SUMMARY OF PROPOSAL AND DECISION Proposal: Application for a zone reclassification of approximately two acres of land from the Light Industrial (I-2) zone to the Heavy Industrial (I-3) zone, for those uses allowed in the Heavy Industrial (I-3) zone. Decision: Approve the rezone application to allow the expansion of the existing specialty metal finishing/electroplating use as proposed in the site development plan; allow other I-3 uses that are also permitted uses in the I-2 zone, subject to administrative site plan review; and allow other I-3 uses subject to the submittal of a change of conditions application and a public hearinc.,. All development is subject to the development standards of the I-2 zone. II. FINDINGS OF FACT AND CONCLUSIONS The Hearing Examiner has reviewed the zone reclassification application and the evidence of record, and hereby adopts the following fndings of fact and conclusions: A. GENERAL INFORMATION: Applicant: Fred LeFriec, 1504 East 64`h Avenue, Spokane, WA 99223 Agent: Ron Kelling, 4114 East Broadway, Spokane, WA 99202 Address: 2616 North Locust Road, Spokane, WA Location: Generally located of and adjacent to Locust Road, approximately 500 feet north of Montgomery Avenue in the NW 1/4 of Section S, Township 25 North, Range 44 EWM, Spokane County, Washington. Legal Description: Lots 2 and 3, Block 1 of Binding Site Plan 86-15, Auditors number 5709110303, being a portion of Tracts 1 through 4 and Tracts 6 and 7. Zoning: Light Industrial (I-2) Comprehensive Plan Category: The property is designated in the Industrial category of the Spokane County Generalized Comprehensive Plan. The property is also located within the Priority Sewer Service Area and Urban Impact Area designated by the Plan. HE Findings, Conclusions and Decision ZE-41-97 Page 1 . • Eovironmental Review. A Determination of Nonsignificance was issued by the Division , of Building and Planning on August 22, 1997. Site Description: The site is flat, slightly more than two acres in size, and involves two legal lots in a binding site plan (File No. BSP 86-15) approved in 1987. The northerly parcel is fully developed with an existing electroplating use, described as a specialty metal finishing business. The southerly parcel is vacant and undeveloped. Surrounding Conditions: The site is located on the east side of Locust Road, south of the Burlington Northern Railway main track line and south of Trent Avenue. Approximately 500 feet south of the site, Locust Road intersects Montgomery Avenue, which is designated by the County Arterial Road Plan as a Minor Arterial. Argoruie Road, designated as a Principal Arterial, lies west of the site, and provides a route to Interstate 90 to the south. Argonne Road and Trent Avenue, which is a state highway, are major traffic and commercial comdors through the Spokane Valley area. The land surrounding the site is zoned I-2, except for Community Business (B-2) and Regional Business (B-3) zoning to the west. The land north and south of the site has commercial uses or is undeveloped, and the land east of the site has commercial uses. The land west of the site includes a fitness club and a shopping center. Project Description: The existing electroFlating business is a non-conforming use in the I-2 zone which applies to the site. The applicant requests approval of I-3 zoning to allow expansion of the existing business on the northerly parcel and extension of the business to the southerly parcel. The site plan of record shows an otfice, shop, warehouse and shipping/ receiving area on the northerly parcel, along with parking for 24 vehicles and existing landscaping. The site plan illustrates a proposed 10,800 square foot building for an office, shop and warehouse on the southerly parcel, 42 additional parking spaces and required landscaping along Locust Road. B. "LU.vE FZECLASSIFIC.1"I,IUN AN.-1LYSIS: In considering a rezone application, Washington case law generally provides that (1) t~ is no presumption in favor of the rezone, (2) the applicant for the rezone must prove that conditions have substantially changed in the area since the last zoning of the property, and (3) the rezone proposal must bear a substantial relationship to the public health, safety or welfare. Parkridee v. Seattle, 98 Wn. 2d 4541) 462 (1978); Biarnson v. Kitsav Countv, 78 Wn. App. 840 ~ (1995). Spokane County Zoning Code Section 14.402 (1)(2) indicates that consistency with the Comprehensive Plan, detriment to the public welfare and changed circumstances are relevant criteria to consider in amending the Zoning Code. The nrouosal Qenerallv conforms with the Spokane County Generalized Comprehensive Plan. A county's comprehensive plan provides guidance to the hearing body in making a rezone decision. Belcher v. Kitsao Countv, 60 Wn. App. 949, 953 (1991). Deviation from a comprehensive plan does not necessarily render a rezone illegal, only general conformance is required. Bassani v. Countv Commissioners, 70 Wn. App. 389, 396 (1993). The property is located in the Industrial category of the Comprehensive Plan. The Industrial category is intended to provide the opportunity for industrial development and reserve land for industrial purposes. The Industrial category contemplates a variety of industrial, mining and transportation uses. Few commercial and residential uses will be found. Open areas for buffering and screening, industrial activities may be needed. Small-scale activities related to industrial uses such as cafes, service stations and parts and service stores may be found in this category. Industrial areas should be served by a high level of urban services, such as public water, sewers and utilities. See Industrial category, "Detailed Definition". Zoning Code 14.632.100 states as follows, regarding such zone: + The purpose of the I-2 zone is to meet the needs for industrial land identified in the Industrial Category of the Comprehensive Plan. Industrial uses in this zone will include processing, fabrication, light assembly, freight handling and similar operations, all of a non-offensive nature. It is the intent of the I-2 zone to allow for these uses by making them compatible with surrounding uses. General characteristics of these areas include paved roads and sidewalks, public sewer and water, a full line of public services including manned fire protection and public transit accessibility. The applicant proposes to rezone the site to the I-3 zone, to allow its existing electroplating and specialty metal finishing business to become a conforming use and to allow its expansion on the site. Zoning Code 14.634.100 states as follows: The purpose of the I-3 zone is to implement the Industrial category of the Comprehensive Plan, providing and protecting areas for primary manufacturing industries. These industvies generally process raw materials into products or byproducts and, therefore, it is the intent of this zone to make these industries as compatible as possible with surrounding uses by requiring standards to ensure compatibility. General characteristics of these areas include paved streets and sidewalks, public sewer and water, and a full line of public services, including manned fire protection and public transit accessibility. In 1996, the County Zoning Code was amended to allow several new uses in the industrial zones of the Zoning Code. See Zoning Code Chapter 14.629, and County Resolution No. 96- 0787. In the I-2 zone, this included the addition of a number of light industrial and conunercial tlses, as well as virtually all uses allowed in the Regional Business (B-3) zone, provided the development standards of the B-3 zone were met. In the I-3 zone, this included the addition of some but not all of the new commercial and industrial uses added to the list of permitted uses in the I-2 zone. This addition of commercial uses to the industrial zones recognized that industrial uses generate a demand for commercial services. The new uses allowed in the I-3 zone included "exercise facility/gym athletic cltib", but did not include general retail sales or grocery store uses. The Industrial category in the general area extends from Locust Avenue east for several blocks, and from Trent Avenue south to Interstate 90. Much of the land in such Industrial category is zoned I-2 and developed for light industrial uses, while none of the land is zoned I-3. The land west of the site is designated in the Major Commercial category, and is zoned and developed for comrriercial uses. Tlie court appointed receiver for Argonne Village objected to the proposal. See letter dated 9-10-97 from James Craven, attorney at law, to the Hearing Examiner; letter dated 8-8-97 from Tomlinson Black Management Inc. to the Spokane County Division of Building and Planning; and testimony of Dwight Hume. Argonne Village owns undeveloped land lying east of the site, across Locust Road, and operates a shopping center between such land and Argonne Road. VVhile not objecting to the proposed use of the site, the receiver contended that the proposed I-3 zone was not compatible with the shopping center use HE Findings, Conclusions and Decision ZE-41-97 Page 4 and could diminish the value of the shopping center property, zoned B-3. The receiver expressed concern over the conversion of the property to other, more offensive heavy industrial uses, and the establishment of a precedent for other I-3 uses in the vicinity. The receiver recommended that a conditional use pennit be issued to allow the applicant's proposed business expansion. The Staff Report found the proposal to be consistent with the Comprehensive Plan. The Examiner adopts the analysis of the consistency of the proposal with the Industrial category found on page 4 of the Staff Report. The primary issue is whether the impacts of the proposal can be adequately buffered from adjoining uses. The applicant has demonstrated that the business is compatible with the surrounding I-2 uses and commercial uses, and there is no reason to thinl: that the expansion of the business as proposed will not be compatible with such uses or devalue them. The record indicates that the project will meet the standards of the I-2 zone, as well as the I-3 zone. Zoning Code 14.508.040 provides for the expansion of extension of a non-conforming use through the issuance of a conditional use permit under the standards and process set forth in Zoning Code Chapter 14.404. The Examiner has no authority at this time to approve a conditional use permit for the project in lieu of the requested rezone, since this would require a separate application. County Planning staff recommended against the option of a conditional use permit, on the basis that the applicant was seeking to extend the use to a separate building lot - which was undeveloped. This would also delay the project for several months. The Examiner does agree with the receiver for Argonne Village that I-3 zoning is generally ~ not appropriate for the area, and that many I-3 uses developed on the site or in the vicinity could negatively impact adjoining uses. However, the proposal can be appropriately conditioned to address such concerns. The Examiner has added conditions of approval limiting development of the site to the currently proposed use; to uses allowed in the I-3 zone which are also allowed in the I-2 zone, subject to administrative site plan review; and to other uses in the I-3 zone subject to the submittal of a change of conditions application and public hearing. A condition has also been added requiring any development of the site to comply with the development standards of the I-2 zone. The Examiner has also added a statement indicating that approval of the project should not establish a precedent for the development of other I-3 zone uses on the site, which are not allowed uses in the I-2 zone, or establish a precedent for the approval of other rezones to the I-3 zone in the vicinity. 2. Conditions in the area in which the propertv is located have chanp-ed substantiallv since the propertv was last zoned. In applying the changed circumstances test, courts have looked at a variety of factors, including changed public opinion, changes in land use patterns in the area of the rezone proposal, and changes on the property itself. The Zoning Code references changes in "economic, technological or land use conditions" as factors that will support a rezone. Spokane County Zoning Code Section 14.402.020 (2). Washington courts have not required a"strong" showing of change. The rule is flexible, and each case is to be judged on its own facts. Bassani v. Countv Commissioners, 70 VVn. App. 389, 394 (1993). Recent cases have held that changed circumstances are not required for a rezone if the proposed rezone implements policies of a comprehensive plan. Biarnson, at 846; Save OLir Rural Environment v. Snohomish Countv, 99 Wn.2d 363, 370-371 (1983). HE Findings, Conclusions and Decision ZE-41-97 Page 5 As disctissed above, the proposal as conditioned is generally consistent with the . Comprehensive Plan. The growth of the business on the northerly parcel, the improvement of Montgomery Avenue and the extension of public sewer to the area could also be cited as changed conditions. 3. The DroDOSed rezone does bear a substantial relationship and is not detrimental to the nublic health, safetv and eeneral welfare. General consistency with a local government's comprehensive plan is relevant in determining whether a rezone bears a substantial relationship to the public welfare. Bassani, at 396-98. As noted, the proposal generally conforms to the Comprehensive Plan. Very little opposition was expressed to the proposal by the public, and the concerns expressed by the owner of property west of the site has been addressed through the conditions of approval. The proposal as conditioned is adequately buffered from adjacent land uses. 4. The nronosed zone chanae complies with the provisions of the State Environmental Policv Act and the Countv's Local Environmental Ordinance. The procedural requirements of chapter 43.21 C RCW and chapter 11.10 of the Spokane C: unty Code have been met. The Hearing Examiner concurs with the Determination of Nonsignificance issued by the Division of Building and Planning. No adverse comments were received from public agencies that would dictate a need for withdrawal of such environmental determination. 5. The nronosal, as conditioned, complies with the Heavy Industrial (I-3) zone, the Spokane Countv Zonine Code (SCZC). and annlicable land use rec-rulations. The proposal has been conditioned for compliance with the applicable requirements of the Zoning Code and other applicable regulations. No deficiencies were identified in the public record. The proposal appears consistent with the development standards of the I-2 zone, as ~,vell as the I-3 zone. III. DECISION Based on the Findings of Fact and Conclusions above, the above application for a zone reclassification is hereby approved, subject to the conditions of the various public agencies specified below. Failure to comply with the conditions of this approval may result in revocation of this approval by the Hearing Examiner. This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with jurisdiction over land development. HL Findings, Conclusions and Decision ZE-41-97 Page 6 SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING 1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The proposal shall comply with the Heavy Industrial (I-3) zone(s) as ainended; pf-ovirlecl, any development on the site shall comply with the development standards of the Light Industrial (I-2) zone, as amended. 3. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Body. Variations, when approved by the Division Director/desibnee, may be permitted, including, but not limited to building location, and landscape plans. Variations proposing uses that are allowed in the I-3 zone which are also allowed uses in the I-2 zone may be approved administratively by the Division Director/designee. Variations propos>>,<_- zrses allowed in the I-3 zone (except for the current electroplating/specialty metal finishing ust - which are not allowed uses iri the I-2 zone may be approved only after the submittal of a chan.;, of conditions application and a public hearing before the Hearing Examiner. All variations must conform to regulations set forth in the Spokane County Zoning Code, and the original intent of the development plans shall be maintained. Any development on the site shnll comply with the development standards of the I-Z zone as amended. . 4. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Division Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 5. The Division of Building & Planning shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Building & Planning. The Title Notice shall generally provide as follows: The parcel of property legally described as is the subject of a land use action by a Spokane County Hearing Body or Administrative Official oa , imposing a variety of special development conditions. File No. is available for inspection and copying in the Spokane County Division of Building & Planning. 6. This decision shall not be cortstrtred to establish a precedent for the approval of other tises ctllotived in the Heavy Indacstrial (I-3) zone in the vicinity, or for the approval of other icses on the site tivhich are not allotived i.cses in the Light Indacstrial (I-2) zone, as amended. HE Findings, Conclusions and Decision ZE-41-97 Page 7 SPOKANE COUNTY DIVISION OF ENGINEERING J Prior to release of a building permit or use of property as proposed: 1. Access permits for approaches to the County Road System shall be obtained from the County Engineer. 2. Applicant shall submit for approval by the Spokane County Engineer drainage and access plans. 3. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard engineering practices. Paving or surfacing as approved by the County Engineer will be required for any portion of the project which is to be occupied or traveled by vehicles. 4. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable county standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. . 5. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners resolution 95-0498 as amended and are applicable to this Proposal. 6. No construction work is to be performed within the existing or proposed right of way until a permit has been issued by the County Engineer. All work within the public road right of way is subject to inspection and approval by the County Engineer. SPOKANE R.EGIONAL HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. A public sewer system will be made available for the project and individual service will be provided. Use of individual on-site sewage disposal systems shall not be authorized. 5. Use of private wells and water systems is prohibited. HE Findings, Conclusions and Decision ZE-41-97 Page 8 S1'OKANE CUUN`I'Y DIVISION OF UTILITIES . 1. A wet (live) sewer connection to the area-wide public sewer system is to be constructed. Sewer connection permit is required. 2. Applicant shall submit expressly to Spokane County Utilities Department "under separate cover" only those plan sheets showing sewer plans and specifications for the public sewer connections and facilities for review and approval. 3. The plans shall be submitted prior to the issuance of the sewer connection permit. 4. Arrangements for payments of applicable sewer charges must be made for prior to issuance of sewer connection permit. 5. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. HE Findings, Conclusions and Decision ZE-41-97 Page 9 . No other responses from the public have been received. Description of the Site: The site involves two Spokane County Tax Parcels and 2+ acres. The northern parcel, involving less than '/Z of the total acreage is flat and is fully developed. The southem parcel is slightly more than'/z the total acreage, is flat, vacant and undeveloped. The northern parcel is the existing business, Novation, Inc. which does specialty metal finishing. The applicant proposes to enlarge the existing business on the northern parcel and to further expand operations to the southern parcel. Access to the site is from Locust Road. Backqround: The applicant submitted the rezone proposal to the Division of Building and Planning on May 28, 1997. The proposal is a request to change the zoning on 2+ acres, from I-2 to I-3. The subject property is lots 2 and 3 of Binding Site Plan BSP 86-15 which was recorded September 11, 1987. The original Binding Site Plan was altered and re-recorded January 19, 1996. A building permit was issued September 24, 1990 when the subject property was zoned Restricted Industrial (RI). The business was therefore legally established under the old Spokane County Zoning Ordinance. On January 1, 1991, the zoning changed to Light Industrial (I-2) pursuant to the Program to Implement the Zoning Code and the use became a legal, non-conforming use since electroplating of inetal is allowed only in the Heavy Industrial (I-3) zone. The applicant wishes to expand the existing facility on the northern parcel and also to expand the business to the southern parcel. The applicant has requested the zone change to Heavy Industrial (I-3) zone to allow expansion of the existing business on the existing northern parcel and to allow expansion of the business to the southern parcel. The site plan shows the existing Novation, Inc. business on the northern parcel consisting of an office, shop, warehouse and shipping/receiving area, parking for 24 vehicles and existing landscaping per Spokane County Zoning Code Development Standards. The site plan also shows a proposed 10,800 square foot office/shop/warehouse on the southem parcel, 42 additional parking spaces, and five feet of Type III ZE-41-97 Staff Report - September 17, 1997 Hearing 3 of 4 . . landscaping. Section 14.802.040 (38) of the Spokane County Zoning Code indicates that one parking space is required per 400 square feet or 27 spaces total. The site plan does not indicate the height of any existing or proposed building but the Zoning Code limits the height of buildings in the Heavy Industrial (I-3) zone to 65 feet. The site plan appears to comply with the development standards of the proposed Heavy Industrial (I-3) zoning. Staff Analvsis: The proposal is located within the Industrial Comprehensive Plan Category and the Industrial Category is intended to provide the opportunity for industrial development and reserve land for industrial purposes. Moderate to high noise levels, odors and other nuisances are likely to be found in industrial areas. Some of the relevant Goals, Objectives and Decision Guidelines are as follows. Goal 7.1 states "the proper location of industries must be given due consideration to aid economic growth and enhance the quality of life in Spokane County". Decision Guideline 7.1.2 states "buffering between proposed and existing development should be required if it is determined that the proposal without buffering under circumstances defined in 7.2.4 may impact existing development". Decision Guideline 7.1.4 states "before industrial proposals can be approved, they must: a) conform to County water, sewer and utility plans or policies; and •b) identify and take steps to resolve significant adverse impacts upon existing water, utility, available and future energy resources and traffic systems; and •c) conform to County transportation plans and policies; and •d) provide necessary buffering as noted in 7.2.1 through 7.2.4. Decision Guideline 7.1.5 states "to encourage planned and efficient industrial areas within Spokane County: a) a development proposal combining light and heavy industry should be done via a planned-unit development or industrial park; •b) all industrial parks or planned unit developments should be compatible with planned or existing surrounding uses conforming to the Industrial Category". Objective 7.2.a states "encourage balanced communities of commercial, industrial and residential development in a compatible relationship". Decision Guideline 7.2.3 states "any requested buffering should be used to mitigate the anticipated negative visual, noise, psychological and other impacts resulting from a proposed development". Objective: 7.3.c states "lighter, inoffensive industry should be allowed to locate near residential areas if adequate-sized sites can be provided with proper amenities. Appropriate performance standards should be designed to assure compatibility". To summarize, the Goals, Objectives and Decision Guidelines of the Comprehensive Plan are supportive of the proposal provided there is sufficient buffering from adjacent non-compatible uses. The existing use is very orderly in outward appearance and noise and odors do not seem to be a problem. The proposed Heavy Industrial (I-3) zone implements the majority of the Goals, Objectives and Decision Guidelines of the Industrial Comprehensive Plan Category. The business exists on a portion of the subject property and is a legal, non-conforming use. In order to expand the existing use, on the existing northern parcel, the applicant could apply for a Conditional Use Permit or change the zoning. By changing the zoning of both the northern and southern parcels, the applicant is able to expand to the southern parcel. There is no existing Heavy Industrial (I-3) zoning in the immediate vicinity and approval of requested zoning coutd set a precedent for similar actions. The proposed zone reclassification is linked to a specific site plan so uses other than the proposed expansion of the existing electroplating business would need additional approvals prior to being permitted. Staff Recommendation: (t is suggested that the Hearing Examiner determine that there is adequate buffering befinreen the proposed use and existing and future uses permitted in the area. The WATER PLAN and certification will be drafted on a transparency suitable for reproduction. The purveyor will also certify that appropriate contractual arrangements and schedule of improvements have been made with the sponsor for construction of the water system in accordance with the approved WATER P.LAN.
