PROPOSAL
The sponsor, Ted Gunning, requests approval of a Zone Reclassification, ZE-30-92,
from Light Industnal (I-2) to Urban Residential-22 (LTR-22) vvittun the Aquifer
Sensitive Area (ASA) Overlay Zone and Vanance request, VE-28-92, for fence height
and landscaping

1 The property is generally located in the Spokane Valley, west of and adjacent to
Wilbur Road, between Ermina Avenue and 1Vlontgomery Dnve ui the southeast 1/4 of
Section 9, Township 25 North, Range 44 EWM, Spokane County, VVashington
2 The committee adopts the Plammmg Department Report as a part of this record
3 The existing land use(s) in the area include a mix ture of single family dwellulgs,
apartments, warehouses, storage areas, light industnal, and manufactured homes
4 The Comprehensive Plan designates this site as Urban The Urban category is for the
purpose of residenaal development, inclu(Iing residential densities of 1 to 17 dwelhng
umts per acre, or 18 5 dwelluig units per acre for this proposal
5 The Artenal Road Plan designates Montgomery Dnve as a Minor Artenal, vvith a
recommended nght of way width of 80 feet

1 Pnor to the release of any builchng perncuts on the subject property, the apphcant
shall submit a revised site plan which illustrates 10 feet of Type III landscapulg
along the north property hne, and a 6 foot sight obscunng wood fence, setback 5
feet from the north property luie (Ertnina Avenue) Fifteen feet of Type III
landscaping shall be provided along the east (Wilbur Street) and south
(Montgomery Dnve) property lines, and a 6 foot sight obscunng wood fence shall
be provided and setback S feet from the south (1Viontgomery Dnve) and 5 feet from
the east property hne (Wilbur Street)
This condition, in effect, grants a 10 foot vanance from the landscaping requned
along Ernaina Avenue and 5 foot landscaping vanances from the landscaping
requned along Montgomery Dnve and Wilbur Street In addition, this condiaon
grants a fence setback vanance of 20 feet along the north and east property hnes and
a fence setback vanance of 17 feet along the south property hne
2 The Hearmg Examiner Comnuttee would provide d.iscreaon to the County Engineer
in determuimg the typical roadway section designated on Ermina Avenue If the
County Engineer approves the Typical Roadway Section #2 for Ernuna, the
apphcant shall pave 36 feet to the existing curb on the north side of Ernuna Avenue
and the apphcant shall construct the Spokane County standard curb and sidewalk
along the proposal's frontage on Ernuna Avenue

asphalt along the frontage of the development The construcnon of curbing and
sidewalk is also requued
7 The County Englneer has designated Typical Roadway Section Number One, Local
Access standard for the unprovement of Wflbur Road, which is adjacent to the
proposed development This will require the add.ition of approxunately 10-12 feet
of asphalt along the frontage of the development The construction of curbing and
sidewallc is also requued
8 The County Engineer has designated Typical Roadway Secaon Number One, Minor
Artenal standard for the improvement of Montgomery Avenue, wtuch is adjacent to the
proposed development This will require the addiaon of approximately 8-10 feet of
asphalt aiong the frontage of the development The construction of curbuig and
sidewalk is also requued
9 All required unprovements shall conform to the current State of Washuigton
Standard Specifications for Road and Bndge Construction and other apphcable
County stand.ards andlor adopted resolutions pertatmng to Road Standards and
Stormwater IVianagement in effect at the date of construcnon, unless otherwise

Spokane County's Comprehensive Plan This category ls intended to
provide for the development of a' city-lilce' environment Since urban areas
will be the most intensely developed of all categones It is pnmanly a
residennal category of single family, two family, multifamily and
condominiums along with neighborhood commercial, industnal parks and
recreanonal facilities Urban areas will have public water systems sanitary
sewer systems and other public facilines typica.l of intensely developed
urban areas
Objective 1 la of the Urban Category encourages fill-in development wnthin
established development areas Those proposals with existing public
services should be approved provided that such development meets the

Both the proposed landscaping and fencing requests must meet the cntena set
forth for approval of vanances in the Zoning Code

Vanance Cntena
1 Any vanance from the terms of the Zorung Code shall be subject to such
conditions as will (a) ensure that the adjustment shall not consntute a grant of
special pnvilege inconsistent with the hmitations upon other propernes in the
vicinity and slrrular zone reclassificanon in which the property is situated, (b)
ensure that the intent and purpose of the Zoning Code is maintained with regard to
location, site design appearance landscaping and other feature of the proposal
and (c) protect the envuonment, public Interest and general welfare, and that the
following cucumstances are found to apply
a Because of special circumstances applicable to the property, including size,
shape, topography, location or surroundings, the smct applicanon of the
Zoning Code creates pracacal difficulties and is found to depnve the property
of nghts and pnvfleges enjoyed by other propernes in the vicinity and sirrular
zone classification, and
b That granting of the vanance will neither be matenally detnmental to the
pubhc welfare nor uljunous to the property or improvements in the vicunity
and zone in which the property is located
Resnonse
1 a The granting of vanances would be granting a special pnvilege to the
applicant, because any other landowner in the UR-22 zone would be held to
the requlred standards and it would adversely impact the residential
neighborhoods adjacent to the site with respect to the amount of landscaping
being taken away from what would normally be provided to protect theu
views and living environment
1 b There are no special cucumstances applicable to the property which make
comphance to the requirements a pracacal difficulty The site plan could be
redesigned to allow for more landscaped area between the parlang areas
and the property hnes and decrease internal open space The proposed
parkmg garages and carports already act as a sufficient buffer between the
streets and the apartments and internal open spaces
The adjacent uses across E=na Avenue and Wilbur Road are single fanuly
residential and would be adversely affected by a 6 foot wall that would echo
traffic noise and not be as pleasant to view as a 20 foot wnde landscaped
area. Wallang on the sidewallc adjacent the site vvill also be much more
pleasing if a 6 foot fence were not nght next to the sidewalk

The "DNS" was cuculated to 11 other agencies of junsd.iction and other
agencies/departments affected by the future development for review and comment
The ' DNS' comment penod ends August 18, 1992 and was advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners vvithin
400 feet of the proposal, and by noace on a sign posted on the proposal site The
Heanng Examiner may consider addinonal envuonmental related testunony at the
pubhc heanng

Purpose of Checklist
The State Environmental Policy Act (SEPA) chapter 43 21C RCW, requires all governmental agencies to consider
the environmental impacts of a proposal before mak.ng decisions An Environmental Impact Statement (EIS)
must be prepared for all proposals vnth probable significant adverse impacts on the quality of the envlronment
The purpose of this checklist is to provide information to help you and the agency identify impacts from your
proposal (and to reduce or avoid impacts from the proposal if it can be done) and to help the agency decide
whether an EIS is required

This environmental checklist asks you to descnbe some basic information about your proposal Governmental
agencies use this checklist to determine whether the environmental impacts of your proposal are significant
requiriog preparation of an EIS Answer the questions brieIIy, with the most precise information known, or give
the best description you can
You must answer each question accurately and carefully to the best oF your knowledge In most cases you should
be able to answer the questions from your own observations or proJect plans without the need to hire experts If
