EMACIO, Deputy Prosecuting Attorney = SPOKANE COUNTY ENG1PlEER + Date: JUNE 28, 1990 Re: MIDLAND INSURANCE MATTER In 1979, the Board of County Commissioners approved the final plat of Gerald Subdivision; The plat consisted of the subdivision of 1.79 acres into three (3) lots for residential office use. A condition of the plat approval was the obligation of the applicant to improve 12th Avenue and Pines Road along the perimeter of the project. Subsequent to the approval of the plat, the applicant, Gerald E. Kofinehl, obtained a road improvement bond in the amount of $6,600 guarantying the road improvements. The bond was with Midland Insurance Company of New York. Subsequent to the approval of the project, an adjoining property owner, Tidyman's, developed a parcel of property on Pines Avenue, also abutting 12th Avenue. On their own, and realizing that they had no legal obligation to do so, they completed Mr. Kofinehl's road improvements on 12th Avenue. Sometime subsequent to the 12th Avenue road improvement completion, Gerald Kofinehl went bankrupt and discharged his personal obligation to complete the road improvements in the bankruptcy proceeding. In 1981, Spokane County commenced a lawsuit against Midland Insurance Company to collect the $6,600 and ho e ly pay that money to Tidyman' s . - Subsequent to the comme ement ,erof the lawsuit in 1981, Midland Insurance Company filed for bankruptcy. Spokane Gounty filed a claim in the bankruptcy pxaceeding and has been advised that there is little likelihood of any recovery. Midland Insurance Company's assets and obligations were subsequently acquired by Allied Fidelity Insurance Campany. Al1ied Fidelity Insurance Campany subsequently filed for bankruptcy, also. Upon learning this, Spokane County filed a claim in the bankruptcy proceeding. Ihave been advised by Betty Seipel that there is little if any likelihoQd of any recavery by Spokane County as to our claim f iled. Mareover, the bankruptcy stay is still pending. As a result of the abQve information, and the fact that this matter has been pending for 9 years, I do not believe it is in the public's interests to continue the legal praeeeding when whatever recQVery we can obtain fram Midland via Allied Fiaelity Insurance Company will be obtained as a result of the claim which has been filed in this matter under carrespondence dated March 31, 1989, sent by certified mail. The f ile daes ref lect that an agpropriate motian and order tv strike the elerk's mationfar dismissal in 1990 was pregared and approved by attorney Pat Dawney. Hawever, the order was never entered as a result of the above information. Since the original "MFS" zoning, Pines Road has developed into one of the Spokane Valley's major commercial areas. In 1981, the Comprehensive Plan recognized this change and classified this area as "Major Commercial." Other properties in the vicinity have been reclassified into the "Business" zones. 2.
