SCOTT, P.E., DIRECTOR November 9, 1998 RE: Notice and Order for the Abatement of a Dangerous Building - 8204 E. Fairview Ave. Dear Mr. Flanigan: This notice and order concerns the unsafe conditions of a dwelling located at the above - referenced address, Spokane County parcel No. 45072.3502. Inspections at the site have determined that the building is dangerous and is hereby declared to be a public nuisance. Conditions are such as to pose a potential hazard to public safety, health and welfare. Conditions and defects of the building as hereinafter described meet the definition of dangerous buildings as described in Section 302 of the Uniform Code for Abatement of Dangerous Buildings. Whenever the building or structure, or any portion thereof, because of the removal, movement or instability of any portion of the ground necessary for the purpose of supporting such building; the inadequacy of its foundation; or any other cause, is likely to partially or completely collapse. Whenever the building or structure has become so dilapidated or deteriorated as to become an attractive nuisance to children; a harbor for vagrants, criminals or immoral persons. Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration, damage, inadequate exits, lack of sufficient fire -resistive construction, faulty electric wiring, gas connections, or heating apparatus, or other cause, is determined by the Fire Marshall to be a fire hazard. It shall remain unoccupied unless otherwise directed. At the time of this order, the building has been posted "Do Not Enter - Unsafe to Occupy." The building and open excavations shall be immediately secured and maintained against entry. Due to the nature of the conditions and defects it is determined that the unsafe conditions can be repaired. All permits, necessary to authorize corrective work are to be secured and the work physically commenced within 30 days of the order. Repairs must be completed within 60 days of the permit issuance. Failure to take appropriate action constitutes a misdemeanor and will result in this matter being forwarded to the Prosecuting Attomey's Office for appropriate legal action. In addition, the Building Official may cause the building to be demolished. Please be advised that Section 3.10.010 of Title 3, Spokane County Code and UCADB provides that costs of such work shall be paid and levied as special assessment against the property or may become a personal obligation of the property owner. Any person having legal interest or record title in the building may appeal this notice and order in writing the Construction Review Board, hearing officer, within ten (10) days of this order. A failure to appeal will constitute a waiver of all rights to a hearing and determination in this matter.
