Gentlemen On January 8, 1987, the Zoning Hearing Examiner Committee met at 9 00 A M to consider one new zone reclassification application and two change of conditions applications. Members present Mrs Kathleen M Carstens, Chairperson, Mr. Ron Odell, and Mr Gary N. Anderberg Mr Odell was absent for the agenda item, ZE-29-86 and ZE-41A-78 Following are the applications in sequence and the action taken by the Committee. If not appealed, these decisions will become final on January 19, 1987. The Findings and Order for this hearing were signed on January 8, 1987. 1) ZE-69A-81, Chanqe of Condition in Commercial and Restricted Industrial Zones. The Cafaro Company Location: Generally located southerly of Interstate #90, west of and adjacent to Liberty Lake Road, and approximately 500 feet northeasterly of the intersection of Henry Road and Kenney Road in Sections 15 and 16-25-45. Proposal: Public hearing review of Site Development Plans as required by condi ti on of approval for exi sti ng CorrIInerci al and Restri cted Industrial Zones. The proposal is for a Regional Shopping Center on approximately 97-Acres. Action Approval. Proposal: Zone reclassification for the purpose of Light Assembly, Office, and Warehouse Use. Amend an original condition in an existing Restricted Industrial Zone to allow partial removal of fencing and landscaping for site expansion of an existing development. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on January 8, 1987y and the members of the Conmittee present being Kathleen M. Carstens, Chairperson, and Gary N. Anderberge B. PROPOSAL The sponsor9 Rolatape Corporation, is requesting approval of a zone reclassification, Agricultural to Light Industrial (I-2) Zone, File Noe ZE-29-86, for the purpose of Light Assembly, Office, and dJarehouse Use. Also a request for a Change of Condition9 ZE-41A-78e in an existing Restricted Industrial Zone for the purpose of amending an original condition of approval to allow partial removal of fencing and landscaping for site expansion of an existing developmente C. FINDINGS OF FACT 1. That the existing land use in the area is residential, commercial, light industrial uses, and open areae 2. That the Comprehensive P1an designates this area as appropriate for Urban developmenta 3e That the existing zoning of the property described in the application is Agriculturale 4e That the provisions of RCW 43o21C (The State Environmental Policy Act) have been complied with, and the Cortpnittee concurs with the Determination of Non-Significancee 5e That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification and Change of Condition. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified, as well as the request for a change of condition. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access planse 3. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineere The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practiceso Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by dehiclese 5e The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successorsa 6e The construction of the road improvements stated herein shall be accomplished as approved by the Spolcane County Engineere 7. The County Engineer has designated Typical Roadway Section Number One, Secondary Arterial standard for the improvement of University Road which is adjacent to the proposed development. A combined surface water and sewage disposal detailed plan shall be approved by the Spokane County Engineer prior to the issuance of any on-site sewage disposal permit or building permit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane Countye 3e Subject to specific application approval and issuance of permits by the Health Officer, the use of individual on-site sewage disposal systems may be authorized. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane)9 State Department of Social and Health Serviceso 6e Use of private wells and water systems is prohibited. 7e Disposal of sewage effluent beneath paved surfaces is currently prohibited. 8e The project shall not produce more than 3,600 gallons of generated wastes per day per acre for on-site sewage disposal. e) COUNTY BUILDING AND SAFETY DEPARTMENT 1. Some landscaping is proposed in the parking area. Other Site Plan Considerations: The proposed rezone site is planned to be a physical extension of the existing industrial development to the east. A proposed driveway will connect the two facilities and parking areas. To accomplish this, an existing sight-obscuring fence along the east property line of the rezone site, as well as enough landscaping to accommodate a 25-foot wide driveway, is proposed to be el iminated. Since both the fence and landscaping were conditions of the Restricted Industrial Zone, where the existing f acility exists, a change in that condition is proposed. Access permits for approaches to the County Road System shall be obtained f rom the Spokane County Engineer. 2. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans. 3. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project or portion thereof, if development is to be phased. 4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 5. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successorse 6. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 7. The County Engineer has designated Typical Roadway Section Number One, Secondary Arterial standard for the improvement of University Road which is adjacent to the proposed development. This wi11 require the addition of approximately 12 feet to 14 feet of asphalt, curb and sldewalk along the frontage of tlio development. 8. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners' Resolution No. 80-1592 as amended and are applicable to thic. proposal. 9. The applicant should be advised that individual driveway access permits are required prior to the issuance of a building permit. 10. No construction work is to be perf ormed within the exis}ing or proposed public right of way until a permit has been issued by the County Engineer. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULIO by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. This project may involve the storage and handling of critical materlals. It is recommended that the applicant contact the Department of Building and Safety for materials identification and containment requirements prior to the issuance of any bu i1 d i ng permi t. 3. The requ i red f i re f 1 ow for any bu i 1 d i ng or property deve 1 opment is determined by building size, type of construction, and proximity of exposures. Required fire flows shall be based on an evaluatlon of each building at the time of building permit application. The specific location of hydrants shall be determi ned by the f i re d i strict. 4. This includes but is not ~ 1 imited to the fol lowing: 1. Air polaution regulations require that dust emissions during demolition, excavation and construction pro3ects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3e A11 travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. SCAPCA Regulation I, Article VI and SCAPCA Regulation II, Article IV addresses emission standards.
