I. GENERAL INFORMATION

Pro osal: request to rezone an approximate 1.49 acre site from Agricultural
and Commercial to Regional Business (B-3) for the purpose of an auto
body repair, painting; sale, and rental business.
Location:
' Ihe site is generally located north of and adjacent Sprague Avenue,
approximately 750 feet west of Flora Road in Section 13-25-44.
II. SITE ANALYSIS
Comprehensive Plan:

The Maj or Commerci al category provi des opportuni ti es for devel opment of
regional serving businesses. Provisions for buffering to adjoining areas,
such as the Suburban to the north, is recommended for mitigation of
compatibility. Development of adequate commercial sites should also
include utility, circulation, and landscape improvements.

Agricultural (established 1942)
Frontages along Sprague Avenue are a mixture of Agricultural,
Commercial, and Restricted Industrial Zones. The Restricted
Industrial property, along the south side of Sprague Avenue, was
approved at a time when the railroad existed along the rear of those
properties. Commercial zoning on the north side of Sprague Avenue
was a block rezone, without regard to property ownership lines, to a
depth of 250-feet from Sprague Avenue. The remainder of area to the
north has remained Agricultural Zone.
The program to implement the new Zoning Code calls for a County-wide
crossover to the new zones by January l, 1991. For this area, the
following crossover would occur:
- Restricted Industrial would become LightIndustrial (I-2) Zone
- Commercial would become Regional Business (B-3) Zone - Agricultural would become Regional Business (B-3) Zone to a depth 600 feet north of Sprague Avenue
- Agricultural would become Suburban Residential 1/2 (SR 1/2) Zone
beyond 600-feet north of Sprague Avenue.
This current proposal would automatically be classified to the
requested zone, Regional Business (B-3) in 1991. It will be adjoined
on the north by Suburban Residential 1/2 (SR 1/2) Zone.
Land Use:

open area
To the SOUTH: Building supply stores and grocery store
To the EAST: Vacant building, lumber yard/storage,
and retail

Land uses along Sprague Avenue frontages are generally commercial and
retail oriented. Areas 200 to 300 feet beyond Sprague Avenue are
used for storage, are undeveloped, and transition to large lot

Proposed Buffering Techniques: The proposed site plan indicates only
grassed drainfield and '208' drainage areas covering nearly 17% of
entire rezone parcel. Detail of any landscaping is not indicated.
Other Site Plan Considerations: Approximately half the site
(33,000 sq.ft.) is planned for immediate development as a paint and
body shop (Phase I). The remainder of the site (Phase II) doesn't
have a specific proposal at this time. It would be developed to a
use permitted in the B-3 Zone per those standards.
note:
- The site plan submitted for review by the Zoning Hearing
Examiner Committee is general in nature. Detailed revietv to
determine compliance with all Ordinance regulations and
conditions of approval is recommended to be administrative and
to occur at the Building Permit stage.

III. SITE DEVELOPMENT RECOMMENDATIONS
Desi4n: The proposed site plan will require modification to accommodate
required parking stalls, parking area landscaping, and sight-obscuring
fencing per Section 8.02 of the Zoning Code.
Bufferinq: The B-3 Zone and new Zoning Code contain requirements for
buffering through landscape treatments along property lines adjacent to ,
residential zones or public roads. Twenty feet of dense Ty pe I -
landscaping will be necessary along extreme north property line and five
feet of a see-through buffer (Type III) is required along Sprague Avenue
frontage. Signage: Section 8.04 of the new Zoning Code contains regulations for
signs in the B-3 Zone. These relate to amount, size, and location of both
attached and detached signage. '
Circulation/Access: Fifteen feet of right of way dedication is required
along Sprague Avenue, along with road improvements through a R.I.D. or
C.R.P. arrangement.
Sewage Disposal: On-site disposal is permitted provided the applicant
agrees not to protest formation of a U.L.I.D. for future public sewers,
and that double plumbing is installed at construction.
Fire Protection: Fire hydrants adjacent to the site and on priva~e
property may not be adequate to serve this proposal without access
agreements. Setbacks may need to be increased for fire protection.
Reviews will occur at building permit stage.
Critical Materials/Use Activity: Reviews for use of critical materials
wiM occur when builTing permits requested. If critical materials are
involved in the operation, then measures to protect aquifer and contain
possible spills will be necessary per requirements of the Aquifer
Sensitive Area Overlay Zone. Future property owners will be put on notice
of this requirement through deed restrictions recorded on the property's
title.
IY. SEPA ENVIRONMENTAL REVIEW
An Environrnental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined
that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of
Non-Siqnificance ("DNS").

IV. SEPA ENVIRONMENTAL REVIEW (continued)
The "DNS" was circulated to eight other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and comment. The "DNS" comment period ends February 5, 1985,
and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on tlie proposal site. ,
The Hearing Examiner Committee may consider additional environmental
related testimony and the "DNS" at the public hearing.
V. PLANNING SUMMARY
The proposed Regional Business (B-3) Zone is appropriate at this
location because:
- The site is within the Major Comnercial category of the .
Comprehensive Plan and along a major arterial;
- The B-3 Zone is intended to implement the Major Commercial
category;
- This site, as well as property to the east, west, and south,
will crossover to the B-3 Zone in 1991 per the adopted Program
to Implement the new Zoning Code; and
- Provisions of the B-3 Zone and other Zoning Code standards are
intended to protect adjacent properties, insure adequate
commercial development and promote land use compatibility.
VI. CONDITIONS OF APPROVAL
Conditions of approval, listed below, indicate requirements that must be
met to satisfy the various governmental agencies. Some modification to
the proposed site plan will be necessary to meet conditions of approval
and Zoning Code requirements.
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
a) COUNTY PLANNING DEPARTMENT
l. All current standards of the Regional Business (B-3) Zone and
the Zoning Code for Spokane County, Washington, as amended,
shall be complied with in the development of this site.

2. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay
Zone) of the Zoning Code for Spokane County, Washington.
Accordingly, as a condition of approval, the sponsor/applicant
shall be required to file with the Spokane County Auditor,
within thirty (30) days of the signing of Findings and Order of
the final decision in this matter, a"Notice to the Public"
which shall provide in material as follows:
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE
ON THE PROPERTY DESCRIBED HEREIPJAFTER, THE APPLICANT
• SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS
OF ZONING CODE FOR SPOKANE COUNTY, WASHINGTON, SECTION 7.06
(AQUIFER SENSITIVE AREA OYERLAY ZONE). THE PROPERTY
WHICH IS THE SUBJECT OF THIS NOTICE IS M0RE PARTICULARLY
DESCRIBED AS FOLLOWS:....".
3. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
4. That the provisions of SEPA's NOTICE OF ACTION pursuant to
° Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners' Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements.
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Applicant shall dedicate 15 feet on Sprague Avenue for
right-of-way prior to any use of the property.
2. Access permits for approaches to the County Road System shall be .
obtained from the Spolcane County Engineer.
3. Applicant shall improve Sprague Avenue in a manner consistent
with Spokane County TYPICAL roadway section No. 1 minimum paving
width Major Arterial Standard.
4. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any
building permit on the property.

b) COUNTY ENGINEERING DEPARTMENT (continued)
5. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engi.neer prior to the
issuance of a building permit on the property. The design,
_ location, and arrangement of parking stalls shall be in •
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
6. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
7. To construct the road improvements stated herein, the applicant
may, with the approval of the County Engineer, join in and be a
. willing participant in any petition or resolution which purpose
is the formation of a Road Improvement District (RID) for said
improvement pursuant to RCW 36.88, as amended. Spokane County
will not participate in the cost of these improvements.
8. As an alternative method of constructing the road improvement
stated herein, the applicant may, with the approval of the
County Engineer, accomplish the road improvements stated herein
by joining and participating in a County Road Project (CRP) to
the extent of the required road improvement. Spokane County
will not participate in the cost of these improvements.
9. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
10. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Corrgnissioners' Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
Distric t.

c) COUNTY UTILITIES DEPARTMENT (continued)
2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) f rom
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. The unit shall be double-plumbed for connection to future
areawide collection systems.
d) COUNTY HEALTH DISTRICT
l. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and the Spokane
County Health District prior to the issuance of any building
permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an on-site sewage disposal
system may be authorized.
4. Water service shall be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.

e) COUNTY BUILDING AND SAFETY DEPARTMENT
l. The site is located in Fire District # l.
2. Approved numbers or addresses shall be placed on all new and
. existing buildings in such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
3. Due to the sensitive storage requirements over the Aquifer, and
this site lies within the Waste Water Management area, we feel
that some language should address the possible storage of
flammable or critical materialswithin these structures.
4. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
5. Building permits will be required for each structure.
6. Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants snall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uniform Fire Code is required prior to
construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction.
7. Comments: The private hydrant located on the Elks' property
"may" not be considered in satisfying the required fire flow.
An agreement between the two parties and approved access will be
required. Al1 walls of the structure "less" than 20'-0" from
property line will require firewalls, and 30 inches parapets
above the highest point of the roof surface. An approval from
the Department of Social and Health Services will be required
for waste from interior sand/oil interceptors.
f) WATER PURYEYOR
1. Water Purveyor is Uera Irrigation District #15, and they can
supply the site with adequate water for domestic, fire and
irrigation uses once arrangements have been made by theapplicant.

g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions f rom the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities. - 2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
-4. SCAPCA Regulation I, Article V requires that a Notice of
Construction and Application for Approval be submitted to and
approved by our Agency prior to the construction, installation
or establishment of an air pollution source.
5. All air pollution regulations must be met.

A. INTRODUCTION
This matter having come before the Zoning Nearing Examiner Committee on
Feb ruary 6. 1986, and the mernbers of the Canmittee present being
Kathleen M. Carstens, Chairperson, Jane E. Myers and Ron Odell.
B. PROPOSAL

Conditions of approval, listed below, indicate requirements that must be
met to satisfy the various governmental agencies. Some modification to
the proposed site plan will be necessary to meet conditions of approval
and Zoning Code requirements.
a) COUNTY PLANNING DEPARTMENT
l. Al1 current standards of the Regional Business (B-3) Zone and
the Zoning Code for Spokane County, Washington, as amended,
shall be complied with in the development of this site.
2. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay
Zone) of the Zoning Code for Spokane County, Washington.
Accordingly, as a condition of approval, the sponsor/applicant
shall be required to file with the Spokane County Auditor,
within thirty (30) days of the signing of Findings and Order of
the final decision in this matter, a"Notice to the Public"
which shall provide in material as follows:
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
- CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE
ON TNE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT

b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Applicant shall dedicate 15 feet on Sprague Avenue for
right-of-way prior to any use of the property.
2. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
3. Applicant shall improve Sprague Avenue in a manner consistent
with Spokane County TYPICAL roadway section No. 1 minimum paving
width Major Arterial Standard.
4. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
- combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
building permit on the property.
5. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
i ssuance of a bui 1 di ng permi t on the property. The desi gn,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
_ requi red for any porti on of the proj ect whi ch i s to be occupi ed

6. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors. •
7. To construct the road improvements stated herein, the applicant
may, wi th the approval of the County Engi neer, joi n i n and be a
wi 11 i ng parti ci pant i n any peti ti on or resol uti on whi ch purpose
is the formation of a Road Improvement District (RID) for said
improvement pursuant to RCW 36.88, as amended. Spokane County
will not participate in the cost of these improvements.
8. As an alternative method of constructing the road improvement
stated herein, the applicant may, with the approval of the
County Engineer, accomplish the road improvements stated herein
by joining and participating in a County Road Project (CRP) to
the extent of the required road improvement. Spokane County
will not participate in the cost of these improvements.

9. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
10. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Commissioners' Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
District.
2. The owner(s) or Successor(s) in interest agree to authorize the
. County to place their name(s) on a petition for the formation of
- a ULID by.~petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
• formation of a ULID by resol uti on method pursuant to RCW Chapter
36.94 wtiich includes the Owner(s) property. PROVIDED, this
condi ti on , shal 1 not prohi bi t the Owner ( s) or Successor ( s) f rom
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. The unit shall be double-plumbed for connection to future
areawide collection systems.
d) COUNTY NEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and the Spokane
County Nealth District prior to the issuance of any building
permi t for thi s project.

2. Sewage disposal method shall be as authorized by the Director of
Uti 1 i ti es, Spokane County.
3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an on-site sewage disposal
system may be authorized.
4. Water service shall be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Nealth Services.
, 6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently.
prohibited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. 7he site is located in Fire District # 1.
2:. Approved numbers or addresses shall be placed on all new and

and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
3. Due to the sensitive storage requirements-over the Aquifer, and
' thi s si te-.1 i es wi thi n the Waste Water Management area, we feel
that some'language should address the possible storage of
fl amnabl e or cri tical materi al swi thi n these structures.
4. Trash enclosures shall not be located ad,jacent to combustible
construction or underneath windows or nonprotected eaves.
5. Building permits will be required for each structure.
6. Fi re hydrants which meet the fi re fl ow are requi red to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uniform Fire Code is required prior to
constructi on of the water servi ce. Al l requi red fi re protecti on
facilities shall be installed and made serviceable prior to and
during the time of construction.

e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued)
1. Comments: The private hydrant located on the Elks' property
"may" not be consi dered i n sati sfyi ng the requi red fi re fl ow.
An agreement between the two parties and approved access will be
required. All walls of the structure "less" than 20'-0" from
property line will require firewalls, and 30 inches parapets
above the highest point of the roof surface. An approval from
the Department of Social and Health Services will be required
for waste from interior sand/oil interceptors.
f) WATER PURVEYOR
' 1. Water Purveyor is Vera Irrigation District #15, and they can
supply the site with adequate water for domestic, fire and
irrigation uses once arrangements have been made by the
applicant.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution re.gulations require that dust emissions during
demolition, excavation and construction projects be controlled.

- - suspens.i on~ of acti vi ty duri ng certai n weather condi ti ons. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from

2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. SCAPCA Regulation I. Article V requires that a Notice of
Construction and Application for Approval be submitted to and
approved by our Agency prior to the construction, installation
or establishment of an air pollution source.
5. Al1 air pollution regulations must be met.
