THIS MAI hR, an application from Clinton Hammond for an Administrative Interpretation, has
been received and decided upon, pursuant to The Spokane County Zoning Code, Spokane
County Short Plat Ordinance and the Revised Code of Washington (RCW 58.17.210), on the

FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering
this decision by the Spokane County Director of Planning.
2. On March 7,1995, Clinton Hammond submitted an application to the Spokane County
Planning Department for an Administrative Interpretation as an "innocent purchaser" for
recognition of a parcel of land for residential use under the provisions of the Revised Code
of Washington, RCW 58.17.210, which states: "No building permit, septic tank permit or
other development permit shall be issued for any lot, tract or parcel of land divided in
violation of this chapter or local regulations adopted pursuant thereto unless the authority
authorized to issue such permit finds that the public interest will not be adversely affected
thereby. The prohibition contained in this section shall not apply to an innocent purchaser
for value without actual notice. All purchasers' or transferees' property shall comply with
provisions of this chapter and each purchaser or transferee may recover damages from any
person, firm, corporation or agent selling or transferring land in violation of this chapter or
local regulation adopted pursuant thereto, including any amount reasonably spent as a result
of inability to obtain a development permit and spent to conform to the requirements of this
chapter as well as costs of investigation, suit, and reasonable attorneys' fees occasioned
thereby. Such purchaser or transferee may as an alternative to conforming his property to
the requirements of this chapter, rescind the sale or transfer and recover costs of
investigation, suit and reasonable attorneys' fees occasioned thereby."
3. The subject property was segregated June 19,1984, is identified by Spokane County tax
parcel numbers 45173.1116 and is located west of and adjacent to Farr Road approximately
900 feet north of the intersection of Farr Foad and Sprague Road in the SW 1/4 of Section
17, Township 25 North, Range 44 E.W.M. Spokane County, WA.
4. The existing zoning of the property described in the application is Urban Residential -3.5
previously established as Agricultural Suburban (file # ZE-77-70) zoning in 1970 and
redesignated to Urban Residential - 3.5 on January 1, 1991, pursuant to the Program to
Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal
and property size does conform to the requirements of the existing zone, however the
frontage does not meet the required 80 feet. (SEE FILE # AEE -22-95)
5. The Spokane County Comprehensive Plan designates this area as URBAN. The uses
proposed and parcel size are in accord with this category.
6. The property will be served by a public water system. Waste water disposal will be as
authorized by the Director of Utilities.
7. The property has direct access to public right of way at Farr Road and may require an
access permit at the time of issuing a building permit.
8. This administrative interpretation is exempt from environmental review under the State
Environmental Policy Act pursuant to WAC 197-11-800 (6) (a).
9. In 1986, the subject site was part of a short plat that had received preliminary approval (file
# SP -86-422). Review of the file shows that the short plat was near complete and ready to
final, however never recorded. Attemps to complete the short plat process by staff
members were unsuccessful, as the applicant never responded to communications. The
property then changed ownership and expired as a short plat after the three year period of
preliminary approval lapsed.
10. Assessor records show Clinton Hammond as the owner of record for parcel 45173.1116
as conveyed on August 1988.
11. A letter from Clinton Hammond, the current owner of the subject property, was received
by the Planning Department on March 6, 1995. The letter stated that the property was
represented as subdivided when purchased in 1988.
CONCLUSION
1. Pursuant to RCW 58.17.210, the Planning Department determines that the applicant is an
"innocent purchaser".
DECISION
BASED UPON THE ABOVE Findings of Fact and Conclusions, Administrative Interpretation
AIE-5-95 is hereby APPROVED. This decision shall apply to the "Applicant", and shall transfer
to the owner or owners of the property, heirs, assigns and successors. This decision is final
unless appealed in writing, consistent with below appeal procedures.
NOTE: All applicable development regulations and ordinances shall
continue to apply to the subject property, which shall also include any
further subdivision of said property.

THIS MATTER, an application for road frontage Administrative Exception, has been
received and decided upon, pursuant to the Zoning Code of Spokane County, Sections
14.506.020 (7) and 14.506.040, on the / `i -+'b day of April, 1995.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been delegated the responsibility for rendering this
decision by the Spokane County Director of Planning.
2. The Spokane County Planning Department has received an application from
Clinton Hammond for an Administrative Exception from the frontage requirements
for residential use. The subject parcel (No. 45173.1116) has sixty five (65) feet
of frontage on a public road; whereas, section 14.616.315 of the Spokane County
Zoning Code requires eighty (80) feet of frontage. The parcel would be served by
a private driveway.
3. In addition to the Administrative Exception, an application (File No. AIE-5-95) for
an Administrative Interpretation has been made. The subject site can meet the
underlaying UR -3.5 zoning provided the road frontage standards can be satisfied.
4. This property is located west of and adjacent to Farr Road, approximately 900 feet
north of the intersection of Farr Road and Sprague Road, in the SW 1/4 of Section
17, Township 25 N, Range 44 EWM.
5. The current zoning of the property is Urban Residential - 3.5 (UR -3.5) ; which
requires a minimum lot size of 10,000 square feet and 80 feet of road frontage.
The subject site is approximately 1 acre in size and has 65 feet of frontage on Farr
Road.
6. In compliance with RCW 36.70.450, the Planning Department has determined that
this proposal for single family residence on 1 acre is consistent, as conditioned,
with the Urban Comprehensive Plan designation.
7. The Arterial Road Plan designates Farr Road as a COLLECTOR ARTERIAL, with
a with 70 feet of right-of-way. The Road Plan is satisfied by the existing 70 feet
of right-of-way of Farr Road.
8. At this time access for personal and emergency vehicle use appears to meets the
requirements of Section 14.506.020 (7a).
10. Improvements made to the property for access purposes would be required to meet
the Spokane County's Department of Buildings Private Driveway Standards.
11. Neither adjacent properties nor the general health, safety and welfare will likely be
adversely affected by approval of this request as conditioned.
12. The project is exempt from the State Environmental Policy Act;. pursuant to WAC
197-11-800(6)(b).
DECISION
BASED UPON THE ABOVE Findings of Fact and Conclusions, this Administrative
Exception application is hereby APPROVED, subject to the conditions noted below.
This decision is final unless appealed in writing, consistent with appeal procedures.
CONDITIONS OF APPROVAL
1. The following conditions shall apply to the applicant, owner or owners of the
property, and successors in interest and shall run with the land.
2. Failure to comply with any of the conditions of approval contained in this
decision, except as may be relieved by the Planning Department, shall constitute a
violation of the Zoning Code of Spokane County and be subject to such
enforcement as is appropriate.
3. Subdivision of the property may render the administrative exception status
determination null and void and of no further force or effect.
4. This parcel shall not be further subdivided unless consistent with RCW 58.17, the
County subdivision ordinances, the Zoning Code and the Comprehensive Plan.
5. The applicant is advised that a access shall be constructed in accordance with the.
provisions of Spokane County Department of Buildings Private Driveway
Standards, Chapter 3.05.050(a) 2(ii), Fire Access, of Title 3 of the Spokane
County Code.
Under State Law and County Ordinance, you have the right to appeal this decision to the
Spokane County Hearing Examiner Committee. If you desire to file such an appeal, you
must submit the appropriate APPEAL APPLICATION together with the required FEE,
