rezone, or to change the conditions of approval imposed on a pnor rezone, be approved by the

Effective January 1, 1991, the zonuig of the site was reclassified to the Regional Business
(B-3) zone, pursuant to the Program to Implement the Spokane County Zorung Code The
Program to Implement specifically required that special condihons and site planrung unposed on
development of a site previously rezoned under the County Zoning Ordmance connnue to apply
to the site after its zorung was reclassified under the County Zorung Code, if more restnctive
than development of the site under the new zone See County Resoluhon No 85-0900, Program
to Implement, Section 1
Two (2) freestanding signs have been installed on the parcel lyuig west of the site, along its
frontage with State Route No 27 The applicant seeks to install an additional sign not exceeding
250 square feet on the current srte, for a retall building Zoning Code 14 504 040 requues the
submittal of a change of condition application when the conditions of approval of a previous
rezone are sought to be revised
The site is designated in the Urban category of the Comprehensive Plan The Urban
category recommends a residential net density range of 1 to 17 units per acre The more
intensive uses in the Urban category, such as light industnal and neighborhood commercial, are
expected to be located near or along the heavily traveled streets The least intensive single-
family residential uses should be isolated from the noise and heavy traffic, wlule multifamily
structures will usually be a transitional use located between single-family residential and the

Recent cases hold that changed cucumstances are not requlred for a rezone if the proposed
rezone unplements pollcies of a comprehensive plan See Bjarnson v Kitsap County, 78 Wn
App 840, 846 (1995), and Save Our Rural Environment v Snohomish County, 99 Wn 2d 363,
370-371 (1983), and Tugwell v Kitntas County, 90 Wn App 1, 8, footnote 6(1997) As
discussed above, the project generally conforms wnth the Comprehensive Plan
Changed conditions which support the proposal include reclassification of the zomng of the
site to the B-3 zone, subject to the conditions of the 1985 rezone, a transition toward more
intensive commercial zorung and uses along SR-27, increased traffic along SR-27 and Mission
Avenue in the area, the extension of public sewer to the area, deslgnation of the site within the
County's IUGA boundanes, and general population growth in the Valley area of the county
IV. DECISION
Based on the above find2ngs of fact and conclusions of law, County Planiung Department
condition #1 attached to the County Heanng Examiner Committee Findings and Order dated
March 6, 1986 in File No ZE-89-85 is hereby revised to allow a free-standing sign of 250 square
feet or less to be erected in the southeast corner of the site along Mission Avenue, subject to the
conditions of approval of public agencies stated below Any new or sigruficantly revised
conditions of public agencies unposed by the Heanng Examiner are ctalrcized
Failure to comply with the conditions of this approval may result in revocation of this
approval by the Heanng Examiner Tlus approval does not waive the applicant's obligation to
comply with all other requirements of other agencies with junsdiction

Description of the Site:
The site is approximatety one acre in size, is relatively flat and is accessed by Nlission Avenue. The site
contains a two story commercial building with associated parking and landscaping. There are no
freestanding s'tgns located on the site. Surrounding uses include a restaurant, commercial and retail uses
and a single family residence.
Backqround:
A zone reclassification, ZE-89-85C from Freeway Commercial to Commercial for the development of a retail
center, was approved by the Hearing Examiner Committee on March 6, 1996 for 3.74 acres which includes
the subject property. The requested change of conditions is for the purpose of modifying the following
condition of approval:
Planning Department Condition #1: That the site be allowed only two (2) detached signs of 150 square feet
each; one for the restaurant and one for the retail center. All other signs are to be placed flat against the
building.

Staff Analysis;
The site is located within the Urban category of the Comprehensive Plan and wi#hin 50 feet of the Major
Commercial categvry. The Urban category is intended to pravide the oqportunity tor the develapment of a
cihylike envir4nment which ineludes varivus land uses, intensive residential development and public facilities
and services. Detailed definitian D states that "Due to the wariety of and rnix of land uses and activities
fvund in the Urban category, there are fev+r land use activities that would be irrappropriate. Many uses may
require screening ar a#her perFormance standards ta make them comp,atible with one another. Mining, major
commercial users, heavy industrial uses, and intensfve farming wvuid not be compatible wi#hin Urban
areas.",
The Pfanning department staff report far the ariginal zvne reclassifi+cation, ZE-89-85, recommended a
condition allowing an{y two freestanding signs for the develapment, but did not expiain the reasoning for #he
recommendation. {t is possible #he recommendation was meant to Wfsualiy protect the residential area
located to the west of the site. The praposed sign, as illustrated on the site pian, is to be IQCated
appraxirnately 250 feet west of Highway 27 and difectly across from the retail and cornmercial development
lvcated south of the site. There is a single family residence Iocated ta the south of the site, however, the
prapased sign is to be Ioca#ed to the northeast of that prvperty.
The purpose and intent of the existing Regional Business (B-3) zvne is to pravide far a wide range of retail
and seniice activities, arrd to implement comprehensirre plan policies which encvurage development along
Principal Arterials or highways. Sign standatds for the Ftegivna! Business {8-3} zcrne are specified in
Section 14.804.120 of the Zoning Cvde. The development standards for freestanding signs wi#hin the
Regionai Business (B-3) zvne are °fireestanding signs shall not exceed two (2) square feet per lineal foat of
street frontage up ta a maximum of two hundred (250) square teet in s'rgn area nor thirty-fve (35) feet in
height abawe grade. There shall be no mvre than vne {1} such sign for each twa hundred (200) feef of
street frontage vr partion thereof." The proposed sign is c4nsistent with the development s#andards of
Sec#ion 14.804.120.
The praposed change of conditjons allouv an additional detached sign is consistent with the dewelapmertt
standards of the existing Regionai 8ustness (B-3) zane and Sectivn 14.804.120 of the Zoning Code, and will
not adUerseiy affect residential uses to the soUth and west of the site.

1. The proposal shall compiy with the Regional Business (B-3), as amended.
2. The applicant shall develop the subject property generally in accordance with the concept
presented to the Hearing Examiner. Variations, when approved by the Director of the
Division of Building and Planning/designee, may be permitted, including but not limited to
building location, landscape plans and general allowable uses of the permitted zone. All
variations must conform to regulations set forth in the Spokane County Zoning Code, and
the original intent of the development plans shall be maintained.
3. Approval is required from the Director of the Division of Building and Planning/designee of
a specific lighting and signing plan for the described property prior to the release of any
building permit.
4. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
5. The Division of Building and Planning shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a variety of special
conditions imposed as a result of approval of a land use action. This Title Notice shall
serve as public notice of the conditions of approval affecting the property in question. The
Title Notice should be recorded within the same time frame as allowed for an appeal and
shall only be released, in full or in part, by the Division of Building and Planning. The Title
Notice shall generally provide as follows:

action by a Spokane County Hearing Examiner on December 9, 1998, imposing a
