The members of the Committee present are Harry Gibbons, Chauperson, Jan Reuter and Lunell Hau ght. PROPOSAL The sponsor, Dwight Hume, requests approval of a Zone Reclassification, File No. ZE-28-93, from Urban Residenrial-3.5 (UR-3.5) to Community Business (B-2) withi-n the Aquifer Sensidve Area Overlay Zone (ASA) FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located south of and adjacent to Valley Way, approximately 250 East of Sullivan Road in the southwest 1/4 of Section 13, Township 25 N., Range 44 EWM, Spokane County, Washington. 2. The committee adopts the Planning Deparnnent Report as a part of this record. 3. The existing land uses in the area are residential and commercial. 4. The proposed use is not compatible with existing uses in the area. 5. The Comprehensive Plan designates this site as Urban. The Urban category is for the purpose of developing a"city-like" environment with various uses including residential and neighborhood business. 6. The proposed zoning does not implement and conform to the Comprehensive Plan. 7. 1'he Arterial Road Plan designates Valley Way as a Collector Arterial, with a recommended right of way width of 70 feet. 8. The existing zoni.ng of the property described in the application is Urban Residential- 3.5 (IJR-3.5), previously established as Agricultural zoning in 1942 and reclassified to Urban Residential-3.5 (UR-3.5) on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. 9. The provisions of RCW 43.21C ('I'he State Environmental Policy Act) have been complied with and a Detennination of Nonsignificance was issued. T'he Committee, after independent review, hereby adopts the DNS. 10. The legal requirement's for public notice have been fulfilled. 11. The applicant has not demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed zone reclassificarion is not justified. 13. ZE-28-93; FROM URBAN RESIDENTIAL-3.5 ) FACT, (UR-3.5) TO COMMUNTTY BUSINESS (B-2) ) DECISION AND ) CONDITIONS sPoNsoR: RoINIAx AssocIAITs THIS MATTER, being the consideration by the Board of County Commissioners of Spokane County, hereinafter referred to as the "Board", of an appeal of the Spokane County Hearing Examiner Committee decision of August 23, 1993 denying Zone Reclassification File No. ZE-28-93, for the purpose of rezoning approximately 1.1 acres of land to facilitate development of certain conarnercial uses, including a restaurant and retail sales, hereinafter referred to as the "Proposal"; and the Board of County Commissioners having held a de novo public hearing on October 26, 1993, and having fully considered all testimony presented thereat, and the public record files for the proposal; and further havini~ individually visited or being familiar with the site and vicinity in question and having rendered an oral decision on the 2nd day of November, 1993 approving said proposa] with modifications, does herebv enter the following: FINll1NGS UF FACT 1. The proposed rezone is for a parcel of land located on the south side of Valley Way, approximately 250 feet east of Sullivan Road, in the SW 1/4 of Section 13, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. "Ihe proposal consists of a zone reclassification request for a portion of a proposed development site from Urban Residential-3.5 (UR-3.5) to Community Business (B-2) to allow develapment of the site for a restaurant and retail sales and those uses permitted in the Community Business (B-2) zone. • 3. The I-learing Examiner Committee held a public hearing on August 19, 1993 subsequent to which by the Findings of Fact, Conclusion and Decision dated August 23, 1993 the Committee denied the proposal. 4. The applicant appealed the Hearing Examiner Committee's decision in writing to the Board on August 31, 1993. The appeal contested the findings entered by the Hearing Examiner Cominittee and contended that the proposal was consistent with the Comprehensive Plan and adjacent land use5. 5. The legal requirements for public notice have bc;c;n fulfilleci. 6. At the public hearing, the applicant testified that the proposal was consistent with the land uses in the area and with the Comprehensive Plan. 7. At the public hearing an owner of adjacent property expressed opposition to the proposal, indicati.ng a concern over increased traffic along Valley Way, inconsistency of the proposal with residential uses in the area, and the destruction of existing single family dwellings on the subject property and adjacent property owned by the applicant. 8. The Board adopts the public record files of the Planning Department and the Board for ZE-28-93 as part of this record. 9. The Board takes notice of provisions of the Spokane County Generalized Comprehensive Plan, the Spokane County Zoning Code and the Spokane County Code. 10. The Hearing Examiner Comzriittee's decision comprises only a recommendarion to the Board on the rezone proposal. The oral testimony submitted to the Hearing Examiner Committee was not considered by the Board as part of the record. 12. The original zoning of the property described in the proposal was Agricultural (A) adopted in 1942 under the Spokane County Zoning Ordinance. The site was redesignated to Urban Residential-3.5 (UR-3.5) under the Spokane County Zoning Code, pursuant to the Program to Implement the Spokane County Zoning Code. 13. The County Arterial Road Plan designates Valley Way as a Collector Arterial with a recommended right of way width of 70 feet. The project has been conditioned to dedicate right-of-way and set aside adequate right of way for future acquisition. 14. The existing land uses in this area include single family residences and commercial uses, including a newly developed Fred Meyer store and Smith's Home Furnishings. 15. The proposal site and adjacent property included in the development project presendy have three (3) vacant single family dwelling units on-site. 16. Spokane County presently has a lack of affordable housing. 17. To help preserve affordable residential housing in the community, the Board finds it reasonable to condition the proposal to require the applicant to provide salvage opportuniaes to the public for the three (3) existing single family dwellings on the development project site. 18. A Utility Local Improvement District (ULID) is currently being circulated for installation of public sewer along Sullivan Road, to be installed in 1994 when Sullivan Road will be widened between Sprague Avenue and Mission Avenue as part of a County Road Project (CRP). 19. The applicant testified that he is willing to participate in a ULID for public sewer service to the site. The provision for public sewer is already a recommended condition of approval by the County Health District and the County Division of Utilities. 20. The Board finds it reasonable to condition the proposal to require the applicant to agree to include the subject property in the ULID petition and proposed ULID. 21. The site plan of record submitted by the applicant includes 1.64 acres of property owned by the applicant within the Community Business (B-2) zone, located west of and adjacent to the proposal at the southeast corner of Sullivan Road and Valley Way. 22. A County Road Project (CRP) is underway along Sullivan Road, a major north/south arterial, which is located approximately 250 feet west of the proposal. 23. The County Road Project (CRP), as proposed, will require the acquisirion of 75 feet from centerline easterly, or approximately 45 feet of the property east of and adjacent to the existing Sullivan Road right-of-way. 24. The acquisition of right-of-way along Sullivan Road will adversely affect the development potential of the existing Community Business (B-2) zoned property west of and adjacent to the subject property. 25. To implement the site plan as proposed, additional Community Business (B-2) zoning is needed for the proposal. 26. The provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with and a Detemaination of Nonsignificance was issued. The Board concurs with the Determination of Nonsignificance. 27. The applicant has demonstrated that conditions have substanrially changed in the area since the original zoning of the site. Specifically, changed condidons include the designadon of Valley Way as an arterial, the County Road Project (CRP) along Sullivan Road, the availability of public sewer in the near future, and recent commercial development in the area. , . ! The future acquisidon area, until acquired, shall be private property and may - be used as allowed in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. 6. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Norice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. The Title Notice shall generally provide as follows: The parcel of property legally described as [ ] is the subject of a land use action by a Spokane County Hearing Body or Administrative Official on August 19, 1993, imposing a variety of special development conditions. File No. ZE-28•93 is available for inspection and copying in the Spokane County Planning Department. 7. Prior to the issuance of building permits, the applicant shall demonstrate to the satisfaction of the Spokane County Planning Department that the existing structures have been removed from the site. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS 1. Prior to issuance of a building permit or at the request of the County Engineer in conjunction with a County Road Project/Road Improvement District, whichever action comes first: 2. Applicant shall dedicate 10 feet on Valley Way for right-of-way purposes beginning at the east property line and continuing to Sullivan Road. Prior To Issuance Of A BuildinE Pemut Or Use Of The Pronertv As Provosed: 3. Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer. 4. The applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. 5. A parking plan and traffic circularion plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 6. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 7. The County Engineer has designated Typical Roadway Section Number Two, Collector Arterial standard for the improvement of Valley Way, which is adjacent to the proposed development. This will require the add.ition of approximately 10-12 feet of asphalt along the frontage of the development and extending to Sullivan Road. The construction of curbing and sidewalk is also required. 8. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 9. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. 10. All required construction within the existing or proposed public right-of-way is to be completed prior to the release of a building pernut, or a bond in an amount ' ~ . - ~ . ' BQCC FINDINGS ZE-28-93 Page 5 estimated by the County Engineer to cover the cost of construction of improvements shall be filed with the County Engineer. 11. No construction work is to be performed within the existing or proposed public right-of-way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 12. The County Arterial Road Plan identif'ies Valley Way as a Collector Arterial. The existing right-of-way width of 40 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addirion to the required right-of-way dedicadon, a strip of property 5 feet in width along the Valley Way frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial unprovements are made to Valley Way. 13. There may exist udlities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocadon regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deternune whether applicant(s) or the utility is responsible for adjustment or relocadon costs and to make arrangements for any necessary work. Svecial Condition: 14. A County Road Project is currently underway for Sullivan Road. Spokane County will be acquiring 75 feet from centerline of Sullivan Road to construct the proposed project. The right of way plan was formally adopted by the County Engineer as per the Spokane County Road Standards. This will effect the site plan as submitted for this rezone, alterations will need to be done to the site plan at the time of building permit to reflect this acquisition by Spokane County on that portion of the site plan that is outside this rezone request. SPOKANE COUNTY DIVISION OF UTILITIES 1. The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petirion method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formadon of a ULID by resolution methai pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petirion or resolution methai under RCW Chapter 36.94. 2. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 3. Applicant shall make connection to public sewer system. Sewer connecrion permit is required. Plans and specifications are to be reviewed and approved by the Utilities Department. SPOKANE COUNTY HEALTH DISTRICT 1. Sewage disposal method sha11 be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. , 4. A public sewer system will be made available for the project. Use of individual on- site sewage disposal systems shall not be authorized." 5. Comprehensive Plan , 1. Land Use Plan: The proposal is located within the Urban category of the Comprehensive Plan and within the Priox'ity Sewer Service Area (PSSA). The Urban category is intended to provide the opportunity for development of a"city-like" environment which includes various land uses with the more intensive land uses located near the heavily travelled streets. Commercial development within the Urban category is intended to be less intensive and limited to those uses permitted in the Neighborhood Business (B-1) zone. The more intensive commercial zones are intended to implement the Major Commercial category of the Comprehensive Plarl which abuts the rezone portion to the west. Commercial zones such as the proposed Community Business (B-2) zone should be located in the Major Commercial category and should not extend into areas designated for less intensive Urban uses. The proposed Community Business (B-2) zone and those uses allowed are not comparible with the Goals, Objectives and Declsion Guidelines of the Urban category of the Comprehens1ve Plan. This proposal, if approved, would extend commercial uses into a residential arel and may establish a precedent for future requests. 2. Arterial Road Plan: The proposal fronts on Valley Way which is designated on the Spokane County Ai-terlal Road Plan as a Collector Arterial with a recommended right-of-way wicitll of 70 feet. The exisring right-of- way width of 40 feet is not consistent wlth that specified in the A.rterial Road Plan. In ord-,r to implement the Plan, the County Engineer is requesting 10 feet of dedication along the Valley Way frontage extended to Sullivan Road. In addition to the reqtlired dedication, a strip of property five (S) feet in width shall also be set aside as Futtire Acquisition Area (FAA) along the rezone portion that fzonts Valley Way, or approximately the easterly 155 feet of the proposal. Sullivan Road, which is adjacent to the existing Community Business (B-2) portion of the proposal, is designated on the Arterial Road Plan as a Principal Arterial with a recommended right-of-way width of 100 feet. A County Road Project (CRP) is currently underway for Sullivan Road which includes improvements along the roadway section adjacent to this proposal. The site plan submitted illustrates property widths ranging between twelve (12) and twenty two (22) feet along Sullivan Road which will be set aside as Future Acquisition Area (FAA). This property will be acquired by Spokane County as needed for the road improvements to Sullivan Road. Note: The Future Acquisition Area (FAA) for Su111van Road as described above is not required as a result of this zone change. 3. County Parks Plan: Sullivan Park is identified as the nearest park facility on the Spokane County Parks and Recreation Plan. Sullivan Park is located northwest of the proposal on the north bank of the Spokane River, west of Sullivan Road. Sullivan Park is a 10 acre community park with various picnic and play equipment on site. 8/93 HEC Staff Report for ZE-28-93 Page 67 - C. Site Characteristics: One existing single family residence is located on the rezone portion of the proposal. The remainder of the site is covered with native grasses, shrubs and deciduous trees. D. Neighborhood Characteristics: 'I'he surrounding area consists of commercial, residential and nonresidential uses. Single family dwellings are located to the west, north, and east of the site. Larbe anlmal keeping is also present in the area. Commercial uses are located along Sprague Avenue and Sullivan Road. A Vera Water and Power Substatian is located directly north of the site on the northeast corner of Sullivan Road and Valley Way. Fred Meyer and Smith's Home Furnishings are constructing stores on parcels south of the proposal along Sullivan Road and Sprague Avenue. E. Zoning Analysis: The existing zone classifications 1n the area allow both residential and commercial uses. Parcels along Sulllvan Road are zoned primarily for commercial use, and those areas east and west of Sullivan Road within the Urban category boundary are zoned for residenrial use. The most recent zone reclassification request in the area is a proposal to convei-t approximately 2 acres from Urban Residenrial-3.5 (UR-3.5) to Urban Residential-7 (UR-7) (ZE-27-93) which will be heard by the Hearing Examiner Committee also this month. That proposal is located north of Valley Way, just west of Sullivan Road. The most recent commercial zone reclassification to occur in the ai-ea was south of the site for the Fred Meyer retai,l center which is located on 25 acres and has the potential to adequately serve the shopping needs in the area. The existing commercial establishments and those under development may suf~'iciently serve the area without necessitating the need for ldditional commercial property through the rezone process. Proposal: Urban Residential-3.5 (UR-3.5) cstablished in 1991 North: Urban Residential-3.5 (UR-3.5) established in 1991, previously classified as Agricultural (ZE-60-42). South: Community Business (B-2) establ.ished in 1989, previously classified as Agricultural, Commercial and Residential Office (ZE- 27-89). East: Urban Residential-3.5 (UR-3.5) established in 1991, previously classified as Agricultural (ZE-60-42). West: Community Business (B-2) established in 1991, previously classified as Agricultural (ZE-60-42). F. Land Use Analysis: Commercial, residential and non-residenrial uses exist in the area which include a power substation to the north, and Fred Meyer and Smith's Home Furnishings which are currently under construction south of the proposal. The most recent development in the area has occurred on parcels fronting Sullivan Road and include Pizza Hut and Subway restaurants which are located on the west side of Sullivan Road. The area has not been subject to recent residential development as most of the area is developed with single farYVly dwellings and duplexes on both platted and unplatted lots. 8/93 HEC Staff Report for ZE-28-93 Page 68 , Site: Single family residence and vacant land. , North: Vera Water and Power Substation, single family residences. South: Future Fred Meyer store, Future Snuth's Home Furnishings. East: Single family resldences. West: Single family residences, Pizza Hut, Subway. G. Circulation: Valley Way will provide direct access to the rezone portion. If the zone reclassification is approved, the applicallt is proposing to develop the subject property and existing Community Business (B-2) parcels as shown on the site plan of record. The proposed site plan illustrates one access approach from Sullivan Road and two (2) access approaches from Valley Way. Based on the adjacent land use to the east and north, the Plannzng Department does not support two access approaches to Valley Way. Access from Valley Way should be located as far west as possible to nutigate potential traffic impacts to the existing single family residences north of and east of the proposal. All internal travel lanes, and parking spaces will be paved. flloading space is proposed along the eastern portion of the site, east of the retail building. The Planning Department recommends relocating this loading area so 1s to elinunate potential adverse impacts to the existing residential use to the east. The applicant will be required to make improvenzents to Valley Way along the frontage of the development and extended to Sullivan Road which include the construction of curb and sidewalk. The consrruction of curbing and sidewalk along Sullivan Road is also required as per the County Road Project (CRP) which is currently underway. H. Design: The site plan of record proposes development of approximately 2.74 acres. The rezone portion includes the east 1.1 acre. The proposed restaurant and the majority of required parkinc, will be located on the western portion of the site and the retail structure will be located on the eastern portion of the property. The site plan illustrates 153 parking spaces which exceeds the 150 required for the proposed uses. Although most of the parking is located west of the proposed retail structure, some parking is proposed east of the structure. The Planning Department recommends the required parking be relocated so that traffic circulation is contained on the westerly portion as opposed to that area adjacent single family residences. The proposed location of the restaurant meets the required Community Business (B-2) setback from Sullivan Road and also provides a 20 foot setback from the south property line although no setback is required. The proposed location of the retail stclicture is 35 feet from the north property line and approximately 63 feet from the east proPerty line. The Fire District and the Division of Buildings Departnient (Fire Marshall) are required to approve fire protection provisions prior to the issuance of building permits. P. Wetlands: Spokane County Wetland Znventory Maps do not indicate the presence of wetlands on the site. Q. Cultural Resources: None have been identified. R. Transit: The proposal is within the Publie Transit Benefit Area (PTBA) boundary. Three (3) service routes, No. 18Broadway Feeder; No. 9/East Sprague; and No. 24/24th Avenue, are within Z blocks of the site. 111. ENVIRONMENTAL REVIEW: An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review coclsidered the specifics of the proposal, other available information, County ordi nances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Planning Depaxtment has determined that "No probable signi.f'icant aciverse impacts" would result from the proposal being developed and has issued a DetenYiinarlal of NonsiLynificance ("DNS The 'DNS" was circulated to 12 other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends August 17, 1993 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner may consider additional environmental related testimony at the public hearing. IV. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION The proposed Community Business (B-2) zone is not consistent with the Goals, Objectives and Decision Guidelines of the Urban category of the Comprehensive Plan. Uses permitted in the Community Business (B-2) zone may be incompatible with established residential zoning and uses along Valley Way. Further, the site pian proposed does not mitigate potential adverse impacts to the established residential uses located north and east of the site. The County Engineer has designated Typical Roadway Section Number Two, Collector Arterial standard for the improvement of Valley Way, which is adjacent to the proposed development. This will require the addltion of approximately 10-12 feet of asphalt along the frontage of the development and extending to Sullivan Road. The construction of curbing and sidewalk is also required. 8. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, uilless otherwise approved by the County Engineer. 9. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. 10.
