A.rterial Road Plan: The Arterial Road Plan designates Dishman-Mica Road as a
1'rincipal Arterial with a proposed 100 foot right of way. The existxng 60 foot right
of way is inadequate. To unplemer.t the Plan 20 feet of additional dedication and or
Futuxe Acquisition Area is required.
, The primary function of Principal Arterials is to move tra.ff'ic. An excessive nu.mber
of direct access points along a 1'nncipal Arterial can impede high speed traffic flow
and create multiple safety hazards. This proposal may require chaiinelization of
- traffic to allow safe acceleration, deceleration, and turning movements.
County Parks: There are two neighborhood parks located within 1-1 1/2 miles of
the proposed zone reclassification. Castle Park, at 33rd Avenue and University Road
is maintained but undeveloped. Browns Park, located at 30th Avenue and Pines
Road, offers a ball field, volleyball courts, and play equipment.
The proposed development does offer the amenity of the private Painted Hills Golf
Cowrse to serve as open space and recrearion for xesidents of the proposed town
houses.

the Aquifer Sensitive Area Overlay Zone
To the NORTH: Urban Residential-3.5 (LTR-3.5) established in 1991.
To the SOtJTH: Urban Residential-3.5 (UR-3.5) established in 1991.
To the EAST: Urban Residential-3.5 (UR-3.5) established in 1991.
To the WEST: Light Industrial (I-2) established i.n 1991.
The Urban Residential-3.5 (UR-3.5) zoning to the north, east and south was
Agricultural (1967) priox to the January 1, 1991 implementation of the Spokane
County Zoni.ng Code. West of the site across Dishman Mica Road, the Light
Zndustrial(Y-2) parcels werc zoned Restricted Industrial (1970).
A Conditional Use Perm.it was approved for the Painted Hills Golf course in 1985
(CUE-26-83) and was required under the previous Agricultural zoning. A golf
cowrse is a permitted use within the existing Urban Residential-3.5 (UR-3.5) zone
classificarion. A review of the Conditional Use file reveals that the proposed rezone
would not affect the original cond.itions of approval for the goLf course.

The proposed rezone is part of a larger contiguous ownership consisting of a private
golf course and must comply with subdivision laws if a sale of this project is
anticipated. North of the golf course is a single farruly development lrnown as
Midilome. A one acre residential development known as Tomlin's Addition is also
north and adjacent of the golf course ownership.

Located to the southeast of the golf course is a single family residential development
known as Myron Estates. .
The Industrial use located to the west oF the site, across Dishman Mica Road, consists
of a vacant automotive repair shop.
An active railroad right of way and the Chester land fill are visible from the site to the
west.

Proposed Buffering Techniaue~: The proposed site plan shows 5 feet of Type I
Z..andscaping along the property frontage with Dishman Mica Road and 16 feet of
Type N Landscaping within the 16 foot Future Acquisition Asea. A 5 foot hugh
fence is shovvn along the new property line frontage with Dishman Micd Road.

1'he site plan indicates a total of 52 parking spaces. Two for each garage, two
stacked in each driveway, and four guest spaces. Stacked parking spaces do not
qualify in the total calculation. The actual total of 28 spaces is more than adequate
under the Code standards.
C)ther Site Plan Consideration~: The property is located within a flood plain.
Compliance with applicable regulations will be required prior to release of building
permits.

The site plan submitted for review by the Hearing Exanuner Committee is
generat in nature. Detailed review to detemiine compliance with all Ordinance
regulations and conditions of approval is recommended to be admirv.strative and
to occur at the Build.ing Pernut stage.
ZII. SITE DEVELOPMENT RECOIVZMENUATIONS
- Density: The pxoposed density is consistent with the Urban Residentia1-7 (UR-7)
zone request.
- Design: The owner/applicant i.s proposing two buildings each with six attached
townhouse units. Each unit has approximately a 2;000 square foot footprint and
includes a two car garage. Zt is assumed that residents would take advantage of the
private golf course adjacent to the site. There would be a slight hazard associated
with waywaxd golf balls.
The Planning Department recomnzends that the landscaping and fence shown along
Dishman Mica be moved to meet Code standards. The proposed fence shall be
setback five feet from the 16 foot Future Acquisition Area. The Type N Landscaping
shown may be located withiLn ttie 16 foot Future Acquisition A.rea. The 5 foot Type Z
Landscaping shall be within the 5 foot fence setback.
Buffering/Landseaping: The proposed site pxan does not show the xequued
buffering and landscaping for adjacent properties. A six foot high sight obscuring
buffer shall be provided along the north, east and south perimeter of the proposed
rezone. Zn addition to the requued buffer the Code requires an additional 5 feet of
_ Type IQ landscaping along the properties boundaries listed above. The Department
zecommends thafi review of t11e lan dscaping/buffering requisements be admuustrative
and accamphshed upon review of the building pernut.
Sagnage: The development of this site shall comply with the signage standards of
Section 14.804.0$4. One wall sign not to exceed 20 square feet or one detached sign

not to exceed 15 square feet pex face, 10 feet in height, or six feet in width is
pemv.tted.
Circulation/Access: Access to the site is provided by one 24 foot and one 30 foot
wide drive. Tzavelways shown are 24 feet wide which is adequate for two way
travel.
Stormwater Drainage: Compliance with "208" stormwater regulations is
required. Sewage Disposal: The applicant/owner stated in his environmental checklist that the proposed use would hookup to the Spokane County Sewer System. This has not
been coordinated through the Utiliries Department. The applicant/owner shall comply
with all wastewater/sewage disposal regulations.
VYater Supply: VVater service will be provided by Spokane County Water District
No. 3. Adequate water shall be provided by the owner prior to construction
Fire Proteetion: The proposal is located in Fire District No. 1 and sha.ll comply
with all Fire Distnct requirements.
Schools: The site is located in the Central Valley School District No. 356.
Iv. SEPA ENVIRONMENTAL RE'VXEW
An Environmental Checklist was submitted by the sponsor and was reviewed by tle
County Planning Deparmnent. 'X'he review considered the specifics of the proposal,
other ava.ilable information, County ord.inances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other County,policies and guidelines. The Planning Department has determined that "No
probable signif'icant adverse impacts" would result firom the proposal being developed _
and has issued a Detennination of Nonsipificance ("DNS").
The "DNS" was circulated to 8 other agencies of jurisdiction and other
agencies/departments affected by the future development for xevi.ew and comment.
The "DNS" comment period ends June 18, 1991 and was advertised 15 calendar days
before said date in the newspaper, by letter to adjacent property owners within 400
feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing
Examiner may consider additional environxnental related testimony at the public
hearing.
V . PLANNING DEPARTMENT SUMMARY
Golf~ing is increasing in popularity both nationally and locally. The proposal is
focussed towards golfing as added ownership along with town house living. Some
major impz-ovements such as sewer connections need to be accomplished before a
builcling perma.t is issued. Minor issues such as setbacks, fencing, and landscaping .
can be resolved during buflding permit review. The Department recommends
approval as conditioned.

VI. CONDITIONS UF APPROVAL
i. All Conditions imposed by the Hearing Examiner Committee shall
' be binding on the "Applicant," which term shaIl include the owner
or owners of the property, heirs, assigns, and successors.
ii. The, Zone Reclassification applies to the following real property:
Commencing at the intersection of the easterly right of way line of Dishman
Mica Road C.P.H. No. 53 and the South line of the Southeast Quarter of
Section 33, Township 25 North, Range 44 East, W.M in Spokane County,
Washington lying S 89° 1524" W, 1085.65 feet from the Southeast corner of
said quarter; thence Northwesterly along said right of way line on a curve
whose center lies S 75° 04' 36" W, 1138.95 feet, Central Angle = 17° 32' 37",
a d.istance of 348.74 feet; thence N 32° 28' O1" W, along said right of way line,
135.00 feet to the point of beginning of this description, thence continuing
along said right of way line, N 32° 28' 0 1" W, 600.00 feet; thence N 57° 31'
59" E, 160.00 feet; thence S 32° 28' O1." E, 600.00 feet; thence S 57° 31' S9"
W, 160.00 feet to said point of beginning.
EXCEPT the Westerly 4.00 feet for additional right of way for said Dishman
Mica Road and containing 2.15 acres.
SPOKANE COUNTX PLANNING DEPARTMENT
1. . The proposal shall comply with the Urban Residential-7 (UR-7) zones as amended.
2. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building pezmits.
3. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
4. The Spokane County Planning Department shall prepare and record with the
Counry Auditor a Title Noace specifyulg a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or i.n part, by the Planning Department. The notice should be
recorded within the same time fra.me as a.n appeal and shall provide the following:
a. At least 16 feet of xeserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly ded.icated right-of-way along
Dishman Ivlica lZoad. NOTE: The County Engineer has required 4 feet of
new dedication.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisitaon area for road right-of-way and

utiilties. If any of tne above unprovements are made within this area, they
shall be relacated at the appiicant's expense when zoadway improvements are
made.
d. T'he future acquisirion area, until acquirecl, shall be private property and may

landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
5. The Planning Department sha.ll prepare and record with the Spokane County
Auditoz a Title Notice noting that the property in question is subject to a vanety of -
special conditions imposed as a result of approval o:f a land use action. Th1s Title
Notice shall serve as, public notice of the conditions of approval affecting the
property in question. The Title Noece should be recorded within the same tune
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Departnlent. The Title Notice shall generally provide as follows:

6. A specific landscape plan, planting schedule and provisi.ons for maintenance
acceptable to the Planning Director/designee sha11 be submitted with a performance
bond for the project prior to release of building perrrzits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impau-ed.
7. This parcel shall not be further subdivided unless consistent with RCW 58.17, the '
various county subdivision regulations and the Spokane County Comprehensive
Plan for the axea.

The applicant is the owner of a golf course which is located immediately to the south
of the proposed plat. The golf course is located within a 100-year flood zone. A
requirement for the issuance of a Conditional Use Permit for the golf course was that
the applicant had to complete a study of the impact of cutting and filling activity on
the golf course upon the flood zone. As of this date the study has not been finalized.
Before the applicant can undertake a flood zone study for the proposed plat it will
be necessary for the flood zone study for the golf course to be completed. The flood
zone study for the golf course will serve as a base line from which the flood zone
study for the plat can be developed.

Senske said in a telephone conversation that he might need to fill the lots along 40th
to obtain building sites out of the 100 year flood zone. B. Sims reported that the
building site elevation is 2007. (Her note at bottom of the memo says the 2007 is the
100-year flood elevation and that the lowest floors would have to be one foot above
that.)

impervious surfaces or fill
- applicant shall provide for in-kind replacement of flood plain absorption area
with currently above the 100-year Chester Creek Flood zone. This
replacement shall be equal to 100% of the area to be raised above the 100-
year flood plain for this proposal. The area purchased above the 100-year
flood plain shall be graded so as to allow the property to be within the 100-
year flood plain.

Summary
From the files relating to the preliminary plat of Painted Hills Fairway and the RE-zone for
the condominiums on the west side of the golf course, it appears that:
- the flood elevation on the property changed from 2007 (our best data in 1988) to 2009
(our best data today). This change will mean more of the property is within the flood zone
than we anticipated in 1988.
- to be consistent with our current flood zone regulations for the Chester Creek area, we
should refer to the conditions that went with the recent zone change.

nonsignificance to construct 12 apartment units proposed by Painted Hills Golf
Course, Inc. (ZE-18-91). We reviewed the environmental checklist and have the
following comments.
Proper disposal of construction debris should be on land in such a manner that
debris cannot enter the stream channel or cause water quality degradation of
state waters.
Proper erosion and sediment control practices should be used on the
construction site and adjacent areas to prevent upland sediments from entering
the stream channel. All areas disturbed or newly created by construction
activities should be seeded, riprapped with clean, durable riprap, or given
some other equivalent type of protection against erosion.

Purpose of Checklist•
The State Environmental Policy Act (SEPA) chapter 43 21C RCW, requires all governmental agencies to consider
the environmental impacts of a proposal before making decisions. An Environmental Impact Statement (EIS)
must be prepared for all proposals with probable significant adverse impacts on the quality of the environment.
The purpose of this chECklist is to provide information to help you and the agency identify impacts from your
proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide
whether an EIS is required.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about your proposal. Governmental
agencies use this checklist to determine whether the Environmental impacts of your proposal are significant,
requiring preparation of an EIS. Answer the questions brietly, with the most precise information known, or give
the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should
be able to answer the questions from your own observations or proJect plans without the need to hire experts. If

Purpose of Checklist:
The State Environmental Policy Act (SEPA) chapter 43.21C RCW, requires all governmental agencies to consider
the environmental impacts of a proposal before making decisions. An Environmental Impact Statement (EIS)
must be prepared for all proposals with probable significant adverse impacts on the quality of the environment.
The purpose of this checklist is to provide information to help you and the agency identify impacts from your
proposal (and to reduce or avoid unpacts from the proposal, if it can be done) and to help the agency decide
whether an EIS is required.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about your proposal. Governmental
agencies use this checklist to determine whether the environmental impacts of your proposal are significant,
requinng preparation of an EIS. Answer the questions bnefly, with the most precise information known, or give
the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should
be able to answer the questions from your own observations or proJect plans without the need to hire experts. If
you really do not know the answer, or if a question does not apply to your proposal, write "do not know" or "does t
not apply " Complete answers to the questions now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations.
