County policies and guideluies The Plannuig Department has determuned that "No
probable significant adverse unpacts" would result from the proposal beuig developed
and has issued a Detemunation of Nonsienificance ("DNS")
The "DNS" was cuculated to 10 other agencies of junsdicaon and other
agencies/departments affected by the future development for review and comment
The "DNS" comment penod ends September 17, 1991 and was advernsed 15
calendar days before said date in the newspaper, by letter to adjacent property owners
wnthin 400 feet of the proposal, and by noace on a sign posted on the proposal site

(UR-3 5) and will be properly buffered from the proposed commercial use with 20
feet of Type I Landscaping as requued by the Zoning Code

Avenue, east of and adjacent to Pines Road and south of and adjacent to 12th Avenue
in Section 22, Township 25 N, Range 44 EWM, Spokane County, Washington
2 The committee adopts the Planni.ng Department Report as a part of this record

change and classified this area as "Major
Commercial " Other properties in the vicinity have
been reclassified into the "Business" zones

proposed project meets all appropriate development
use standards to minimize adverse impacts to adjacent
land uses This praject also implements the goals
and objectives in the "Major Commerclal" catagory
of the Comprehensive Plan including buffering and
spatial separation from adjacent land-use catagories,
aesthetic development meeting standards for
landscaping, signage, and architectural treatment,
conformance with plans, policies, and regulations
of the County water, sewer, storm sewer, and utility
districts, adequate on-site areas for required
parking, and conformance with other listed Decision

Re: MIDLAND INSURANCE MATTER
In 1979, the Board of County Commissioners approved the final plat of
Gerald Subdivision; The plat consisted of the subdivision of 1.79
acres into three (3) lots for residential office use.
A condition of the plat approval was the obligation of the applicant
to improve 12th Avenue and Pines Road along the perimeter of the
project.
Subsequent to the approval of the plat, the applicant, Gerald E.
Kofinehl, obtained a road improvement bond in the amount of $6,600
guarantying the road improvements. The bond was with Midland
Insurance Company of New York.
Subsequent to the approval of the project, an adjoining property
owner, Tidyman's, developed a parcel of property on Pines Avenue,
also abutting 12th Avenue. On their own, and realizing that they had
no legal obligation to do so, they completed Mr. Kofinehl's road
improvements on 12th Avenue.
Sometime subsequent to the 12th Avenue road improvement completion,
Gerald Kofinehl went bankrupt and discharged his personal obligation
to complete the road improvements in the bankruptcy proceeding. In
1981, Spokane County commenced a lawsuit against Midland Insurance
Company to collect the $6,600 and ho e ly pay that money to
Tidyman' s . -
Subsequent to the comme ement ,erof the lawsuit in 1981, Midland
Insurance Company filed for bankruptcy. In conjunctioQn with the

bankruptcy application, the bankruptcy court issued a stay arder
precluding the County proceeding in its lawsuit. Spokane Gounty
filed a claim in the bankruptcy pxaceeding and has been advised that
there is little likelihood of any recovery.
Midland Insurance Company's assets and obligations were subsequently
acquired by Allied Fidelity Insurance Campany. Al1ied Fidelity
Insurance Campany subsequently filed for bankruptcy, also. Upon
learning this, Spokane County filed a claim in the bankruptcy
proceeding. Ihave been advised by Betty Seipel that there is little
if any likelihoQd of any recavery by Spokane County as to our claim
f iled. Mareover, the bankruptcy stay is still pending.
As a result of the abQve information, and the fact that this matter
has been pending for 9 years, I do not believe it is in the public's
interests to continue the legal praeeeding when whatever recQVery we
can obtain fram Midland via Allied Fiaelity Insurance Company will be
obtained as a result of the claim which has been filed in this matter
under carrespondence dated March 31, 1989, sent by certified mail.
The f ile daes ref lect that an agpropriate motian and order tv strike
the elerk's mationfar dismissal in 1990 was pregared and approved by
attorney Pat Dawney. Hawever, the order was never entered as a
result of the above information.

subsequently designated "UR-22" with the adoption
of the current zoning code Since the original
"MFS" zoning, Pines Road has developed into one
of the Spokane Valley's ma3or commercial areas
In 1981, the Comprehensive Plan recognized this
change and classified this area as "Major
Commercial " Other properties in the vicinity have
been reclassified into the "Business" zones
2 The infrastructure (utilities, roadways, curbs,
sidewalks, public services) for commercial use of
the sub3ect property is generally in place The
proposed project meets all appropriate development
use standards to minimize adverse impacts to ad3acent
land uses This pro3ect also implements the goals
and objectives in the "Ma3or Commercial" catagory
of the Comprehensive Plan including buffering and
spatial separation from ad3acent land-use catagories,
aesthetic development meeting standards for
landscaping, signage, and architectural treatment,
conformance with plans, policies, and regulations
of the County water, sewer, storm sewer, and utility
districts, adequate on-site areas for required
parking, and conformance with other listed Decision
Guidelines described in the Comprehensive Plan

1. The site was originally zoned "MFS" in 1977 and
subsequently designated "UR-22" with the adoption
of the current zoning code. Since the original
"MFS" zoning, Pines Road has developed into one
of the Spokane Valley's major commercial areas.
In 1981, the Comprehensive Plan recognized this
change and classified this area as "Major
Commercial." Other properties in the vicinity have
been reclassified into the "Business" zones.
2. The infrastructure (utilities, roadways, curbs,
sidewalks, public services) for commercial use of
the subject property is generally in place. The
proposed project meets all appropriate development
use standards to minimize adverse impacts to adjacent
land uses. This project also implements the goals
and objectives in the "Major Commercial" catagory
of the Comprehensive Plan including: buffering and
spatial separation from adjacent land-use catagories;
aesthetic development meeting standards for
landscaping, signage, and architectural treatment;
conformance with plans, policies, and regulations
of the County water, sewer, storm sewer, and utility
districts; adequate on-site areas for required
parking; and conformance with other listed Decision
Guidelines described in the Comprehensive Plan.
