DEMPSEY, CHIEF EXAMINER September 20, 2001 RE: File No. SP -1274-01, Request for Reconsideration Dear Mr. Helt: I am in receipt of your letter to me dated September 17, 2001, requesting reconsideration of my September 6, 2001 decision in the above file. Your letter requests that I delete County Planning condition #14, which requires that the ingress and access easements in the preliminary short plat be paved prior to the issuance of any building permits on the site. Section 17 of the Hearing Examiner Rules of Procedure, adopted by County Resolution No. 96-0294, provides the Examiner with limited authority to reconsider a final decision, which is confined to addressing "exceptional circumstances such as correcting clerical errors, fraud or obvious ambiguity". This does not allow me to consider new facts or evidence submitted after the entry of my decision. The reasons I imposed this requirement are due to the length of the driveway easement in its westerly extension from Farr Road, the fact that it will abut an existing lot for 110 feet (essentially making it a "corner" lot), dust and noise concerns raised by abutting owners at the public hearing, and the urban setting of the proposed lots. But for the paving requirement, I would have found that the design, shape and orientation of the lots in the project were inappropriate for the residential uses proposed for the site, and the character of the area. I have not "singled out" Mr. Clinton in imposing this paving requirement. I imposed a similar paving requirement in my July 2, 2001 decision in File No. PE -1885- 01, where I approved a preliminary plat to divide 2.34 acres into seven (7) single-family lots. The private driveway in that case also served three (3) lots, had a similar length to the driveway in the current case, and abutted the back yard of two existing residences. Similar design issues will probably be encountered in platting and short -platting other small "fill-in" properties within the County's IUGA/UGA boundaries. This does not mean that I would require paving for all driveways.
