11 The following are additional findings of fact considered by the Heanng
Examiner Committee
a The proposal is consistent with the Urban Category of the
Comprehensive Plan in that it proposes office usage adjacent to a
pnncipal artenal and adjacent to a ARajor Commercial Category
b The applicant has indicated the mtent to reserve an area for future
nght of way acquisition to comply with the long range goals of the
Arterial Road Plan for Sullivan Road
c. The proposed site plan generally, with the exception of needed
parking, indicates compliance with the various standards of the
Zoning Code. The landscaping requirements for this site need to be
scaled back so it does not exceed the rnaximum fifteen (15°l0) percent
landscaping area required by the Zoning Code Measures will be
taken to ensure t6at adequate landscaping for buffenng purposes is
not eliminated in those areas along the west property line and
_ around the proposed parking areas

accordance within the concept presented to the Heanng Examiner

changes Buildmg location, landscape plans, and general allowable
uses of the permitted zone All vanations must conform to
regulations set forth in the ZONING CODE FOR SPOKANE COUNTY The
ongiaal intent of the development plans shall be maintained

measures dealing with wastewater disposal, spill protection
measures, and stormwater runoff

whether or not the use of or materials stored on the site are in

of the ZONING CODE FOR SPOKANE COUNTY Accordingly, as a
condition of approval, the spon sor/appl i cant shall be required to file
with the Spokane County Auditor, within thirty (30) days of the
signing of Fmdings and Order of the final decision in this matter, a
"Notice to the Public" which shall provide in material as follows

stormwater runoff and provide necessary landscaping for runoff

comply with itCW 58-17 and the Spokane County Platting Ordinances

7 That Spokane County Planning Department be required to record
with the County Auditor a"Title IVotice", as prepared and signed by
the applicant, for a future acquisition area for road nght of way and
utilities to run with the land and said future acquisition area
reservation shall not be removed without pnor approval by the
Spokane County Planning Department Said notice shall be recorded
pnor to the issuance of a building permit and shall provide the
following.
a At least twenty (20) feet of future acquisition area for road right
of way and utilities, in addition to the existing nght of way, along
Sullivan Road
b That building and other setbacks required by the Spokane County
Zoning Code shall be measured from the future acquisition area
reserved for road right of way and utilities
c That no required, tandscaping, parking, '208' areas, drainfield or
allowed signs shall be within the future acquisition area for road
right of way and utilities If any of the above improvements are
made within this area, they shall be relocated at the applicant's
expense when roadway improvements are made

Code, no more than 159b of the entire site shall be required to be
landscaped AccordingIy, the required landscaping may be reduced
to the maximum 159o required generally as indicated on the site plan
reviewed by the Heanng Examiner Committee on Apnl 6, 1989
Provided the site is developed as preliminanly designed (building
toward west property line and parking, access, and building
entrance to the east) then landscaping w i d th along, first, the north
property line and, second, the west property line may be reduced in
width (but not eliminated) Other adjustments may be made
administratively as necessary provided the intent of the standards
(especially buffering and screening) are maintained
