secondary access and improvement of Nora Avenue FINDINGS OF FACT AND CONCLiJSIOIVS 1 The property is generally located east of Wilbur Road, east of Nora Avenue (extended) and south of Interstate 90 (I-90), in the SE 1/4 of Section 9, Townslup 25 North, Range 44 EWM, Spokane Counry, Waslungton 2 The Comnuttee adopts the Planrung Department Report as a part of tlus record 3 The existing land uses in the area include single farnily residences and duplexes 4 The proposed use is compatible with existuig uses in the area 5 The property is located witlun the Urban (U) category of the Spokane Counry Comprehensive Plan and inside both the AqLUfer Sensitive Area (ASA) and the _o Prionty Sewer Service Area (PSSA) The Urban category is intended to provide the opporturuty for development of a"citylilce" envuonment which includes vanous land uses, intensive residential development, and public facilities and services such as water, sarutary and storm sewer lines, and pohce and fire protecuon The land use within tlus category is intended to be pnmanly residential, with single-family, two-farruly, multifanuly, and condomuuum buildings along with neighborhood commercial, hght indusmal, and pubhc and recreational facihtres The maximum residential net density within the Urban category will range from 1 unit to 22 uruts per acre The Change of Cond.itions to the existuig Urban Residential-22 (UR-22) zone can unplement the majonty of the Goals, Objectives, and Decision GuudeLnes of the Urban category of the Comprehensive Plan 6 The existuig zorung does implement and conform to the Comprehensive Plan. 7 The subject property is located between Uruon Road, wluch is identified by the Spokane County Artenal Road Plan as a local access street, and Nora Avenue wtuch is also identified as a local access street Nhssion Avenue, two blocks south of the proposal, is designated as a Nlinor Artenal The ~ ision of Engineering ~ ~ ~ requues no dedication or reservation of nght of way to unplement the Artenal Road Plan 8 The existuig zoning of the property descnbed in the apphcation is Urban Residential-22 (UR-22) estabhshed in 1991, previously estabhshed as Multiple Family Suburban (MFS) in 1984 (116-84C) The proposal does conform to the requuements of the existuig zone 9 The provisions of RCW 43.21C (The State Envuonmental Policy Act) have bcen comphed with and a Deternunation of Nonsigtuficance (DNS) was issued The Comnuttee, after independent review, hereby adopts the DNS 10 The legal reqwrements for pubhc notrce have been fulfilled 11 The owners of adjacent lands expressed disapproval of the proposed use Four persons cited the probabilrty of increased traffic on already overcrowded roads ia the vicinity of the proposal Adjacent landowners also expressed concem over the need for public sewer to serve the proposed development 12 The apphcant has demonstrated that cond.itions have substanually changed since the ongulal zorung of tlus area and accorduigly, the proposed change of conditions is justified Specifically, changed conditions include provision of a second access to the property from Union Road 13 The proposed use will not be
