This matter has come before the Hearing Examiner Comnuttee on February 22, 1990.
The memhers of the Committee present are Ron Odell, Chairperson, and Jane Myers.
PROPOSAI,
The sponsor, Spokane Care Venture 1, Partnership, requests approval of a Change of
Conditions to existing Urban Residential-12 (UR-12) Zoning, File No. ZE-26A-87,
for the purpose of substituting a previous approval for 112 retirement housing units
hy a 125 hed skilled care facility, and a 56 unit retirei7ient housing buildizig.

Adams Road and 4th Avenue, in Section 23, Township 25 N., Range 44 EWM,
Spokane County, Washington.
2. The committee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the area are single family, duplex, Adams Elementary
School, large lot, vacant, church, and multiple family use.
4. The Comprehensive Plan designates this site as Urban. The Urban category supports
a variety of residential uses and densities, supporting generally higher density
residenfial use along arterials and heavily traveled roads.
5. The Arterial Road Plan designates both 4th Avenue and Adams Road as arterials,
with a recommended right of way width of 70' and 80' respectively. "Future
acquisition areas" have been required for the reservation of the needed future right of
way.
6. The existing zoning of the property described in the application is Urban Residential-
12 (UR-12), previously established in 1987.
7. The provisions of RCW 43.2IC (Tle Slate EIlV1CUIlI11eIlLaj PUlll:y AC:t) have E»c°fl
complied with and a Determination of Nonsignificance was issued.
8. The legal requirements for public notice have been fulfilled.
9. One owner of adjacent land expressed concern about access to Adams Elementary

2. The following Conditions of Approval apply to the real property described below:
TRACT 137, all in Vera, in the County of Spokane and State of Washington as per
map thereof recorded in Book "O" of Plats, page 30, in the office of the County
Auditor of said county.
COUNTY PLANNING DEPARTMENT
1. All current standards of the Urban Residential-12 (UR-12) Zone, as amended, shall
be complied with in the development of this site.
2. The project is subject to Section 14.706, the Aquifer Sensitive Area Overlay Zone
of the ZONIlVG CODE FOR SPOKANE COUNTY, which sets forth various
measures for Aquifer protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
3. The present proposal is not detailed enough to determine whether or not the use of
or materials stored on the site are in compliance with Chapter 4.16A (Aquifer
Sensitive Area Overlay Zone) of the SPOKANE COUNTY ZONING
ORDINANCE. Accordingly, as a condition of approval, the sponsor/applicant
shall be required to file with the Spokane County Auditor, within thirty (30) days of
the signing of Findings and Order of the final decision in this matter, a"Notice to
the Public" which shall provide in material as follows:
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR CERTIFICATE '
OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY
DESCRIBED HEREINAFTER, THE APPLICANT SHALL BE RESPONSIBLE
FOR COMPLYING WITH THE PROVISIONS OF SPOKANE COUNTY
ZONING ORDINANCE CHAPTER 4.16A (AQUIFER SENSITIVE AREA
OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS

4. I'he applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Examiner Committee. Variations, when approvc (i
by the Planning Director/designee, will be perrr~tted, including, but not limited to
the following changes: building location, landscape plans, and general allowablc

8. Spokane County Planning Department record with the County Auditor a'"Title
Notice," prepared and signed by the applicant, for a future acquisition area for road
right of way and utilities to run with the land The future acquisition area reservation
shall not be removed without prior approval by the Spokane County Planning
Department. The notice shall be recorded prior to the issuance of a building perrnit
and shall provide the following:
a. At least 5 and 8 feet of future acquisidon area for road right of way and utilides,
in addition to the existing right of way, along 4th Avenue and Adams Road
respectively.
b. Building and other setbacks required by the Spokane County Zoning Code shall
be measured from the future acquisition area reserved for road right of way and
utilities. Setbacks are 25' along 4th Avenue and 35' from Adams Road.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs shall
be within the future acquisition area for road right of way and utilities. If any of
the above improvements are made within this area, they shall be relocated at the
applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired by Spokane County, shall be private
property and may be used as allowed in the zone except any improvements
(such as landscaping, parking, surface drainage, drainfields, signs, or others)
shall be considered "interim" uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway improvements after '
acquiring said future acquisition area.
f. This "Title Notice" shall be signed by the applicant to serve as official noace
and acknowledgment of said future acquisition area for road right of way and
utilities.

g. The Spokane County Planning Department shall prepare and record with the
Spokane County Auditor a"Title Notice" noting that the property in question is
subject to a variety of special condiaons imposed a.s a result of approval of a
land use action. This "Title Noace" shall serve as official public notice
regarding conditions of approval affecting the property in question. The "Title
Notice" shall be recorded within fifteen (15) days of final disposition of the
approved land use action and shall only be extinguished by the Spokane County
Planning DepartJnent. The "Title Notice" shall generally provide as follows:
The parcel of property legally described as (legal descriprion art(i tcz_x
parcel number) is the subject of a land use action, imposing a
variety of special development conditions, by a Spokane County
Hearing Body or Administrative Official on (date) and as maybe
amended, altered or su,pplemented by official action or as already changed.

9. A specific landscape plan, planting schedule and provisions for mallllC17aI1CC'
acceptable to the Planning Director/designee shall be submitted with a perforrlia,lce
bond for the project prior to release of building pernuts. Landscaping shall be
installed and maintained such that sight distance at access points is not obscured or
impaired. Landscaping shall be 20' Type III along 4th Avenue and Adams Road.
Landscaping shall include 10' Type III along the south and east property line or as
determined by the Planning Department.
10. Prior to building permit release for the retirement build.ing a deed restriction shall be
filed against the property used for the retirement building and required property
limiting use of the site to retirement/elderly housing. The purpose of this restriction
relates to different p?rkinR snace requirements for retirement/elclerly housing versu`
standard apartments.

the Spokane County Engineer.

6. The County Engineer has designated Typical Roadway Section Number One,
Collector Street Standard for the improvement of 4th Avenue, which is to be
conswcted within the proposed development. This will require the installation of
12 to 14 feet of asphalt, curb and sidewalk.
7. The County Engineer has designated Typical Roadway Secrion Number One,
Secondary Arterial Standard for the improvement of Adams Road, which is to be
constructed within the proposed developmenL This will require the installation of
12 to 14 feet of asphalt, curb and sidewalk. A special roadway section whicll
separates the sidewalk from the curb may be required along Acianis Roacj. Tllis is
because of the location of power lines adjacent to itie site.
8. All required improvements shall conforni to the current State ot Washington
Standard Specifications for Road and Bridge Construcaon, and other applicable
County standards and/or adopted resolutions pertaining to Road Standards anci
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
9. The proposed plat shall be improved to the 5tanciarus 5c;c toi-th i~i Spukane Lvuncy
Board of Commissioners Resolution No. 80-1592, as amended and are applicable
to this proposal.
10. No construction work is to be perfonned within the existing or pmposed public
right-of-way until a permit has been issued by the County Engineer. All work is
subject to inspection and approval by the County Engineer.
11. All required construction within the existing or proposed public right of way is to
be completed prior to the release of a building pernut or a bond in the amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
12. The County Arterial Road Plan identifies Fourth Avenue as a Collector Arterial.
The existing right of way width of 50 ft. is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan it is recommended that a strip of
property 5 ft. in width along the 4th Avenue frontage be set aside in reserve. This

13. The County Arterial Road Plan identifies Adams Road as a Minor Arterial. The
existing right of way width of 62 ft. is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan it is recommended that a strip of
property 8 ft. in width along the Adams Road frontage be set aside in reserve. This '
property may be acquired by Spokane County at the time when Arterial
Improvements are made to Adams Road.

2. Requirements of Fire District No. 1 need to be satisfied during the building pernut
process.
FIRE PROTECTION DISTRICT NO. 1
1. No new conditions from the original ZE-26-87 are needed.
2. Fire access to be approved prior to building permit release by Fire District No. 1.
3. Fire flows for and apparatus required by the proposed development shall be
reviewed and approved prior to building pernut release by Fire District No. 1.

County Planning Department The review considered the spocifics of the proposal,
othcr available infarmadon, Camry ordinances, other regulaaons and laws, possible
starxiard Conditions of Appnoval, the Generalized CoaYprehensive Plan, and othcr
County policies and guidelines. 'Ihe Planning Department has determined that "No
probable significant adverse irnpacts" would result from the proposal being developcd
and has issucd a Dztermination of Nonsignificancc ("DNS").
The "DNS" was circulat,ed to 7 ahcr agcncies of jurisdicdon and other agencics/
deparoments affoctod by the future dcvclopment for rcvicw and commcnL Thc "DNS"
comment period cnds February 20, 1990 and was advcrased 15 calendaz days bcforc
said date in the newspaper, by laticr to adjacent propcrty owncrs within 400 fat of the
proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner
