HE Findinas, Conclusians and Decision ZE-3 6-96 Page 1 / ~ Environmental Review: A Determination of Nonsignificance was issued on October 17, 1996 by the Division of Building and Planning. Site Description: The site is approximately 1.82 acres in size, and relatively flat. The property is rectangular-shaped, being 165 feet wide along Fourth Avenue and 480 feet long from north to south. The site is vegetated with native grasses and weeds. The net density of the proposal, after the dedication of right of way is 1.78 acres. Surrounding Conditions: The site fronts along the north side of Fourth Avenue, and is situated about 300 feet west of Evergreen Road and four blocks south of Spragve Avenue. Fourth Avenue is designated as a 70 foot wide Collector Arterial on the Spokane County Arterial Road Plan, and Evergreen Road and Sprague Avenue are designated as Principal Arterials. McDonald Road, located about half a mile west of the site, is designated as a Minor Arterial. Evergreen Road south of Sprague Avenue is a two-lane road, and Fourth Avenue is a two-lane road with an existing right of way width of 40 feet. A new freeway interchange is being planned at Evergreen Road and Interstate 90, to facilitate access to a new regional shopping mall that is currently under construction north of Interstate 90. Spokane County has plans to widen Evergreen Road from Interstate 90 south to Sprague Avenue within the next few years. Approximately 100 feet south of the site is an abandoned railroad right of way that has been dedicated to Spokane County. The right of way extends east and west parallel to Sprague Avenue for a considerable distance, midway between Fourth Avenue and Sprague Avenue. Spokane County has installed a public sewer interceptor in the abandoned right of way, and is considering a long range plan to extend a new east-west traf~ic arterial in such right of way. South of Sprague Avenue, the right of way provides the dividing line between a) the Major Commercial category of the Comprehensive Plan and commercial uses to the north, and b) the Urban category and residential uses to the south. Land uses in the vicinity consist primarily of single-family residences, with some vacant land located immediately east, west and north of the site. Between the site and Evergreen Road, at the northwest corner of Evergreen Road and Fourth Avenue, is a vacant 3.75 acre parcel zoned Urban Residential-22 (UR-22). Development of such parcel is contingent on the submittal of a detailed site plan for review and approval at a public hearing before the County Hearing Examiner, pursuant to the conditions of approval of the 1981 rezone of such parcel for multifamily development (Division of Building and Planning File No. ZE-88-80). The vacant land located immediately north and west of the site is zoned Urban Residential-3.5 (UR-3.5). Further west along the north side of Fourth Avenue, and along the south side of Fourth Avenue west of Evergreen Road, the land is developed with single-family residences on land zoned UR-3.5. The area south of Fourth Avenue is dominated by single-family residences on land zoned UR-3.5. In December, 1995) the Spokane County Zoning Adjustor approved a conditional use pernut for a home industry (dance studio) on a single-family lot located along the south side of Fourth Avenue, approximately 100 feet west of the site (Division of Building and Planning File No. CUE-22-95). Mamer Road, between Fourth Avenue and Fifth Avenue, was vacated a number of years ago. Keystone Elementary School is found at the southwest corner of McDonald Road and HE Findings, Conclusions and Decision ZE-36-96 Page 2 . Fourth Avenue and multi-fa.mily housing is found along the west side of McDonald Road immediately north of Fourth Avenue Intensive commercial development is found along Sprague Avenue to the north with commercial uses and Reglonat Business (B-3) zoning typically extending south from Sprague Avenue to the abandoned raalroad nght Qf way A relatively new Target retail store is found at the southwest corner of Evergreen and Sprague Avenue, and a new Safeway store and other retail uses are found at the southeast corner of such artenals The nearest County park is located about a rrule south of the site near Evergreen Road and 24~' Avenue Project T3escription The site plan dated August 6 1996 dlustrates two buildings onented north and south along the west border of the site contairung a total of 44 multiple-family unrts Space for 40 garages placed pnmanly along the east border of the site, 10 spaces for recreational vehicles along the north border and 32 spaces for cars along the east side of the proposed burldings are also shown A single access to Fourth Avenue is tndicated at the sautheast corner of the site Required landscaping is shown along the north south and west borders vf the site and required fenctng is indicated along the north and west borders The County Division of Building and Planrung has recommended that the height of the buildings on the site be limlted to 3 5 feet The site will be served by pubilc sewer and the applicant must subrrut a dra.inage plan far approval by County Engineenng The applicant is requesting one unit of bonus density in zone reclassification must comply with the cntena for amending the Official County Zoning Code Map particularly paragraphs (1) and (2) of Spokane County Zoning Code Section 14 402 020, and the requirements established under Washulgton case law for the approval of rezones The proposal must also satisfy the requirements of the Urban Residential-22 (UR-22) zone, other related provisions of the condomuruum buildings along with some nerghborhood cornmercial light mdustnal uses, and public and recreational facilities The Urban category allows a vast range of residentlal densities from one unit per acre to 17 units per acre The category promotes the concept that single-fa.mily uses will be isolated from the noise and heavy traffic while the more intensive uses such as light industnal and neighborhood commercial will be located near the heavily traveled streets Multifanuly uses will usually be a transitional use located between single-family residential and #he more intensive uses of the Urban category There are four residential zoning classifications which implement the Urban category The least intensive is the current zorung designatron for the site UR-3 5 It allows densrties of 3 5 units per acre the typical density for single-family residential subdivision in the area The applicant seeks a zone reclassification to the UR-22 zone which allows a densrty of 22 uruts per acre even more than the 17 units per acre generally provided for in the Urban category The Urban category however, indicates that the base net density for multifamily dwellings areas may be increased through bonus options" or "bonus densities' within developed areas where utilities artenals, schools, and community facilities have a.lready been estabhshed Urban category, Decision Guideline 1 12 Zoning Code Chapter 14 820 authonzes "bonus densities' for muttifamily housing in excess of 22 uruts per acre in the UR-22 zone, under certain HE Findings Conclusions and Decision ZE-36-96 Page 5 ~ circumstances and conditions Besides multifamily development the UR-22 category also allows office uses and other uses more intensive than single farrvly Zorung Code 14 622 100 Chapter 14 605 As to the proper location of Urban Residential-22 (UR-22) zones in the Urban category, the purpose and intent section of the UR-22 zone states The highest density residential zone, UR-22 is intended pnmanly for multiple-farruly dwellings and is usuallv located adiacent to maior or secondarv artenals It is used as a transition between low or medium density multiple uses and intensive commercial or low intensity industnal uses and to provide for tugher density housing in locations close to employment shopping and maJor transportation routes where movements of people can be handled efficiently and wnth least overall adverse impact [Emphasis added] Zorung Code 14 622 100 "Major or secondary artenals" as referenced above equates to roads classified as a Pnncipal Artenal or Niinor Artenal under the Spokane County Artenal Road Plan, but does not include roads classified as a Collector Artenal See Comprehensive Plan, Glossary, defirvtions of "Secondary Artenal',"Major Artenal and ` CoUector Artenal", Zorung Code 14 300 100, defimtion of "Artenals-Pnncipal, Minor and Coilector', Zorung Code 14 710 140 and Spokane County Road Standards Section 1 12, paragraph 2 Objective 1 1 b of the Urban category of the Comprehensive Plan more generally provides that higher-density developments such as multifarruly dwelling areas should be located with near or direct access to the major artenal systems rather than on intenor neighborhood streets" Fourth Avenue is designated by the Artenal Road Plan as a Collector Artenal However, the proposal is located only 300 feet from Evergreen Road, a Pnncipal Artenal, and is closer to Evergreen Road than it is to Leatha Lane the closest neighborhood street to the site by motor vehicle It is also noted that the land situated between the site and Evergreen Road is zoned UR- 22 and is likely to be developed for multifamily housing Further consistent vvith a stated purpose of the UR-22 zone the proposal provldes a transition from the single-farruly residences located south of Fourth Avenue to the intensive commercial uses located along Sprague Avenue and to the nearby nght of way dedicated to the County The site is also located close to employment shopping and the major transportation routes Exlubit A in the record, subrrutted at the public heanng by area residents opposed to the project, shows the approximate location of multifamily complexes either existing or under construction in the general area, as well as whether the complex is under or over 50 units in sue The exhibit establishes that most multifanuly complexes in the general area of the site are located either along a Pnncipal Artenal (Pines Road Sullivan Road Broadway Avenue) or a Niinor Arterial (McDonald Road Mission Avenue Adams Road) However, the map shows an existing multifarrvly complex of less than 50 uruts located along the north side of Fourth Avenue, at some distance west of McDonald Road (tlus complex is in addition to the complex located at the northwest corner of McDonald Road and Fourth Avenue) Exhibit A does not accurately depict the location of this complex, which is actually located rrudway between Pines Road and HE Findings, Conclusions and Decision ZE-36-96 Page 6 f McDonald Road, between Vercler Road and Leta Road extended north Wlule the complex is in good condition it is unknown when the compleY was constructed or zoned for multifamily development There are also a number of large multifarruly complexes either existing or under construction lirung both sides of Fourth Avenue east of Sulllvan Road for several hundred feet The applicant contended that the proposal is consistent unth other development along Fourth Avenue but was not specific in ttus regard Most development located along Fourth Avenue is single-famlly The Hearing Examiner does not find the multifarrnly development along Fourth Avenue east of Sullivan Road that comparable to the proposal Sullivan Road is a four-lane Pnncipal Artenal for a considerable distance south of Sprague Avenue and cames considerably more traffic than does Evergreen Road at the current time The major concern with the proposal is its potential for adverse impacts to the single-family homes located along Fourth Avenue, and to the residential neighborhood located west of the site Objective 1 1 b of the Urban category indicates that when multifam.ily housing is located adjacent to single-family areas careful consideration must be given to the density and designs of the multiple-farruly development so as to ensure protection of the amemties of the single-fanuly area The applicant testified that the project was designed to target retired seruor citizens (55 and older) and that there was a strong market for such housing in the Spokane Valley The record indicates that the proposed 40 urvts of elderly housing would only introduce an additional four vetucle tnps per hour dunng the peak traffic hours duruig the weekday See testimony of Pat Harper County Engineenng, letter dated August 6, 1996 from J R Bonnet Englneenrig These estimated totals would nse to 18 tnps per a m peak hour and 20 tnps per p m peak hour if the project was marketed for 40 uruts of general population housing Area residents quoted County traffic figures indicating that the average vehicle tnps per day along Evergreen Road and Fourth Avenue had nsen markedly in 1995 and 1996 and attnbuted such increases to the construction of the new Safeway and Target store and other development m the area Testimony was also offered that a number of accidents had occurred at the intersections of Evergreen Road with Eighth Avenue and Fourth Avenue However County Englneenng staff testified that deternunation of the adequacy of county roads and county road intersections was properly based on the peak hour velucle tnps generated dunng peak hour traffic and not vehicle tnps per day and expressed the opirvon that roads in the vicimty of the proposal could adequately handle the additional traffic from the proJect in terms of capacity and safety The opuvons by qualified professionals on technical issues such as traffic safety and capacity of roadways must be given weight over the unqualified opinlons of lay persons in ttus instance The Heanng Examiner finds that the proposal will not degrade area streets and intersections to a level that requires additional traffic rnitigation by the applicant However, it is apparent that the proposal will materially increase traffic along Fourth Avenue and possibty on neighborhood streets in the victnity particularly if the umts in the proposal end up being marketed to the general housing population Area residents also eYpressed concern wnth regard to the proposed height and number of uruts in the proposal particularly if the adjacent land east of the site zoned UR-22 and the vacant land west of the site are developed for dense multifamily housing Decision Guidelines 1 5 7 and 1 5 8 of the Urban category of the Comprehensive Plan indicate that the structure height of multifamily HE Ftndings Conclusions and Decision ZE-36-96 Page 7 ~ housing in relation to the structure height of nearby structures should be considered before approving any multifamily housing, as well as whether new structures will negatively impact a neighborhood s architectural character The single-family residences lirung Fourth Avenue west of Evergreen Road are generalty single-story structures However, there is approxunately 165 feet of vacant land between the site and the single-famtly residences Iocated west of the site on the north side of Faurth Avenue Further the Division of Budding and Planrung conditions of approval linut the budding height of the proposal to 35 feet The Zorung Code generaUy measures building height from the "average firushed grade to the highest point of the roof, except for skylights chimneys a.nd other exceptions See Zoning Code 14 300 100 defirvtion of building height and ?orung Code 14 810 120 The applicant testified that due to the placement of a berm the actual helght of the roof of the proposal would vary from 3540 feet The 35 foot helght restnction cvmpares to the maximum allowable building heights in the UR-3 5 UR-7, UR- 12 and UR-22 zones which are respectively 3 5 feet, 40 feet and 50 feet Spokane County Zomng Code The visual impact of a multifamily buildmg also depends on the size and profile of the buflding other than its height The alignment of the buildings on the site from north to south and the narrowness of the lot does help mitigate the visual unpact of the proposal when viewed from the south, although not necessanly fram the west However there is concern about the densrty of the proposal The appticant indicated that plans were being made to develop 80 uruts of multifamily housing on the 3 75 acre parcel zoned UR-221ocated adjacent to the site at the northwest corner of Evergreen Road and Fourth Avenue which equals to a density of over 21 ututs per acre Further there is potential for multifa.mily development af the vacant land located adjacent to the site on the west, land wh.tch the applicant has expressed an interest in acquinng See Envuonmental Checklist, p 1 The record does not indicate any opposition to the proposal from the owner of the vacant land to the west If the proposal and the adjacent sites to the east and west were all developed at the density allowed in the UR.-22 zone, the single-family neighborhood in the vicinity could be overwhelmed It is the opiruan of the Heanng Examiner that s4me transition is needed along Fourth Avenue between the property zoned UR.-22 located at the corner of Evergreen Road and FQUrth Avenue and the srngle-family residences located west and south vf the site zoned Urban Residential-3 5 (UR-3 5) Such transition could be provided by the Urban Residentfal- 12 zone, wh.ich like the LTR-22 zone is frequently used to provide transltion between low-density residential zones and intensive business zones Zorung Code 14 624 100 However, the proxinuty of Regivnal Business (B-3) uses and the Sprague Avenue busaness distnct to the s1te, the nearness of Evergreen Road, and the probable marketing of the site for elderly housing convinces the Heanng Examiner that UR-22 zorung is appropnate for the site but at a reduced density Restncting the net density of the proposal to a density that is trudway between the maximum allowable net density in the UR-22 zone with bonus density (27 uruts per acre) and the maximum allowable density in the UR-12 zone {12 uruts per aere} seems a reasonable comprornise under the ctrcumstances Such reduced density would allow the applicant 34 multlple-fa.mily dwelling units instead of the 44 uruts requested Depending on the circumstances, the vacant land located west of the site could be rezoned to the LTR-12 zone or LTR-7 zone to provide further transition to the adjacent single-family neighborhood HE Findings, Conclusions and Decision ZE-36-96 Page 8 2 Conditions in the area in wtuch the oropertv ls located have not sufficientlv changed to iustifv the oroDosed rezone. as conditioned In applying the changed circumstances test, courts have looked at a vanety of factors, including changed public opinion, changes in land use patterns in the area of the rezone proposal, and changes on the property rtself The Zorung Code references changes in "econorruc, technological or land use condrtions" as factors that will support a rezone Spokane County Zoning Code Section 14 402 020 (2) Washington courts have not required a"strong" shownng of change The rule is flexible, and each case is to be judged on its own facts Bassarv v Countv Commissioners 70 Wn App 389, 394 (1993) Recent cases have held that changed circumstances are not required for a rezone if the proposed rezone unplements policies of a comprehensive plan Biarnson at 846 Save Our Rural Envlronment v Snohomish Countv, 99 Wn 2d 363 370-371 (1983) Some changed cucumstances have occurred in the area since adoption of the Zorung Code in 1986, and re-designation of the zorung of ihe site to the Urban Residential-3 5(UR-3 5) zone of the Zorung Code in 1991 pursuant to the Program to Implement the Spokane County Zorung Code Such changes include increased traffic in the viciruty and population growth in the area, intensive commercial development south of Sprague Avenue m the viciruty, and the extension of public sewer to the area 3 The vronosed rezone bears a substantial relationship to and is not detnmental to the oublic health. safetv and eeneral welfare General consistency with a local government's comprehensive plan is relevant in deternurung whether a rezone bears a substantial relationship to the public welfare Bassaru, at 396-98 As conditioned the proposal generally confonns to the Comprehensive Plan The site is adequately buffered from the nearby single-family neighborhood based on its design, location, restncted height reduced density and landscaping and screerung features Wlule neighbonng property owners introduced evidence that there is a considerable supply of new and existing multifanuly housing in the general area of the proposal, the unrebutted testimony of the applicant is that there is a market for elderly housing in the area The proposal provides for the extension of curb and sidewalk along the frontage of the site with Fourth Avenue, in response to the concern expressed by area residents related to the use of Fourth Avenue by schoolchildren and other pedestnans The impact of the project on area schools vvill be rrutigated by the ` voluntary" fee agreement that the applicant must negotaate with the Central Valley School Distnct The proposal is vvithui the Public Transit Benefit Area designated by the Spokane Transit Authonty, with the nearest bus route being approximately 1/8 of a rrule to the north on Sprague Avenue There was some discussion in the record as to whether the proposal will be a"gated' community for secunty purposes The applicant s Cypress Point multifamily proJect along McDonald Road near 1VLssion Avenue cited for companson has a white picket-type fence placed around the borders of the front yard of the site While the fence does enhance the residential appearance of such site, it does not restnct access to the site or make it gated for secunty or smaller stores and businesses between Pynes Road and Sullivan Road un Sprague Avenue Also Safeco Insurance has a building on Sprague Avenue in this same area These stores and businesses on Sprague Avenue will attract many of the trips generated by this project I assumed 30 % of the additional trips generated by this project will go to or come from Sprague Avenue This percentage is increased on the weekends to 45 % due to pe.ople generally not working on the weekends and available to do shopping 3) Ano[her primary desttnauon of trips generated by this pro1ect will travel narth of I- 40 on Sullivan Road This is a highly indusveyalized area with several large companies employing many people Among them are several companies leasing space at the Spokane Industrial Park, Johnson Matthey, Inland Asphalt and Kalser Aluminum (Trentwood) The rouce that will be used to get to this area will be to Sullivan Road and then over 190 I assumed that 25 % of the addttional trips generated by this project wil I use Sullivan Road tolfrom work Another S% will use Pines Rc►ad to travel to destinations north of 1-90 4) Since the proposed project site ts located almosc equidistant rrom elther Pines generated by this project S) Most of those traveling to Sullivan and north to I 90 will use Sprague Road to a%,old having to ma.ke a left turn onto Sulltv-tn Road at 4th Avenue However there will be some that will use 4th Avenue and turn lett onto Sullivan Road Also some will use 4th Avenue co go to Central Valley High Schuol iocated south on Sullivan Road I assumed 15 % wil l travel east on 4th thzn to the site They may du shopping banking ect on the way home from work or may want to use the safer more developed roadway without potential interference trom pedestrians or vehicles entering or average weekday Saturday and Sunday A future 190 interchange at Evergreen Road will lessen the impacts due to this proposed development on both the Pines Roa.d/I-90 interchange and the Sullivan Last week I accepted a telephone call from Mr. Arger, who wanted to know if Iwould I entertain approval of a retirement center on the site, which he felt would be more acceptable to the neighborhood and would have considerably less traffic impact than the general multi-housing project presented at the recent hearing in the above matter. He explained that he had recently received an inquiry from a developer of retirement housing, who expressed a strong interest in developing such a project on the site. Mr. Arger's letter explains that he would still need the 136 units, density and building heights proposed earlier to make the retirement project economically feasible. Mr. Arger also told me over the telephone that the design of a retirement center on the site would differ somewhat from the current design, with the retirement center probably occupying the center of the site, as is typical of such housing. If the retirement center does not work out, Mr. Arger would agree to do a traffic study for the general multi-family project. If there is substantial interest in this alternative, I will expeditiously schedule a brief public hearing to consider the same. I am also by this letter requesting the Spokane County Traffic Engineer to consider promptly evaluating traffic safety conditions at the intersection of Fourth and Evergreen, in light of the number of accidents that have occurred at such intersection recently and over the past few years, as discussed in my previous letter. The Traffic Engineer should indicate whether the County is willing to do this, and how soon it could be done. Please be advised that last week my office was advised by Susan Scott and by Neil Francom of yet another accident occurring at this intersection, this time a three-car injury accident occurring on the afternoon of Apri123, 1998.
