FINDINGS AND OROER
A. INTRODUCTION
This matter having come before the Zoning Hearing Exaininer Committee on
November 5, 1987, and the members of the Committee present being Phillip
D. Harrisa Chairman, and Jim Schurra and Ron Odell.
B. PROPOSAL
The sponsor, ROLATAPE CORPORATION, is requesting approval of a zone
reclassification, File Noe ZE-41-87, RESTRICTED INDUSTRIAL, LIGHT
INDUSTRIAL, AND AGRICULTURAL to LIGNT INDUSTRIAL (I-2) Zone, for the
purpose of developing offices9 warehouses9 and 1ight industrial uses.
C. FIIdDI(dGS UF FACT
le That the existing land use in the area is single family residential,
offices, grocery warehouse, towing service, industrial buildings,
parking, outbu,ldings, light industrial, and open area.
2. That the Comprehensive Plan des>gnates this area as appropriate for
URBAN deveiopmente
3e That the existing zoning of the property described tn the application
is Agricultural9 Light Industrial and Restricted Industrial.
4. That the provisions of RCW 43e21C (The State Env,ronmental Policy
Act) have been complied with, and the Comm'ttee concurs with the
Uetermination of Non-Signtficance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfi1 lede
6. That the land use in this area is suitable for the proposed use, or
uses within the proposed Zone Classification.
7. That the app'licant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly9 the proposed rezone is justifiedo
8e That the proposed use is coinpatible with existing uses in the area.
9. That the owners of adjacent lands and/or their representatives
expressed neither approval nor disapproval of the proposed useo
10. The Near i ng Exarniner Cofunittee finds the proposed use to be i n
harmony with the general purpose and will not be otherwise
detriinental to the public health, safety, and welfare.

11. The following are additional findings of fact considered by the
Hearing Examiner Coinmittee:
a) The proposed Light Industrial (I-2) rezone is consistent with
the Comprehensive Plan; both the transitional policies of the
Plan as well as the Urban designation of this siteo
b) The site plan indicates conformance to the Light Industrial
(I-Z) Zone standards of the Spokane County Zoning Codee
Additionally, a setback greater than is required by the Zoning
Code standards is provided along the north property line to
accommodate a transition from this site to adjacent residential
uses.
c) The proposed rezone is consistent with the zoning and land use
pattern found to the southy east, and west of the proposed
site. The existing Multi-Famlly Suburban Zone found to the
north of the proposal will also provtde a transition from this
industrial site to single family residential uses further north.
d) The site plan proposes aesthetics which are comparable to those
existing in the industrial park to the east and those required
on the site immediately south of this proposal.

lo The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committeea Variations when approved by the Zoning Administrator
rdill be permitteds including, but not limited to the following
changes: Building location9 landscape plans, and general
allowable uses of the permitted zoneo Al1 variations must
conform to regulations set forth in the ZONING CODE FOR SPOOCANE
COUNTY. The original intent of the developrnent plans shall be
maintained.
2. That the project is subject to Section 7°069 the Aquifer
Sensitive Area Overlay Zone of the ZOtdING CODE FOR SPOKANE
CUUNTY, which sets forth various ineasures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protectton measures, and storrnwater runoff.
3e Applicant shall comply with 1208' recoinmendations concerning
storiawater runoff and provide necessary landscaping for runoff.

4. Any diviston of land for the purpose of sale, lease or transfer,
shall coinply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
SPECIAL:
5. That the new six foot high redwood fence, as shown on the site
plan along the northerly property line, be installed with
developinent of the proposed building addition and/or future
building as shown on the site plane The fence may be phased
with each construction phase.

7. That development of the parking areas on this site shall require
compliance with the landscape standards for parking areas as

b) COUNTY ENGI(dEERING DEPARTMENT
Prior To The Issuance Of A Bui lding Permit Or Use Of The Property As
Proposed:

le Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
Zo Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans.
3. The appl'cant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or any portion thereof, if the
development is to be phasede
4. A parking plan and traffic circulation plan shall be submitted
and approved by tioe Spokane County Engineere The design9
location, and arrangement of parOcing stalls shall be in
accordance with standard traf fic eng ineering pract ices e Pav ing
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
5. The construction of the road improveinents stated herein shall be
accomplished as approved by the Spokane County Engineer.

6. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Managernent in effect at the date of construction, unless
otherwise approved by the County Engineere
7. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
8. Ido construct ion work Is to be perforined with in the ex ist ing or
proposed public right of way until a permit has been issued by
the County Engineere Al1 work within the public road right of
way is subject to inspection and approval by the County Engineere
9e All required construction within the existing or proposed public
right of way is to be completed prior to the release of a
building permit or a bond in the amount estimated by the County
Engineer to cover the cost of construction of irnprovements shall

SPECIAL:
10. Applicant shall dedicate to Spokane County a sufficient amount
, of road right of way so as to provide 39 feet east of the
centerline of University Road.
11. The County Engineer has designated Typical Roadway Sectlon
Number Oney Secondary Arterial standard for the improvement of
University Road which is adjacent to the proposed development.
This wi11 require the addition of approximately 12 to 14 feet of
asphalt along the frontage of the development. Curbing and
sidewalKs must also be constructed.
c) COUNTY UTILITIES DEPARTMENT
STANDAKD:
1. Pursuant to Board of County Con~nissioners Resolution No.
80-0418, the use of on-s i te sewer disposa 1 systems i s hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Nealth
District.

the direction of vehicular approach to the hydrant.

STANDARD:
lo Air pollution regulations require that dust emissions during
demolition9 excavation and construction projects be controlled.
Th is inay requ ire use of water sprays, tarps, spr ink l ers 9 or
suspension of activity during certain weather conditions. Naul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions froin
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and inud
froin unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
lirunediately to clean these surfacese

3. All travelled surfaces (ingress, egress, parking areas, access

construction phase of the project and froin motor vehicles using
the site following completion of the project and from occupants
of the proposed projecto
5. SCAPCA Kegulation Ia Article V requires that a Notice of
Construction and Application for Approval be submitted to and
approved by our Agency prior to the construction, installation
or establishment of an air pollution source.
6. SCAPCA Regulation I, Article VI and SCAPCA Regulation II,
Article IV addresses emission standardso All emission standards

Desi n: The proposed site development plan generally indicates
compance with the design standards of the Light Industrial (I-2) Zone
and the Spokane County Zoning Codeo The thirty-five (35) foot setback
area indicated along the north property line should be a condition of
approval to provide separation from adjacent land uses to the north.
Bufferin /Landsca in : Landscaping shown on the proposed site plan,
speci7ic y aloniversity Road and along the north property line, is
generally consistent with standards of the Spokane County Zoning Code.
It should be noted that the Type I landscaping required along the north
property l ine is to be a minimwn twenty foot in width. The site plan
also shows the continuation of a six foot high redwood fence along the
north property line with the phased development of this property.
Installation of this fence should be required as a condition of approval
of th is rezone. .
Si na e: The sign standards of the new Spokane County Zoning Code
shou d allow adequate identification of businesses while at the same
time minimizing sign competition and protecting adjacent residential

Circulation/Access: The County Engineers will require the applicant to
aedicate ac@itional right of way along University Road to provide for at

Sewage Disposal : The Spobcane County Health District wi 11 al low on-site
sewage disposaf for this projecto However, on-site disposal shall not
exceed 3,600 gallons per acre per day from this proposalo This sewage
flow restriction is due primarily to the fact that the site is located
in a drainage basin which is north of Interstate 90 and is not planned
for irmnediate connection to the public sewerage system.
