FINDiNGS AND ORDER -
A. INTRQDUGTION
This matter having come before the Zoning Hearing Examiner Committee on
December 3, 1987, and the members of the Committee present being Phillip
D. Harris, Chairman, and Jim Schurra and Gary N. Anderberg.
B. PRQPQSAL
The sponsor, Don Henrichs, is requesting approval of a zone
reclassification, File No. ZE-52-87, SINGLE FAMILY RESIDENTIAL to
URBAN RESIDENTIAL-3.5 (UR-3.5) Zone, for the purpose of
continued single family residential use.
Also, a Conditional Use Permit, File No. CUE-36-87, CONDITIONAL USE
PERMIT FOR A HOME INDUSTRY (ARCHITECTS OFFICE) for the purpose
of allowing a home industry (architect's office) in the Urban Residential-3.5
(UR-3.5) Zone.
C. FINQINGS OF FACT
1. That the existing land use in the area is single family residential,
apartments, and retail convenience center.
2. That the Comprehensive Plan designates this area as appropriate for
URBAN development.
3. That the existing zoning of the property described in the application is
Single Family Residential.
4. That the provisions of RCW 43.21 C(The State Environmental Policy Act)
have been comptied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land use in this area is suitable for the proposed use, or uses
within the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the
proposed rezone is justified. However, the proposed Conditional Use
Permit for a home industry (architect's office) is not justified.

8. That the proposed home industry (architect's office) could be compatibie
with existing uses in the area.
9. That the owners of adjacent lands expressed disapproval of the
proposed use.
10. The Hearing Examiner Committee finds the proposed use not to be in
harmony with the general purpose and could be otherwise detrimental
to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) That home industries are becoming more and more a popular
concept. As such, it can be expected that the number of home
industry issues coming before the Hearing Examiner Committee will
increase significantly. Home industries are a concept encouraged by
the Comprehensive Plan provided they do not have an adverse
impact on adjacent residential uses. Therefore, review of these
proposals must consider site specific issues related to each proposal.
b) That the Hearing Examiner Committee believes that this specific
proposat would not have a significant adverse effect on the
neighborhood. In fact, it may be an asset to the area. The existing
house and lot lends itself to adequately accommodate an architect's
office as a home industry. Traffic associated with that use is minimal.
The only exterior alteration would be the addition of a small parking
area and the visual impact,cou{d be reduced by various conditions
suggested by the Planning Department. The operation would
probably go unnoticed by the neighborhood.
c) Existing Home Occupations standards within the existing Single
Family Residential (R-1) Zone would cuRently allow the architect's
office in the house. However, these standards would preclude the
employment of people outside of those family members residing on
the property. The applicant's need to have two non-family employees
is the primary reason for the proposed land use action.
d) That the private covenents of Midilome 2nd Addition, in which the
proposal is located, prohibits commercial uses in the plat. The
Hearing Examiner Committee recognizes that these private
covenents were not imposed and are not enforceable by Spokane
County. However, the Hearing Examiner Committee notes that all
owners of property in this area, including the applicant, bought
property based on private covenent assurances prohibiting
commercial uses. Therefore, the Hearing Examiner Committee is

uncomfortable considering a proposai that- may violate surrounding
owner's expectations and assurances.
e) That the applicant had the option of attempting a change to the private
covenents through the proper neighborhood channels prior to
applying for this action. Had this been done and the covenent
changed to allow home industries/occupations then the Hearing
Examiner Committee would have been more comfortable with this
proposal.
ORDER
The Zoning Hearing Examiner Committee, pursuant to the aforementioned,
finds that the application of Don Henrichs for a zone reclassification and
Conditional Use Permit as described in the application should be DENIED.

Vote: (3-0) UNANIMOUS TO DENY THE ZONE RECLASSIFICATION

THIS MATTER, Being the consideration by the Board of County
Commissioners of Spokane County, hereinafter referred to as the "Board"
of an appeal of the Spokane County Zoning Hearing Examiner Committee
Decision of December 3, 1987, denying the zone reclassification, ZE-52-
87, Single Family Residential (R-1) to Urban Residential-3.5 (UR-3.5)
Zone, and Conditional Use Permit, CUE-36-87, Home Industry, for the
purpose of converting a portion of a residence into an architect' s office
with two (2) employees, hereinafter referred to as the "Proposal", and the
Board of County Commissioners having held a public hearing on January
5, 1988, and having fully considered all testimony presented thereat, and
further having individually visited with the site and vicinity in question,
and having rendered a decision on the 19th day of January, 1988, denying
said proposal, does hereby make the following:
FINDINGS OF FACT
1. That the proposal is generally located at the northwest corner of

2. That the proposal consists of an approximate 11,700 square foot
site for the purpose of continued single family residential use and a
proposed conversion of a portion of the existing residence into an
architect' s office with two (2) employees.
3. That the adopted Spokane County Generalized Comprehensive
Land Use Plan indicates URBAN type usage of the area encompassed by
the proposal. This category allows home industries provided the use will
not:
a. Disrupt residential amenities concerning sight, sound, smell and
similar factors; or
b. Create traffic which exceeds road design or which develops traffic
hazards within the neighborhood; or
c. Negatively affect the intended uses within this category.
As indicated by these findings the project cannot demonstrate
compliance with these guidelines.
The Comprehensive Plan defines "Home Occupations" as
a profession or craft carried on in the residential
property by the occunants which activity is clearly
incidental to the use of the residence as a dwelling and
does not change the residential character thereof, is
conducted in such a manner as to not give any outward
appearance of a business in the ordinary meaning of the
term, and does not infringe upon the right of
neighboring residents to enjoy a peaceful occupancy of
their homes.
The project does not meet the definition of home occupation as defined
in the Comprehensive Plan.
4. That in denying the proposal, the Board makes no findings
regarding the provisions of RCW Chapter 43.21C (State Environmental
Policy Act).
5. That the Spokane County Hearing Examiner Committee held a
public hearing on December 3, 1987, concerning the proposal, subsequent
to which by Findings of Fact, Decision and Order dated December 3, 1987,
they denied the proposal.

6. That the existing land uses in the area of proposal include single
family residences on all four immediate common boundaries.
7. That the proposal is not compatible with existing uses in the area
nor appropriate in the location. In particular it will generate increased
traffic and its frontage is not necessarily large enough to support the
necessary access.
8. That the proposal may be detrimental or otherwise harmful to the
residential character of the area by the parking lot necessary to
accommodate the architect's office which is not consistent with the
surrounding area, i.e., it would afford space for five (5) individuals.
9. That the applicant has not demonstrated changed conditions since
the original zone change warranting the placement of a Home Industry use
within the residential area.
10. That the proposal is not consistent with the surrounding land use
classifications, which do not have any home industries, and if granted
provides a special privilege or right to the applicant different than those
enjoyed by adjacent property owners.
11. That access to the site would be via Robie Street. The proposal
would generate increased traffic as a result of two (2) additional employees
at the site and clients or contractors visiting the architect' s office. That
although the applicant indicated that very few such persons would visit the
site, it is very difficult to estimate such usage.
12. That there is a restrictive covenant which has been placed on the
property by the plat sponsor, providing that "no lot shall be used except for
residential purposes. " Although the Prosecuting Attorney' s office advises
that the County is not and cannot be responsible for enforcing this private
covenant; it does have a bearing on whether or not the proposed architect' s
office is "compatible" with other uses in the area. Furthermore, the
proposed use with its additional parking and increased traffic, in light of
this condition, would make the proposal not compatible with the
surrounding residential areas.
13. That the Spokane County Zoning Code distinguishes the
terminology "home industry" as applied for herein, and a"home
p r o f e s s i o n". On e ma jor distinction is that the home profession onl y allows
members of the family who reside on the premises to be engaged in the
home profession. Likewise, there is a limitation on the number of parking
spaces. A home profession would be less detrimental to the surrounding
properties and consistent with the urban land use category.
- 14. That the Board finds that the proposal is located within the
recorded water service area of Model Irrigation District #18 and they are
supplying the site with adequate water for domestic, fire and irrigation
uses.
15. That the proposal is situated within the recorded fire service area
of Fire District #1.
16. That the proper legal requirements for advertising of the hearing
before the Board of County Comrnissioners of Spokane County have been
met.

The Urban category encourages the development and retention of
residential areas. However, 'rt also provides opportunities for neighborhood
services and light industrial uses generafly on properties with direct access
to major arterials and in areas where they would not be disnuptive of the
residential character.
The Urban category makes specific reference to home occupations
through a specific objective and decision guidelines. Objective 1.1.i states:
"Home Occupations may be allowed provided they are non•disruptive of
neighborhood amenities." To implement this Objective, Decision Guideline
1.7 states: "It should be determined prior to approval that operation of a
home occupation within an existing residential area will not:
a) Disrupt residential amenities conceming sight, sound, smell and
similar factors; or
b) Create traffic which exceeds road design or which develops traffic .
hazards within the neighborhood; or
c) Negatively affect the intended uses within this category." -
The energy management section of the Comprehensive Plan, specifically
Objective 12.1.1, encourages cottage industries as a means to reduce the
amount of transportation required to and from worc. However, there are no
specific decision guidelines stated to implement this Objective.

convenience center which is adjoined along the north and west by

Zoning in this immediate area is scheduled to cross-over in 1991 from the
old pokane County Zoning Ordinance to the new Spokane County Zoning
Code as ollows.

right of way improved with two paved and curbed
lanes.
The plat of Midilome 2nd Atfdition, in which the proposed reZOne is
located, was conditioned by Spokane County to prohibit any lots from
aocessing 32nd Avenue. The existing singie family residence on site
accesses 33rd Avenue with its driveway. The proposed driveway to
serve the parking needs of the home industry wouid access Robie Street.

Proposed Home Industry: The applicant proposes no signifcant
changes to the residential appearance of the existing house
on site. The proposed office space, consisting of approximately
750 square feet, would be located in the basement with the entryway
near the northwest comer of the house. A proposed 3-car parking area
wouid be located north of the house between the house and 32nd
Avenue. The parcing area would be enclosed on the north and along the
south (between the parking area and the house) by a 6-foot tall sight-
obscuring fence. The proposed focation of the driveway is as far south
on Robie as possible from 32nd Avenue so as to avoid traffic hazards at
the intersection of 32nd and Robie and to retain as much of the existing
residential landscaping exissting on site as possible.
On the application fonn submitted for the proposed rezone and -
Conditional Use Permit the applicant has indicated his intention to
comply with the standards of the home industry Conditional Use Permit.
Specifically, the applicant has indicated that no more than two
employees, outside the members of the househoid, would be employed

on thd premises. The most significant change to the property, the
addition of the 3-car parking lot and driveway, will be landscaped and
screened to minimize the impact to the residential character and
appearance of the property. The applicant does not anticipate many
client visits to the office and most of the office would be devoted to
production space.
Proposed Buffering Techniques: The extensive existing residential
landscaping will remain. Exterior improvements will include only the
addition of the parking area and driveway; both oriented to the back yard
of the house. This will be screened, as much a possible from public view,
by fencing and additional landscaping.
note:
- The site plan submitted for review by the Zoning Hearing Examiner
-Committee is general in nature. Detailed review to determine
compliance with all Ordinance regulations and conditions of approval
is recommended to be administrative and to occur at the Building
Permit stage.
III. 5ITE DEVELQPMENT RECQMMENDATIONS
Condition f Use Siandards: The minimum standards that apply to a Home
lndustry Conditional Use Permit are contained in the Spokane County
Zoning Code. Some of these standards require that the Hearing Body make
_ a specific decision to define the {imits of the operation. Additionally, the
Code allows the Hearing Body to add conditions to mitigate identified
concerns. The minimum Home Industry standarcls are as follows:
"a) The property shall retain its residential appearance and character;
- b) The use shall be carried on in a primary residence or may be allowed in
accessory, detached structures which are not, in total, larger than two (2)
times the gross floor area of the primary residence;
c) Only members of the family residing on the premises, and no more than
two (2) employees outside of the family, may be engaged in the home
industry;
d) Signs identifying the home industry shall be unlighted and may be
attached or detached per the following standards:
ii. In the Suburban Residential-1 (SR-1), Suburban Residential-1/2 (SR-
1/2), Urban Residential•3.5 (UR•3.5), and the Rural Settlement (RS)
- Zones, signs totafing a maximum of four (4) square feet on a face.

III. SITE DEVELOPM NT RECQMMENDATlONS ZE-52-87 & CUE-36-87 _
e) Window or outside disp(ays may be allowed as approved by the Hearing
8ody; -
f) 1'here shail be no stock stored nor commodity kept for sale on the
premises which is not necessary to the occupation, profession, or craft;
g) AII material or mechanical equipment shall be used in such a manner as
to be in compliance with WAC-173-60 regarding noise;
h) Parking, traffic, and storage requirements shall be as approved by the
Hearing Body; and i) All storage areas shall be enclosed or completely screened from view by
a maximum s+x (6) foot high sight obscuring fence meeting accessory use
setback requirements."
ensit : Density allowed under the Urban Residential-3.5 Zone, that is 3 1/2
dwelling units pef acre, will be no different than the density currently allowed
by the surrounding Single Family Residential (R-1) Zone. T'he proposed
Urban Residential•3.5 (UR-3.5) Zone is not a significant issue in this
proposal. The existing Single Family Residential (R-1) Zone is scheduled to
cross-over to the new Urban Residentiaf-3.5 Zone in 1991. This, therefore,
is an earfy cross-over of zoning.
Design: No exterior struciural design changes are proposed which would
negatively impact the residentiat character of the area.
Circulation/Access: The County Engineer will require additional
consultation with the applicant to resolve any sight distance problems
associated with the driveway aocess at Robie Road and at the intersection of
32nd Avenue and Robie Road.
As a measure to soften the visual impaci of the parcing area and ddveway,
the Planning Department suggests that, if possible, the hard surfacing be
constructed of concrete grass pavers.
Sewaoe Dis o~s-at: The site is currently connected to a public sewer system
serving the Midilome Subdivision and will Continue as such under the
current proposal.
IV. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was -
reviewed by the County Planning Department. The review considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions of
Approval, the Generalized Comprehensive Pian, and other County

policies and guidelines. The Zoning Administrator has determined that
- "No probable significant adverse impacts" would result from the proposal
b DN developed and has issued aDetermination of Non-Siynificance
( S)
The "DNS" was circulated to nine other agencies of jurisdiction and other
agenciesJdepartments affected by the future development for review and
comment. The "DNS" comment period ends December 2, 1987, and was advertised 15 cafendar days before said date in the newspaper, by letter
to adjacent property owners within 400 feet of the proposal, and by notice
on a sign posted on the proposal site. The Hearing Examiner Committee
may consider additional environmental related testimony and the "DNS"
at the public hearing.
V. PLANNING SUMMARY
The proposed zone change from Single Family Residential (R-1) to Urban
Residential•3.5, considered a minor action, should be approved because:
a) It is consistent with and implements the Urban category of the
Comprehensive Plan.
b} Both the proposed Urban Residential-3.5 Zone and the surrounding
_ Agricunural Suburban and Single Family Residential (R•1 ) Zones are
comparable in permitted residential densities.
_ c) Generally, this entire area is scheduled to cfoss-over to the Urban
Residential-3.5 (UR-3.5) Zone of the new Spokane County Zoning Code
in 1991.
The proposed Conditional Use Permit for an architect's office as a home
industry is the principal issue. The minimum Conditional Use Permit
standards contained in the Spokane County Zoning Code are intended to
protect adjacent residential uses if the Conditional Use Permit is approved.
The following facts tend to support approval of this request:
a) Both the Urban category and the Energy Management Seciion of the
Comprehensive Plan supports approval of home professions and
industries, provided adjacent residential areas will be adequately
protected.
b) The minimum home industry standards of the Spokane County Zoning
_ Code serve to meet the Comprehensive Plan's three criteria for locating
a home occupation in a residential area.

c) The proposed site plan and supponing materiai indicate the applicant's -
intention to operate the home industry (architect's office) with minimal
impacts to adjacent residential usese
d) While an architect's office can be cons+dered a rather high-volume office
use, the applicant has indicated that client visits to the office wiil be at a
- minimum. This iimiting of ciient visits is strongiy dependent upon the
management style of the appiicant since it would not be an easily
enforceable condition by the County.
e) The major exterior afteration to the property, the addition of a 3-car
parking area and driveway, wili be oriented towards the back of the lot in
close proximity to 32nd Avenue, a high volume County arterial. Traffic
flow along 32nd Avenue is so high that individual lot accesses to 32nd
Avenue have been prohibited as evidenced by Spokane County's
restriction on the Midilome plats. Measures to scteen from public view,
added landscaping, and surfacing with grass pavers will all help to soften
the visual appearance of the parking area.

1. All cuRent standards of the Urban Residential-3.5 (UR-3.5) Zone, as
amended, shall be complied with in the development of this s'rte.
SPEQIAL:
THAT THE FOLLOWING CONDtTIONS OF APPROVAL APPLY TO THE
OPERATION OF A HOME INDUSTRY (ARCHITECTS OFFICE):
2. That the applicant shall develop subject property in strict conformance
with the site plan presertted to the Hearing Examiner Committee on
December 3, 1987. All aspects of the concept and proposal shall be
binding on the development; including proposed use. Variations, to
be approved by the Zoning Administrator, shall only be allowed to -
meet Ordinance standands and conditions of approval. Any other
modification must be pr+esented to the Hearing Examiner Committee
for review and approval.

a) COUNTY PLANNING DEPARTMENT (continued)
3. The specific development plan wiil be submitted for Planning
Department review and approval prior to issuance of building permits.
4. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
5. That all specific standards as required by Section 6.16.240(4) of the
Zoning Code for Spokane County be binding on the development of
the home industry.
6. That approval is granted for an architect's office only.
7. That the architect's office must be located within the primary
residence and shall not be allowed in any detached structure.
8. That no more than two (2) employees outside of the family may be
engaged or employed in the architect's office.
9. No window or outside disp{ays are allowed.
10. That ma~cimum hours of operation shall be Monday through Saturday
from 7:00 a.m. to 9:00 p.m.
11. That the parking area and driveway be surfaced with concrete grass
pavers or some other comparable product. If not possible, then the
Zoning Administrator may approve an alternative that will aid in
softening the visual impact of the parking area and driveway.
b) COUNTY ENGINEERING DEPARTMENT

1. Access permits for approaches to the County Road System shall be
obtained from the County Engineer. 2. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof if the development is
phased.
. 3. A parking plan and traffic circulation plan shall be submitted and
. approved by the Spokane County Engineer. The design, location
and arrangement of parking stalls shall be in accordance with

3. standard engineering practices. Paving or surfacing as approved by
the County Engineer will be required for any portion of the project

construciion and other applicable county standards andlor adopted
resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless othervvise
approved by the County Engineer. 5. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 80-1592 as amended and are applicable to this proposal.
SPECIAL:
6. THAT PRIOR TO THE RELEASE OF A BUILDING PERMIT THE
APPLICANT SHALL CONSULT WITH THE COUNTY ENGINEER TO
DETERMINE THE MEASURES WHICH MUST BE TAKEN TO
ASSURE ADEQUATE SIGHT DISTANCE AT THE INTERSECTION OF ROBIE ROAD, THIRTY SECONO AVENUE AND THE PROPOSED
DRIVEWAY APPROACH. "
c) COUNTY UTILITIES DEPARTMENT
1. No recommendations; the existing sewers are not affected.
d) COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Oirector of
Utilities, Spokane Courrty.
2. Water service shall be coordinated through the Director of Utilities,
Spokane County.
3. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.

without first obtaining a change in use permit from the Department of

f) WATER PURVEYOR
1. Water Purveyor is Model Irrigation District #18, and they are supplying
the site with adequate water for domestic, fire and irrigation uses.
g) SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
STANDARD:
1. Air pollution regulations require that dust emissions during
- demolition, excavation and construction projects be controlled. This
may require use of water sprays, tarps, sprinklers, or suspension of
activity during certain weather conditions. Haul roads should be
treated and emissions from the transfer of earthen material must be
controlled as well as emissions from all other construction related
activities.
2. Measures must be taken to avoid the deposition of dirt and mud from
. unpaved surfaces onto paved surfaces. If tracking or spills occur on
paved surfaces, measures must be taken immediately to clean these
surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access roads)
must be paved and kepi clean.
4. Some objectionable odors will likely resutt during the construction
phase of the project and from motor vehicles using the s'rte following
completion of the projed and from occupants of the proposed project.
SPECIAL:
5. Any solid fuel combustion units must meet the requirements of
January 1, 1988, regulations. 38

8, Preliminary Submittal
Prior to filing an application, the project sponsor shall become familiar with the
current procedures and forms. Planning Department staff inembers are available for
advice on current procedures, past actions which may affect the proposal and the
Zoning Ordinance requirements.
C. Scheduling an Application for Public Hearinj
Complete applications received by the Planning Department will be scheduled for public
hearing on the earliest possible date. Staff will contact the applicant approximately
Zl days prior to the public hearing, and provide the information needed to fulfill the
notificatlon requirements outlined in "E." below.

Prior to filing an application, the project sponsor shall become familiar with the
current procedures and forms. Planning Department staff inembers are available for
advice on current procedures, past actions which may affect the proposal and the
Zoning Ordinance requirements.
C. Scheduling an Application for Public Hearinq
Complete applications received by the Planning Department will be scheduled for public
hearing on the earliest possible date. Staff will contact the applicant approximately
21 days prior to the public hearing, and provide the information needed to fulfill the
notification requirements outlined in "E." below.

l E. 'Notification Requirements
The applicant is to provide notification as follows: More detailed instructions
are provided when notification packet is picked up at the Planning Department.
Step I: All property owners and taxpayers within three hundred (300) feet of
the property, all additional contiguous ownership and any easement providing
access across other properties shall be notified by the proponent. Utilizing
a list of property owners and taxpayers obtained from the Planning Oepartment
or a Title lCompany and copies of the Agenda Notification prepared by the Planning
Department, the applicant shall accomplish notification by mailing the a9enda
notification by first class mail as directed by the Planning Oepartment staff.
Step 2: The applicant shall provide the mailing list, Affidavit of Mailing and
all returned mailings to the Planning Oepartment at least two (Z) days prior
to the public hearing for inclusion in the file.
