10. The owners of adjacent lands expressed both approval and disapproval of the
proposed use.
11. Prior to the hearing the Planning Department and the apphcant agreed to modify the
zone reclassification area as follows:
a. No land would be rezoned to SR-1/2.
b. The extent of the B-2 zoning would be to approximately 1000 feet north of the
centerline of Sprague Avenue and to approximately 1200 feet east of the centerline of
S ullivan Road, except for the pr+operty on the immediate northeast corner of Sprague
and Sullivan and excluding the chiropractor's office and residential property in the
southeast corner of the site documents submitted with the applicarion.(Alternate A
best represents the approved concept and property.)
12. The Committee concludes:
a. The proposed B-2 zoning implements the Comprehensive Plan, furthering its
objectives and goals.
b. The northeast portion of the ownership, beyond the B-2 zoning is best left in the
Agricultural zone.
c. Buffering and landscaping as recommended in the Planning Department report
(page 74; V.B.) is needed.
d. The proposed use is compatible with existing uses in the area and incompatible
uses can be successfully buffered.
e. The applicant has demonstraed that conditions have substantially changed since
the original zoning of this area and accordingly, the proposed zone reclassification
is justified.
f. T'he proposal does not result in spot zoning.
g. The proposed use will not be detrimental to the public health, safety, morals or
welfare.
h. The provision of B-2 zoning at this intersection stands a good chance of
promoting a focal point for business in the area and should discourage strip
commercial development on Sprague Avenue east of Sullivan Road.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant", which term shall include the owner or owners of the property, heus,
assigns, and successors-in-interest.
PLANNING DEPARTMENT
1. A revised legal description representing the B-2 zoning (approximately 1005' ft
north of Sprague Avenue and 1192' fL east of Sullivan Road centerlines, except the

southwest and the southeast corners of this rectangle) needs to be submitted and
approved by the Department within 15 days of the finalization of this matter. No
rezoning shall occur to the remaining properry described in the applicarion.
2. The Planning Director/designee shall approve a specific exterior hghting plan for the
approved area prior to installation of such lighting. (Such plan shall attempt to
confine illumination to the area with full consideration to adjacent properties).
3. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained such that sight distance at access points is not obscured or
impaired. The Department report (page 74; V. B.) provides substanrial guidance for
approval of a landscaping plan. Additionally, the colored site plan, although not for
Alternate A, contained in the file shall be clarificarion.
4. T'he applicant shall develop sub}ect property generally in accordance within the
concept presented to the Hearing Examiner Committee. Variations, when approved
by the Planning Director/designee, will be pernutted, includ.ing, but not limited to
building location, landscape plans, and general allowable uses of the pernutted zone.
All variations must confoim to regulations set forth in the ZONIlVG CODE FOR
SPOKANE COUNTY. The origuial intent of the development plans shall be
maintained..
5. Direct light from any exterior area lighting fixture shall not extend over the property
bou ndary.
6. The specific development plan will be submitted for Planning Department review and
' approval prior to issuance of building permits.
7. All current standards of the B-2 zone, as amended, shall be complied with in the
development of this site.
8. The present proposal is not derailed enough to determine whether or not the use of or
materials stored on the site are in compliance with Section 14.706 (Aquifer Sensitive
Area Overlay Zone) of the ZONING CODE FOR SPOK:ANE COUNTY.
Accordingly, as a condition of approval, the sponsor/applicant shall be required to file
with the Spokane Counry Auditor, within thirty (30) days of the signing of Findings
and Order of the final decision in this matter, a"Notice to the Public" which shall
provide in material as follows:

and provide necessary landscaping for runoff.

10. The applicant shall comply with all agency's regularions as amended prior to issuance
of building permits.
11. Spokane County Planning Department record with the County Audltor a Title
Notice," prepared and signed by the applicant, for a future acquisition area for road
right of way and urilities to run with the land The future acquisition area reservation
sha11 not be removed without prior approval by the Spokane County Planning
Department. The nonce shall be recorded prior to the issuance of a building pemvt
and shall provide the following:
a. At least 5' feet of future acquisition area for road right of way and utilities, in addition
to the existing right of way, along Sullivan Road. NOTE: This is in addition to the
30' ft. of dedicarion required by the County Engineer.
b. B uild.ing and other setbacks required by the Spokane County Zoning Code (35'-0")
shall be measured from the future acquisition area reserved for road right of way and
utilities (Sullivan Road).
c. No required landscaping, parking, '208' areas, drainfield or allowed signs shall be
within the future acquisidon area for road right of way and utilities. If any of the
above improvements are made within this area, they shall be relocated at the
applicant's expense when roadway improvements are made.
d. The future acquisition area, unril acquired by Spokane County, shall be private
property and may be used as allowed in the zone except any improvements (such as
landscaping, parking, surface drainage, drainfields, signs, or others) shall be
considered "interim" uses.
e. The property owner shall be responsible for relocating such "interim" improvements
at the time Spokane County makes roadway irnprovements after acquiring said future
acquisition area. f. This "Title Notice" shall be signed by the applicant to serve as official notice and
acknowledgment of said future acquisition area for road right of way and utilities.
g. Required landscaping shall be placed as far away from future right of way
imprnvements as possible such that they may remain after roadway improvements are
made.
12. The Spokane County Planning Department shall prepare and record with the Spokane
County Auditor a"Tide Notice" noting that the property in question is subject to a
variety of special conditions unposed as a result of approval of a land use action.
This "Tide Notice" shall serve as official public notice regarding conditions of
approval affecting the property in question. The "Title Notice" shall be recorded
within fifteen (15) days of final d.isposition of the approved land use action and shall
only be extinguished by the Spokane County Planning Department, The "Title
Notice" shall generally provide as follows:
The parcel of property legally described as (legal description and tcix parcel
number) is the subject of a land use action, imposing a variety of
special development conditions, by a Spokane County Hearing Body
or Administrative Ofiicial on (date) and as maybe amended, altered or

supplemented by o~``icial action or as already changed. File No. (Planning
Department File Number) is available for inspection and copying in the
Spokane County Planning Department.
COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Builciinaernut Or T,LSe Of The PropLrty As Froposei:
1. Applicant shall petition the Boand of County Commissioners for the vacation of Main
Avenue from Sullivan to their east property boundary.
2. Dedication of 30' ft. of additional right-of-way along Sullivan Road
3. In addition to the required right of way dedication, a strip of property 5' ft in width
along the Sullivan Road frontage shall be set aside in reserve. This property may be
acquired by Spokane County at the time when arterial unprovements are made to
S ullivan Road.
4. Access permits for approaches to the County Road System shall be obtained from the
' Spokane County Engineer.
5. Applicant shall submit for approval by the Spokane County Engineer road, drainage,
and access plans.
6. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location, and arrangement of parldng stalls
shall be in accordance with standard traffic engineering practices. Pavulg or
surfacing as approved by the County Engine.er, will be required for any portion of the
project which is to be occupied or traveled by vehicles.
7. All required improvements shall conform to the curnent State of Washington Standard
Specifications for Road and Bridge Construction, and other applicable County
standards andlor adapted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless othenwise approved by the
County Engineer.
8. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of Connty Commissioners' Resolution No. 80-1592 as
amended and are applicable to this proposal.
9. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
10. All required construction within the existing or proposed public right of way is to be
completed prior to the release of a building pemut or a bond in the amount estimated
by the County Engineer to cova the cost of construction of improvements shall be
filed with the County Engineer.
11. Sprague Avenue shall be improved in a manner consistent with the improvements
which are constructed East of Sullivan Road. The improvements shall extend from

the East property line of the proposal to the terminus of existing unprovements. The
construction of sidewal.k along the frontage of the development is also required.
These improvements are required on the north side of Sprague Avenue only.
12. Sulhvan Road shall be improved in a manner consistent with the approved typical
cross section for Sullivan Road which is attached and made a part of the record. The
improvements shall extend southerly fnom the north property line of the proposal to
Sprague Avenue. The construction of sidewalk along the frontage of the
development is also requined. These requirements shall include the left turn
channelization, and the two way left turn lane. The interim free right turn lane shall
only be constructed adjacent to the applicant's property ownership.
13. Applicant shall be responsible far the cost of upgrading or replacing the existing
signal system to oonform to the required improvements to Sprague Avenue and S ullivan Road; recognizing background traffic and prorated cost sharing of the
improvements.

COUNTY UTILTTIES DEPARTMENT
1. Project will make oonnection to Vallcy sewer. Pians and specs to be reviewed by
County Utilities Department. Sewer permit required
2. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of
on-site sewer d.ispasal systems is hereby authorized. This authorization is
conditioned on vompliance witfi all rules and regularions of the Spokane County
Health District and is further conditioned and subject to specific application approval
and issuance of penrrits by the Health District.
3. Any water senrice for this projoct shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Uvlities, Spokane
County.

2. Water service shall be coordinated through the Director of Utilities Spokane County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Social & Health Services.
4. A public sewer system will be made available for the project. Use of individual on-
site sewage disposal systems shall not be authorized.
COUNTY BUILDING AND SAFETY DEPARTMENT
1. The applicant shall contact the Department of Building and Safety at the earliest
possible stage of design/development in order to be informed of Code requirements
administered/enforced by the department, e.g., State Building Code Act regulations
such as requirements for fire hydrant/flow, fire apparatus access roads, street address
assignment, barrier-fiee regulations, energy code negulations, and general
coordination with other aspects of project implementarion.
2. Prior to issuance of building peamits, the Department shall receive written verification
from the water purveyor of record that adequate water service exists for domestic and
fire fighting purposes.
WATER PURVEYOR
1. The district shall attest, prior to issuance of building permits that adequate water
service is available to the site far domestic and fire fighting needs.

Location: Generally located on the north side of Sprague Avenue, south of Valley Way
and east of Sullivan Road (approximately on the Northeast corner of Sprague Avenue
and Sullivan Road) in Section 13, Township 25 N, Range 44, EWM, Spokane
County, Washington.
II. RECOMMENDATION SUMMARY
Approval of the B-2 zone reclassification basically as set forth in the application, but
without any zone reclassification to SR-1/2 for the northeast portion (keep existing
Agricultural zoning) and with some minor adjustments to the proposed landscaping
III. HISTORY
The applicant has assembled land on the northeast corner of Sprague Avenue and
Sullivan Road (except the immediate corner), for the purpose of establishing a retail
center and applicant seeks zone reclassification to B-2 for this purpose. Applicant
also seeks rezone of the north and northeast portions of property to be consistent with
- the January l, 1991, crossover zoning of Suburban Residential-1/2 (SR-1/2). The
Planning Department has now come to support no rezoninti to SR-1/2.

The Major Commercial category exists to about the centerline of Main Avenue
600' ft. north of Sprague Avenue), where as the B-2 zone reclassification
is proposed to about 940' ft. north of Sprague with the northerly corner of the
major retail building being approximately 890' ft. north of Sprague Avenue
(Note: The existing Commercial zoning extends to about 765' ft. north of '
Sprague Avenue right of way). The Major Commercial Comprehensive Plan
category exists to about 300' ft. east of the centerline of Sullivan Road and this
places substantial portions of the shops/supermarket and major "A" structures in
the Suburban Comprehensive Plan category to the north. Approximately
100,000 sq. ft. (2.25 acres) of lbuildings lie outside the Ma jor
Commercial Cornprehensive Plan category and in the Suburban
category; although, due to the existing Commercial zoning, only about 27,000
sq. ft. (.6 acres) actually lies outside both the Major Commercial category and
the existing Commercial zoning.
Probably most important, the possibly objectionable acriviaes of truck off-
loading wi11 almost all be taking place in the Suburban category. The Suburban
category addresses '°commercial uses'° only as "neighborhood services." -
However, the Comprehensive Plan traclsition policy applies here and allows
limited Major Commercial intrusion to the Suburban category. Buffering of the
more intensive activides becomes a necessity in order to ensure "protection" to
the Suburban category.
C . Arterial Road Plan:
The Plan identifies Sprague Avenue and Sullivan Road as principal arterials,
requiring six (6) lanes plus a turn lane in a 130' ft. right of way. Sprague
Avenue right of way presently is so constructed to six (6) lanes and Sullivan
Road falls short, the right of way being but 60' ft. wide. Additional right of
way is recommended on Sullivan road.

Proposed Buffering Techniques: Ten feet of TYPE II landscaping, plus 208 areas,
as proposed on a portion of the north side of the site. Likewise, for both
alternatives there are 208 areas and landscaping shown for the east side of the
project. Actual Department recommendations are spelled out below.
Other Site Plan Considerations: Lighting, signs and landscaping are to conform to
the Zoning Code. (NOTE: Planning Department recommendations on
landscaping clarify Department preferences.)

The site plan submitted is general in nature and is in compliance with the B-2 -
zone or can easily be brought to within compliance. Detailed review to determine
compliance with all Ordinance regulations and conditions of approval is
recommended to be administrative and to occur at the Building Permit stage.
V. SITE DEVELOPMENT IZECOMMENDATIONS
A. Design: Depending upon land actually controlled, either alternative will be
acceptablee Building placement to the rear with well landscaped parking in front
should be an approved concept.
B. Buffering Landscaping: Primary efforts to buffer adjacent uses to the north and
northeast should be achieved. Screening, primarily landscaping, but possibly
supplemented by fences or architectural features, is necessary. Areas where trucks
wi11 circulate and/or idle while off loading should be a screened to the maximum
extent; actual screening of the north edge of any off loading area with tall dense
shrubs or architectural wall is recommended. Buffering/screening immediately next
to the truck off load area for the Major "A" building is not necessary (see colored site
plan in file for Department landscaping recommendarion of area; shown circled and in
red. )

D. Circulation/Access: Sprague Avenue right of way width and paving is
. satisfactory. 30' ft. right of way needs to be dedicated on Sullivan with an additional
5' ft. reserved for future acquisition.
E. Stormwater Drainage: Prescriptive regulations apply.
F. Sewage Disposal: Hook up to Valley sewer.
G. Water Supply: Vera Irrigation District #15; satisfy standards.
H e Fire Protection: Fire Protection District #1; satisfy standards.
I. Critical Materials/Use Activity: At building permit review or Certificate of
Occupancy time, the facility shall comply with the regulations.
J o Easements: Such easements as may be identified prior to building permit issuance
shall be reserved/set aside.
V I. ZONING ANALYSIS
The following applies to the proposal as conditioned, mitigated and revised.
A. The proposal, taking into account the transition policy, carries out and conforms to
the County's Comprehensive Plan.
B. The proposal furthers the objectives and goals of the Comprehensive Plan.
- C. Since the original zoning of 1942, 1953, 1970, 1971 and 1973, the conditions in the
area have substantially changed. Residenrial growth has proliferated, a major
freeway connection now exists to the north at I-90, numerous rezoning acrions to
business and commercial has occurred and much new construction has occurred.
D. The proposal does not qualify as spot zoning.
E. The proposal bears a substantial relationship to the public health, safety, morals and
welfare.
F. The Comprehensive Plan categories are well implemented by the proposed
distribution of the B-2 and the SR-1/2 zone classificaaon, but greater flexibility
would exist if no SR-1/2 zoning accurred. Crossover could then occur in 1991 for
the entire area designated as Agricultural (A).
VII. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available information, Counry ordinances, other regulations and laws, possible
- standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Administrator has determined that "No probable
signif'icant adverse unpacts" would result from the proposal being developed and has
issued a Determination of Non-Significance ("DNS").

The "DNS" was circulated to 8 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and comment, The .
"DNS" comment period ends July 18, 1989, and was advertised 15 calendar days
before said date in the newspaper, by letter to adjacent property owners within 400 feet
of the proposal, and by notice on a sign posted on the proposal site. The Hearing
Examiner may consider additional environmental related testimony at the public
hearing.
VIIIo PLANNING DEPARTMENT SUMMARY
Department recommends B-2 zone reclassification (except Two Swabbies property) for
a rectangular piece of land approximately 1005' ft. north of the centerline of Sprague
Avenue and 1192' ft. east of the centerline of Sullivan Road. This land set forth in the
application for SR-1/2 and a 120' ft. x 335' fte piece at the northeast corner set forth as
proposed B -2. Landscaping should be 10' ft. to 20' ft. of 'I'YPE II on the north and
south sides and on the northerly 335°ft. of the east side. The west side should be 5' ft.
to 10' ft. of TYPE II landscaping. Screening should be particularly effective, possibly
architectural walls or heavy, tall bush stock, at north edge of off-loading area for
supermarket structure. Future construction should be in substantial conformance to the
site plan in so far as accesses and parking lot/structure relationships. Finally, road
dedication, future reserved acquisition areas and traffic control/road improvements of
County Engineers should be approved.
I X. CONDI'TIONS OF APPROVAL
All Conditions imposed by the Hearing Examiner Committee shall be
bending on the "Applicant," which terxr' shall include the owner or
owners of the property, heirs, assignsg and successors in interesto .
COUNTY PLANNING DEPARTMENT
1. A revised legal description representing approximately 1005' ft. north of Sprague
Avenue and 1192' ft. east of Sullivan Road centerlines needs to be submitted and
approved by the Deparcment within 15 days of the finalization of this matter.
2. The Planning Director/designee shall approve a specific exterior lighring plan for the
approved area prior to installation of such lighting. (Such plan shall attempt to
confine illumination to the area with full consideration to adjacent properties).
3. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building pennits. Landscaping shall be
installed and maintained such that sight distance at access points is not obscured or
impaired.
4. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Examiner Committee. Variations, when approved
by the Planning Director/designee, will be pernutted, including, but not limited to the -
following changes: building location, landscape plans, and general allowable uses of
the permitted zone. All variations must conform to regularions set forth in the
ZONING CODE FOR SPOKANE COtTNTY. The original intent of the development -
plans shall be maintained.

- 5. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
6. The specific development plan will be submitted for Pianning Department review and
approval prior to issuance of building pennits.
7. All current standards of the B-2 Zone, as amended, shall be complied with in the
development of this site.
8. The present proposal is not detailed enough to determine whether or not the use of or
materials stored on the site are in compliance with Section 14.706 (Aquifer Sensitive
Area Overlay Zone) of the ZONING CODE FOR SPOKANE COUNTY.
Accordingly, as a condition of approval, the sponsor/applicant shall be required to file
with the Spokane County Auditor, within thirty (30) days of the signing of Findings
and Qrder of the final decision in this matter, a"Notice to the Public" which shall
provide in material as follows:

SPOKANE COUNTY SECTIQN 14.706 (AQUIFER SENSITNE AREA
OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS

9. Applicant shall comply with '208' recommendations concerning stormwater runoff
and provide necessary landscaping for runoff.
10. The applicant shall comply with all agency's regulations as amended prior to issuance
of building permits.
11. Spokane County Planning Department record with the County Auditor a"Title
Notice," prepared and signed by the applicant, for a future acquisition area for road
right of way and utilities to run with the land The futwe acquisition area reservavon
shall not be removed without prior approval by the Spokane County Planning
Department. The notice shall be recorded prior to the issuance of a building pernut
and shall provide the following:
a. At least 5' feet of future acquisition area for road right of way and utilities, in addition
to the existing right of way, along Sullivan Road. NOTE: This is in addition to the
30' ft. of dedication required by the County Engineer.
b. Building and other setbacks required by the Spokane County Zoning Code (35'-0")
shall be measured from the future acquisition area reserved for road right of way and
utilities.
' c. No required landscaping, parking, '208' areas, drainfield or allowed signs shall be
within the future acquisition area for road right of way and utilities. If any of the
. above improvements are made within this area, they shall be relocated at the
applicant's expense when roadway improvements are made.

property and may be used as allowed in the zone except any improvements (such as .
landscaping, parking, surface drainage, drainfields, signs, or others) shall be
considered "interim" uses.
e. The property owner shall be responsible for relocating such "interim" improvements
at the time Spokane County makes roadway improvements after acquiring said future
acquisirion area.
f. This "'I'itle Notice" shall be signed by the applicant to serve as official notice and
acknowledgment of said future acquisition area for road right of way and utilities.
g. Required landscaping shall be placed as far away frorri future right of way
improvements as possible such that they may remain after roadway improvements are
made.
12. The Spokane County Planning Department shall prepare and record with the Spokane
County Auditor a"Title Notice" noting that the property in question is subject to a
variety of special conditions imposed as a result of approval of a land use acrion.
This "Title Notice" shall serve as official public notice regarding conditions of
approval affecting the properry in quesrion. The "Title Notice" shall be recorded
within fifteen (15) days of final disposition of the approved land use action and shall
only be extinguished by the Spokane County Planning Department. The "Title
Notice°" shall generally provide as follows:

COLJNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit Or LJse Of The Propertv As ProDosed:
1. Applicant shall petition the Board of County Corrunissioners for the vacation of Maun
Avenue from Sullivan to their east property boundary.
2. Dedication of 30' ft. of addidonal right-of-way along Sullivan Road.
3. In addition to the required right of way dedication, a strip of property 5' ft. in width
along the Sullivan Road frontage shall be set aside in reserve. This property may be
acquired by Spokane County at the time when arterial improvements are made to
S ullivan Road.
4. Access permits for approaches to the County Road System shall be obtained from the
Spokane County Engineer.

5. Applicant shall submit for approval by the Spokane County Engineer road, drainage,
' and access plans.
6. A parking plan and traffic circulation plan shall be subcmtted and approved by the
Spokane County Engineer. The design, location, and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of the
project which is to be occupied or traveled by vehicles.
7. All required improvements shall conform to the current State of Washington Standard
Specificarions for Road and Bridge Construction, and other applicable County
standards and/or adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless otherwise approved by the
County Engineer.
8. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners' Resolution No. 80- I592 as
amended and are applicable to this proposal.
9. No construction work is to be performed within the existing or proposed public right-
of-way until a permit has been issued by the County Engineer. All work is subject to
inspection and approval by the County Engineer.
10. All required construction within the existing or proposed public right of way is to be
' completed prior to the release of a building permit or a bond in the amount estimated
by the County Engineer to cover the cost of construction of improvements sha11 be
filed with the County Engineer.
11. Sprague Avenue shall be improved in a manner consistent with the improvements
which are constructed East of Sullivan Road, The improvements shall extend from
the East property line of the proposal to the ternlinus of existing improvements. The
construction of sidewalk along the frontage of the development is also required.
These improvements are required on the north side of Sprague Avenue only.
12. Sullivan Road shall be improved in a manner consistent with the approved typical
cross section for Sullivan Road which is attached and made a part of the record. The
improvements shall extend southerly from the north property line of the proposal to
Sprague Avenue. The construction of sidewalk along the frontage of the
development is also requued. These requirements shall include the left turn
channelization, and the two way left turn lane. The interim free nght turn lane shall
only be constn.icted adjacent to the applicant's property ownership.

Dear Mr. Edwards:
Spokane County Hearing Examiner Committee findings of fact, conclusions
aad decisions for Zone Change No. ZE 27-89, Item No. 6 of the findings and
Items No. 2 and 3 of the County Engineering Department recammendations,
required the dedication of 30 Feet ot additional right of way along Sullivan
Road together with a S foot wide strip to be set aside in reserve for future
acquisition by Spokane County.
At such time as the additional 5 feet in reserve is required for road
purposes, Spokane County will negotiate with the property owner for purchase
of the reserved property.
