The committee adapts the Planning Departinent Report as a pan of this record. 3. The existing lat7d use(s) i-n the aY`ea-are commercial and residentia.l. 4. The Campzehensive P'lan designates this site as LTrban. 5. The existz-o.g zoning of the property describe.d in the applicatio'n is Uz`ban Residentia.l- _ 3.5 (LTR-3.5), previously established in 1991. 6. All current standards of the B-2 Zone and Aquifer Sensitive Area Overlay Zone, as amended, shall be complied with in the development of this site. 7. Applicant shall comply with'208" recommendations concerning stormwater runoff and provide necessary landscaping for runoff. 8. The applicant shall comply with all agency's regularions as amended prior to issuance of building penmits. 9. The Spokane County Planning Department shall prepare and record with the . Spokane County Auditor a"Title Notice" noting that the property in question is subject to a variety of special-conditions imposed as a result of approval of a land use acrion. This "Title Notice" shall serve as official public notice regarding conditions of approval affecting the property in quesrion. The "Title Notice" sha11 be recorded within fifteen (150 days of final disposition of the approved land use action and shall only be extinguished by the Spokane Counry Planning Department. The following "Condition of Approval" shall be required: That the owner(s) or successor(s) in interest agree to join in any county approved Stormwater Management Program and to pay such rates and charges as may be fixed through public hearings for service or benefit obtained by the planning, design, construction, maintaining or operation of stormwater control facilities E58 No construction work is to be performed within the existing or proposed right of way until a permit has been issued by the County Engineer. All work within the public road right ot way is subject to inspection and approval by the County Engineer. E59 All required construction within the existing or proposed public right of way is to be completed prior to the release of a building permit or a bond in an amount estimated by the County Engineer to cover the cost of construction or improvements shall be filed with the County Engineer. Special Conditions: In addition to the required right of way dedication, a strip of property 5 feet in width along Sullivan Road frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to Sullivan Road. r I pag,e,3~» Sprague Avenue shall be improved in a maiiner consistent with the impxovements which are constructed East of Sullivan Road. The improvements shall extend trom the East property line of t11e proposal to the terminus of existing improvements. The construction of sidewalk along the frontage of the development is also required. These improvements are required on the north side of Sprague Avenue only. - Sullivan road shall be improved in a manner consistent with the approved typical cross section for Sullivan Road which is attached and made a part of the record. The improvements shall extend southerly from the north property line of the proposal to Sprague- Avenue. The construction of sidewalk along the frontage of the development is also required. These requirements shall include the left turn channelization, and the two way left turn lane. The interim free right turn lane shall only be constructed adjacent to the applicant's property ownership.
