' 12. The applicant has demonstrated that condinons have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified.
13 The proposed zone reclassification and varlance request will not be detrimental to the
public health, safety, morals or welfare.
14. The Committee additionally finds/concludes:
a. The proposed setback variance is justified, given the physical characteristics of
the site, and hardship imposed due to required nght of way dedications and future
acquisirion areas.
b. The applicant requested reducnon of landscaping on the east property line from
15 to 10 feet to provide addhnonal area for off-street parlang. The Hearing
Examiner Committee supports this request and has provided a modhfied condition
of approval herein.
c. The Hearing Examiner Committee finds the applicant's request to modify County
Engineer's condition requinng paving of Dalton Avenue is justified, and that
alternative condiaons allowing for improvement of Dalton Avenue through a
Road Improvement Distnct (RID) or County Road Project (CRP) are acceptable.
d. 1he applicant shall maintain requved landscaping consistent with maintenance
standards specified in the Spokane County Zoning Code.
CONDTTIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
~ 1. All Cond.itions imposed by the Heanng Exarruner Committee shall be binding on the
"Applicant," which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest

HEARING EXAMINER COMMITTEE
1. County Planning Department Condihon No. 2 is amended to read as follows:
A specific landscape plan, planting schedule and provlsions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance '
bond for the project pnor to release of building permuts Landscaping shall be
installed and maintained such that sight distance at access points is not obscured or
impaired. Landscape plan shall illustrate up to 10' of Type III landscaping adjacent
Flora Road, Euclid Avenue, Dalton Avenue, and east property line
2. County Englneer's Condition No 10 is amended to read as follows•
To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any

petition or resolution which purpose is the forniation of a Road Improvement
Distnct (RID) for said improvement, pursuant to RCW 36 88, as amended
Spokane County will not participate in the cost of these improvements This is
applicable to Flora Road, Euclid Avenue, and Dalton Avenue.
3. County Engineer's Condition No. 11 is amended to read as follows
As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by,joining and pamcipahng in a County Road Project
(CRP) to the extent of the required improvement Spokane County will not
parncipate in the cost of these improvements. This is applicable to Flora Road,
Euclid Avenue, and Dalton Avenue.
4. County Engineer's Condinon No. 14 is amended to read as follows: The County
Engineer has designated Typical Roadway Secaon Number 4ne, Local Access
standard for the improvement of Dalton Avenue, which is adjacent to the proposed
development. This will requue the addhnon of approximately 40 feet of asphalt
along the frontage of the development. The construction of curbing and sidewalk is
also required.
5.. County Engineer's Condinon No. 22 is amended to read as follows:
Applicant shall sign and record Spokane County Nonce to the Public No 6 which
specifies the following•
The owner(s) or successor(s) in interest agree to authonze the County to place thevr
name(s) on a pention for the formahon of a Road Improvement Distnct (RID) by
the petition method pursuant to Chapter 36 88 RCW, which pention includes the
. owner(s) property, and further not to object, by the signing of a ballot, the
formation of a RID by the resolution method pursuant to Chapter 36.88 RCW,
which resoluaon includes the owner(s) property If an RID is formed by either the
petirion or resolution method, as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree•
(1) that the unprovement or construction contemplated within the proposed RID
is feasible;
(2) that the benefits to be denved from the formaaon of the RID by the property
included therein, together with the amount of any County parncipation, exceeds the

COUNTY PLANNING DEPARTMENT

3. The applicant shall develop subject property generally in accordance within the
concept presented to the Heanng Examiner Committee Vanaaons, when approved
by the Planning Director/designee, will be permitted, including, but not limited to
the following changes: building locanon, landscape plans, and general allowable
uses of the permitted zone. All variations must conforrn to regularions set forth in
the ZONING CODE FOR SPOKANE COUNTY The onginal intent of the
development plans shall be maintained
4. The specific development plan will be submitted for Plammng Department review
and approval pnor to issuance of building permits.
5. All current standards of the Light Indusmal (I-2) Zone, as amended, shall be
complied with in the development of this site
6. The present proposal is not detailed enough to determine whether or not the use of
or matenals stored on the site are in compliance with Secnon 14.706 (Aquifer
Sensiave Area Overlay Zone) of the ZONING CODE FOR SPOKANE COUNTY.
Accordingly, as a condition of approval, the sponsor/applicant shall be required to
file with the Spokane County Auditor, within thirty (30) days of the signing of
Findings and Order of the final decision in this matter, a"Nonce to the Public"
which shall provide in matenal as follows:

12. The applicant shall submit a final site development plan consistent with proposed
Vanance request, and Planning Depaitment recommendahon, to illustrate a 40 foot
structural setback from the centerline of Dalton Avenue and not less than a 10 foot
setback from the north property line.
- COUNTY ENGINEER'S OFFICE
Pnor To The Issuance Of A Building Permit Or uje Of The Prooerty As Pronosqd:
1. Applicant shall dedicate 2 feet on Flora Road for nght-of-way.
2. Applicant shall dedicate 5 feet on Dalton Avenue for nght-of-way.
3. Apphcant shall dedicate 10 feet on Euclid Avenue for nght-of-way.
4. The applicant shall dedicate a 40-foot rachus on Dalton Avenue and Flora Road.
5. The applicant shall dedicate a 40-foot radius on Euclid Avenue and Flora Road.
6. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
7. The applicant shall submlt for approval by the Spokane County Engineer road,
drainage and access plans.
8. The applicant shall subnut for approval by the Spokane County Engineer and the
Spokane County Health Distnct a detailed combined on-site sewage system plan
and surface water disposal plan for the ennre project, or pornon thereof, if the
development is to be phased.
9. A parlang plan and traffic cu-culanon plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance wlth standard traffic engineenng practices Paving or
surfacing as approved by the County Engineer, will be required for any poruon of
the project which is to be occupied or traveled by vehicles
10. To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any

Euclid Avenue only. NOTE: This condition was amended by the Hearing
Exarruner Committee. See Heanng Examiner Committee Condltion No. 3.
12. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
13. The County EngYneer has designated Typical Roadway Section Number One,
Collector Artenal standard for the improvement of Euclid Avenue, which is adjacent
to the proposed development This will require the addition of approximately 9- 11
feet of asphalt along the frontage of the development. The construcrion of curbing
and sidewalk is also required
14. The County Engrneer has designated Typical Roadway Secnon Number One, Local
Access standard for the improvement of Dalton Avenue, which is adjacent to the
proposed development. This will require the addition of approximately 30 feet of
asphalt along the frontage of the development. The construction of curbing and
sidewalk is also requued. NOTE. This condinon was modified by the Heanng
Examiner Committee. See Heanng Examiner Conditlon No 4
15. The County Engineer has designated Typical Roadway Secnon Number One,
Secondary Arterial standard for the improvement of Flora Road, which is adjacent
to the proposed development. This will require the addition of approximately 12 -
14 feet of asphalt along the frontage of the development. The construcnon of
curbing and sidewalk is also requued.
16. All requued improvements shall conform to the current State of Washington
Standard Specificanons for Road and Bndge Construction and other applicable
County standards and/or adopted resolunons pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer
17. Applicant shall construct a paved and delineated approach(es) to meet the existing
pavement on Euclid Avenue and Dalton Avenue.
18 Access to Flora Road shall be prohibited until such nme as specifically authonzed
by the Spokane County Engineer
19. Roadway standards, typical roadway sectlons and drainage plan requirements are
found in Spokane Board of County Commissloners Resolution No. 80-1592 as
amended and are applicable to this proposal
20. No construchon work shall be perfonned within the exishng or proposed public
nght-of-way until a permit has been issued by the County Engineer All work

County Engineer.
21. All required construction within the existing or proposed public right-of-way is to
be completed prior to the release of a building permit, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer
22. Applicant shall sign and record Spokane County Nohce to the Public No. 6 which
specifies the following:

23. The County Arterial Road Plan identifies Flora Road as a Pnncipal Artenal. The
exisang nght-of-way width of 60 feet is not consistent with that specified in the
Plan. In order to implement the Artenal Road Plan, in addition to the required
nght-of-way detiication, a smp of property 18 feet in width along the Flora Road
frontage shall be set aside in reserve This property may be acquired by Spokane
County at the time when artenal improvements are made to Flora Road
24. The Counry Artenal Road Plan identifies Euclid Road as a Minor Artenal The
existing nght-of-way width of 40 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addition to the required
nght-of-way dedication, a smp of property 10 feet in width along the Euclid
Avenue frontage shall be set aside in reserve This property may be acquired by
Spokane County at the time when artenal improvements are made to Euclid
Avenue.

' 25. Applicant should be advised that should Euclid Avenue cross street traff'ic become a
traffic safety problem due to the same business on either side of Euclid Avenue,
channelization of Euclid Avenue may be constructed at the applicants expense.
COUNTY UTILITIES DEPARTMENT
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer disposal systems is hereby authonzed. This authorization is
conditioned on compliance with all n,les and regulations of the Spokane County
Health Dismct and is further conditioned and subject to specific applicaaon
approval and issuance of pernuts by the Health District.
2. The dedicaaon shall state: "The owner(s) or successor(s) in interest agrcee to
authorize the County to place their name(s) on a petition for the formation of ULID
by petition method pursuant to RCW 36.94, which the petition includes the
owner(s)' property, and further not to object by the signing of a protest petition
against the formanon of a ULID by resolunon method pursuant to RCW Chapter
_ 36.94 which includes the owner(s)' property. PROVIDED this condition shall not
prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the
property as a result of improvements called for in conjuncuon with the formaaon of
a ULID by either petihon or resolunon method under RCW Chapter 36 94 "
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended
4. The dedication shall state: "Each structure/unit shall be double-plumbed for
connection to future areawnde collecaon systems "
J COUNTY HEALTH DISTRICT
1. A combined surface water and sewage dlsposal detailed plan shall be approved by
the County Engineer and the Spokane County Health Distnct pnor to the issuance
of any building permit for this project
2. Sewage disposal method shall be as authonzed by the Duector of Utilities, Spokane
County.
3. Water service shall be coordinated through the Director of Uhlines Spokane
County.
4. Water service shall be by an existing public water supply when approved by the
Reglonal Engineer (Spokane), State Department of Health Services.
5. Disposal of sewage effluent beneath paved surfaces is currently prohibited
6. Subject to specific applicanon approval and issuance of permits by the health
officer, the use of (an) individual on-site sewage disposal system(s) may be
authonzed NOTE: A maximum density of 3600 gallons of wastewater per acre of
gross land area shall be allowed.
7. Use of pnvate wells and water systems is prohibited

' COUNTY BUILDING AND SAFETY DEPARTMENT
1. The applicant shall contact the Department of Building and Safety at the earliest
possible stage of design/development in order to be informed of Code requuements
administered/enforced by the department, e g, State Building Code Act regulations
such as requirements for fire hydrant/f7ow, fire apparatus access roads, street
address assignment, barrier-free regulations, energy code regulations, and general
coordination with other aspects of project implementaaon.
2. The issuance of a building permit by the Department of Building and Safety is
requumd.
3. Requirements of Fire Dismct No. 1 need to be saasfied during the building pernut
process.
SPOKANE COUNTY AIR PnLLUTION CUNTROL AUTHORITY
_ 1. All air polluhon regulations must be met This includes but is not limited to the
following•
2. Au polluaon regulaaons requu-e that dust emissions dunng demolition, excavanon
and construction projects be controlled This may requue use of water sprays,
tarps, sprinklers, or suspension of activity dunng certain weather conditions. Haul
roads should be treated and emissions from the a-ansfer of earthen material must be
controlled as well as emissions from all other construcdon related acdvities.
3. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces If tracking or spills occur on paved surfaces,
~ measures must be taken immediately to clean these surfaces
4. All travelled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean
5. SCAPCA Regulation I, Arncle V requires that a Notice of Constniction and
Apphcauon for Approval be submitted to and approved by our Agency pnor to the
construcaon, installation or establishment of an au pollunon source.
6. SCAPCA Regulation I, Article VI and SCAPCA Regulation II, Article N addresses
emission standards. All emission standards must be met
7. Solid fuel heating device regulations must be met. Curtailment penods occur when
au pollution levels are elevated. A source of heat other than a pellet stove is needed
if applicant intends to have heat dunng curtailment penods.

The Heanng Examiner Committee, pursuant to the above Findings of Fact and
Conclusion, APPROVES the application of Spokane Pres-to-Log for a zone
reclassification and vanance as described in the applicahon or as herein modified.

combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof if the
development is phased.
E45 A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
location and arrangement of parking stalls shall be in
accordance with standard engineering practices. Paving or
surfacing as approved by the County Engineer will be required
for any portion of the project which is to be occupied or
traveled by vehicles
E46 To construct the roadway improvements stated herein, the
applicant may, with the approval of the County Engineer, Join in
and be willing to participate in any petition or resolution
which purpose is the formation of a Road Improvement District
(RID) for said improvement pursuant to RCW 36.881 as amended.
Spokane County will not participate in the cost of these
improvements. This is alplicable to Flora Road and Euclid Avenue
only.
E97 As an alternative method of constructing the road improvements
stated herein, the applicant may, with the approval of the
County Engineer, accomplish the road improvements stated herein
by joining and participating in a County Road Project (CRP) to
the extent of the required improvement. Spokane County will not
participate in the cost of these improvements. This is
applicable to Flora Road and Euclid Avenue only.
E48 The construction of the roadway improvements stated herein shall
be accomplished as approved by the Spokane County Engineer.
E50 The County EnginePr has designated Typical Roadway Section
Ni_lmber One* Collector Arterial standard for the improvement of

I. GENERAL INFORMATION

Location: Generally located east of and adjacent to Flora Road between Dalton
Avenue and Euclid Avenue in the Southwest 1/4 of Secnon 6, Township 25 N,
Range 45 EWM, Spokane County, Washington.
- Proposal: Zone reclassification from Agncultural (A) to Light Industnal (I-2), on
approxunately 2.3 acres for the purpose of developing an industnal warehouse, and
Variance from minimum front yard setback requirements of the Light Industrial (I-2)
' Zone.
II. SITE ANALYSIS
Comprehensive Plan: Category is Indusmal and inside the General Sewer Service
Area (GSSA) Boundary, inside the Prionty Sewer Service Area (PSSA) Boundary
and inside the Urban impact Area (UTA) Boundary.
The Industrial category is a land use designation designed to provide for the
opportunity for industrial development to be composed of a variety of industrial,
manufacturing and transportation uses. Proposed Light Industrial (I-2) Zone serves
to implement the Industrial category and is consistent with goals, objectives, and
decision guidelines of said category.
Arterial Road Plan: The Arterial Road Plan designates Flora Road as a Principal
Arterial - without controlled access. To implement Artenal Road Plan objecrives,
Principal Artenals should have an ultimate nght of way width of 100 feet, with
required setbacks measured from this ultimate nght of way. Existing Flora Road
right of way of 60 feet is inadequate to implement the Arterial Road Plan. Therefore,
in addition to the required 2 foot dedication, a stnp of property 18 feet in width
adjacent Flora Road should be set aside in reserve as a future acquisition area.
_ Euclid Avenue is designated as a Minor Artenal by the Artenal Road Plan, which
suggests an ultunate nght of way width of 80 feet for Minor Artenals with required

setbacks measured 35 feet from the ulamate nght of way. Existing Euclld Avenue
nght of way width of 40 feet is inadequate to implement Arterial Road Plan pohcies.
Therefore, in addition to the required 10 foot dedication, a strip of property 10 feet in "
width adjacent Euchd Avenue be set aside in reserve as a future acquisition area.
Dalton Avenue is not affected by Arterial Road Plan policies. However, the Spokane
County Engineer has requested dedication of 5 feet of additional right of way adjacent
Dalton Avenue. Implementation of recommended nght of way dedications and future
acquisirion areas will require modificarion of proposed site plan.

Sensitive Area Overlay Zone.

the established land use trend in the area adjacent to the Spokane Industnal Park.

Spokane County Comprehensive Plan.

January 1, 1991, existing zoning classificanons in the area will crossover to the

Proposed site plan also indhcates three vehicular access points to Euchd Avenue and Dalton Avenue, and no access to F1ora Roa.d. Site plan does not illustrate required
right of way dedications, future acquisihon areas, or provide 40 foot radius at
intersections of Flora Road and Dalton Avenue, and Flora Road and Euclid
Avenue.
Site plan does illustrate proposed Variance from the rrunimum front yard setback
requirements of the Spokane County Zoning Code and Light Industrial (I-2) Zone,
to allow a 40 foot setback from the centerline of Dalton Avenue and a 15 foot
setback from the property line, whereas the proposed Light Industrial (I-2) Zone
requires a front yard setback of 65' from the centerline of the road right of way and
a 35' setback from the front property line. Variance Analysis section of this report
wnll analyze the variance request in greater detail.
Variance Analysis: The applicant has requested a Vanance from the minimum
front yard setback requirements of the Spokane County Zoning Code and Light
Industrial (I-2) Zone, to allow a 40 foot setback from the centerline of Dalton
Avenue and a 15 foot setback from the north property line; whereas the proposed
I-2 Zone specif'ies a front yard setback of 65 feet from the centerline of the road
right of way and a 35 foot setback from the front property line. In variance request,
the apphcant contends that the lot width is narrow, and that setback requuements
affect normal use of site due to the fact that the subject property is adjacent to three
streets, each of which requues a frontyard setback as specified by the Spokane .
County Zoning Caie. The applicant also states that the proposed 40 foot setback
from the centerhne at Dalton Avenue is not detrimental to the general public,
environment, or adjacent properties. In addition, the proponent contends that stnct
apphcation of required setbacks affects the ability to ualize the subject property.
Given the above informanon, and physical charactenstics of the subject property,
the Planning Department response is as follows:
• The subject property is somewhat unusual in shape, and is affected by unique
situation of having frontage on three streets, and having to maintain three front yard
setbacks. Size and shape of sub,Ject property is a nunor hardship in site design and
development Site configurarion may allow a reasonable use of the site without a
variance. However, alternate design may not allow use of property as proposed.
• Use of subject property is further affected by required right of way ded.icarions and
unplementation of Artenal Road Plan policies. Said right of way dedications and
future acquisiaon areas wnll result in reducrion of 10 feet of buildable area adjacent
Euclid Avenue and Flora Road. If the applicant wants to retain the proposed 15
foot setback along the north property line, then 5 feet of bufldable area would be
lost as a result of the nght of way dedicaaon adjacent Dalton Road. Reduction of
buildable areas as result of above stated dedicanons and future acquisinon areas are
a hardship applicable to the parcel and support proposed vanance.

• Apphcant's statement that proposed vanance is not detnmental to general public,
environment, and adjacent propemes is a subjective statement which may or may
not be supported through public tesnmony or long-range development of area,
especially along Dalton Avenue.
• Smct applicanon of requued setback only marginally affects the ability to utilize the
property in a reasonable manner. As stated previously, use of property is affected
more substantially by implementation of Arterial Road Plan policies and dedication
of addirionai nght of ways.
In recognition of the above statements, the Planning Department recommends that
the site plan be mod.ified to illustrate compliance with recommended nght of way
dedications and future acquisition areas, and that proposed setback vanance to
allow a 40 foot setback from centerline of Dalton Avenue and not less than a 10 foot
setback from north property line, be approved This recommendation recognizes
that subject property does have a hardship of a degree necessary to support the
proposed variance.

The site plan submitted for revlew by the Hearmg Examiner Committee is
general in nature. Detailed review to detemune compliance with all Ordinance
regulanons and condiaons of approval is recommended to be administrative and
to occur at the Building Permit stage.
III. SITE DEVELOPMENT RECOMMENDATIONS
Design:
Site plan revisions will be necessary to illustrate dedicanon of addinonal right of way
adjacent to F1ora Road, Euclid Avenue and Dalton Avenue, and to illustrate future
acquisition areas adjacent Euchd Avenue and Flora Road.
Implementation of Arterial Road Plan policies, dedication of additional right of way,
and measurement of required setbacks from ultimate nght of ways will result in
reducrion of 10 feet of building area adjacent Euclid Avenue and Flora Road.
Dedicauon of 5 feet of addhnonai nght of way adjacent Dalton Avenue will reduce
proposed 15 foot setback from north property line to a 10 foot setback. However,
proposed building would sall be located 40 feet from the centerline of Dalton Avenue.
If the applicant wants to retain the proposed 15 foot setback from the north property
line, then 5 feet of building area would be lost as a result of the requimd right of way
dedication. Variance request is to allow a 40 foot setback from the centerline of
Dalton, and a 15 foot setback from the north property line. Required 5 foot right of
way dechcaaon along Dalton Avenue does not substantially alter proposed vanance,
in that 40 foot setback from centerline of Dalton Avenue is maintained.
Administranve review of specific site plan is recommended, and to occur at building
pemut stage, with careful attention to monitor required parking, setbacks, right of
way dedicaaons, and future acquisinon areas.

Landscaping/Buffering:
Provision of 5 feet of Type III landscaping adjacent to Flora Road, Euclid Avenue, and Dalton Avenue is required, and conslstent with Spokane County Zoning Code if
said landscaping is continuous (excluding driveways). However, the Planning
Department recommends that applicant provide a minimum of 10 foot of Type III -
landscaping adjacent to Dalton Avenue, Euclid Avenue, Flora Road, and provide a 15
foot wide Type III landscape strip adjacent the east property line. This
recommendauon is consistent with the proposed site plan, (excluding Flora Road)
and provides a visual/aesthenc buffer, and will rrutigate effects of proposed setback
vanance adjacent Dalton Avenue. Muior site plan revision will be necessary to
comply with this recommendation.
Proposed Light Industrial (I-2) Zone also requires provision of one off-street loadhng
space, and that storage of all raw materials, finished products, machinery and
equipment, including company-owned trucks or vehicles shall be within an entirely
closed building or sight-obscunng non-pierced fence not less than six feet in height
and to a height to screen machinery and vehicles from view at ground level.
Submittal of a detailed landscape plan in comphance with requuement of Spokane
County Zoning Code and Planning Department recommendations is required.
Administrative review of specific landscape plan is recommended and to occur at
budding permit stage of project.
Signage:
As per Light Industrial (I-2) Zon,e standards, which allow one detached sign not to exceed 40 square feet in area, and no more than 20 feet above grade.
Circulation/Access: '
Access to subject property is provided by three curb cuts each to Dalton and Euchd
Avenues. Proposed site plan does not indicate access to Flora Road. Spokane
Counry Engineer has recommended that access to Flora Road be prohibited until as
authorized by the Spokane County Engineer.
Stormwater Drainage:
Prior to release of building pemut the apphcant must subrrut a drainage plan
illustrating compliance with '208' regulations.
Sewage Disposal:
Use of an on-site sewage disposal system is anacipateci, with the sripulation that a
maximum density of 3600 gallons of wastewater per acre of gross land be allowed.
In addition, structure shall be double plumbed for connection to future area-wide
collection systems.
Water Supply:
To be supphed by Consolidated Imgation Dismct when arrangements have been
completed. _

I V. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, posslble
standard Condirions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has determuned that "No
probable signlf'icant adverse impacts" would result from the proposal being developed
and has issued a Determination of NonsiQmficance ("DNS").
The "DNS" was cu-culated to 7 other agencies of junsdiction and other agencies/
deparaments affected by the future development for review and comment. The
"DNS"comment penod ends July 17, 1990 and was advertised 15 calendar days
- before said date in the newspaper, by letter to adjacent property owners witbin 400
feet of the proposal, and by norice on a sign posted on the proposal site. The Heanng
Examiner may consider additional environmental related testimony at the public
- hearing.
V . PLANNING DEPARTMENT SUMMARY
Proposed zone reclassification is consistent with, and implements Industrial category
of Comprehensive Plan, and is compatible with existing land uses and trends in area.
Proposed Vanance is supported by analysis of physical characteristics of site and
hardship due to nght of way dedications and future acquisinon areas. Plammng
Department recommends approval of proposed Zone Change and Variance, as
condirioned.
VI. CONDITIONS OF APPROVAL
i. All Conditions imposed by the Hearing Examiner Committee shall be
binding on the "Applicant," which term shalt include the owner or
owners of the property, heirs, assigns, and successors.

COUNTY PLANNING DEPARTMENT
1. The Planning Director/designee shall approve a specific exterior hghting plan for the approved area pnor to installation of such lighting. (Such plan shall attempt to
confine illumination to the area with full consideration to adjacent properties)
2. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained such that sight distance at access points is not obscured or
impaired. Landscape plan shall illustrate up to 10' of Type III landscaping adjacent
Flora Road, Euclid Avenue, and Dalton Avenue, and provide up to 15' Type IIT
landscaping adjacent the east properry line.
3. The applicant shall develop subject property generally in accordance wnthin the
concept presented to the Hearing Examiner Committee. Variations, when approved
by the Planning Duector/designee, wfl1 be peruutted, including, but not lumted to
the following changes: building location, landscape plans, and general allowable
uses of the pemutted zone. All vananons must conform to regularions set forth in
the ZONING CODE FOR SPOKANE COUNTY. The onginal intent of the
development plans shall be maintained.
4. The specific development plan will be subnutted for Planning Department revlew
and approval prior to issuance of buildzng permits.
5. All current standards of the Light Industnal (I-2) Zone, as amended, shall be
complied with in the development of tlus site.
6. The present proposal is not detailed enough to detennine whether or not the use of
or materials stored on the site are in compliance with Section 14.706 (Aquifer

9. A parlang plan and traffic circularion plan shall be subnutted and approved by the
Spokane County Engineer. The design, location and arrangement of parlang stalls
shall be in accordance with standard traffic engineering pracrices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
_ 10. To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any
petition or resolution which purpose is the fonnanon of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36.88, as amended.
Spokane County vvill not participate in the cost of these improvements. This is
applicable to Flora Road and Euclid Avenue only.
11. As an alternative method of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
unprovements stated herein by joining and parncipaang in a County Road Project
(CRP) to the extent of the requued improvement. Spokane County will not
participate in the cost of these improvements. This is applicable to Flora Road and
Euclid Avenue only.
12. The construction of the road unprovements stated herein shall be accomplished as
approved by the Spokane County Engineer,
13. The County Engineer has designated Typical Roadway Section Number One,
Collector Artenal standard for the improvement of Euclid Avenue, which is adjacent
to the proposed development. This will require the addirion of approxirnately 9- 11
feet of asphalt along the frontage of the development. The construction of curbing
and sidewallc is also required.
14. The County Engineer has designated Typical Roadway Section Number One, Local
Access standard for the improvement of Dalton Avenue, which is adjacent to the
proposed development. This will requue the addiaon of approximately 30 feet of
asphalt along the frontage of the development. The construcrion of curbing and
sidewalk is also required.
15. The County Engineer has designated Typical Roadway Section Number One,
Secondary Arterial standard for the improvement of Flora Road, which is adjacent
to the proposed development. This wfll require the addinon of approximately 12 -
14 feet of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.
16. All required improvements shall conform to the current State of Washington
Standard Specif'ications for Road and Bndge Construcrion and other applicable
County standards andlor adopted resolurions pertaining to Road Standards and
. Stonnwater Management in effect at the date of construcnon, unless otherwise
approved by the County Engineer.

17. Applicant shall construct a paved and dehneated approach(es) to meet the existsng
pavement on Euclid Avenue and Dalton Avenue. 18. Access to Flora Road shall be prohibited until such nme as specifically authorized
by the Spokane County Engineer.
19. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
20. No construction work shall be performed within the exisang or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
21. All required construction within the existing or proposed public right-of-way is to
be completed prior to the release of a building pernut, or a bond in an amount
esamated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer. '
22. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
spec~'ies the following:
The owner(s) or successor(s) in interest agree to authonze the County to place their _
name(s) on a petition for the formation of a Road Improvement District (RID) by
the petition method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s) property, and further not to object, by the signing of a ballot, the n
fonnation of a RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s) property. If an RID is formed by either the
petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s)
or successor(s) further agree:
(1) that the irnprovement or construction contemplated within the proposed RID
is feasible;
(2) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation, exceeds the
cost and expense of formanon of the RID; and
(3) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment on the property as a
result of the improvements called for in conjunction wnth the formation of the RID
by either petirion or resolunon method under Chapter 36.88 RCW. This condition
is applicable to Flora Road and Euclid Avenue only.
23. The County Arterial Road Plan idenrifies Flora Road as a Pnncipal Arterial. The
existing right-of-way width of 60 feet is not consistent with that specified in the
Plan. In order to implement the Artenal Road Plan, m addition to the required
nght-of-way dedicarion, a strip of property 18 feet in width along the Flora Road

frontage shall be set aside in reserve. Thus property may be acquired by Spokane
. County at the time when artenal improvements are made to Flora Road.
24. The County Arterial Road Plan identifies Euclid Road as a Minor Artenal. The
- existing nght-of-way width of 40 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addition to the required
right-of-way dedicarion, a strip of property 10 feet in width along the Euclid
Avenue frontage shall be set aside in reserve. This property may be acquu-ed by
Spokane County at the time when arterial improvements are made to Euchd
Avenue.
25. Applicant should be advised that should Euclid Avenue cross street traffic become a
traffic safety problem due to the same business on either side of Euclid Avenue,
channehzanon of Euclid Avenue may be constructed at the applicants expense.
COUNTY UTILITIES DEPARTMENT
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer d.isposal systems is hereby authonzed. This authorization is
condhaoned on compliance with all rules and regulations of the Spokane County
Health Ihstrict and is further conditioned and subject to specific application
approval and issuance of permits by the Health District
2. The dedication shall state: "The owner(s) or successor(s) in interest agree to
- authorize the County to place theu name(s) on a perition for the formaaon of ULID
by petiaon method pursuant to RCW 36.94, which the petition includes the
owner(s)' property; and further not to object by the signing of a protest petition
- against the formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the owner(s)' property. PROVIDED this condition shall not
prohibit the owner(s) or successor(s) from objecring to any assessment(s) on the
property as a result of improvements called for in conjunction with the formation of
a ULID by either petition or resolution method under RCW Chapter 36.94."
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.
4. The dedication shall state: "Each structure/unit shall be double-plumbed for
connection to future areawnde collection systems."

1. A combined surface water and sewage disposal detailed plan shall be approved by
the County Engineer and the Spokane County Health District pnor to the issuance
of any building pernut for this project.

Thank you for sharing your knowledge with me regarding the above. You did
help to clarify a point or two.
T should like to request consideration of the following however:
Bottom of page 2, ESO with reference to Dalton Ave. It states that the
applicant wi11, at his expense, have to sidewalk, curb and pave Dalton
30 ft. along the frontage of the project. As we discussed, the possibzlity
exists that a request will be made to vacate Dalton Ave. from Flora to
a point 600 ft. East of F1ora right-of-way. Thls would involve the
applicant, Matchette Trucking, and Larry & Joan Lock; the only "persons"
fronting on Dalton Ave. for that distance. Other properties fronting on
Dalton Ave. would have access from Tschirley Road and would not be effected.
I would request that if the vacate becomes a fact, that the paving, curbing,
and sldewalk requirement for Dalton Ave. be waived.
Please remember that Dalton and Euclid Avenues wound up closer than is norm3l-
or real.
