PROPOSAL
The sponsor, Charles and Jinelle Hogan, request approval of ZE-27A-88, A Change
of Conditions to allow all those uses allowed in the Light Indusmal (I-2) zone
FINDINGS OF FAC1' AND CONCLUSIONS
1 The property is generally located east of and adjacent to Adams Road approximately
300 feet south of Sprague Avenue in the NE 1/4 of Section 23, Township 25 North,
Range 44 EWM, Spokane County, Washington
2 The committee adopts the Planning Department Report as a part of this record
3 The existing land uses ui the area are commercial, hght industnal, single family,
mulnple family, and a pnvate school
4 The proposed use is compahble with existing uses in the area
5 The Comprehensive Plan designates ttus site as Major CommercW The Major
Commercial category is pnmanly intended to provide for commercial and retail uses
in a smp development fashion Some light industnal uses are supported ui the Major
Commercial category when the are located" "in well designed cluster areas with
commercial activities when they are compatible "
6 The existing zorung does implement and conform to the Comprehensive Plan
7 The Artenal Road Plan designates 2nd Avenue as a Pnncipal Artenal vvith limited
access and Adams Road as a Muior Artenal The reservation of land adjacent to both
roads and setbacks from the future acquisiaon area were unplemented with the
ongznal zonng approval established for the site in 1988 (ZE-27-88)
8 The existtng zorung of the property descnbed in the application is Light Industnal (I-Z),
previously established as Commercial zotung ui 1973 and reclassif'ied to Light
Industnal (I-2) on August 4, 1988 pursuant to the Program to Implement the Spokane
County Zoning Code
9 The provisions of RCW 43.21 C('I`he State Envuonmental Pohcy Act) have been
comphed with and a Deternunaaon of Nonsignificance was issued. The Committee,
after independent review, hereby adopts the DNS

Auciitor a Title Noace noting that the property in question is subject to a vanety of
special condiaons imposed as a result of approval of a land use action This Title
Notice shall serve as pubhc nohce of the conditions of approval affecting the
property in question The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planrung Department The Title Nohce shall generally provide as follows

An Envimnmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department The review considered the specifics of the proposal,
other available information, County ordinances, other regulaaons and laws, possible
standard Condinons of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines The Planning Department has deternuned that "No
probable significant adverse impacts" would result from the proposal being developed
and has issued a Determination of Nonsienificance, ("DNS")
The "DNS" was cuculated to 12 other agencies of junsdiction and other
agencies/departments affected by the future development for revlew and comment
The "DNS" comment penod ends June 22. 1922 and was advemsed 15 calendar days
before said date in the newspaper, by letter to adjacent property owners within 400
feet of the proposal, and by nonce on a sign posted on the proposal site The Heanng
Exanuner may consider additional environmental related testimony at the public
heanng
IV. PLANNING DEPARTMEIVT SU1Vi1ViARY AND RECOIVIMENDATION
The proposed Change of Cond.itions is consistent with the Spokane County Zoning
Code and is also consistent with the Comprehensive Plan cntena for allowuig light
industnal uses within the Major Commercial Comprehensive Plan category However,
the Planrung Deparnnent considers as inappropnate the prohibition of uses within a
zoning category that are normally allowed within that zone Negoaated uses withui a
pamcular zone (contract zoning) are contrary to consistent apphcation of zonmg
regulaxions and encourage arbiaary apphcation of the Zorung Code The Plannulg
Department posinon is that land use decisions should be based on estabhsheri standards
and policies rather than negotiated on a case by case basis
The Planiung Departrnent concludes that the stand.ards and regulations that apply to all
allowable uses in the Light Industnal (I-2) zone are sufficient to nutigate unpacts to the
site and surrounding neighborhood, The Plammmg Deparnnent recommends approval
of the Change of Condiaons with a furt}ier recommendation that the proposal be
modif'ied to allow all uses vvithin the Light Industnal (I-2) zone except for outdoor
storage (Chapter 14 632 355 of the Spokane County Zoning Code) which should
connnue to be prohibited as per the ongYnal zoning approval (ZE-27-88)
