This letter is in regards to the recent complaint. you lodged with this office
alledging illegal business activity, work being done without a building
permit and an eight foot high fence at North 1823 Felts Road.
A recent on-site inspection by our field inspector found no evidence of
any business activity nor any construction work being done without appro-
priate permits.
There was a fence eight feet in height located on the property and the
occupant indicated that he would bring the fence into compliance with ordi-
ance requirements.

This letter is in regards to our recent conversations concerning the
eight foot fence on your property, located at North 1823 Felts Road,
Spokane County, parcel number 08544-0308.
As we discussed, Section 4.17.040 of the Spokane County Zoning Ordinance
stipulates that, "No fence over thirty-six (36) inches in height may be
erected within the required front yard of any lot used for residential
purposes. No residential fence shall exceed a height of six (6) feet
without first obtaining a variance from the Board of Adjustment." As
this fence has already been constructed, it may be necessary for you
to obtain a waiver of violation rather than a variance if you wish to
keep the fence at its present height. Please contact the Spokane County
Planning Department at 456-2205 for further information concerning
variances, waivers of violation, or other options which might be available
to you to rectify this situation. Additionally, the Uniform Building
Code requires building permits for fences in excess of six feet in height.
As per our discussions, due to the length of time this matter has been
pending, we are of the opinion that a period of 14 days, beginning with
your receipt of this letter, should be sufficient extension of time for
you to either bring your fence into compliance with ordinance require-
ments; i.e., six foot in height, or submit application through the
Spokane County Planning Department for a waiver of violation.
If these matters are not taken care of within the previously mentioned
14 days, we will be unable to grant any further extensions of time and
will have no choice but to forward this case to the Spokane County
Prosecuting Attorney's Office for appropriate legal action.

Per our conversations of March 14, 1983, I conducted an on-site
investigation/inspection of the above referenced property on March 17,
1983. Please reference the attached photographs.
1. I found no indication of a continuous yard sale. Mr. Schmidt
(the occupant) is moving to Alaska "within a couple weeks" and had
had a moving sale prior to my on-site inspection. As can be seen
in the photographs, the property does not have the character of a
second hand store.
2. With reference to photograph number two, please take note of the
damp spots at the point of connection of both driveways with the
county road. These are apparently the drainage problems and mosquito
breeding areas you indicated Mrs. Overland was concerned with.
