F4 G - 1995 BEFORE THE BOARD OF COUNTY COMMI5SIONERS V"7E8#4r OF SPOKANE COUNTY, WASHINGTON IN THE MA.TTER OF ZE-20-93, REVISION TO ) REVISED USES ALLOWED IN PREVIOUS ZONE ) FINDINGS OF FACT, RECLASSIFICATION FROM NEIGHBORHOOD ) DECISION AND BUSINESS (B-1) TO REGIONAL BUSINESS (B-3) ) CONDITIONS APPLICANT: JOHN STONE THIS MATTER, being the consideration by the Board of County Commissioners of Spokane County, hereinafter refened to as the "Board", of a revision of the conditions imposed by the Board in its previous rezone decision of October 4, 1994, in Zone Reclassification File No. ZE-20-93, for the purpose of expanding the limited number of uses allowed within the Regional Business (B-3) zone category on approximately 4.15 acres of land, hereinafter referred to as the "Proposal"; and the Board of County Commissioners having held a public hearing on the proposal on June 27, 1995 and having fully considered all testimony presented, the documents subnutted and the public record files; and the Board further having individually visited or being familiar with the site and vicinity in question, and having rendered an oral decision on the 27th day of June, 1995, approving said proposal with modifications, does hereby enter the following: FINDINGS OF FACT 1. The proposal is generally located at the northeast corner of 12th Avenue and Pines Road in the southwest 1/4 of Section 22, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. The proposal consists of a request to modify the revised Findings of Fact, Decision and Conditions for ZE-20-93 entered by the Board on October 4, 1994. The revision would add general wholesale sales/ distribution to the following list of uses within the Regional Business (B-3) zone pernutted on the site: Animal clinic/veterinary, large and small animals; antique store; appareUtailor shop; appliance sales/service; bowling alley; entertainment/recreation facilities (bingo hall, dance hall, skating rink, etc.), (N.E.C.); exercise facility/spa; food locker; furniture sales/repair; nursery/greenhouse, retaiUwholesale; pet shop; radiofI'V salesiservice; rental shop; repair shop for power equipment; restaurant, alcoholic; self service storage facility; specialized trainingllearning schools or studios (dance, gymnastics, martial arts, etc.) (N.E.C.); theater, indoor; trade school; upholstery shop. 3. The Board held a public hearing on the proposal on June 27, 1995, and entered an oral decision to approve the proposal on the same date. 4. There was no opposition expressed at the June 27, 1995 public hearing to the requested revision to the Board's October 4, 1994 decision. 5. The Board takes notice of the provisions of the Spokane County Generalized Comprehensive Plan, the Spokane County Zoning Code and the Spokane County Code. 6. The Board adopts the public record files of the Planning Department and of the Board for ZE-20-93 as part of the record. 7. The legal requirements for public notice for the public hearing have been fulfilled. 8. The Spokane County Comprehensive Plan designates the area encompassed by the proposal as Major Commercial. 9. The provisioas of RCW 43.21C (The State Environmental Policy Act) have been complied with and the Board finds that the DeternZination of NonSignificance (DNS) issued for the original proposal remains applicable. . ~ BOCC FINDINGS ZE-20-93 Page 2 10. The applicant has demonstrated that conditions have substantially changed since the original zoning of the property to justify revising the Board's previous decision to allow general wholesale sales/distribution on the site. 11. The proposal as modified and conditioned bears a substantial relationship to the public health, safety, and general welfare. DECISION The Board hereby approves the applicant's request to revise the Board's revised Findings of Fact, Decision and Conditions adopted on October 4, 1994 in Zone Reclassification ZE-20-93, in accordance with the conditions and restrictions listed below. IN REFERENCE TO THE AT[LGFED FINDINGS AND ORDER, THE BOARD OF COUNTY COMMISSIONERS ADOPTS THE FOLLOWING CONDTTIONS OF APPROVAL ATT_ACHED HERETO:, SPOKANE COUNTY PLANNING DEPARTMENT 1. All conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant", which terms shall include the owner or owners of the property, heirs, assigns and successors. 2. The zone reclassification applies to the following real properiy: Parcel "A" : The North 120 feet of the South 210 feet of the North half of Tract 214 of OPPORTUNITY, as per plat thereof recorded in Volume "K" of Plats, page 20; EXCEPT the East 230 feet thereof; AND EXCEPT that portion deeded to the State of Washington under Auditors File No. 8504160087; Situate in the County of Spokane, State of Washington. Parcel "B": The south 90 feet of the West 275 feet of the North half of Tract 214 of OPPORTUNII'Y, as per plat thereof recorded in Volume "K" of Plats, page 20; AND the South 90 feet of the North half EXCEPT the East 230 feet; AND EXCEPT the West 275 feet of Tract 214 of OPPORTIJNITY; EXCEPT that portion deeded to the State of Washington under Auditor's File No. 8504160084; Situate in the Caunty of Spokane, State of Washington. Parcel "C" : The West 300 feet of the south half of Tract 214 of OPPORTUNTTY, as per plat thereof recorded in Volume "K" of Plats, page 20; EXCEPT 12th Avenue as d.isclosed in Deeds recorded under Auditor's file Nos. 7901030250 and 8309270232; AND EXCEPT that portion deeded to the State of Washington under Auditor's File No. 8504010043; Situate in the County of Spokane, State of Washington. 3. The proposal shall comply with the proposed Regional Business (B-3) and Aquifer Sensitive Area Overlay zone(s) as amended. 4. Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any building permits. 5. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 6. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 7. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title r ` BOCC FINDINGS ZE-20-93 Page 3 Notice shall serve as public notice of the cond.itions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. The Title Notice shall generally provide as follows: The parcel of property legally described as [ ] is the subject of a land use action by a Spokane County Hearing Body or Administrative Official on [ imposing a variety of special development conditions. File No. [ ] is available for inspection and copying in the Spokane County Planning Department. 8. If the site is developed for mini-storage, outdoor storage shall not be pernutted prior to construction of the proposed mini storage buildings or other improvements to adequately screen the site. 9. Development of the site shall be expressly limited to the following Regional Business (13-3) uses: Animal clinic/veterinary, large and small animals; antique store; appareUtailor shop; appliance sales✓service; bowling alley; entertainmentJrecreation facilities (bingo hall, dance hall, skating rink, etc.), (N.E.C.); exercise facility/spa; food locker; furniture sales/repair; nursery/greenhouse, retaiUwholesale; pet shop; radiolTV sales/service; rental shop; repair shop for power equipment; restaurant, alcoholic; self service storage facility; specialized training/learning schools or studios (dance, gymnastics, martial arts, etc.) (N.E.C.); theater, indoor; trade school; upholstery shop and general wholesale sales/distribution. 10. Development of the site shall be in substantial conformance to the site plan of record submitted by the owner at the June 27, 1995 public hearing. 11. If the site is developed for a self service storage facility, a 15 foot height limitation is required for all outside storage. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior To Issuance Of A Building Permit Or Use Of The Propertv As Provosed: 1. Access pernuts for new approaches to the County Road System shall be obtained from the County Engineer. 2. Access permits and improvements to Pines Road must be approved by the Washington State Department of Transportation (WSDOT). 3. Applicant shall submit for approval by the Spokane County Engineer drainage and access plans. 4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard engineering practices. Paving or surfacing as approved by the County Engineer will be required for any portion of the project which is to be occupied or traveled by vehicles. 5. The construction of the roadway improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 6. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable county standards and✓or adopted resolutions pertaining to road standards and stormwater management in effect at the date of construction, unless otherwise approved by the County Engineer. 7. The applicant shall construct a paved and delineated approach to meet the e3cisting pavement on 12th Avenue. 8. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. 9. No construction work shall be performed within the existing or proposed public right-of-way until a permit has been issued by the County Engineer. All work i • ~ r BOCC FINDINGS ZE-20-93 Page 4 within the public road right-of-way is subject to inspection and approval by the County Engineer. 10. There may exist utilities, either underground or overhead, affecting the subject property, includ.ing property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utilities. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to deternune whether applicant(s) or the utility is responsible for adjusbnent or relocation costs and to make arrangements for any necessary work. 11. Development is subject to approval of access to State Route 27 and adjacent county roads respectively, by the Washington Department of Transportation and the County Engineer. SPOKANE COUNTY DIVISION OF UTILITIES 1. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 2. Applicant shall make connection to public sewer system. Sewer connection permit is required. Plans and specifications are to be reviewed and approved by the Utilities Department. SPOKANE COUNTY HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by ihe Regional Engineer (Spokane), State Department of Health. 4. A public sewer system will be made available for the project and individual service will be provided to the lot prior to sale. Use of individual on-site sewage d.isposal systems shall not be authorized. 5. Use of private wells and water systems is prohibited SPOKANE COUNTY DIVISION OF BUILDINGS 1. The applicant shall contact the Division of Buildings at the earliest possible stage in order to be informed of code requirements administeredlenforced as authorized by the State Buildings Code Act. Design/development concerns include: fue apparatus access roads; fire hydrant/flow; approved water systems; building accessibiliry; construction type; occupancy classification; exiting; exterior wall protection; and energy code regulations. WASHINGTON STATE DEPARTMENT OF TRANSPORTATION 1. Direct Access to SR-27 (Pines Road) requires that the applicant obtain the needed WSDOT road approach permit for the intended property use. In this case the road approach permit(s) must be updated to reflect this mini-storage operation. Contact Janet Jordan at 625-5144 regarding road approach permits. 2. Due to the traffic generation potential associated with some of the uses allowed in a B-3 zone, WSDOT requires that the applicant route any further site plans through WSDOT for review and comment. This is to insure that adequate access is available to SR-27 for the projected traffic volumes this site could generate. It should also be noted that this again will require that road approach pernZit to be updated to reflect the intended property usage. Depending on the trip generation of this new use, WSDOT reserves the right to require the developer to construct the necessary mitigating measures. 3. WSDOT requires that signs fronting SR-27 be set back a sufficient distance so that no part of the sign extends out into WSDOT right-of-way. I r ' ' BOCC FINDINGS ZE-20-93 Page 5 SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related activities. 3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. Measures must be taken to avoid the deposition of d.irt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. Debris generated as a result of this project must be d.isposed of by means other than burning (i.e construction waste, etc.) 6. Demolition and renovation projects must comply with the requirements of CFR 40, Part 61, Subpart M and SCAPCA Regulation I, Article IX. Intent to Demolish forms are available at the SCAPCA office. 7. The Washington State Department of Transportation (WSDOT) has the following comments: Due to the implementation of Access Management, the access points into this site from SR 27 will need to be brought into conformance. Please be advised, the access management laws state only one access per property, unless it can be shown that additional access will not have adverse impacts to the highway. In addition, all access points must meet the minimum spacing criteria of 125 feet, including neighboring accesses. In order to evaluate this site, WSDOT will need to see an estimated trip gener-ation and traffic distribution. With this information, we will be better able to determine reasonable access to the highway for the applicant. As a part of this evaluation, the applicant will be required to apply for and obtain a valid WSDOT road approach per-r7iit for this site. The proposal is generally located at the northeast corner of 12th Avenue and Pines Road in the southwest 1/4 of Section 22, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. The proposal consists of a request to revise the written decision for ZE-20-93 entered by the Board on November 23, 1993. The revision would allow Regional Business (B-3) zoning of the site for a health club or indoor theater, with variation of the approved site development plan for the following uses subject to future administrative review by the Planning Department: Animal clinic/veterinary, large and small animals; antique store; apparel/tailor shop; appliance sales/service; bowling alley; entertainmenUrecreaaon facilities (bingo hall, dance hall, skating rink, etc.), (N.E.C.); exercise facility/spa; food locker; furniture sales/repair; n u rsery/green house, retail/wholesale; pet shop; radioiI'V sales/service; rental shop; repair shop for power equipment; restaurant, alcoholic; self service storage facility; specialized training/learning schools or studios (dance, gymnastics, martial arts, etc.) (N.E.C.); theater, indoor; trade school; upholstery shop. 3. The Hearing Examiner Committee held a public hearing on July 22, 1993 subsequent to which by the Findings of Fact, Conclusion and Decision dated July 22, 1993 the Committee approved a zone reclassification from Neighborhood Business (B- I) to Regiona! Business (B-3) for mini-storage and those uses allowed in the Regional Business (B-3) zone. 4. Maurice Cauchon, a property owner in the area, filed an appeal of the Hearing Examiner Committee's decision to the Board of County Commissioners on August 2, 1993, and listed the following as a basis for the appeal of the decision: a. The property is ideal for a grocery store. b. A storage facility would become an eyesore and decrease the property values of the neighborhood. 5. On Septecnber 14, 1993, the Board held a de novo public hearing on the appeal of the Hearing Examiner Committee's decision. Commissioner Mummey did not attend the fiearing or participate in ihe decision. 6. The Hearing Examiner Committee's decision comprised only a recommendaaon to ~ the Board regarding the approval sought by the applicant. The oral tesdmony submitted to the Hearing Ex-timiner Committee on the rezone proposal before the • , . ~ . BOCC FINDINGS ZE-2(}-93 Page 2 Hearing Examiner Committee was not part of the record before the Board and was not considered by the Board. 7. On November 23, 1993, by written decision, the Board denied the appeal of the Hearing Examiner Committee's decision and approved the rezone with certain restr-iccions and conditions in addition to those recommended by the Hearing Examiner Committee. In its decision, the Board expressly limited development of the site to a mini storage facility and requireti additional landscaping and fencing. The Board further required that the restrictions and conditions imposed by the Board be secured with a contract rezone agreement. 8. The Board cakes notice of the provisions of the Spokane County Generalized Comprehensive Plan, the Spokane County Zoning Code and the Spokane County Code. 9. The Board adopts the public record files of the Planning Department and of the Board for ZE-20-93 as part of the record. 10. The legal requirements for public notice have been fulfilled. 11. The Spokane County Comprehensive Plan designates the area encampassed by the proposal as Major Commercial. 12. The original zoning of the site under the Spokane County Zoning Ordinance was Local Busiriess, which was redesignated to Neighborhood Business (13-1) under the Spokane County Zoning Code effective January 1, 1991, pursuant to the Program to Irnplement the Spokane County Zoning Code. 13. State Route 27 (Pines Road) bc;tween Sprague Avenue and 16th Avenue is a developing commerc;ial corridor characterized by small retail and office facilities intermixed with some apartment complexes and a few single family residences. This corridor abuts primarily single farnily residential neighborhoods on both sides, and single family residential neighborhoods predominate south of 16th Avenue. 14. The proposal is consistent with the intent of the Major Commerciai Category of the Comprehensive Plan to provide the opportunity for development of commercial uses directly related to major throughways. However, not all uses allowed in the Regional Business (B-3) zone are appropriate for the site, due to the character of the surrounding residentiaf neighborhood, the mixed zoning in the area, and the relatively truncated length of the commercial corridor before it terminates at 16th Avenue. 15. There was no opposition expressed at the June 14, 1994 public hearing to the requested revision to the Board's previous decision. 16. The provisions of RCW 43.21C (The State Environmenta] Policy Act) have been complied with and a Determination of Nonsignificance was issued. The Board concurs with the Determination of Nonsignificance (DNS). 17. The applicaclt has demonstrated that conditions have substantially changed since the original zoning of the property. 18. The proposal as modified and conditioned bears a substantial relationship to the public health, safety, and gener:il welfare. DECISION The Board hereby approves the applicant's request to revise the Board's November 23, 1993 written decision in Zone Rec;lassification ZE-20-93, in accordance with the conditions and restrictions listed below. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shaU be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4, A public sewer system will be made available for the project and individual service will be provided to the lot prior to sale. Use of individual on-site sewage disposal systems shall not be authorized. 5. Use of private wells and water systems is prohibited SPOKANE CUUNTY DIVISION ()F BUILDINGS 1. The applicant shall contact the Division of Buildings at the earliest possible stage in order to be informed of code requirements ad mini stered/en forced as authorized by the State Buildings Code Act. Design/development concerns include: fire apparatus access roads; fire hydrantlflow; approved water systems; building accessibility; construction type; occupancy classification; exiting; exterior wall protecdon; and energy code regulations. WASHINGT()N STATE DEPARTMENT UF TRANSPORTATION 1. Direct Access to SR-27 (Pines Road) requires that the applicant obtain the needed WSDOT road approach permit for the intended property use. In this case the road approach pernlit(s) must be updated to reflect this mini-storage operation. Contact .ianet Jordan at 625-5144 regarding road approach permits. 2. Due to the traffic generation potential associated with some of the uses allowed in a B-3 zone, WSDOT requires that the applicant route any further site plans through WSDOT for review and comment. This is to insure that adequate access is available to SR-27 for the projected traffic volumes this site could generate. It should also be noted that this again will require that road approach pemiit to be updated to reflect the intended property usage. Depending on the trip generation of this new use, WSDOT reserves the right to require the developer to construct the necessary micigating measures. 3. WSDOT requires that signs fronting SR-27 be set back a sufficient distance so that no part of the sign extends out into WSDOT right-of-way. SPOKANE COUNTY AIR POLLUTI()N CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be con[rolled. This may require use of water sprays, tarps, Sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other con struc ti on -related activities. 3.
