Dear Mr. Olinger:
This office has received reports that three mobile homes have been
placed on your property located at the above -referenced address
without valid building permits. This property was recently short
platted _ file number SP -85-375.
For the purpose of providing minimum building standards on all new
construction to safeguard health and safety, a building permit is
required in accordance with Section 301 of the Uniform Building
Code as adopted by Spokane County.
The intent of this letter is to advise you of our permit
requirements and to request that you take appropriate action to
obtain the permit within ten (10) days of the date of this letter.
Please be advised that should you fail to comply with this request,
this office, in accordance with Section 304(d) of the Uniform
Building Code, will assess a double fee.
If you wish to discuss these findings, have any questions, or
believe that our findings are unfounded, please feel free to
contact me at 456-3675.

Dear Mr. Olinger:
-Our district inspector reports that two mobile homes have been or are
being installed on your property located at E. 7321 Fairview, parcel
number 12531-0206, without a valid building permit. In accordance
with Section 301 of the Uniform Building Code as adopted by Spokane
County, such work requires that you first obtain the appropriate
permit.
Section 304(d) of the Uniform Building Code requires that a double
fee be charged whenever any work for which a permit is required has
commenced without first obtaining such permit.
The intent of this letter is to waive -the double fee, provided, you
take the appropriate action to obtain a permit within ten (10) days of
the date of this letter. I can assure you a double fee will be
assessed should you fail to comply with this request.
A recheck of our files will be conducted immediately following the
time frame specified above. Your compliance with the above will
negate the need for further action on this matter.
Should you have any questions, please contact this office between
8:00 a.m. and 4:00 p.m., weekdays.

on April 17, 1986, has lapsed and no effort was made on your part to
contact this office, a double fee will be assessed on your permit, as
per Section 304(d) of the Uniform Building Code.
It should be further noted that you will be given ten (10) days from
the date of this letter in which to contact this office and make
arrangements to obtain the aforementioned permit(s) or the entire

Tom Davis, of the Spokane County Department of Building and Safety, has
contacted our office regarding an alleged violation of Section 301 of
the Uniform Building Code in connection with the mobile homes located
at East 7321 Fairview.
Specifically, it is alleged that mobile homes have been placed on that
property without valid permits issued by the Spokane County Department
of Building & Safety.
Please be advised that a violation of the Uniform Building Code
constitutes a misdemeanor. As such, it is punishable by up to ninety
(90) days in jail, a fine of -up to $500, or by both such fine and
imprisonment.
Please take immediate steps to obtain the required permits. Your
failure to do so within thirty (30) days of the date of this letter may
result in a complaint being filed against you for a violation of the
Uniform Building Code.

Over the last two weeks, the County Planning Department has reviewed
and refused two building permits for manufactured homes on prrpPrty
located within Short Plat #85-375. I would like to remind you of our
phone conversation on April 15, 1986 and our subsequent oonversation
in my office. In order to Obtain building permits or provide lots with-
in the short plat for sale, leaqe, rent or transfer, a "Final Short Plat"
must be recorded. This Final Short Plat must be signed by the County
Engineer, County Utilities Department, County Health District, County
Assessors, County Treasurers, County Planning Department and finally
recorded with the County Auditor. The Departments listed above will
review a proposed Final Plat in order to insure that the Findings and
Order dated July 18, 1985, by the Spokane County Hearing Examiner
Committee, are completed. Specifically within the Findings and Order
are the "Conditions of Approval" which you are required to satisfy prior
to getting your Final Plat recorded. The County Planning Department and
Building & Cafety Department have received complaints about manufactured
hones moved on the property without building permits. Location of
manufactured hares without building permits is a violation of Spokane
County Subdivision regulation.
We will take any and all measures to prevent location of residential
units on the site until a Final Short Plat has been recorded. We
urgently request that you complete finalization of this Short Plat to
prevent civil enforcement action for unlawful location of hares on this
site.
Contact me immediately so we can get this Short Plat legally filed.

make any effort to contact your office to obtain
proper permits. Scott Valentine was contactqd and
Jim was also down at your offices talking to Paul
Jensen about this. Survayer Scott Valentine is still
waiting for a decision from the county as to if there
needs to be a 208 study on the road for drainage.
We are now and have been in the process of doing every
thing we possibly can to please you.

Be advised that Spokane County Planning Department has received virtually all
of the necessary docunents and fees necessaxy,to complete the final plat
of this proposal. After discussions with Mr. Olinger, myself and Jim Ernacio,
on October 10, 1986, it appears that Mr. Olinger would be able to catplete
the platting process by Novenber of this year.
An on-site inspection of the existing residences was conducted by Gary
Koeppel of our office on October 13, 1986. Mr. Koeppel reports that the
structures located on the site conform to the Hearing Examiner Cammittee
requirements established for these structures and therefore, Spokane County
Planning Department finds that Mr. Olinger has complied with the special
conditions established by the Hearing Examiner Committee for the development
on these lots.

RE: SP -85-375, APPEAL OF APPROVED SHORT PLAT APPLICATION
1. That the proposal is to subdivide approximately 1 acre into four (4) lots
for single family residences. •
2. That the proposal is located north and adjacent to Fairview Avenue
approximately 350 ft. west of Park Road in the Spokane Valley in Section
12, Township 25N, Range 43 E.W.M., Spokane County, Washington.
3. That the item has been properly advertised in accordance with state and
local regulations.
4. That the Committee has considered and evaluated the information and
conditions contained in the Planning Report for this proposal.
5. That the Comprehensive Plan designates this area as Suburban and the
proposal appears generally consistent with the fill-in policy. The lot
sizes, although smaller than Suburban policies are consistent with the
established'densities of this area..
6. That this is an established neighborhood with a unique character and that
approval of this proposal shall in no way be detrimental.
7. That a manufactured home park would not be in keeping with the character
of this area.
8. That after considerable testimony, it appears that other options may be
available to neighboring property owners for rear property access and
further development.
9. That the owners of adjacent property spoke against the cul-de-sac as
proposed by the developer and preferred the extension of Bowman Road from
Euclid to Fairview which could serve all of the interior properties, and
also stated concerns over manufactured housing decreasing the property
values.
10. That area residents generally favored fill-in development as long as its
character is consistent with the surrounding neighborhood.
11. That the Findings .of the Short Plat Administrator are made a part of this
decision by reference.

The Hearing Examiner Committee pursuant to the above findings DENIED the

County Engineer for approval prior to construction and/or the filing of

3. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for approval prior
to construction and/or the filing of each final plat. Drainage plans to
be prepared under the direction of a licensed Professional Civil Engineer.
4. A statement must appear in the dedicatory language of the final plat:
"that individual driveway access permits be required prior to issuance of
a building permit for driveway approaches to the County road system."

10. To construct the road improvements stated herein, the applicant may, with
the approval of the County Engineer, join in and be a willing participant
in any petition or resolution which purposes is the formation of a Road
Improvement District (RID) for said improvements pursuant to RCW 36.88, as
amended. At such time as an RID is created or any Road Improvement
Project is sanctioned by Spokane County, the improvements required (curb,
sidewalk, drainage control and paving to existing pavement) will be at the
sole expense of the undersigned owner, their heirs, grantees and assigns.

11. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road project (CRP) to the extent of the required
road improvement. At such time as an RID is created or any Road
Improvement Project is sanctioned by Spokane County, the improvements
required (curb, sidewalk, drainage control and paving to existing
pavement) will be at the sole expense of the undersigned owner, their

12. That the following statement be placed in the plat dedication: The
owners, their heirs, grantees and assigns, agree to join in the formation

13. The proposed private road(s) as shown on the preliminary plat serving 4
lots with no extension possible is approved by the County Engineer.
14. That private road(s) be improved to Spokane County standard for a private

15. That the following statement be placed in the plat dedication:
WARNING:Spokane County has no responsibility to build, improve, maintain,
or otherwise service the private roads contained within or providing
service to the property described in this plat. By accepting this plat or
subsequently by allowing a building permit to be issued on property on a
private road, Spokane County assumes no obligation for said private road
and the owners hereby acknowledge that the County has no obligation of any
kind or nature whatsoever to establish, examine, survey, construct, alter,
repair, improve, maintain, provide drainage or snow removal on a private
road. This requirement is and shall run with the land and shall be
binding upon the owner, their heirs, successors or assigns including the
obligation to participate in the maintenance of the private road as
provided herein.
16. The proposed plat shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80-1592, as amended, which
establishes regulations for roads, approaches, drainage, and fees in new
construction.
17. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County Road
System warrants the dedication of additional right-of-way and the roadway
improvements herein specified.
18. All vested owners shall sign and record private road documents as
prescribed by the Spokane County Engineer. These documents shall be
reviewed and approved by the County Engineer prior to recording with the
Spokane County Auditor. Recording numbers shall be referenced in the
dedicatory language of the plat.
COUNTY HEALTH DISTRICT ,
1. A combined surface water and sewage disposal detailed plan shall be
approved by the County Engineer and the Spokane County Health District
prior to the issuance of any building permit for this project.
2. The dedicatory language of the plat will state that: "Subject to specific
application approval and issuance of permits by the Health Officer, the
use of (an) on-site sewage system(s) may be authorized."
3. Water service shall be by an existing public water supply when approved by
the Regional Engineer (Spokane), State Department of Social & Health
Services.
4. Prior to filing the final plat, the sponsor shall present evidence that
the plat lies within the recorded service area of the water system
proposed to serve the plat. The dedicatory language on the plat shall
state: "Use of private wells and water systems is prohibited."

5. A plan for water facilities adequate for domestic use, domestic irrigation
use and fire protection use shall be approved by the water supplier. Said
water plan must have been approved by the fire protection district and the
appropriate health authorities. The health authorities, water supplier
(purveyor) and fire protection district will certify, prior to the filing
of the final plat, on the face of said water plan that the plan is in
conformance with their requirements and will adequately satisfy their
respective needs. Said plan and certification will be drafted on a
transparency suitable for reproduction.
6. The purveyor will also certify prior to filing the final plat on a copy of
said water plan that appropriate contractual arrangements have been made
with the plat sponsor for construction of the water system, in accordance
with the approved plan, and in accordance with a time schedule. The time
schedule will provide, in any case, for completion of the water system and
inspection by the appropriate health authorities prior to application for
building permits within the plat. The contractual arrangements will
include a provision holding Spokane County, Spokane County Health
District, and the purveyor harmless from claims by any lot purchaser
refused a building permit due to failure of the plat sponsor to
satisfactorily complete the approved water system.
7. The plat dedication will contain a statement to the effect that: "The
public water system as approved by County and State health authorities and
the local firedistrict and purveyor will be installed within this plat,
and the subdivider will provide for individual domestic water service as
well as fire protection to each lot prior to sale of each lot."
8. Prior to filing the final plat, the sponsor shall demonstrate to the
satisfaction of the Spokane County Health District that a suitable site
for on-site sewage disposal systems are available on all ,lots.
COUNTY UTILITIES DEPARTMENT
1. Pursuant to the Board of County Commissioners Resolution No.80-0418, the
use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all rules and regulations
of the Spokane County Health District and is further conditioned and
subject to specific applicaton approval and issuance of permits by the
Health District.
2. The dedication shall state: "Tbe owner(s) or Successor(s) in interest
agree to authorize the County to place their name(s) on a petition for the
formation of ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to object by the
signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the
Owner(s) property. PROVIDED, this condition shall not prohibit the
owner(s) or successor(s) from objection to any assessment(s) on the the
property as a result of improvements called for in conjunction with the
formation of a ULID by either petition or resolution method under RCW
Chapter 36.94.

3. Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each dwelling unit shall be double plumbed
for connection to future area -wide collection systems."
5. Plans and specifications for the double plumbing are to be reviewed and
approved by the Utilities Department, prior to making septic tank permit
application.
SECTION 6: -
Add to Planning Department Conditions:
That site -built structures or Type A manufactured homes with pitched roofs
and conventional siding which will be compatible with adjacent
properties. All manufactured homes built on this proposal shall be placed
on permanent foundations and sited in a manner that allows an attached
garage to be built if not constructed at the same time as the construction
of the home.
