PLANNING DEPARTMENT REPORT TO: SPOKANE COUNTY HEARING EXAMINER COMMITTEE FROM: CURRENT PLANNING SECTION DATE: JULY 22, 1993 SUBJECT: ZE-21-93; ZONE RECLASSIFICATION FROM URBAN RESIDENTIAL-3.5 (UR-3.5) TO REGIONAL BUSINESS (B-3) WITHIN THE AQUIFER SENSITIVE AREA (ASA) OVERLAY ZONE. I. GENERAL INFORMATION Applicant: Sylvia Riddle S. 4120 Dishman Mica Road Spokane, WA 99206 (509) 926-6217 Contact Planner: Stacy Bjordahl Location: Generally located south of and adjacent to Dishman Mica Road, approximately 100 feet northwest of the intersection of Bowd.ish Road and Dishman Mica Road, in the SW 1/4 of Section 33, Township 25 North, Range 44 EWM, Spokane County, Washington. Proposal: Zone Reclassification from Urban Residential-3.5 (UR-3.5) to Regional Business (B-3) for a Contractor's yard, off-ice, and those uses allowed in the Regional Business (B-3) zone. II. SITE INFORMATION A. Site Size: Approximately 38,400 square feet B. Comprehensive Plan 1. Land Use Plan: The property is located within the Urban category of the Comprehensive Plan and within the Priority Sewer Service Area (PSSA). The Urban category is lntended to provide the opportunity for development of a"city-like" environment which includes various land uses with the more intensive land uses located near the heavily travelled streets. Commerclal uses are intended to be lunited and of a"neighborhood" character. The proposed Regional Business (B-3) zone is intended to implement the Major Commercial category of the Comprehensive Plan. The Regional Business (B-3) zone and those uses allowed are not compatible with the intent of the Urban category of the Comprehensive Plan. 7/'93 HEC Staff Report for ZE-21-93 Page 50 . '1 2. Arterial Road Plan: The Spokane County Artenal Road Plan idennfies Dishman Mica Road as a Principal Arterial with an existing right-of-way width of 60 feet and a future right-of-way width of 100 feet. In order to implement the Plan, the County Engineer is requesting 4 feet of dedication along Dishman Mica Road and that a strip of property 16 feet in width be set aside as Future Acquisition Area (FAA). C. Site Characteristics: The site is currently vacant and undeveloped with grasses, weeds and other ground coverings. The site is generally flat with a descending slope toward the southern portion of the parcel and the railroad right -of-way which runs along the southern property boundary. D. Neighborhood Characteristics: The area surrounding the proposal consists of existing commercial uses including a feed store, contractors office, and retafl store/gas starion. A warehouse and other commercial uses also exist. A manufactured home owned by the applicant is located on the parcel adjacent to the west. Plouf Creek also runs south of the property. E. Zoning Analysis: Most recent zone reclassif'ication requests in the area have been for residential development and not commercial use. The most recent commercial zoning in the area was from Local Business (LB) to Commercial (C) in 1982 (ZE-36-82C) and is located east of the proposal . Pursuant to the program to implement the Zoning Code in 1991, the Commercial zoning was redesignated to Regional Business (B-3). The existing Neighborhood Business (B-1) zoning adjacent to the proposal on the east was established in 1977 as Local Business (LB) and prior to the adoption of the Comprehensive Plan in 1981 which designated the area for Urban development. The exisring Regional Business (B- 3) zoning located north of the proposal was previously classified as Commercial (C) zoning in 1952 and redesignated to Regional Business (B-3) pursuant to the program to implement the zoning code in 1991. Although the proposed Regional Business (B-3) zoning may be compatible with existing Regional Business (B-3) zoning north and east of the proposal, those areas are underutilized for a Regional Business (B-3) classification. The exisring zoning classifications in the area could provide neighborhood facilities to the area without additional Regional Business (B-3) zoning. Proposal: Reclassify land presently zoned Urban Residential-3.5 (UR-3.5) established in 1991 to Regional Business (B-3). North: Regional Business (B-3) established in 1991, previously classif'ied as Commercial (C) (ZE-79-52). South: Urban Residential-3.5 (UR-3.5) established in 1991, previously classified as Agricultural (A) (ZE-12-67). West: Urban Residential-3.5 (UR-3.5) established in 1991, previously classified as Agricultural (A) (ZE-12-67). East: Neighborhood Business (B-1) established in 1991, previously classified as Local Business (LB) (ZE-105-77C). 7/°93 HEC Staff Report for ZE-21-93 Page 51 ~ The Regional Business (B-3) zone is intended to implement the Major Commercial category of the Comprehensive Plan. The proposed zoning and those uses permitted in the Regional Business (B-3) zone would not be considered compatible with the Urban category. Approval of Regional Business (B-3) zoning could establish precedent for conversion of residential uses to commercial activities and potential land use conflicts could occur. F. Land Use Analysis: The proposal is within the community of Chester which includes residenrial uses and established commercial uses to serve the area. Commercial uses are located along the north and south side of Dishman Mica Road. Most residential use is located in areas further north or south from Dishman Mica Road, although some existing single family residences and a manufactured home are located along Dishman Mica. Site: Vacant and undeveloped. North: Reta.il and commercial uses. South: Railroad right-of-way. Ea.st: Feed store and commercial uses. West: Manufactured home and vacant land. G. Circulation: Dishman Mica Road will provide direct access to the site. The site plan submitted illustrates two access points to the property. Parking areas and travel ways will be paved. H. Design: The site pIan submitted illustrates one rectangular structure of approximately 3,000 square feet. Thirteen parking spaces are shown which exceeds the minimum required for the proposed use. The proposed locarion of the building meets all applicable setbacks. A storage area will be located adjacent to the proposed structure and enclosed within a sight obscuring fence. Landscaping is also i.llustrated on the site plan along the Dishman Mica frontage and the west and south property lines. The site plan is in general conformance with development standards of the proposed Regional Business (B-3) zone. 1. Site Plan Data Proposed Site Pian: Use: Contractor's Off'ice/Yard. This will include five (5) feet of Type III landscaping along Dishman Mica Road and twenty (20) feet of Type I landscaping along the west and south property lines to provide a buffer to adjacent land uses. Strict compliance with the requirements of the Zoning Code would result in approxirnately 24 % of the site area being landscaped. Chapter 14.808; Modification of Landscaping Requirements, allows the Planning Department to reduce required landscaping when application of such requirements would result in more than 15 % of the site area being landscaped. Accordingly, the following landscaping requirements are recommended by the Planning Department to be most beneficial to the public while maintaining the purpose of the Zoning Code requirements. The recommendations are also based on the adjacent land uses and lot configuration.
