I. GENERAL INFORMATION

Location: Generally located south of and adjacent to Dishman Niica Road, west
of and adjacent to Hatherly Cucle, and approxunately 150 feet east of the intersection of
Bowdish Road and Dishman IV&ca Road in Section 33, Township 25 North, Range 44
EWM, Spokane County, Wastungton
Proposal: Zone reclassification from Urban Residential-7 (UR-7) to Regional
Business (B-3) for an existing beauty salon and those uses allowed in the Regional
Business (B-3) zone
History The apphcant received a Home Profession Pernut (HPE-10-93) in 1993
to operate a beauty shop on the site. A Home Profession is defined as "a profession or
craft camed on witlun a residence by the occupants, which activity is clearly incidental
to the use of said residence as a dwelluig and does not change the residential character of
the dwelling or neighborhood, and is conducted Ln such a manner as to not give any
outward appearance of a business in the ordinary meaning of the term " Home
professions are requued to comply with specific cntena to qualify for a home profession
pernut
II. SITE INFORMATION
A. Site Size: Approximately 6,500 square feet
B. Comprehensive Plan
1. Land Use Plan The property is located within the Urban category of the
Comprehensive Plan, the Prionty Sewer Service Area (PSSA), and the Aquifer
Sensitive Area (ASA) Overlay zone The Urban category is intended to provide
for a"citylike" envuonment with primanly intensive residential development

Major commercial uses are considered noncompatible within the Urban
category
The proposed rezone to Regional Business (B-3) is not consistent with the
Comprehensive Plan. The detailed definition for the Urban category specifically
identifies major commercial uses as noncompatible. The Regional Business
(B-3) zone is the most intensive commercial zone and is used to unplement the
Major Commercial category of the Comprehensive Plan.
2. Arterial Road Plan: The site is adjacent to Dishman 1Vhca Road wluch is
identified as a Principal Arterial with a future nght of way width of 100 feet. In
order to unplement the Arterial Road Plan, the County Engineer has requested
that a stnp of property 20 feet in width along Dishman Mica Road be set aside
as a Future Acquisition Area (FAA)
C. Site Characteristics The site is a relatively flat residential lot with an existing
home that is currently being used as a beauty salon. A gravel lot to the north and east
of the house provides parking
D. Neighborhood Characteristics The site is located in a manufactured home
subdivision with 341ots Other uses in the area include some commercial uses
adjacent to Dishman Niica Road and single fa.rruly residential neighborhoods
E . Zoning Analysis
Proposal Urban Residential-7 (UR-7) estabhshed in 1991, previously
designated as Residential Manufactured Home (RMH) (95-70)
North Urban Residential-3 5(UR-3 5) established in 1991, previously
established as Agncultural (A) (12-67).
South Urban Residential-7 (UR-7) established in 1991, previously
designated as Residential Manufactured Home (RMH) (95-70)
East: Urban Residential-7 (UR-7) established in 1991, previously
designated as Residential Manufactured Home (RMH) (95-70).
West Regional Business (B-3) established in 1991, previously zoned
Commercial (C) (36-82C)
Zorung witlun the viciruty of the intersection of Bowdish Road and Dishman Mica
Road has included past approvals for business uses Pnor to Spokane County
adopting the Comprehensive Plan in 1980, three commercial rezones had been
approved In 1952 an area at the northwest corner of Bowdish and Dishman 1Vhca
was rezoned from Agncultural to Commercial (ZE-79-52) In 1967 the area duectly
west of the proposal was rezoned from Agncultural to Local Business, and in 1977
the area at the southwest corner of Bowdish and Dishman Mica was rezoned from
Agncultural to Local Business (ZE-105-77C).
Since the adoption of Spokane County's Comprehensive Plan, two additional
business zones have been approved The Local Business zone directly east of the
proposal was rezoned to Commercial (ZE-36-82C) in 1982, and an area south of
Dishman Mica and£tst of Bowdish Road was rezoned from Urban Residential-3 5

to Regional Business (ZE-21-93C) in 1993. See the attached zoning map for current
zone designations which were implemented with the adoption of the Spokane Counry
Zoning Code in 1991.

III. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
staadard Conditions of Approval, the Generalized Comprehensive Plan, and other
County pohcies and guideli.nes. The Planning Department has determined that "No
probable significant adverse unpacts" would result from the proposal being developed
and has issued a Determination of Nonsignificance ("DNS").
The "DNS" was cuculated to 13 other agencies of junsdiction and other agencies/
departments affected by the future development for review and comment. The "DNS"
comment penod ends September 19, 1995 and was advert.ised 15 calendar days before
said date in the newspaper, by letter to adjacent properiy owners within 400 feet of the
proposal, and by notrce on a sign posted on the proposal site. The Hearing Exarruner may
consider addstional envuonmental related testunony at the public heanng.
IV. DIVISION OF BUILDING AND PLANNING DEPARTMENT SUMMARY
The proposed Zone Reclassification from Urban Residential-7 (UR-7) to Regional
Business (B-3) is not consistent with the Urban category of the Spokane Counry
Comprehensive Plan. The Plan states that major commercial uses are noncompatible in
Urban category. In add.ition to being inconsistent with the Comprehensive Plan, the site
lacks adequate land area to comply with many of the development standards of the Regional
Business (B-3) zone and is located ln a flood hazard area which poses sigruficant obstacles
to development for commercial purposes. The potential for stnp commercial development
along the Dishman Mica corndor would increase with approval of add.iuonal commercial
use zones
V . CONDITIONS OF APPROVAL
i. All conditions imposed by the Hearing Examiner Committee shall be
binding on the "Applicant", which terms shall include the owner or

INTRODUCTION
This matter has come before the Hearing Exanuner Comrruttee on September 21,
1995. The members of the Committee present are Donald Moore, Chair, Brenda
Bodenstein and Frank Yuse
PROPOSAL
The sponsor, Pamela Ayers, requests approval of a Zone Reclassification,
ZE-30-95, from Urban Residential-7 (UR-7) to Regional Business (B-3) for an
existing beauty salon and those uses allowed in the Regional Business (B-3) zone.
FINDINGS OF FACT AND CONCLUSIONS
1 The property is generally located south of and adjacent to Dishman 1VIica Road,
west of and adjacent to Hatherly Circle, and approxinately 150 feet east of the
intersection of Bowdish Road and Dishman 1Vhca Road in Section 33, Township 25
North, Range 44 EWM, Spokane County, Washington.
2 The Comrruttee adopts the Planning Department Report as a part of tlus record
3 The existing land uses in the area include commercial businesses adjacent to
Dishman 1Vbca Road, vacant land, and single family residential uses.
4 The proposed use is not compatible with exlsting uses in the area
5 The property is located within the Urban category of the Comprehensive Plan, the

Members of the Board,
You may recall that I, Dwight Hume, represent Pam Ayers
regarding [he above matter. She has FAXED me the three documents
pertaining to this request. (Oral Decision #95-1263, 11-14-95 Ady
Letter, and the Dempsey letter of 11-22-95 to Pam Ayers). From my
review of these documents I offer the following comments andlor
suggestions on her behaIf as requested in the Dempsey letter.

Please correct the 6th line wherein it states: "....Urban
Residential - 22 Zone,..." This should be Regional Business Zone B-3.
(It is my understanding that this may already be corrected).
2) 11-14-95 Ady t er
Your record is clear that they were given proper legal notice in
a timely manner. Pam has confirmed that aIl other adjacent owners
received their notice as well. Exactly why they were not in
attendance is beyond me. But thirty other people took the time to
come down on election niaht ir1 tiie snow and inclement weather to
support the rerone.
T'he second paragraph complains about the fact that
they,(Ady's) had to comply with the flood insurance program when it I
appears my client will not have to. They simply weren't at the
second hearing to learn what my client had done to overcome the
concerns of the Hearings Examiner Committees reasons for denial. In
other words, since the first hearing, she retained the services of a
land use planning consultant and a civil engineer to demonstrate how
the site could comply with the applicabie regulations affecting this
site. In fact, Commissioner Harris asked Chuck Simpson to affirm on

the record that the drainage issue could be engineered to an
approvable design. (Which he affirmed could be done). Accordingly,
a new site plan was approved and modifications to the previous
conditions of approval are being drafted to reflect the new site plan.
With regard to their suggestion that the site be conditioned to
limit the use within the B-3 zone to that of a beauty salon and
nothing else, I submit the following comment. The site was
advertised as a beauty salon or any other uses of the B-3 zone. T h e
site size and configuration will limit the use of the site to very few
other uses. Consequently, I do not see a purpose in making Pam pay
for, (and wait for) a public hearing just to have rights and privileges
the Ady's enjoy outright. Let the site constraints dictate the use.
From all of our prior dealings with these people, it is clear they do
not want competition. But what can compete on our 7000 sf of dirt
that would hurt their business? Who else in the neighborhood has a
concern for "other uses" permitted in the B-3 zone? That's what was
advertised and still, no one came in opposition. Had Ady's been there,
they would have been the only ones to complain. The other 30
attending were in favor.
I can only conclude that the Ady's are unaware of the revised
site plan, unaware of the engineering research regarding flooding,
unaware of the amended access to the site, unaware of the parking
requirements and solutions and unaware of the 244 signatures in
favor and the numerous neighbors and friends who cared enough to
spend their evening on Pam's behalf to support this rezone, for this
and all other allowed uses of the B-3 zone.
Let the record stand and deny the request for reconsideration.
No new evidence can possibly be generated that would alter the
Boards decision.
3) Dempsev tetter of 11-22-95
Pursuant to this letter we are responding to the request for
reconsideration as stated above and as follows: The last paragraph of
page 1 of said letter suggest that the Board amend the Division of
Building and Planning Condition #2 to strictly limit the use of the site

to a beauty salon unless reviewed by the public hearing process. As
stated above, this is unjustifiable and inequitable to the rights and
privileges allowed the Ady's on their B-3 site. Contrary to the "Oral
Decision" intent, the application was advertised for more than this
use and we testified that the site size and other constraints will
severely limit other uses anyway. We simply don't foresee any use
that will both, fit and be intense enough to generate any public
concerns. Remember, we only have 7000 sf. of dirt, (before
dedications).
Since numerous amendments were approved in the site plan
and the staff conditions for access andlor improvements to roads, we
see a need for careful review and rewording of the conditions of
approval. These revisions could be written per the following, with
the "revised language" in italics.
SPOK:ANE COUNTY DIVISION OF BUILDING AND PLASJNING
2. The applicant shall develop subject property generally in
accordance with the revised site plan of record presented to the
Board of County Cornmissioners. Variations, when approved by the
Planning Director/designee, may be permitted, including but not
limited to building location, Iandscape plans and general allowable
uses of the permitted zone. All variations must conform to
regulations set forth in the Spokane County Zone Code.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS (REVISED
PER 9/18/95 MEMO).
Note: Review these conections with Scot Engelhard for his
concurrence.
1) Access per the revised site plan of record will be permitted on
Dishmara Mica Rd.. Access to Hatherly Court is optional though not
shown on the revised site plan of record. If access is proposed,
improvements to Hatherly Court as described ira Cortdition #7 below
may be deferred and completed as a subsequent RID uraless the use
or intensity of use changes in which case, improvements wall be
required prior to the change of intensity or use.
In conclusion, I would suggest that the request for
reconsideration be denied; that the Findings and Order be prepared

successor(s) in interest hereby request and authorize Spokane County to include the
above described property in a Road Improvement District (RID) and to support the
formation of a Road Improvement District for improvement of the road(s) described below
by requesting and authorizing Spokane County to place their name(s) on a petition for
the formation of a Road Improvement District pursuant to RCW 36.88 050, or by
requesting and autborizing Spokane County to cast their ballot in favor of a RID being
formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a
protest against the 'Lormation of a RID being formed under the alternative resolution
method provided for in RCW 36 88.065 and Chapter 35 43 RCW
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor (s) further agree. (1) that the improvements or construction contemplated
hithin the proposed RID are feasible and (2) that the benefits to be derived from the
formation of the RID by the property included therein, together with the amount of any
County participation, exceeds the cost and expense of formation of the RID, and (3)
that the property within the proposed RID is sufficiently developed, provided,
themselves, their heirs, grantees, assigns and successor(s) shall retain the right, as
authorized under RCW 36.88 090, to object to any assessment(s) on the property as a
result of the improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36 88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll; provided further, it is recognized that actual assessments may vary
from assessment estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the property
It is further acknowledged and agreed that at such time as a RID is created or any
County Road Improvement pr03ect is authorized by Spokane County, the improvements
required shall be at the sole expense of the owner(s) of property within the RID or
served by the improvements without any monetary participation by Spokane County
The RID waiver contained in this agreement shall expire after ten (10) years from the
date of execution below This provision is applicable to Dishman-Mica Road
E61 The County Arterial Road plan identifies Dishman Mica Road as a 100 foot Principal
Arterial The existing right of way width of 60 feet is not consistent with that
specified in The Plan. In order to implement the Arterial Road Plan it is recommended
that a strip of property 20 in width along the Dishman Mica Road frontage be set aside
in reserve. This property may be acquired by Spokane County at the time when Arterial
Improvements are made to Dishman Mica Road.

The following "Conditions of Approval" for the above referenced zone change
are submitted to the Spokane County Hearing Examiner Committee for inclusion
in the "Planning Report" and "Findings and Order" of the public hearing
scheduled September 21, 1995.
Prior to release of a building permit or use of property as proposed:
E40 Access permits for approaches to the County Road System shall be obtained from the
County Engineer.
E43 Applicant shall submit for approval by the Spokane County Engineer road, drainage and
access plans.
E44 The applicant shall submit for approval by the Spokane County Engineer and the Spokane
County Health District a detailed combined on-site sewage system plan and surface water
disposal plan for the entire project or portion thereof if the development is phased
E45 A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls shall

to operate a beaury shop on the site. A Home Profession is defined as "a profession or
craft carried on witlun a residence by the occupants, which activity is clearly lncidental
to the use of said residence as a dwelling and does not change the residential character of
the dwelling or neighborhood, and is conducted in such a manner as to not give any
outward appearance of a business in the ordinary meaning of the term." Home
professions are required to comply wrth specific cntena to qualify for a home profession
pernut. -

Zoning within the vicuuty of the intersection of Bowdish Road and Dishman Mlca
Road has included past approvals for business uses. Pnor to Spokane County
adopting the Comprehensive Plan in 1980, three commercial rezones had been
approved In 1952 an area at the northwest corner of Bowdish and Dishman Niica
was rezoned from Agncultural to Commercial (ZE-79-52) In 1967 the area directly
west of the proposal was rezoned from Agncultural to Loca1 Business, and in 1977
the azea at the southwest corner of Bowdish and Dishman Niica was rezoned from
Agricultural to Local Business (ZE-105-77C).
Since the adoption of Spokane County's Comprehensive Plan, two additional
business zones have been approved. The Local Business zone directly east of the
proposal was rezoned to Commercial (ZE-36-82C) in 1982, and an area south of
Dishman 1Vbca and East of Bowdish Road was rezoned from Urban Residential-3.5

area Commercial uses are located along the north and south side of Dishman Mica
Road. Most residential use is located in areas further north or south from Dishman
Niica Road, although some existing single family residences and a manufactured
home are located along Dishman N11ca.

An Environmental Checkllst was subnutted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines The Planning Department has deternuned that "No
probable significant adverse impacts" would result from the proposal being developed
and has issued a Deternunation of Nonsigruficance ("DNS")
The "DNS" was cuculated to 13 other agencies of junsdiction and other agencies/
departments affected by the future development for review and comment. The "DNS"
comment period ends September 19, 1995 and was advertised 15 calendar days before
said date in the newspaper, by letter to adjacent property owners within 400 feet of the

I V. DIVISION OF BUILDING AND PLANNING DEPARTMENT SUMMARY

SUBJECT: ZONE CHANGE CONDITIONS # ZE-XX-95 / AYERS PAMELA S
The following "Conditions of Approval" for the above referenced zone change
are submitted to the Spokane County Planning Department for inclusion in the
Design Review Meeting scheduled August 9, 1995.
Prior to release of a building permit or use of property as proposed:
E40 Access permits•for approaches to the County Road System shall be obtained from the
County Engineer
E43 Applicant shall sunmit for approval by the Spokane County Engineer road, drainage
and access plans.
E44 The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan and
surface water disposal plan for the entire pro3ect or portion thereof if the
development is phased
E45 A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard engineering practices Paving or surfacing as
approved by the County Engineer will be required for any portion of the pro3ect
which is to be occupied or traveled by vehicles
E48 The construction of the roadway improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
E50 The County Engineer has designated a Principal Arterial Roadway Section for the
improvement of Dishman Mica Road which is ad3acent to the proposed development This
will require th~e addition of approximately 12-14 feet of asphalt along the frontage
of the development. Curbing and sidewalk must also be constructed.
E50 The County Engineer has designated a Local Access Roadway Section for the
improvement of Hatherly Court which is ad3acent to the proposed development This
will require the addition of approximately 27 feet of asphalt along the frontage of
the development. Curbing, gutter and sidewalk and sidewalk on one side must also be
constructed
E51 All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bridge construction and other applicable county
standards and/or adopted resolutions pertaining pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
E55 Roadway standards, typical roadway sections and drainage plan requirements are found
in Spokane Board of County Commissioners resolution 95-0498 as amended and are
appla.cable to this proposal.
E57 That the regulations of the National Flood Insurance Program be observed since the
proposed development is affected by a flood hazard zone. A development permit shall
be obtained from the County Engineer before construction or development begins
within any area.of the special flood hazard zone (reference Spokane County Ordinance
80-0726)
E58 No construction work is to be performed within the existing or proposed right of way
until a permit has been issued by the County Engineer All work within the public
road right of way is sub3ect to inspection and approval by the County Engineer
E59 All required construction within the existing or proposed public right of way is to
be completed prior to the release of a building permit or a bond in an amount
estimated by the County Engineer to cover the cost of construction or improvements

shall be filed with the County Engineer.
E61 The County Arterial Road plan identifies Dishman Mica Road as a 100 foot Principal
Arterial. The existing right of way width of 60 feet is not consistent with that
specified in The Plan. In order to implement the Arterial Road Plan it is
recommended that in addition to the required right of way dedication, a strip of
property 20 in width along the Dishman Mica Road frontage be set aside in reserve
This property may be acquired by Spokane County at the time when Arterial
Improvements are made to Dishman Mica Road.
E90 The applicant qhould be advised that there may exist utilities either underground
or overhead affecting the applicants property, including property to be dedicated
or set aside future acquisition Spokane County will assume no financial obligation
for adjustments or relocation regarding these utilities. The applicant should check
with the applicable utilities and Spokane County Engineer to determine whether the
applicant or utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
SPECIAL CONDITION. The applicant shall grant applicable border easements adjacent to Spokane
County Right of Way per Spokane County Standards.
SPECIAL CONDITION: The applicant shall provide documentation though a flood study that no
more than 5t of the site shall contain imprvious surface and that the commercial
structure shall be floodproof.
