The members of the Committee present are Phil Hams Chauperson, Hany Gibbons
and Bud Skadan
PROPOSAL
The sponsor, Richard Johnson, requests approval of a zone reclassificanon from
Agncultural (A) to Urban Residennal-3 5(UR-3 5), File No ZE-1-90 and a
condiaonal use permit, File No CUE-1-90 for the purpose of allowing a real estate
office in a detached structure as a home industry

1 The property is generally located in the Spokane Valley north of and adjacent to
Mission Avenue approxunately 200 feet west of Union Street in the SE 1/4 of Secnon
9, Township 25 N, Range 44 EWM, Spokane County, Washington
2 The committee adopts the Planning Department Report as a part of this record

4 The Comprehensive Plan designates this site as Urban The Urban category is

recommended nght of way width of 80 feet Existuig Mission Avenue nght of way

uses of the pernutted zone All vanations must conform to regulations set forth in
the ZONIIVG CODE FOR SPOKANE COUNTY The onguial intent of the
development plans shall be maultained.
2 The specific development plan will be subautted for Planning Deparnnent review
and approval pnor to issuance of budding permits
3 All current standards of the Urban Residennal (UR-3 5) Zone as amended shall be
complied with in the development of this site
4 The project is subject to Section 14 706, the Aquifer Sensitive Area Overlay Zone
of the ZONIlVG CODE FOR SPOKANE COUNTY, which sets forth vanous
measures for Aqwfer protection, specif'ically, measures dealing with wastewater
disposal, spill protecnon measures, and stormwater runoff
5 Applicant shall comply with '208' recommendanons concerning stormwater runoff
and provide necessary landscaping for runoff
6 Any division of land for the purpose of sale, lease or transfer shall comply with
, RCW 58 17 and the Spokane County Platting Ordinances pnor to issuance of
building permits

1 Apphcant shall dedicate 2 feet on Mission Avenue for nght-of-way
~ 2 Access permits for approaches to the county road system shall be obtained from the
Spokane Counry Engineer
3 The applicant shall subnut for approval by the Spokane County Engineer and the
Spokane County Health Dismct a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project, or pornon thereof, if the
development is to be phased
4 A parDang plan and traffic cuculation plan shall be subnutted and approved by the
Spokane County Engineer The design, locaaon and arrangement of parlang stalls

surfacing as approved by the County Engineer, will be requued for any pornon of

5 To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any
petinon or resolution which purpose is the formation of a Road Improvement
Distnct (RID) for smd imprnvement, pursuant to RCW 36 88, as amended
Spokane County will not parncipate in the cost of these improvements
6 As an alternative method of construcang the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and parncipahng in a County Road Project
(CRP) to the extent of the required improvement Spokane Counry will not
i participate in the cost of these improvements

~ 7 The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
8 The County Engineer has designated Typical Roadway Secdon Number One,
Secondary Artenal Standard for the improvement of Niission Avenue, which is
adjacent to the proposed development Thls will requum the addition of
approximately 6 to 8 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required
9 Applicant shall construct a paved and delineated approach(es) to meet the emsting
pavement on A/Tission Avenue
10 Roadway standards typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No 80-1592 as
amended and are applicable to this proposal
11 Applicant shall sign and record Spokane County Notice to the Public No 6 which
specifies the following
The owner(s) or successor(s) in interest agree to authonze the County to place theu
name(s) on a peauon for the formanon of a Road Improvement Distnct (RID) by
the petiaon method pursuant to Chapter 36 88 RCW which petinon includes the
owner(s) property, and further not to object, by the signing of a ballot, the
formation of a RID by the resolution method pursuant to Chapter 36 88 RCW
which resoluaon includes the owner(s) property If an RID is formed by either the
~ peanon or resolution method, as provided for in Chapter 36 88 RCVV, the owner(s)
or successor(s) further agree
i (1) that the unprovement or construction contemplated wittun the proposed
RID is feasible,
(2) that the benefits to be denved from the formaaon of the RID by the
property uicluded therein, together with the amount of any County
pamcipaaon, exceeds the cost and expense of formaaon of the RID, and
(3) that the property vvithin the proposed RID is sufficiendy developed
Provided further that the owner(s) or successor(s) shall retain the nght, as authonzed
under RCW 36 88 090, to object to any assessment on the property as a result of the
unprovements called for in conjunction with the fonnanon of the RID by either peaaon
or resoludon method under Chapter 36 88 RCW
The County Artenal Road Plan identifies Mission Avenue as a Minor Artenal The
existing nght-of-way width of 60 feet is not consistent with that specified in the
Plan In order to implement the Artenal Road Plan, in addiuon to the requued
nght-of-way dedication, a stnp of property 8 feet in width along the Mission
Avenue frontage shall be set aside in reserve This property may be acquired by
Spokane Counry at the time when artenal improvements are made to Mission
Avenue

The following "Conditions of Approval" for the above referenced zone
change are submitted to the Spokane County Hearing Examiner Committee
for inclusion in the "Planning Report" and "Findings and Order" of
the public hearing scheduled May 24, 1990.
Prior to the release of a building permit or use of the property as
proposed:
E36 Applicant shall dedicate 2 feet on Mission Avenue for
right of way.
E40 Access permits for approaches to the County Road System shall be
obtained from the County Engineer.
E44 The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof if the
development is phased.
E45 A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
location and arrangement of parking stalls shall be in
accordance with standard engineering practices. Paving or
surfacing as approved by the County Engineer will be required
for any portion of the project which is to be occupied or
traveled by vehicles
E46 To construct the roadway improvements stated herein, the
applicant may, with the approval of the County Engineer, Join in
and be willing to participate in any petition or resolution
which purpose is the formation of a Road Improvement District
