SCOTT, P.E., DIRECTOR Dear Mr. McCormick: To follow up on our phone conversation on May 11, 1993, we still have not received a copy of the manufacturer's specifications for the installed pellet stove located at the above referenced address. As you are aware from previous correspondence, the stove does not meet code requirements as stated in Chapter 5 of the Uniform Mechanical Code regarding clearances from combustible construction for unlisted appliances. In response to your comment that you have received a final inspection prior to the discovery of the non -complying appliance, please be advised that Section 305(a) of the Uniform Building Code states that: "Approval as a result of an inspection shall not be construed to be an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction. Inspections presuming to give authority to violate or cancel the provisions of this code or of other ordinaces of the jurisdiction shall not be valid." In order for your project authorized under the building permit # 91-2945 to be finalized, either the manufacturer' s listing of the pellet stove specifications must be submitted and/or the stove brought into compliance with required clearances as specified in the Uniform Mechanical Code. Fancher Road, SPOKANE COUNTY, WA. 99210 CIRCUMSTANCES SUPPORTING PROBABLE CAUSE: Records of the Spokane County Assessor's Office identify the defendant, John Mc Cormack, as the owner of the referenced property located at 1421 S. Fancher Road, Spokane County, Washington at the time the building permit was issued on June 10, 1991 to construct a residence. Dave Silva, an inspector for the Division of Buildings, on May 3, 1993, inspected the property located at 1421 S. Fancher Road, Spokane County, Washington and observed the following Construction and occupancy on said property: Pellet stove has been installed without required clearances to combustibles and without the submission of the manufacturer's stove specifications. The residence is being occupied by the current property owner, Clayton Beck who has been advised by the Division of Buildings not to use the stove because of a potential safety hazard. The records of the Division of Buildings show that on June 10, 1991 a permit had been issued to the defendant for the construction of the residence. On April 5, 1993, and on May 6, 1993 the Division of Buildings notified the defendant, in writing, of the permit requirement for final inspection of said construction. As of the date of this affidavit, the records of the Division of Buildings show no action has been initiated to correct the violation regarding the installation of the pellet stove and that occupancy or use has not been approved for the said construction.
