Further, the mobile home appears to be occupied. For the purpose of providing minimum building standards on all new construction, including mobile homes, to safeguard health and safety, a building permit is required in accordance with Section 301 of the Uniform Building Code as adopted by Spokane County. Also, our files indicate that you have received approval of',your short plat application, number SP -86-426, on April 15, 1986. However, the plat has not been finalized. The intent of this letter is to request that you initiate appropriate action to file your short plat and obtain the requested permit within thirty (30) days of the date of this letter. Please be advised that failure to comply with this request will result in further action by Spokane County, including the assessment of a double fee in accordance with Section 304(d) of the Uniform Building Code. Davis, of the Spokane County Department of Building & Safety, has contacted our office regarding an alleged violation of Section 301 of the Uniform Building Code in connection with the double -wide mobile home located at the above address. Specifically, it is alleged that you have failed to obtain required building permits for that double -wide mobile from the Spokane County Department of Building & Safety. Please be advised that a violation of the Uniform Building code constitutes a misdemeanor. As such, it is punishable by up to ninety (90) days in jail, a fine of up to $500.00, or by both such fine and imprisonment. Please take immediate steps to obtain the required permits. DAVIS, being first duly sworn on oath, deposes and says: I. That I am employed as a Code Compliance Coordinator for Spokane County, Department of Building and Safety. II. That in the course of my employment, it was reported to me on July 24, 1986 that a mobile home had been located on property located at North 515 Farr Road without the issuance of a building permit. The mobile home is occupied. III. That upon receipt of the foregoing information, I conducted a thorough search of Building and Safety's permit records, finding that no permit had been issued for the mobile home. However, records indicate that on April 18, 1986 an application for a double wide mobile home was submitted for review by the owner, Jon Johnson, residing at North 515 Farr Road. A permit could not be issued pending completion of subdividing the property. IV. That an application for a short plat was filed with the Planning Department on March 12, 1986 and received preliminary approval on April 15, 1986. The final filing of the short plat by Mr. Johnson would allow the issuance of a building permit. V. That on December 15, 1986 a written notice was mailed to the owner, Jon Johnson, stating his application had been on file for more than six months and would be voided unless an extension is requested. No such request was made. VI. That on July 27, 1987 notice was mailed advising Mr. Johnson to complete his subdivision of property and obtain the building permit. A period of thirty days was extended. VII. That on November 3, 1987 a written final notice was mailed to Mr. Johnson directing that unless a building permit was issued within ten days, the matter would be referred to the County Prosecuting Attorney for legal action. VIII. Due to the failure of the owner, Mr. Jon Johnson, to comply with County Code requirements after due notice, and the fact that the residence continues to be occupied, I referred the file documents to Ronald Arkills, Deputy Prosecuting Attorney, Civil Division, requesting assistance. On April 5, 1988, a final notice was issued by Deputy Prosecuting Attorney Arkills granting a period of thirty days to bring the residence into compliance with all applicable statutes and ordinances. IX. Based on the foregoing information, there is probable cause to believe that the above Jon Johnson did criminally violate Section 301 of the Uniform Building Code and Section 3.10.020 of Title 3, Spokane County Code, by failing to obtain the required building permit and by allowing said mobile home to be occupied without final inspection and approval by the Building Officia .
