Re Interpretation of Section 4.04.040 (a)(h)
This office has recently received complaints regarding a family day
care home located within an existing single family residence at E.
10921 Empire, Spokane 'County parcel number 04543-0308. The
property is zoned agricultural.
The issue is that the lot, while consisting of 22,000 square ,feet, has
only 70 feet of public road frontage where as 100 feet of frontage is
referenced under Section 4.04.040.
A determination as to wheather such day care facilities as an
accessory use to a single family residence would require a minimum
100 feet of public road frontage would be greatly appreciated.

Subject Determination of Section 4.04.040-(a) and (h)

This determination of the Spokane County Zoning Ordinance is in response to your inquiry
dated November 21, 1985, wherein you request the following:
a) A determination as to whether a day care facility can be permitted as an accessory
use to a single family residence when said residence contains only 70 feet of
frontage on a public road,whereas the Spokane County Zoning Ordinance requires
100 feet of frontage on a County maintained road.
b) Answer to question. The single family residence on a lot substandard to today's
frontage requirement may contain a mini day care facility in a single family
dwelling provided said residence was legally established upon the substandard
lot.
c) Justification for response. Chapter 4.04, Agricultural Zone, Section 4.04.040
allows single family uses as well as accessory uses to the residence which include
boarders, home occupations, single family conventional as well as manufactured
homes (double and single wide), family day care and mini day care. This section
of the Zoning Ordinance allows for the minimum uses to which property zoned •
Agricultural can be put to. It is, therefore, the determination of this Depart-
ment that those uses listed as accessory to a single family residence would be
permitted on substandard lots provided the residence was legally established at
such time as a lesser frontage requirement may have been in effect.
d) Summary. Section 4.04 of the Spokane County Zoning Ordinance establishes the
minimum and basic rights of property owners within the Agricultural Zone. It
has been the past practice of the Planning Department to allow new construction
on non -conforming lots of record, and it is the purpose of this determination to
recognize the other accessory uses that would be permitted on a non -conforming lot.
