1995, which was continued from the regularly scheduled Heanng Examiner
Committee meetmg on October 19, 1995 The members of the Committee present
are Michael Schrader Chair, Verana Southern and John Roskelley
PROPOSAL
The sponsor, Deany Christenson and Associates, requests approval of a 2one
Reclassificatian, ZE-38-95, from Urban Residential-22 (UR-22) and Urban
Residential-3 5(UR-3 5) to Community Business (B-2) for an existing off ce and
those uses allowed in fhe Community Business (B-2) zone
FINDINGS OF FACT A►ND CONCLUSIOitIS
1 The property rs generally located at the northeast comer of the intersection of Pines
Road (SR-27) and 8th Avenue in the NW 1/4 of Section 22, Township 25 Narth,
Range 44 EWM, Spokane County, Washingtan
2 The Committee adopts the Planrung Departinent Report as a part of tlus record
3 The exYStang land uses in the area include a vanety of commercial office and multi
family uses
4 The proposed use is compatible with existing uses in the axea
5 The proposal is located wrtlun the Nlajor Commerclal category of the Comprehensive
Plan The Major Commercial category is intended to provide the opporturuty for
development of eommercial uses duec[Iy related to major throughways Highway and
artenal strip cammercial areas will usually be made up of businesses or individual
parcels clustered along a heaVily traveled street or highway, each providing off-street
parking
The Major Commercial category is u►tended to be unplemented by the Commuruty
Business (B-2) and Regional Business (B-3) zones The proposed zone
reclassification from Urban Residential-22 (UR-22) and Urban Residential-3 5
(UR-3 5) is consrstent with and implements the Goals Objectives and Decision
Gwdelr.nes of the Major Commercial category of the Comprehensive Plan
6 The proposed zorung does implement and canform to the Comprehensive Plan
7 The site is adjacent to Pines Road (SR-27) and 8th Avenue The 5pokane County
Arterial Road Plan identifies Pines Road as a state highway vwned by the Washington ,
State Department of Transportation (WSDOT) and Sth Avenue as a Minor Arterial with

a future right of way width of 80 feet In order to implement the Plan the County
Engineer has required dedication of seven feet af addrtionai nght of way along $th
Avenue and that a stnp of property eight feet in width along 8th Avenue be set aside as
a Future Acquisrtion Area
8 The existing zoiung of the property described in the apphcation is Urban
Residential-22 (UR-22) and Urban Residential-3 5(UR-3 5) established in 1991,
previously classified as Residential Office (R4) (ZE-19o-77C) and Agricultural
Suburban (AS) (ZE-171-55) respectively and redesignated to Urban Residential-22
(UR-22) and Urban Residential-3 5(UR-3 5) on January 1 1991 pursuant to the
Program to Implement the Spokane County Zoning Code The proposal does
conform to the reqturements of the proposed zone, however the final site plan will
requue modification to meet the development standards of the zone ~
9 The provisions af RCW 43 21C (The State Environmental Policy Act) have been
complied with and a Deterrrunation of I`+donsignificance (DNS) was issued The
Committee after rndependent review hereby adopts the DNS
10 The legal requirements for public notice haVe been fulfilled
11 The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use
12 The apphcant has demanstrated that conditions have substantially ehanged since the
original zonmg of ttus area and accordingly, the proposed zone reclassification 1s
justified Specifically, changed conditions include growth in the Spokane Valley
and progressive develapment of Pines Road far commercial uses
13 The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in hght of the conditions recommended by the reviewing
agencies

DIVISION OF BUILDgNG ANI) PLANNING CONDI'TIONS
1 The proposal shall comply with the Community Business (B-2) and Aquifer
Sensitive Area (ASA) Overlay Zones as amended
2 The apphcant shall develop subject property generally in accordance witlun the
concept presented to the Hearing Body Variations when approved by the
Planning Duector/designee may be permitted, including but not limited to building
location, landscape plans and general allowable uses of the perrrvtted zone All
vanations must conform to regulations set forth in the Spokane County Zoning
Code, and the onginal intent of the development plans shall be maintalned
3 A specific landscape plan planting schedule and provisions for maintenance
acceptable to the Building and Planning Director/designee shall be subrrutted with a
performance bond for the project prior to release of building pernuts Landscaping
shall be installed and ma.intained so that sight distance at access points is not
obscured or impaired
4 Direct light from any exterior area llghting fixture shall not extend over the property
boundary
5 The Building and Planning Division shall prepare and record with the Spokane
County Auditor a Title Notice noting that the property in question is subject to a
vanety of special conditions imposed as a result of approval of a land use action
This Title Notice shall serve as public notice of the conditions of approval affecting
the property in question The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released in full or in part by the

recorded witlun the same time frame as an appeal and sball provide the following

8th Avenue NOTE The County Engineer has required 7 feet of new

shall be relocated at the apphcant s expense when roadway improvements are

d The future acquisition area until acquired, shall be pnvate property and may
be used as allowed in the zone, except that any improvements (such as
landscaping parking, surface drainage, drainfield, signs or others) shall be
considered interim uses
e The property owner shall be responsible for relocating such interim
improvements at the time Spokane County makes roadway improvements
after acquiring said future acquisition area
8 The apphcant shall contact the Department of Buildings at the earhest possible stage in
order to be informed of code requirements administered/enforced as authonzed by the
State Building Code Act Design/development concerns include Addressing fire
apparatus access roads fire hydrant/flow, approved water systems, building
accessibilrty, construction type, occupancy classification, exiting extenor wall
protection and energy code regulations (Note The Department of Buildings reserves

3 Access permits and improvements to Pines Road must be approved by the
Waslungton State Department of Transportation (WSDOT)
4 The applicant shall subrrut for approval by the Spokane County Engineer road
drainage and access plans
5 The applicant shall subnut for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project, or portion thereof, if the
development is to be phased
6 A parlcing plan and traffic circulation plan shall be subrrutted and approved by the
Spokane County Engineer The design, location and arrangement of parlcing stalls
shall be in accordance with standard traffic engineenng practices Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles
7 The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
8 The Counry Engineer has designated a rrunor artenal roadway section for the
improvement of Eighth Avenue which is adjacent to the proposed development
Tlus will require the addition of approximately 18 to 20 feet of asphalt along the
frontage of the development The construction of curbing and sidewalk is also
required
9 All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction unless otherwise
approved by the County Engineer
10 Roadway standards rypical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No 95 0498 as
amended and are apphcable to tlus proposal
11 No construction work shall be performed witYun the existing or proposed public
right-of-way until a pernvt has been issued by the County Engineer All work
withln the public road right-of-way is subject to inspection and approval by the
County Engineer
12 All required construction within the existing or proposed public right-of-way is to
be completed pnor to the release of a building perrrut, or a bond in an amount

Spokane County assumes no financial obligation for adjustments or relocation

purveyor and the Spokane County Engineer to determine whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work
15 The applicant shall grant applicable border easements adjacent to Spokane County

and exeavation projects be controlled This may requue use of water sprays tarps
sprinklers or suspension of activrty during certa.in weather conditions Haul roads
should be treated, and enussions from the transfer of earthen matenal must be
controlled, as well as enussions from all other construction-related activities
3 SCAPCA strongly recommends that aIl traveled surfaces (ingress egress parlcing
areas access roads) be paved and kept clean
4 Measures must be taken to avoid the deposition of dut and mud from unpaved
surfaces onto paved surfaces If traclang or spills occur on paved surfaces,
measures must be taken unmediately to clean these surfaces
5 SCA►PCA Regulatian I, Article, V requues that a Notice of Construction and
Apphcation for Approval be subrrutted to and approved by aur Ageney pnor ta the
constructian, installation or establishment of atr pollution source This includes any
fuel fired equipment rated at greater than 440,000 BTU/hour (boilers, hot water
heaters, ovens, etc ) It also includes paint booths and other sources of au
contaminants
6 Debris generated as a result of this project must be disposed of by means ather than
burning (i e construction waste, etc)
7 Demolition and renovation projects must comply with the requirements of CFR 40,
Part 61 Subpart M and of SCAPCA Regulation I Artlcle IX bath of which address
asbestos abatement issues Intent to Demolish and Renovate forms ,are available at
the SCAPCA office

The following "Conditions of Approval" for the above referenced zone change
are submitted to the Spokane County Hearing Examiner Committee for inclusion
in the "Planning Report" and "Findings and Order" of the public hearing
scheduled October 19, 1995
E36A Prior to issuance of a building permit or at the request of the County Engineer in
conjunction with a County Road Project/Road Improvement District whichever comes
first
E39 Applicant shall dedicate 7 feet on Eighth Avenue and the applicable radius on Eighth

the northern portion of the site which wdl include 2 stones and a total floor area
of 27,300 square feet
The site plan fatls to adequately provide for parking for the proposed btulding on
the north portion of the site and a btulding of dus size could not be constructed
given the minunum requuements for parking and landscaping Any future
builciuig will be requued to meet the development standards of the Commuruty
Business (B-2) zone and those development standards will require a substantial
reduction m the size of the future bLUlding compared to that dlustrated on the site
