INTRODUCTION
7'hls matter has come before the Hearing Examiner Committee on February 18, 1993.
The members of the Committee present are Harry Gibbons, Chairperson, Frank Yuse
and Phil Hams.
PROPOSAL
The sponsor, Fire District No. 1, requests approval of a Zone Reclassification, ZE-50-
92, from Community Business (B-2) and Urban Residential-3.5 (UR-3.5) to Regional
Business (B-3) within the Aquifer Sensitive Area (ASA) Overlay Zone.
FINDI\TGS OF FACT AND CONCLUSIONS
1. The property is generally located at the southeast corner of Sullivan Road and
Broadway Avenue in the southwest 1/4 of Secrion 13 , Township 25 Nortl1, Range
44 EWM, Spokane County, Washington.
2. The committee adopts the Planning Departiment Report as a part of this record. The
Planning Department has recommended that the proposed rezone be approved.
3. The exisring land use(s) in the area are vacant, commercial, office, single family and
church.
4. The proposed Regional Business (B-3) zoning uses are compatible with existing uses
in the area.
5. The Comprehensive Plan designates this site as Major Commercial and Urban. The
Major Commercial category is for the purpose of business and commercial use as
allowed in the Regional Business (B-3) zone.
b. The proposed zoning does implenaent and conform to the Comprehensive Plan.
7. The Arterial Road Plan designates both Broadway and Sullivan a Principal Arterial ds
an arterial, with a recommended right of way width of 100 feet.
8. The existing zoning of the property described in the application is Communiry
Business (B-2) and Urban Residenrial-3.5 (UR-3.5) zoning (the east 80 feet
approxirnately) previously established as Agricultural zoning in 1942 and reclassified
to Community Business (B-2) and Urban Residential-3.5 (UR-3.5) zoning on
January l, 1991 pursuant to the Program to Implement the Spokane County Zoning
Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements
of the proposed Regional Business (B-3) zone reclasslfication.

9. The provisions of RCW 43.21 C(The State Environmental Policy Act) have been
complied with and a Deternunation of Nonsignificance was issued. The Committee,
after independent review, hereby adopts the DNS.
10. The legal requirements for public norice have been fulfilled.
11 The owners of adjacent lands expressed neither approval nor disapproval of the
proposed rezone.
12. The applicant has demonstrated that conditioiis have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. Specifically, changed conditions include approval of Arterial Road Plan; the
Comprehensive Plan, adoption of a new 7oning Code, and numerous comnlercial and
business zone changes in this vicinity since the original zoning.
13. The Regional Business (B-3) zone will not be detrimental to the public health, safety,
morals or welfare especially in light of the condirions recommended by the reviewing
agencies.
CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant," which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the real property described below:
That portion of the East 300.00 feet of the West 310.00 feet of the North 300.00 feet
of Tract 20 of Vera, per plat recorded in Volume "0" of Plats, page 30, in Spokane
County, Washington, described as follows:
Begin at the West 1/4 corner of Section 13, Township 25 N., Range 44 E.W.M.;
thence S 00° 09' 27" E, along the centerline of Sullivan road, a distance of 320.00
feet; thence East, parallel with the centerline of Broadway Avenue, a distance of
30.00 feet to a point on the East right of way line of Sulllvan Road and the SW corner
of said East 300.00 feet of the West 310.00 feet of the North 300.00 feet and the
True Point of Beginning; thence N 00° 09' 27" W, parallel with the centerline of
Sullivan road, a distance of 3.94 feet; thence N 04° 39' 58" E a distance of 261.51
feet to a point 51.99 feet East of the centerline of Sullivan Road, as measured at nght
angles, and 55.42 feet South of the Centerline of Broadway Avenue, as measured at
right angles; thence N 46° 44' 14" E a distance of 37.09 feet to a point 30.00 feet
South of the centerline of Broadway Avenue, as measured at right angles, and 70.07
feet East of the centerline of Sullivan Road, as measured at right angles; thence East,
along a line 30.00 feet South and parallel with the centerizne of Broadway Avenue, a
d.istance of 250.93 feet to the East lme of said property; thence S 00° 09' 27" E,
parallel with the centerline of Sullivan Road, a d.istance of 290.00 feet; thence West,
parallel with the centerline of Broadway Avenue, a distance of 300.00 feet to the True
Point of Beginning.

SPOKANE COUNTY PLANNING DEPARTMENT
1. - The proposal shall comply with the Regional Business (B-3) zone and Aquifer
Sensitive Area (ASA) Overlay zone as amended with the following limitations:
a. Signs are limited to one free standing sign of a maximum of 250 square feet
and 35 feet in height on each street (Sullivan and Broadway).
b. Landscaping width shall be increased to 15 feet along Sullivan and Broadway
frontage, also 208 Drainage areas may be incorporated into these areas as
allowed by the County Engineer and Planning Deparnnent.
2. The Spokane County Planning Department shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition azea for road
right-of-way and utilities. The reserved future acquisieon area Title Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorded within the same time frame as an appeal and shall provide the following
a. That a strip of property varying from 7 feet to 17.43 feet of reserved future
acquisition area is required for road right-of way a.nd utilities, in addition to
the existing and/or newly dedicated right-of-way along Broadway Avenue.
b. Future building and other setbacks required by the Spokane County 7oning
Code shall be measured fronz the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, suzface drainage, drainfield, signs or others) shall be
considered interim uses
e. T'he property owner shall be responsible for relocating such "intenm"
improvements at the time Spokane County makes roadway improvements
after acquiring said future acquisYtion area.
5. The Planning Department shall prepare and record wlth the Spokane County
Auditor a Title Notice noting that the properry in question is subject to a variety of
special conditions imposeti as a result of approval of a land use action. This Title
Norice shall serve as public notice of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time
frarne as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice shall generally provide as follows:

Prior to issuance af a building permit or at the reauest of the Countv Engineer in coniuncrion
with a Cauntv Road Proiect/Road Imnrovement District, whichever action comes frst:
1. Applicant shall dedicate to 72 feet from centerline on Sullivan Road for nght-of-
way. (per approved nght of way plan).
2. Applicant shall dedicate varying amounts of right of way from 43.74 feet from
centerline to 32.53 feet from centerline of Broadway Avenue for right of way purposes.
(Yer approved right of way plan).
3. The applicant shall dedicate an applicable radius on Broadway Avenue and Sullivan
Road,
Prior to release of a buildinQ nermit or use of the propertv as aro'Dosed:
4. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
5. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
6. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, locaaon and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
7. The consmuchon of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
8. The County Engineer has designated a Special Roadway Section standard for the
improvement of Broadway Avenue, which is adjacent to the proposed
development. This will require the addiaon of varying amounts of asphalt along the
frontage of the development. The construction of curbing and sidewalk is also
required.
9. The County Engaineer has designated Typica.l Roadway Section Number for the
improvement of Sullivan Road, which is adjacent to the proposed development

10. All requued improvements shal.l conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards andlor adopted resolutions pertaining to Road Standards and

approved by the County Engineer.

11. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commzssioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
12. No construction work shall be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspecCion and approval by the
County Engineer.
13. All required construction within the exlsting or proposed public right-of-way is to
be completed prior to the release of a building permlt, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
• 14. The County Arterial Road Plan identifies Broadway Avenue as a Principal artenal.
The existing right-of-way width of 80 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addition to the required
right-of-way ded.ication, a strip of property varying from 7 feet to 17.43 ln width
along the Broadway Avenue frontage shall be set aside in reserve. This property
may be acquired by Spokane County at the ame when arterial improvements are
made to Broadway Avenue.
15. There may exist utilities, either underground or overhead, affecang the subject
property, includ.ing property to be dedicated or set aside for future acquisirion.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to determine whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
Special condition:
16. Any access to Sullivan Road shall be approved by the County Engineer.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer disposal systems is hereby avthorized. This authorization is
conditioned on compliance with all rules and regularions of the Spokane Counry
Health District and is further conditioned and subject to specific application
approval and issuance of permits by the Health District.
2. (The dedication shall state: ]
"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of ULID by petition method pursuant
to RCW 36.94, which petition includes the owner(s)' property; and further not to
object by the signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) or
successor(s) from objecring to any assessment(s) on the property as a result of

improvements called for in conjunction with the formation of aUL.ID by either
petition or resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
4. [The dedication shall state: ]"Each unit shall be double-plumbed for connecaon to
future areawide collection systems."
SPOKANE COUNTY HEALTH DYSTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utiliaes, Spokane
County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the plat/project, and individual
service will be provided to each lot prior to sale. Use of individual on-site sewage
disposal systems shall not be authorized.

2. Applicant shall dedicate varying amounts of right of way from 43.74 feet from
centerline to 32.53 feet from centerline of Broadway Avenue for right of way purposes.
(Per approved right of way plan).
3. The applicant shall dedicate an applicable radius on Broadway Avenue and Sullivan
Road.
Prior to release of a building nermit or use of the pronertv as proposed:
4. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
5. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
6. A parlang plan and traffic circulation plan sha11 be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traff'ic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
7. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
8. The Counry Engineer has designated a Special Roadway Section standard for the
improvement of Broadway Avenue, which is adjacent to the proposed
development. This will require the addition of varying amounts of asphalt along the
frontage of the development. The construcrion of curbing and sidewalk is also
required.
9. The County Engineer has designated Typical Roadway Section Number for the
improvement of Sullivan Road, which is adjacent to the proposed development.
This will require the addirion of varying anlounts of asphalt along the frontage of
the development. The construction of curbing and sidewalk is also required.
10. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards andlor adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.

11. Roadway standards, typical roadway 10,ection~ and drainage plan requirements are
found in Spokane Board of County Commissioners Resolurion No. 80-1592 as
amended and are applicable to this proposal.
12. No construction work shall be performed within the existing or pzoposed public
• right-of-way unril a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
13. All re.quired construction within the existing or proposed public right-of-way is to
be completed prior to the release of a building permit, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
14. The County Arterial Road Plan identifies Broadway Avenue as a Principal arterial.
The existing right-of-way width of 80 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addition to the required
right-of-way dedication, a saip of property varying from 7 feet to 17.43 in width
along the Broadway Avenue frontage shall be set aside in reserve. This property
may be acquired by Spokane County at the time when arterial improvements are
made to Broadway Avenue.
15. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
- regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to detennine whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
Snecial condirion:
16. Any access to Sullivan Road shall be approved by the County Engineer. ,
SPOKANE COUNTY DIVISION OF UTILITIES
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer disposal systems is hereby authorized. This authorization is
conditioned on compliance with all rules and regulations of the Spokane County
Health District and is further condirioned and subject to specific application approval and issuance of permits by the Health District.

"The owner(s) or successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formation of ULID by petition method pursuant
to RCW 36.94, which perition includes the owner(s)' property; and further not to

property. PROVIDED, this condition shall not prohibit the owner(s) or

SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane
County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the plat/project, and individual
service will be provided to each lot prior to sale. Use of individual on-site sewage
disposal systems shall not be authorized.

- II. SITE INFORMATION
A. Site Size: 2 acres
B. Comprehensive Plan
1. Land Use Plan: The property is located within the Major Commercial
and the Urban categories of Spokane County's Comprehensive Plan. The
Major Commercial category is intended to provide the opportunity for
development of commercial uses, specifically community and regional

shopping centers and commercial uses directly related to major -
throughways.
Highway and arterial strip commercial area will usually be made up of -
businesses or individual parcels clustered along a heavily traveled street or
highway, each providing off-street parking. Shopping is not done by
walldng from one store to another, but rather is of a single purpose nature.
The existing commercial uses along with the proposed zone reclassification
to Regional Business (B-3) conforms to the Major Commercial category of
the Comprehensive Plan.
The east 80 feet of the proposal is located within the Urban category of
Spokane County's Comprehensive Plan. The Comprehensive Plan
supports transition of zones. In this case, the zone change request is for a
single parcel and the adjacent land use is not residential.
2. Arterial Road Plan: The site is adjacent to Sullivan Road. The Spokane
County Arterial Road Plan idenrifies Sullivan Road as a Major Arterial. In
order to implement the Plan, the County Engineer has required the applicant
to dedicate property that would equa172 feet from the centerline of Sullivan
Road for right of way purposes.
The site is adjacent to Broadway Avenue. The Spokane County Arterial
Road Plan identifies Broadway Avenue as a Major Arterial with an existing
width of 80 feet and a planned width of 100 feet. In order to implement the -
Plan, the County Engineer has required dedication varying from 43.74 from
the centerline to 32.53 feet from the center line of Broadway Avenue and an
aXea to be set aside as future acquisition area varying from 7 feet to 17.43
feet.
C. Site Characteristics: The site has one structuxe used as a fire station for
Spokane County Fire District No. 1. The majority of lot is a graveled parking lot.
D. Neighborhood Characteristics: The proposal is located in the Sullivan Road
commercial corridor. This area is a mix of commercial uses including retail sales,
restaurants, offices, and hotelJmotels. There is a large area of undeveloped land
north of the proposal located at the northeast corner of Sullivan Road and
Broadway Avenue. This area is approximately 35 acres and has approval for a _
retail shopping center
E . Zoning Analysis:
Proposal: Reclassify land presently zoned Community Business (B-2) and
Urban Residential 3-5 (UR-3.5) established on January 1, 1991 to
Regional Business (B-3).

The Sullivan commercial corridor is a mix of B-1, B-2, and B-3 zoning. At the
time of the county wide zone redesignation in 1991 those areas that did not have a
commercial zone were designated as B-2 zoning when located in the Major
Commercial category of the Comprehensive Plan.
The property to the north has approval for a retail shopping center with specific
cond.itions of approval regarding landscaping and signage contained in file ZE-34-
91.
The current B-3 zone change request has been conditioned to be consistent with
ZE-34-91 (see section "H. Design " for specific requirements).

Proposed Buffering/Landscaping Techniques: Site plan illustrates
15 feet of Type III landscaping adjacent to Sullivan Road and Broadway
Avenue. This is consistent with the zone change on the north side of
Broadway Avenue, ZE-34-91. The east boundary is required to have 20
feet of Type I landscaping adjacent to UR-3.5 zoning.
Other Site Plan Considerations: Signage shall be linv.ted to one
freestanding sign of 250 square feet and 35 feet in height on each street
frontage.
The site plan submitted for review by the Hearing Examiner Committee is
general in nature. Detailed review to determine compliance with all
Ordinance regulations and conditions of approval is recommended to be administrative and to occur at the Building Permit stage.
J. Drainage: A drainage plan is required. This plan must be reviewed and
approved by the County Engineer's Department prior to developmenG
K. Water Supply: The proposal is within the Vera Water District.
L. Sewage Disposal: The proposal is required to connect to public sewer.

III. ENVIRONMENTAL REVIEW: -
An Envyronmental Checklist was subnutted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has determuned that "No
probable significant adverse unpacts" would result from the proposal being developed
and has issued aJkLermina,tion of Nonsignificance ("DNS").

The "DNS" was circulated to 12 other agencies of jurisd.iction and other
agencies✓departments affected by the future development for review and comment
The 'DNS" comment period ends February 16, 1993 and was advertised 15 calendar
_ days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site. The
Hearing Examiner may consider additional environmental related testimony at the
public hearing.
IV. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposed Regional Business (B-3) zoning is consistent with zoning and land uses
in the area. The proposal is consistent with the goals and objectives of the Major
Commercial and Urban categories of the Spokane County Comprehensive Plan. The
east 80 feet of the site is in the Urban category of the Spokane County Comprehensive
Plan, but is appropriate for the B-3 zone in light of adjacent land uses, the site is a
single parcel, and the proposed rezone is consistent with the transition area policy of the
Comprehensive Plan. The Planning Department recommends approval as conditioned.

SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Regional Business (B-3) zone and Aquifer
Sensinve Area (ASA) Overlay zone as amended with the following limitations:
a. Signs are li.mited to one free standing sign of a maximum of 250 square feet
and 35 feet in height on each street (Sullivan and Broadway).
b. Landscaping width shall be increased to 15 feet along Sullivan and Broadway
, frontage, also 208 Drainage areas may be incorporated into these areas as
allowed by the County Engineer and Planning Department.
2. The Spokane County Planning Department shall prepare and record with the
County Auditor a Tide Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorded within the same time frame as an appeal and shall provide the following:
a. That a strip of property varying from 7 feet to 17.43 feet of reserved future -
acquisition area is required for road right-of-way and utilities, in addition to
the existing and/or newly dedicated right-of-way along Broadway Avenue.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located withiin the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, unril acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the rime Spokane County makes roadway improvements
after acquiring said future acquisition area. _
5. The Planning Department shall prepare and record with the Spokane County
Auditor a Tide Notice noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the conditions of approval affecting the
property in question. The Tide Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice shall generally provide as follows:

4. Access pemuts for approaches to the county road system shall be obtained from the
Spokane County Engineer.
5. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
6. A parldng plan and traffic circularion plan shall be submitted and approved by the
Spokane County Engineer. The design, location and amangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
7. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
8. The County Engineer has designated a Special Roadway Section standard for the
improvement of Broadway Avenue, which is adjacent to the proposed
development. This will require the addition of varying amounts of asphalt along the
frontage of the development. The construction of curbing and sidewalk is also
. required.
9. The County Engineer has designated Typical Roadway Section Number for the
- improvement of Sullivan Road, which is adjacent to the proposed developmenL

11. Roadway standards, typical roadway secrions and drainage plan requirements are .

12. No construction work shall be performed within the existing or proposed public
right-of-way unril a pernut has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
13. All required construction within the existing or proposed public right-of-way is to
be completed prior to the release of a building permit, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
14. The County Arterial Road Plan identifies Broadway Avenue as a Principal arterial.
The existi.ng right-of-way width of 80 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addition to the required
right-of-way dedication, a strip of property var}ring from 7 feet to 17.43 in width
along the Broadway Avenue frontage shall be set aside in reserve. This property
may be acquired by Spokane County at the time when arterial improvements are
made to Broadway Avenue. -
15. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition. -
Spokane Counry assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to deternune whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
