Gentlemen
On January 8, 1987, the Zoning Hearing Examiner Committee met at 9 00 A M to consider
one new zone reclassification application and two change of conditions applications.
Members present Mrs Kathleen M Carstens, Chairperson, Mr. Ron Odell, and
Mr Gary N. Anderberg Mr Odell was absent for the agenda item, ZE-29-86 and ZE-41A-78
Following are the applications in sequence and the action taken by the Committee.
If not appealed, these decisions will become final on January 19, 1987. The Findings
and Order for this hearing were signed on January 8, 1987.
1) ZE-69A-81, Chanqe of Condition in Commercial and Restricted Industrial Zones.
The Cafaro Company
Location: Generally located southerly of Interstate #90, west of and adjacent
to Liberty Lake Road, and approximately 500 feet northeasterly of
the intersection of Henry Road and Kenney Road in Sections 15 and
16-25-45.
Proposal: Public hearing review of Site Development Plans as required by
condi ti on of approval for exi sti ng CorrIInerci al and Restri cted
Industrial Zones. The proposal is for a Regional Shopping Center
on approximately 97-Acres.
Action Approval. (Vote 3 - 0)
2) CZE-41A-78, 29-86,~A qricultural to Light Industrial (I-2) Zone Rolatape Corporation
khange of Condition in the Restricted Industrial Zone
Location: Generally located east of and adjacent to University Road and
west of and adjacent to VanMarter Road, approximately 300 feet
north of Montgomery Drive in Section 9-25-44.
Proposal: Zone reclassification for the purpose of Light Assembly, Office,
and Warehouse Use.
Amend an original condition in an existing Restricted Industrial
Zone to allow partial removal of fencing and landscaping for site
expansion of an existing development.

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
January 8, 1987y and the members of the Conmittee present being
Kathleen M. Carstens, Chairperson, and Gary N. Anderberge
B. PROPOSAL
The sponsor9 Rolatape Corporation, is requesting approval of a zone
reclassification, Agricultural to Light Industrial (I-2) Zone, File Noe
ZE-29-86, for the purpose of Light Assembly, Office, and dJarehouse Use.
Also a request for a Change of Condition9 ZE-41A-78e in an existing
Restricted Industrial Zone for the purpose of amending an original
condition of approval to allow partial removal of fencing and landscaping
for site expansion of an existing developmente
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, commercial,
light industrial uses, and open areae
2. That the Comprehensive P1an designates this area as appropriate for
Urban developmenta
3e That the existing zoning of the property described in the application
is Agriculturale
4e That the provisions of RCW 43o21C (The State Environmental Policy
Act) have been complied with, and the Cortpnittee concurs with the
Determination of Non-Significancee
5e That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or
uses within the proposed Zone Classification and Change of Condition.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is justified, as well as the request
for a change of condition.

harmony with the general purpose and will not be otherwtse
detrimental to the publ ic health, safety, and welfaree
lle The following are addittonal findings of fact considered by the
Hearing Examiner Committee:
a) The proposed rezone to I-2 is appropriate and is approved for
the following reasons:
le The Comprehensive Plan's Urban category supports light
industrial uses along arterials where impacts to adjacent
residential uses can be mitigatede
2e The parcel is a transition development occurring between
existing industrial uses or zones to the south, east, and
west.
3. The site plan proposes aesthetics comparable to those
existing in the industrial park to the east and those
required on the site to the southo

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zonang Hearing Examiner Committee shall be
binding on the "Applicant"9 which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
a) COUNTY PLANNING DEPARTMENT
REGARDING THE REZONE (ZE-29-86):
le All current standards of the Light Industrial (I-2) Zone, as
amended, shall be complied with in the development of this
site.
2e That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #17-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application9 and prior to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION is
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982.
REGARDING THE CHAPIGE OF CONDITIONS (ZE-41A-78):
1 That Condition #9 of the Board of County Conunissioners'
Resolution #78-1038 (File ZE-41-78), as it relates to
applicant's Condition #79 dated May 31, 1978, be amended as
follows:
That fencing along the property line common to the rezone site
descr i bed i n Fi le ZE-29-86 and Lot 49 B 1 ock 1 of Montgomery
Commercenter be eliminatedo That a portion of landscaping,
along that same described line, be eliminated so as to
accommodate a driveway generally as shown on the site plan for
ZE-29-86 and ZE-41A-78e

accordance within the concept presented to the Hearing Examiner
Committee. Yariations when approved by the Zoning Administrator

allowable uses of the permitted zoneo All dariations must
conform to regulations set forth in the SPOKAfVE COUNTY ZOfVING

Sensitive Area Overlay Zone of the ZONING CODE FOR SPOKANE
COUNTY, which sets forth various measures for Aquifer
protection9 specifically, measures dealing with wastewater
disposal, spill protection measures9 and stornewater runoff.
3e Any division of land for the purpose of sale9 lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
b) COUNTY ENGINEERING DEPARTMEIdT
Prior To The Issuance Of A Building Permit:
le Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineera
2. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access planse
3. The applicant sha11 submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof, if development
is to be phased.
4. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineere The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practiceso Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by dehiclese
5e The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successorsa
6e The construction of the road improvements stated herein shall be
accomplished as approved by the Spolcane County Engineere
7. The County Engineer has designated Typical Roadway Section
Number One, Secondary Arterial standard for the improvement of
University Road which is adjacent to the proposed development.
This will require the addition of approximately 12 feet to
14 feet of asphalt, curb and sidewalk along the frontage of the
development.

permits are required prior to the issuance of a building permit.

c) COUNTY UTILITIES DEPARTMEIdT
lo Pursuant to Board of County Comnnissioners Resolution No.
80-04189 the use of on-site sewer disposal systems is hereby
authorizede This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approdal and issuance of permits by the Health
Districte
2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36e94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCbJ Chapter
36.94 which includes the Owner(s) propertye PROVIDEDa this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCdd Chapter
36.94.
3e Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each new unit shall be double-plumbed for connection to future
areawide collection systems.

d) COUNTY HEALTH DISTRICT
l. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer prior to the issuance
of any on-site sewage disposal permit or building permit for
this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane Countye
3e Subject to specific application approval and issuance of permits
by the Health Officer, the use of individual on-site sewage
disposal systems may be authorized.
4. Water service shall be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane)9 State Department of
Social and Health Serviceso
6e Use of private wells and water systems is prohibited.
7e Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
8e The project shall not produce more than 3,600 gallons of
generated wastes per day per acre for on-site sewage disposal.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District # l.
2e This project may involve the storage and handling of critical
materialse It is reconmended that the applicant contact the
Department of Building and Safety for materials identification
and containment requirements prior to the issuance of any
building permito
3e The required fire flow for any building or property development
is determined by building size, type of construction, and
proximity of exposures. Required fire flows shall be based on
an evaluation of each building at the time of building permit
app 1 i cat i on o The spec if i c 1 ocat i on of hydrants sha 11 be
determined by the fire district.
4e Any proposed conditions relating to building location, design,
and occupancy shall be rediewed by Building and Safety for
compliance with the Uniform Building and Fire Codes prior to

g) COUNTY AIR P4LLUTION CONTROL AUTHORITY
All air,pvllution regulations must be met. This includes but is not
1imited to the followrng:
ld Air pollutZOn regulations require that dust emissions during
demolitiony excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, ar
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be control]ed as well as emissions f rom
a1T other construction reiated activitieso
2. Measures must be taken to avvid the depvsition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spi11s occur on Raved surfaces, measures must be taken
immediately to clean these surfaces.

or establishment of an air poilution source.
7e SCAPCA Regulation I9 Article VI and SCAPCA Regulation II,
Article IV addresses emissiun standardso A11 emission standards
must be met.
8. Demolition and renovation pro3ects must comply with the
requirements of ~CFR 40 Part 619 Subpart M. Intent to Demolish
and Renovate fvrms are available at the SCAP'CA oMce.

Proposed Buffering Techniques: Site plan proposes: 1) 35' of
landscaping, consisting of 5' of Type III and 30' of lawn, adjacent
to the west property line (University Road); Z) 20' of Type I and
'208' area adjacent to the north property line; and 3) 5' of Type IV
adjacent to the south property line. Some landscaping is proposed in
the parking area.
Other Site Plan Considerations: The proposed rezone site is planned
to be a physical extension of the existing industrial development to
the east. A proposed driveway will connect the two facilities and
parking areas. To accomplish this, an existing sight-obscuring fence
along the east property line of the rezone site, as well as enough
landscaping to accommodate a 25-foot wide driveway, is proposed to be
el iminated. Since both the fence and landscaping were conditions of
the Restricted Industrial Zone, where the existing f acility exists, a
change in that condition is proposed.

Desiqn: Approval of the Change of Condition, to remove the fence and some
~ landscaping, is appropriate with approval of the rezone. The residential
~ use intended to be buffered by that condition wi11 be eliminated with
~ redevelopment under the new rezone.

; Bufferinq: The proposed buffering along the west and north property lines
~ meets the required landscape standards of the I-2 Zone.

~ An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined
that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of
Non-Siqnificance ("ONS").

The "DNS" was cireulated to ezght other agencies of jurisdlction and
other agencies/departments affected by the future development for
, review and comment. The "DNS" comnment period ends January 7, 1987,
anfd was advertised 15 calendar days before said date in the
' newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal s7te.
The Hearing Examiner Committee may consider additional environmental
related testimony and the "DN~S" at the public hearing.
V. PLANN I NG SUMMARY
The prvpvsed rezone to I-2 is appropriate and shvuld be appraved for
the following reasons:
1. The Cvmprehenslve P]an's Urban category supports light
industriai uses along arteriais where impacts to adjacent
residential uses can be mitlgatede
2. The parcel is a transltion development occurring between
exlsting lndustrial uses or zones to the south, east, and west.
3e The site plan proposes aesthetics camparable to those existing
in the industrial park to the east and those required on the
site to the south.
4. The purpose and intent of t'he requTred fencing and landscaping
as a buffer will be no longer va17d with redeveiopment of the
rezone srtte from residential to light industrial use.

~ conform to regulations set forth in the SPOKANE COUNTY ZONING

b) COUNTY ENGINEERING DEPARThiENT
Prior To The Issuance Of A Building Permit:
1. Access permits for approaches to the County Road System shall be
obtained f rom the Spokane County Engineer.
2. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans.
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof, if development
is to be phased.
4. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
5. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successorse
6. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
7. The County Engineer has designated Typical Roadway Section
Number One, Secondary Arterial standard for the improvement of
University Road which is adjacent to the proposed development.
This wi11 require the addition of approximately 12 feet to
14 feet of asphalt, curb and sldewalk along the frontage of tlio
development.
8. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to thic.
proposal.
9. The applicant should be advised that individual driveway access
permits are required prior to the issuance of a building permit.
10. No construction work is to be perf ormed within the exis}ing or
proposed public right of way until a permit has been issued by
the County Engineer. All work within the public road right of
way is subject to inspection and approval by the County Engineer.

b) COUNTY ENGINEERING DEPARTMENT (continued)
11. All required construction within the existing or proposed public
right of way is to be completed prior to the release of a
building permit. A bond in the amount estimated by the County
Engineer to cover the cost of construction of improvements shall
be filed with the County Engineer.
12e Applicant shall convey to Spokane County a sufficient amount of
road right of way so as to provide 39-feet east of the
centerline of University Roade
c) COUNTY UTILITIES DEPARTMENT
l. Pursuant to Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
Districta
2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULIO by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each new unit sha11 be double-plumbed for connection to future
areawide collection systems.
d) COUNTY HEALTH DISTRICT
1. A combined surf ace water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer prior to the issuance
of any on-site sewage disposal permit or building permit for
this projecte
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.

' approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
8. The project shall not produce more than 3,600 gallons of
generated wastes per day for on-site sewage disposal.
e) COUNTY BUILDING AND SAFETY DEPARTPIENT
lo The site is located in Fire District # 1.
2. This project may involve the storage and handling of critical
materlals. It is recommended that the applicant contact the
Department of Building and Safety for materials identification
and containment requirements prior to the issuance of any
bu i1 d i ng permi t.
3. The requ i red f i re f 1 ow for any bu i 1 d i ng or property deve 1 opment
is determined by building size, type of construction, and
proximity of exposures. Required fire flows shall be based on
an evaluatlon of each building at the time of building permit
application. The specific location of hydrants shall be
determi ned by the f i re d i strict.
4. Any proposed conditions relating to bui lding location, design,
and occupancy shall be reviewed by Building and Safety for
compliance with the Uniform Building and Fire Codes prior to
finalization of actiona
5e Fire hydrants sha11 be located so as to be accessible to fire
apparatus and not be obstructed by any structure or vegetation
or have the visibility inpaired for a distance of fifty feet in
the direction of vehicular approach to the hydrant.
6e Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.

7. Depending on the extent of existing water malns and hydrant
locations, fire hydrants which meet the minimum fire flow
requirements as enumerated in Chapter 6, Title 3 of the Spokane
County Code, may be required to be installed prior to any
construction.
8. Approved numbers or addresses shall be placed on a11 new and
existing buildings in such a position as to be plainly visible
j and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
9. The relocation of the existing building or the demolitlon of the
building shall comply with the provlsions of Title 3, Spokane
County Code and that prior to the relocation or demolition, a
permi t f rom the Department of Bu i1 d i ng and Saf ety i s requ i red.
f) WATER PURVEYOR
l. Water Purveyor is Irvin Water District, and they are able to
supply the site with adequate water for domestic, fire and
irrigation usese
i g) COUNTY AIR POLLUTION CONTROL AUTHORITY
~
All air pollution regulations must be met. This includes but is not
~ 1 imited to the fol lowing:
1. Air polaution regulations require that dust emissions during
demolition, excavation and construction pro3ects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
