provides 6.3 units per acre, or an approximate manufactured home
stall siZe of 6,580 square feet. The Comprehensive Plan Text
recommends a variety of housing types with buEfering between uses to
make them compatible.

BUFFERING TEGHNIQUES: The gponsor indicates an his site plan that a
b-foot sight-obscuring fence is to be located along the north, west,
and easC property lines with a hedge to be provided aloeg the south
property line.
OTHER SITE PLAN CONSIDERATIONS: The site plan shows three tqpical
lot developments; typical lots 1(2 lots located along Buckeye) can
accommodate double-wides as well as can typical Lots 3(2 lots
located at the north end of the private cul-de-sac). The typical
lots 2(18 lots located within the interior) are indicated for
single-wide manufactured homes. Each individual lot is to be
landscaped within ninety (90) days of occupancy of the unit.
IV. CONCLUSION: This praject is consisteat with the general housing types and
densities of the area, although past developments have been for individual
lot ownerships.

a) COUNTY PLANNING DEPAItTMENT
1. That a 6-foot sigbt-obscuring fence be provided along the north,
west, and east propertp lines. Also, that an evergreen hedge,
maintained in compliance with the "Clear-View Triangle"
pYOVisions, be provided along tbe south property line. .
2. 'i'he Zoning Administrator ahall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illuminatioa
to the area with full consideration to adjacent proper[ies).
3. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
pro3ect prior to release of building permits. Tandscaping shall
be installed and maintained such that sight distance at access
poiats is not obscured ot impaired.
4. The applicant shall develop subject property generally in
accordaace within tbe concept preseated to the Aearing Examiner
Committee. Variations when approved by the Zoniag Administrator
will be permitted, including, but not limited to the followiag
~ changes: Building location, landscape plans, and general
allowable uses of the permitted zoae. All variations must
canform to regulations set forth in the Spokane Coun[y Zoning
Ordinance. The original intent of the development plans shall
be maintained.
5. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
6. All current standgrds of the Residential Manufactured Home Zone,
as amended, shall be complied with in the development of this .
site.
7. That the project is subject to Section 4.16A.050, the Aquifer
Sensitive Area Overlay Zone of the Spokane County Zoning
Ordinance, which aeta forth various measures for Aquifer
protection; specffically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.

obtained from the Spokane County Engineer.
2. Applicant shall improve Buckeqe Avenue in a manner consistent
with Spokane County TYPICAL roadway section No. 2 minimum paving
width Access Standard. Improvements to be constructed oa north
aide of Buckeye along the frontage of the proposed zone change.
3. Applicaat shall submit•for approval by the Spokane County
Engineer road, drainage, aad access plans prior to the issuance
of a building permit on the property.
4. The applicant ahall submit for approval by the Spokane County
Engineer and the Spokane County Aealth District a detailed
combined on-site sewage system plan and sVrface water disposal
plan for the entire project prior to the isauance of anq
building permit on the property,
5. A parking plan and traFfic circulation plan shall be submitted
and approved by the Spokaae County Eugineer prior to the
issuance of a building permit on the propertq. The design,
locetion, and arrangement of parking stalls shall be in
accordance with etandard traffic engineering prac[ices. Paving
or surfaciag as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles. '
6. The word "applicant" ahall include the owmer or owners of the
property, his heirs, assigus, aad successors.
7. The construcrion of the road improvements stated herein shall be
accomplished as approved bq the Spokane County Engineer.

Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
9. Roadway standards, typical roadway sections and drafnage plan
requirements are found in Spokane Board of Couaty
Commissioners'Resolution No. 80-1592 as amended.
c) COUNTY UTILITIES DEPA1tTMENT
1. Pursuant to Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal sqstems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to epecific
application approval and issuance of permits by the Health
District.
2. The owner(s) or Successor(s) in interest agree to authorize the
Countq to place their name(s) on a petition for the formation of
a IILID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuan[ to RCW Chapter
36.94 whtch ineludes the Owaer(s) property. PROVIDED, this
condition shall not prohibit the Owrner(s) or Successor(s) fram
objection to any assessment(s) on the property as a result of
improvements called for in con3unction with the formation of a
IJLID bq either petition or resolution method under ftCW Chapter
36.94.
3. Anq water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each dwelling unit shall be double-plumbed for connectioa to
future areawide collection systems.
5. Plans and specifications for the double plumging are to be
reviewed and approved by the Utilities Department prior to
coastruction.

d) COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Health District prior
to the issuance of any building permit for this pro3ect.
2. Sewage disposal method ehall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to apecffic application approval and issuance of permits ,
by the Health Officer, the use of an individual on-site sewage
system may be authorized.
4. Water service ahall be coordinated through the Director of
Utilities, Spokane Countq.
5. Water service shall be by an exiating public water eupply when
approved bq the Regional Engineer (Spokane), State Department of
3ocial and Health Services.
6. Use of private wells and water sqstems is prohibited.
7. Disposal of sewage eff lueot beAeath paved surfaces is currently

e) COUNTY BUILDIIVG AND SAFETY DEPARIMENT
1. The site is located in Fire District # 1.
2. Approved numbers or addresses shall be placed on all new and
euieting buildings in such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers ehall contrast with theit background.
3. Trash enclosures shall not be located adjacent ro combustible
construction ot underneaCh windowa or nonprotected eaves.
4. A land use permit will be required for each structure.

e) COUNTY BIIILDING AND SAFETY DEPARTMENT (continued)
5. Each structure shall be accessible to Fire Department apparatus
by waq of accesa roadways with all-weather driving surface
capable of supporting the imposed loads of fire apparatus. The
minimum paved roadway width, inside curb face to iaside curb
face, shall be 24 feet with no parking. Parallel parking is
permitted on one side with road widths of minimum 30 feet.
Parallel parking is permitted on both sides with road widths of
minimum 36 feet. Signs noting such ie required For fire lane.
The turaing radius of private roadways and drive aisles shall be
a minimum of 20 feet inside and a minimum 45 feet outside to
curb face. Cul de saca more than 600 feet from the center line
of the nearest cross street shall have a minimum radius of 37
feet, 6 inches (75 feet diameter).
6. Inetallation of f ire hydraats are required to be installed and
serviceable in accordance with the Spokane County Department of
Building and Safety prior to development. The water plan shall
show each fire hydrant and be ia compliance with the provisions
in Chapter 10.04 of the 1979 edition of the Uniform Fire Code.
The present design requires a IDinimum fire f low of 500 g.p.m.
for 30 minutea. The water plan shall specify the gallons per
minute for each fire hydrant at a residual preasure of no less
than 20 p.s.i. (minimum pressure).
7. Where it is desired to have access control gates in residential
developmeats, the followi.ng shall apply:
The n►inimum width of roadway, inside of access gate, shall be
twelve feet (121). There shall be at least two (2) suct► drive
apgroaches where the gates are located. One msy be used For
vehicles exiting. Tire flatting spikea shall not be used unless
the entrance is a minfmum of twenty feet (201) wide. The gates
shall be provided with an approved method of emergency operation
in accordance with the fire department standards. Where each
drive approach ia less than twenty feet (20') in width and
controlled by gates, a secondarq means of access shall be
provided with a clear, twentq feet (20') unobstructed opening.
F) WATER PURVEYOR
1. Water Purveyor is Consolidated Irrigation District #19, and they
will supply the site with adequate water for domestic, f ire and
irrigation uses, although satisfactory arraagements have not
been anade to serve this proposal.

g) COUNTY AIR POLLOTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolitioa, excavation aad coastruction projects be controlled.
This may require use of water sprays, tarpe, sprinklers, or
suapension of activity during certain weather condi tioas. Haul
roads should be treated and emissions from the trarsfer of
eartben material muat be controlled as well as emieaions from
all other conatraction related activities.
2. Meaaures must be taken to avoid the depositioa of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean theae surfacea.
3. All travelled surfaces (ingreas, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odore will likely result during the
construction phase of the project and from motor vehicles using
the site following completion of the project and f com occupants
of [he proposed project.
5. A11 air pollution regulations must be met.

FINDINGS AND ORDER
A. INTRODUCTION '
This matter having come before the Zoning Hearing Euaminer Committee on
January 3, 1985, and the members of the Committee present being
Jane E. Myers, Chafrperson, F. Lqnn Tennican and Richard L. SkalBtad.
B. PROP4SAL
The aponsors, Randy and Jayn Courcheine, are requesting approval of a zone
reclaesification, File No. ZE-75-84, Agricultural to Residential
Manufactured Home, for the purpose of developing a Manufactured Home
Park. Also, a request for a Variance, VE 100-84, to allow a Manufactured
Home Park on less than 5 Acres as required by Section 4.05A.050-(b)-(le)
of the Spokane County Zoning Ordinance, (Approximately 3.5 Acres).
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, manufactured
home subdivieions and cultivated.
2. Ttiat the Compreheneive Plan designetes this area as appropriate for
Urban development.
3. That the existing zoning of the property described in the application
is Agricultural.
4. That the provisious of RCW 43.21C (The State Envirorunental Policy
Act) have been complied with, and the Committee concurs with the
Declaration of Non-Significance.
5. That the proper legal requiremente for advertisement of the Agenda
Item have been fulfilled.
6. That the land in thie area is suitable for the propoeed use, or
uses withia the proposed Zone Claesif ication. That Residential
Manufactured Home zoniag existe to tbe eouth of the proposal, and the
iseue of iadividual lot ownership was not brought up by property
owners at the public hearing.

C. FINDINGS 0F FACT (continued)
7. That the applicant hae demonstrated that conditions have
substautially changed eince the original zoning of this area and
accocdingly, the proposed rezone ie justified.
8. That the propoeed use is compatible with existing uses in the
area. 9. That the ownere of adjacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwiee
detYimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Nearing Examiner Committee:
a) That the proposed manufactured home park will be competible with
the exieting environmeat and neighborhood land use of
manufactured homes in the immediate area.
b) That the Zoning Administrator give consideration to the
landscaping which is planned for the property for that portion
of Che site witb froatage on Buckeqe Aveaue. Landecaping in
this area should be designed in a"stepped" concept similar to
that existing to the aouth of this eite. Landecaping shall be
consistent with the "Clear-View Triangle" requirements.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS AYPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, aseigns, and successors.)
a) COUNTY PLANNING DEPABTMENT
1. That a 6-foot sightrobscuring fence be provided along the north,
west, and eaet property lines. Also, that an evergreen hedge,
maintained in compliaace with the "Clear-View TriaAgle"
ptovisions, be provided along the soutb property line.
2. The Zoning Administrator ehall approve a specific exterior
lighting plan for the approved area prior to inetallation of
such lighting. (Such plan shall attempt to confine illumina[ion
to [he area with full consideration to adjacent properties}.

3. A epecific landecape plan, planting schedule and provisions for ,
maintenance acceptable to the Spokane County Zoning
Adminietrator ehall be submitted with a performance bond for the
project priot to release of building permits. Landscaping shall
be inetalled and meintained such that sight distance at access
points is not obscured or impaired.
4. The applicant shall develop subject property generallp in
accordance within the concept presented to ttte Hearing Examiner
Committee. Variations when approved by tbe Zoning Administrator
will be permitted, including, but not limited to the follpwing
changes: Building location, landscape plans, and general
allowable uses vf the permitted zone. All variations muet
conform to regul8tions set forth in the Spokane Countq Zoning
Ordinance. The original intent of the development plans shall
be maintained.
5. The apecific development plan will be submitted for Planning
Department review and approval prior [o issuance of building
permits.
6. All current etandards of the Residential Manufectured Hame Zone,
as amended, shall be complied with in the development of this
site.
7. That the project is subject to Section 4.16A.050, the Aquifer
Sensitive Area Overlay Zone of the Spoksne Countq Zoning
Ordinance, which sets forth varioue measures for Aquifer
protection; specificallq, meaeures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
8. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58 17 and the Spokane County Platting
Ordlnences prior to iesuance of building petmits.
9. That the provisions of SEPA's NOTICE OF ACTION pursuant [o
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the pro,ject
applicant within thirty (30) daye of final disposition of this
application, and priar to any on-eite improvements.
10. Thar prior to release of building permits, the sponsor shall
eubmit a final Manufactured Home Park design plan to the
Plenning DepaTtment which demon8trates compliance with the
Residential Manufactured Home Zone, Development Standards of
Section 4.05A.050-(b-1-9), and all Heariag Examiner Committee
conditionB of approval.

b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit Or Use Of The Property As
Propoeed : 1. Accesa permit8 for approachee to the County Roed Sqetem shall be
obtained from the Spoksne County Engineer.
2. Applicent shall improve Buckeye Avenue in a manaer coneistent
with Spokane County TYPICAL roadway section No. 2 minimum paving
width Accesa Standard. Improvemeats to be conetructed on north
side of Buckepe along the f rontage of the proposed zone change.
3. Applicant shall submit far approval by the Spokane County
EDgineer road, draitiage, and access pl.ene prior to the issuance
of a building permit on the property.
4. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combiaed on-aite sewage systeID plan and surface water disposal
plan f or the entire project prior to the iesuance of any
building permit on the property.
5. A parking plan and traff ic circulation plan shall be eubmitted
and approved by the Spokane Countq Engineer prior to the
lesuaACe of a building permit on the property. The design,
location, and arrangement of parking etalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing $s approved by the Couaty Engineer, will be
required for any portion of the praject which le to be occupied
or traveled by vehicles.
6. The word "applicant" ahall include the owner or ovners of the
property, his heirs, assigns, and euccessors.
7. The construction of the road improvements stated hereia shall be
accomplished as approved bq the Spokane County Engineer.
8. All required improvements ehall conform to the current State of
Washington Standard Specifications for Road and Bridge
Coastruction, and other applicable County standarde aad/or
adopted resolutions pertaining to Road Standards and Stormwater
Managemeat in effect at the date of construction, unless
otherwise approved by the County Engineer.

requirements are found in Spokane Board of County Commissioners'
Resolution Na. 80-1592 as amended.

a 1JLID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the eigning of a protest petition againet the

36.94 which includes the Owner(s) property. PROVIDED, thie
conditioa shsll not prohibit the Owner(s) or Succeseor(e) from
objection to any assessment(s) on the property as a result of

ULID by either petition or resolution method under RCW Chapter

3. Any water Bervice for this project shall be provided in
accordance with the Coordinated Water Sysrem Plan for Spokane
County, as amended.

d ) COUNTY flEAI.TH DISTRICT
1. A combined surface water and sevage disposal detailed plan shall
be approved by the County Engineer and the Health District prior
to the iesuance of any building permit for this project.
2. Sewage dieposal method ehall be se authorized by the Director of
Utilities, Spokane County.
3. Subject to epecific applicatior approval and iseuance of permite
by the Nealth Off icer, the use of an individual on-site sewage
system may be authorized.

4. Water service shall be coordinated through the Director of
Utilities, Spokane County.

approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.

e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The eite is located in Fire Dietrict # 1.
2• Approved numbere or addreeses ehall be placed on all new and
existing buildinge in such a position ae to be plainly visible
and legible f rom the street or road fronting the property. Said
numbers shall contraet with their background.
3. Traeh enclosures shall not be located sdjacent to combustible
construction or underaeath windowe or nonptotected eaves.
4. A land use permit will be required for each structure.
5. Eacb structure shall be accessible to Fire DepartmeAt apparatve
by way of access roadways with all-weather driving surface
capable of supporting the imposed loads of f ire apparatus. The
minimum paved roadway width, inside curb face to ineide curb
face, shall be 24 feet with no parking. Parallel parking is
permitted on one side with road widths of minimum 30 feet.
Parallel parking ie permitted on both sideB with road widths of
mioimum 36 feet. Signs noting such is required for fire lane.
The turning radiue of private roadwaye and drive sieles shall be
a minimum of 20 feet inside and a minimum 45 feet outside to
curb face. Cul de eacs more than 600 feet f rom the center line
of the nearest crose street shall have a minimum radius of 37
feet, 6 inches (75 feet diameter).

e) COUNTY BUILDING AND SAFETY DEPARTMENT (continued)
6. Installation of f ire hydrants are required to be instelled and. ,
eerviceable in accordance with the Spokane County Department of
Building and Safety prior to development. The water plan shell
show each f ire hydrant and be in compliance with the provisione
in Chapter 10.04 of the 1979 editioa of the Uniform Fire Code.
The preeent design requires a miAimum fire flow of 500 g.p.m.
for 30 minutes. The water plan shall specify the galions per
minute for each fire hydrant at a residual pressure of no less
than 20 p.s.i. (minimum preesure).
7. Where it is desired to have acceas control gatea in residential
developmente, the following shall apply:
The minimum width of roadway, ineide of access gate, shall be
twelve feet (121). There shall be at least two (2) such drive
approaches where the gates are located. One may be used for
vehicies exiting. Tire flatting spikes ehall not be used unless
the entrance is a minimum of tweaty feet (201) wide. The gates
shall be provided with aa approved method of emergency4peratioa
in accordance with the fire department staAdards. Where each
drive approach is lees than tweaty feet (20') in width and
controlled by gates, a secoadary meane of access shall be
provided with a clear, twenty feet (20') unobstructed opeaing.
f ) WATER PURVEYOR
1. Water Purveyor is Consolidated Irrigatioa District #19, and they
will supply the site vith adequate water for domesCic, fire and
itrigation uses, although satisfactory arrangements have not
been made to serve this proposal.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be cvn[rollEd.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certaia weather conditions. Haul
roads Bhould be treated and emissione from the tranBfer of
earthen material must be coatrolled as well as emfasions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from uapaved eurfaces onto paved surfaces. If trackir►g or
spills occur on paved surfaces, meaeures must be taken
immediately to clean these surfaces.
