive Plan
The subJect site is located within the Industrial category of the Comprehensive Plan The Industrial category
is intended to provide the opportunity for industflal development and reserve land for industrial purposes
The Industrial category is expected to be composed of a variety of industrial mining and transportation
uses Few commercial and residential uses will be found
Public water systems sanitary sewer systems storm water systems and other public utilities shouid be
availabie within Industrial areas Streets should curbed and paved and have high load bearing capabilities
Police and fire protection refuse collection and removal and street maintenance will be typically available to
Industrial areas The site wiil be served by public water and sewer Knox Avenue and Woodruff Road are
paved 2 lane street without curbing or sidewalks
The intensive use of land in Industnal areas will often create noise odor and other problems which make
many other land uses inappropnate here In some cases there will be open areas for buffering and
screening of industrial activities from less intensive uses Industnal sites will idealiy have landscaping and
fencmg to improve their overall appearance
The followmg Decision Guidelines of the Industnal category are applicable to the proposed Change of
Conditions Decision Guidelmes 7 1 b 7 1 e and 7 3 2 recommend that only light mdustrial uses should be
allowed to existing or proposed residential areas Decision Guideline 7 3 2 recommends that when
industrial and residential uses occur adjacent to each other an acceptable buffer will separate the two uses
The proposed use is for an office/warehouse building that will not include any additional industrial uses
such as manufacturing The proposed office/warehouse uses are allowed in the existing Light Industrial (I-
2) zone The site plan illustrates a proposed building setback of 123 feet from the edge of Woodruff Road
and mciudes a 17-foot wide landscaping stnp along the Woodruff Road frontage The applicant has
proposed extending the existing 6-foot high cham link fence with slats that currently exists south of the site
in order to provide a buffer to the smgle family residences located west of Woodruff Road
Decision Guideline 7 1 3 recommends that large or medium scale industrial sites should be directiy
accessible to highways freeways arterial roadways or airways and should not overioad or congest such
routes The subject site is located adJacent to Interstate 90 however there is no direct access from the site
to the Freeway and both Knox Avenue and Woodruff Road are designated as Local Access Roads by the
Spokane Arterial Road Plan Aithough the proposed development is generally inconsistent with this
recommendation the subJect site is currently zoned Light Industrial (I-2) zone and the proposed uses are
allowed within the existing Light Industrial (12) zone
As proposed the Change of Conditions is generally consistent with the Goais Objectives and Decision
Guidelines of the Industrial category of the Comprehensive Plan
Zoning
The existing zoning of the site is Light Industriat (I-2) established in 1991 and previously classified as
Restricted Industrial (RI) in 1980 (ZE-222-79) The purpose and intent of the Light Industrial (I-2) zone is to
meet the needs for industrial land identified in the Industrial category of the Comprehensive Plan and to
allow for these uses by making them compatible with surrounding uses General characteristics of these
areas include paved road and sidewalks public sewer and water and a full line of pubiic services including
manned fire protection and public transit accessibility The proposed office/warehouse uses are allowed
uses in the existing Light Industrial (I-2) zone

1. SUMMARY OF PROPOSAL AND DECISION
Proposal: Application for a change of conditions to the conditions and the site development
plan approved for a previous rezone of approximately four (4) acres of land, in the existing Light
Industrial (I-2) zone.
Decision: Approve application, subject to conditions, except to require primary access via
Knox Avenue and to deny frontage access along Woodruff Road.
The Hearing Examiner has reviewed the application and the evidence of record, and hereby
makes the following findings of fact, conclusions and law and decision:
II. BACKGROUND/FINDINGS OF FACT
A. GeneralInformation:
Applicant: Lawrence Sinclair, c/o Dwight J. Hume, 422 West Riverside, Suite 722,
Spokane, WA 99201
Owner: Howard and Delvona Rude, dlb/a Parrott Mechanical, 6599 Rude Street, Coeur
d'Alene, ID 83815
Location: Generally located along the east side of Woodruff Road, approximately 270 feet
south of Knox Avenue, in the South 1/2 of Section 8, Township 25 North, Range 44 EWM,
Spokane County, Washington.
Legal Description: Assessor's Tax Parcel No. 45087.0207
Zoning: Light Industrial (I-2), subject to the conditions and the site development plan
approved for the rezone approved on April 11, 1980, in Current Planning File No. ZE-222-79.
The site is also located in the Aquifer Sensitive Area Overlay zone and the Public Transit Benefit
Area designated by the County Zoning Code.
Compre6ensive Plan: Industrial category. The property is also located within the Town of
Millwood Influence Area, Aquifer Sensitive Area, Priority Sewer Service Area and Urban
Impact Area designated by the Comprehensive Plan.

Zoning Code for Spakane Cvunty, Section 14.706 (Aquifer Sensitive Area +Qverlay Zone). The

Priar to release of a building permit or use of property as prvpased:
4. `I`lle applicant shall submit dvcumentativn to the satisfactian of the County Engineer that
appropriate easements exist for ingresslegress to Knox Avenue,
5. Access permits far appraaches to the County Road System shall be obtained from the
Coaanty Engineer.
6. Applicant shall submit for approval by the Spokane County Engineer Road, drainage and
access plans.
7. The applicant shall suhmit fvr approvaI by the Spakane Caunty Engineer and the Spokane
County Health Disfrict a detailed combined an-site sewage system plan and surface water
disposal plan for the entixe project or portion thereof if the development is phased.
8. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane
County Engi.neer. The design, location and arrangement of parking stalls shall be in accordance
with standard engineering practices. Paving or surfacing as apprvved by the County Eng;ineer
will be required far any partivn vf the prvject which is to be occupied or traveled by veh.icles
9. The construction of the roadway improvements stated herein shall be accomplished as
apprvved by the Spokane Caunty Engineer.

10. If'r'ndirect access to Woadr-i~ff Raad is allowed through the adjacent parcel to the north, cas
authorized by the approval of a chartge rf conditians application fnr such adjacent parcel, the
applicarlt shall provide a 24 foat strip paving improvement from the driveway approach on
Woodruff Raad extendirig to the intersection o#` Woodruff Road and Knax Avenue. The
Argonne Sanitary Sewer Project, ULII] #003, installed asphalt in Wovdruff Road in conjunction
with such sewer improvements. If'the width of asphalt equals vr exceeds 24 feet, no additional
paving is required at this time. Nv additional vvidening of Woodruff Road svuth of the driveway
appraach tQ the southerly terminus of the rcrad is required at this time.
11. All required `tmprovements shall confvrm #a the current Sta.te of Washington Standard
5pecifications for Road and Bridge cvnstruction and other applicable County standards andlor
adapted resalutions pertaining to Road Standards and Stcarmwater Managenlent Yn effect at the
date of constructivn, unless vtherwise appraved by the County Engineer.
12. The applicant shall construct paved and delineated approaches ta rneet the existing
pavement an Knox Avenue, ar on Waodruff Road fot• any off-site access allawed. A11 praposed
driveways ta Knvx Avenue, or to Woodruff Raacl a_ff=site, shail be paved.
13. Semi-tractvr trailer vehicles shall access Knax Avenue via the 40-fovt driveway easement
as shown on the site plan of record, or cather approved access to Krzox Avenue. Cvmmercial
industrial vehicles accessing the site shauld not use Shannon Avenue.
14. Roadway standards, typical raadway sectians and drainage plan requirements are found in
Spokane Caunty Resolution No. 99-0265 as arnended and are applicable to this proposal.
15. No conslruction wark is to be perfarmed within the existing or proposed right of way until
a permit has been issued by the Caunty Engineer. AlI work within the public road right of °way is
subj ect to inspection and approvai by the Courrty Engineer,
16. Al1 required constructivn within the existing or propased public riglzt of vvay is to be
completed prior to the release of a building permit vr a bvnd in an amount estirnated by the
