No ZE-58-90, Urban Residential-22 (UR-22) to Regional Business (B-3) with
Aquifer Sensitive Area (ASA) Overlay Zone

1 The property is generally located on the northeast corner at the intersecaon of Mullan
Road and Mission Avenue in the southwest 1/4 of the southwest 1/4 in Secnon 8,
Township 25 N, Range 44 EWM, Spokane County, VVashington
2 The committee adopts the Plarwng Department Report as a part of this record along
with the infomnation presented at the public heanng and infomnation contamed in
County File No ZE-58-90
3 The existing land uses in the area are commercial, office, and apartments
4 The Comprehensive Plan designates tlus site as Major Commercial The Major
Commercial category is intended to provide the opportuniry for development of
commercial developmenL
5 The Artenal Road Plan designates 1Viission Avenue as a Nbnor artenal, with a
recommended nght of way wndth of 80 feet The County Engineer has recommended
dedication of an add.itional2 feet and a Future Acquisition Area of 8 feet

d. A specific landscape plan, planting schedule and provisions for maintenanoe
acceptable to the Planning Ihrwtor/designee shall be subnvtted wnth a
perfomiance bond for the project pnor to release of building pernuts
Landscaping shall be installed and maintained so that sight distance at access
points is not obscured or impaired
3 The Planning Department shall notify the Department of Building and Safety to
"flag" the subJect property(ies) in order to tngger the requued review when a
building or change-in-use pernut may be requested
4 The Spokane County Planmng Department shall prepare and record with the
County Auditor a Title Notice specifyuig a future land acquisition area for road
nght-of-way and uaLties The reserved future acquisition area Title Noace shall be
released, in full or in part, by the Planning DepartmenL The nonce should be
recorded wnthin the same tlme frame as an appeal and shall provide the following

shall be relocated at the applicant's expense when roadway improvements are

be used as allowed in the zone, except that any improvements (such as

Spokane County Engineer
4 Access pernuts and unprovements to Mullan Road must be approved by the
Wastungton State Department of Transportat►on (WSDOT).
5 The construcaon of the road unprovements stated herein shall be acvomphshed as
approved by the Spokane County Engineer
6 The County Engineer has designated Typical Roadway Section Number 1,
Secondary Artenal standard for the unprovement of 1VIission Avenue, which is
adjacent to the proposed development
7. The County Enguieer has designated Typical Roadway Section Number 1, Major
Artenal standard for the improvement of 1Vlullan Road, which is adjacent to the
proposed development.
8. All required unprovements shall conform to the current State of Washington
Standard Specificaaons for Road and Bndge Construcnon and other applicable
County standards and/or adopted resolutions pertaimng to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
9 Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No 80-1592 as
amended and are apphcable to this proposal
10 This plat or development proposal is located within a drainage basin which has been
identified by the Spokane County Engineer's office as having stormwater runoff
problems Since this plat or development proposal is affected by or is a contnbutor
to stormwater flows, property owners should panccipate in the planning and
unplementaaon of a future basinwide stormwater management system The
following "Conditions of Approval" shall be required
The owner(s) or successor(s) in interest agree to join in any County-approved
stonnwater management program and to pay such rates and charges as may be fixed

12 The County Artenal Road Plan idendfies Nbssion Avenue, as a Minor artenal The
existing nght-of-way width of 60 feet is not consistent with that specified in the
Plan. In order to implement the Artenal Road Plan, in addibon to the requued
nght-of-way dedication, a stnp of property 8 feet in width along the Mission
Avenue frontage shall be set aside in reserve. This property may be acquired by
Spokane County at the time when artenal improvements are made to Mission
Avenue
13 There may exist utiliues, either underground or overhead, affecting the subjeci
prnperty, including property to be dedicated or set aside for future acquisition
Spokane County assumes no financial obhgaaon for adjustments or relocation
regarding these utihnes Applicant(s) should check vvith the applicable udhty

County.
3. Water service shall be coordinated through the Director of Utiliaes, Spokane
County.
4 VVater service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health

- The site was reclassified in 1973-74 for development of a leased office complex. Ile
Program tio Itnplement the Spokane County Zonuig Code designated the subject
parcel as Urban Residenlaal-22 (UR-22) a.s of January 1,1991 with sunilar permitted
uses. Ile site has had a vanance issued (VE-82-74) to construct a freestanduig sign
