To follow up on our phone conversation on May 11, 1993, we still have not received a copy of
the manufacturer's specifications for the installed pellet stove located at the above referenced
address. As you are aware from previous correspondence, the stove does not meet code
requirements as stated in Chapter 5 of the Uniform Mechanical Code regarding clearances from
combustible construction for unlisted appliances.
In response to your comment that you have received a final inspection prior to the discovery of
the non -complying appliance, please be advised that Section 305(a) of the Uniform Building
Code states that:
"Approval as a result of an inspection shall not be construed to be an approval of a
violation of the provisions of this code or of other ordinances of the jurisdiction.
Inspections presuming to give authority to violate or cancel the provisions of this code
or of other ordinaces of the jurisdiction shall not be valid."
In order for your project authorized under the building permit # 91-2945 to be finalized, either
the manufacturer' s listing of the pellet stove specifications must be submitted and/or the stove
brought into compliance with required clearances as specified in the Uniform Mechanical Code.
For specific requirements on clearances, please contact Dave Silva at 456-3675 between the
hours of 8:00 a.m. and 9:00 a.m., weekdays.

Back in December we had a conversation concerning the improper installation of a pellet
stove at 1421 South Fancher Road.
At that time you assured this office that you would rectify the problem and bring it into
compliance with the applicable codes. As of this date no arrangements have been made to
rectify this problem.
This Department feels that we have no alternative but to recline the approved final on this
residence and begin compliance procedures to insure that this issue is resolved.
