FINDIN(:S AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee
on September 1, 1988, and the members of the Committee present being
Ron Odell, Chairman, Gary N. Anderberg and Phillip D. Harris.
B. PROPOSAL
The sponsor, ESTATE OF HARRY BECK, is requesting approval of a zone
reclassification, File No. ZE-26-88, AGRICULTURAL to REGIONAL BUSINESS
(B-3) Zone, for the purpose of future commercial development.
C. FINDINGS OF FACT .
1. That the existing land use in the area is single family residences,
apartments, manufactured home park, outbuildings, fire station,
greenhouse, oil/gas company, old service station, storage, light
industrial and open area.
2. That the Comprehensive Plan designates this area as appropriate for
URBAN development.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21 C(The State Environmental Policy Act)
have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item bave been fulfilled.
6. That the land use in this area is suitable for the proposed use, or uses
wiihin the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substantially
changed since the original zooing of this area and accordingly, the
proposed rezone is justified.

8. That the proposed use is- compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by ihe Hearing
Examiner Committee:
a. While the Urban designation of the Comprehensive Plan does not
support major commercial development, it does recognize that
certain non-residential development (such as neighborhood
commercial or light industrial) should be located along major
arterials. Additionally, the Urban Category suggests that decision
makers take into consideration the character of a neighborhood whea considering new land use actions. This neigbborhood is
bounded by Industrial categories to the north and east and Major
Commercial to the west; all within a short distance of the proposed
rezone.
b. The land use and zoning pattem for tbis area indicates that the
character aloog the north side of Apple Way, east of Barker Road, is
commercial in nature. Zoning approved in 1981 (subsequent to the
adoption of the Comprehensive Plan and the urban designation of
this area) has led to the situation where the present proposal is
situated with commercial zoning on either side of it.
c. The buffering standards of the Zoning Code will require a
significant amount of landscaping along the north and east property
lines which are located adjacent to property that is currently, or will
in the future be, zoned residential unless changed in the interim.
d. The reservation of an additional seven (7) feet of land for future
acquisition along Apple Way will help to implement the Arterial
Road Plan Section of the Generalized Comprehensive Plan.

Standard:
1. All current standards of the Regional Business (B-3) Zone, as
amended, shall be complied with in the development of this site.

2. Thai the project is subject to Section 7.06, the Aquifer Sensitive Area
Overlay Zone of the ZONING CODE FOR SPOKANE COUNTY, which sets
forth various measures for Aquifer protection; specifically,
measures dealing with wastewater disposal, spill protection
measures, and stormwater runoff.
3. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay Zonc)
of the ZOIVING CODE FOR SPOKANE COUNTY. Accordingly, as a
condition of approval, the sponsor/applicant shall be required to file
with the Spokane County Auditor, within thirty (30) days of the
signing of Findings and Order of ihe final decision in this matter, a
"Notice to the Public" which shall provide in material as follows:
PRIOR TO THE ISSUANCE OF ANY BUII.DING PERNIIT OR CERTIFICATE OF OCCUPANCY FOR ANY BUII.DING OR ANY USE ON THE PROPERTY
DESCRIBED HEREINAFMR, THE APPLICANT SHALL BE RESPONSIBLE
FOR COMPLYING WITH TI-E PROVISIONS OF THE ZONING CODE FOR
SPOK:ANE COUNTY SECTION 7.06 (AQUIFER SENSITIVE AREA OVERLAY
ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS NOTICE IS MORE
PARTICULARLY DESCRIBED AS FOLLOWS:. . .
4. Any division of land for the purpose of sale, lease or transfer, shall
comply with RCW 58-17 and the Spokane County Platting Ordinances
prior to issuance of building permits.
Special:
5. That Spokane County Planning Department be required to record
with the Couaty Auditor a"Title Notice", as prepared and signed by
the applicant, for a future acquisition area for road right of way and
utilities to run with the Iand and said future acquisition area '
reservation shall not be removed without prior approval by the
Spokane County Planning Department. Said notice shall be recorded
prior to the issuance of a building permit and shall provide the
following:
a. Seven (7) feet of future acquisition area for road right of way and
utilities, in addition to the existing right of way, along Apple Way.
b. That building and other setbacks required by the Spokane County
Zoning Code shall be measured from the northerly edge of the
seven (7) foot wide future acquisition area reserve for road right
of way and utilities.
c. The seven (7) foot wide future acquisition area, until acquired by
Spokane County, shall be private property and may be• used as
allowed in the zone except any improvements (such as

landscaping, parking, surface drainage, drainfields, signs, or
others) shall be considered "interim" uses.
The property owner shall be responsible for relocating such
"interim" improvements at the time Spokane County makes
roadway improvements after acquiring said future acquisition
area. .
d. This "title notice" shall be signed by the applicant to serve as
official notice and acknowledgment of said future acquisition
area for road right of way and utilities.
b) COUNTY ENCINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit Qr tlse Qf The Property As
Proposed:
Standard:
1. Access permits for approaches to the County Road System shall be
obtained from the County Engineer.
- 2. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed combined
on-site sewage system plan and surface water disposal plan for the
entire project or portion thereof if the development is phased.
3. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, locatio❑ and
arrangement of parking stalls shall be in accordance with standard
engineering practices. Paving or surfacing as approved by the
County Engineer will be required for any portion of the project
which is to be occupied or traveled by vehicles.
4. The construction of the roadway improvements stated herein shall
be accomplished as approved by the Spokane County Engineer.
5. All required improvements shall conform to the cunent State of
Washington Standard Specifications for Road and Bridge
Construction and other applicable County standards and/or adopted
resolutions pertaining to road standards and stornawater
management in effect at the date of construction, unless otherwise
approved by the County Engineer.
6. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 80-1592 as amended and are applicable to this proposal.

b) COLINTY ENCINEERINC DEPARTMENT
Special:
7. To construct the roadway improvcments stated herein, the applicant
may, with the approval of the County Engineer, join in and be
willing to participate in any petition or resolution which purpose is
the formation of a Road Improvement District (RID) for said
improvement pursuant to RCW 36.88, as amended. Spokane County
will not participate in the cost of these improvements.
8. As an altemative method of constructing the road improvements
stated herein, the applicant may, with the approval of the County
Engineer, accomplish ihe road improvements stated herein by
joining and participating in a County Road Project (CRP) to the
extent of the required improvement. Spokane County will not
participate in the cost of these improvements.
9. The County Engineer has designated Typical Roadway Section
Number Two, Major Arterial Standard for the improvement of
Appleway which is adjacent to the proposed development. This will
require the addition of approximately 12 to 14 feet of asphalt along
the frontage of the development. Curbing and sidewalk must also be
constructed. .
c ) ('niINTY UTILITIES DEPARTMENT
Standard:
1. Pursuant to the Board of County Commissioners Resolution No. 80-
0418, the use of on-site sewer disposal systems is hereby authorized.
This authorization is conditioned on compliance with all rules and
regulations of the Spokane County Health District and is further
conditioned and subject to specific application approval and issuance
of permits by the Health District.
2. The Owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of a
ULID by petition method pursuant to RCW 36.94 which the petition
includes the Owner(s) property and further not to object by the
signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the
Owner(s) property. PROVIDED, this condition shall not prohibit the
Owner(s) or Successor(s) from objection to any assessment(s) on the
property as a result of improvements called for in conjunction with
the formation of a ULID by either petition or resolution method
under RCW Chapter 36.94.
3. Any water service for this project shall be provided in accordance
with the Coordinated Water Systcm Plan for Spokane County, as
amended. 5

c ) ('OLINTY CITILITIES DEPARTMENT
4. Each new unit shall be double plumbed for connection to future
area-wide collection systems.
d ) COUNTY HEALTH DISTRICT .
Standard:
1. A combined surface water and sewage disposal detailed plan shall be
approved by the Spokane County Engineer and Spokane County
Health District prior to the issuance of any on-site sewage disposal
permit or building permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Water service shall be coordinated through the Director of Utilities, '
Spokane County.
4. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
5. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
6. Subject to specific application approval and issuance of permits by
the Health Officer, the use of an individual on-site sewage disposal
system may be' authorized.
7. Use of private welis and water systems is prohibited.
e)COLTNTY BUILDINC AND SAFETY DEPARTMENT
Standard:
1. The site is located in Fire District #1. 2. The Department of Building and Safety has discussed Code
requirements with the applicant's agent.
f ) WATER PURVEYOR
Standard:
1. Water Purveyor is Consolidated Irrigation District and they will
supply the site with adequate water for domestic, fire and irrigation
uses. _

Standard:-:= -
1. Air pollution regulatioas require that dust emissions during
demolition, excavation and construction projects be controlled. This
may require use of water sprays, tarps, sprinklers, or suspension of
activity during certain weather conditions. Haul roads should be
treated and emissions from the transfer of earthen material must be
controlled as well as emissions from all other construction related
activities.
2. Measures must be taken to avoid the deposition of dirt and mud from
unpaved surfaces onto paved surfaces. If tracking or spills occur on
paved surfaces, measures must be taken immediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access roads)
must be paved and kept clean.
4. SCAPCA Regulation I, Article V requires that a Notice of Construction
and Application for Approval be submitted to and approved by our
Agency prior to the construction, installation or establishment of an
air pollution source.
5. SCAPCA Regulation I, Article VI and SCAPCA Regulation II, Article IV
addresses emission standards. All emission standards must be met.
6. Demolition and renovation projects must comply with the
requirements of CFR 40 Part 61, Subpart M. Intent to Demolish and
Renovate forms are available at the SCAPCA office.
h) WASHIN *TON STATE DEPARTMENT OF ECOLOGY
Special:
1. A State waste discharge permit may be required from the Department
of Ecology. Application forms and information on this permit are
available from the Eastcrn Regional Office, N. 4601 Monrae, Suite 100,
Spokane, WA 99205-1295.

The Urban Category of the Comprehensive Plan supports a variety of
residential land uses, neighborhood commercial uses, and Iight
industrial uses. The more dense resideniial developments and intense

Comprehensive Plan:
land uses (such as ncighborhood commcrcial and light industrial) are
encouraged along the fringe areas of a neighborhood or near major
arterials. The Urban Category is not intendcd to support major
commercial uses. However, the Comprehcnsive Plan suggests that the
- character and development pattern of a neighborhood be considered in
review of any land use action. The site is Iocated in close proximity to
Industrial categories of the Comprehensive Plan; approximately 1,000
feet east and less than a quartcr mile north.
Arteriai Road Plan: '
Apple Way, which adjoins the site to the south, is designated a Principal
Arterial without controlled access by the Comprehensive Plan's Arterial
Road Plan Section. To the south of Apple Way is the Milwaukee Road
' Transportation Corridor which is designated a Principal Arterial with
controlled access. To implement the Arterial Road Plan policies along
Appte Way, an additional seven (7) feet of area along this site's frontage
should be reserved for future right of way acquisition.

There has been a history of commercial zone approvals along the north
side of Apple Way extending easterly from Barker Road. In 1981,
subsequent to adoption of the Comprehensive Plan and the designation
of this area as Urban, a commercial zone was approved easterly of the
cunent proposal at the northwest corner of Apple Way and Michigan
Road. This site, therefore, is iocated between two (2) areas of
commercial zoning.

- The site plan submitted with the rezone application simply indicates
the location of existing improvements (such as buildings, asphalt,
residence, bam and shed) on the subject property. There is no
iadication of future devetopment options. Detailed review to
determine compliance with all Ordinance regulations and conditions
of approval is recomrriended to be administrative and to occur at the
Building Permii stage.
III.SITE DEVEL•OPMENT RECO1v_rMFNnaTiONS
Buffering: If approved to the Regional Business (B-3) Zone, devetopment
of the site will require the installation of tweaty (20) foot wide landscape strips, consisting of a Type I landscape treatment (screen), along the north
and east property lines.
L a n d s e a p i n g: In addition to the bufferiag mentioned above, an
approximate three (3) to five (5) foot wide landscape area will be required
along the frontage of Apple Way. Additionally, landscaping within
required parking areas will be necessary.
Circulation/Access: The Spokane County Engineer requires the
improvement of Apple Way adjacent to the property whieh will consist of
an additionat twelve (12) to fourteen (14) feet of asphalt, curbs and
sidewalk along the site's frontage. However, those road improvements can
be deferred to a future Road Improvcment District (RID) or a County Road
Projcct (CRP).

III.SIT DEVELOPMENT RE _OMMENDATIQNS ZE-26-88
Circulation/Access:
To implement the Arterial Road Plan's long range goal designating Apple
Way as a Principal Arterial without controlled access, the applicant should
be required to reserve an additional seven (7) feet of property adjacent to
Apple Way for future right of way acquisition. The reservation will be
accomplished by the applicant's acknowledgment and recordation of a
notice regarding the reservation. The notice states that the reservation
area is private property and may bc used for certain improvements but that
such improvements within that area are considered interim uses and must
be relocated when and if the road is improved. Setbacks will be measured
from the northerly most edge of the reservation strip; this will basically
add an additional seven (7) foot setback over that which would be normally
required. '
Critical Materials/Use Activity: When specific development plans are
proposed, the project will be reviewed for use of critical materials. If such
materials are found to be part of the project, then compliance with the
Aquifer Sensitive Area Overlay standards related to protection of the
Aquifer and spill containrrient will be necessary.
IV.SEPA .NVIRONMENTAL. REVIEW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered the
specifics of the proposal, other available information, County ordinances,
other regulations and laws, possible standard Conditions of Approval, the
Generalized Comprehensive Plan, and other County policies and guidelines.
The Zoning Administrator has dctermined that "No probable significant
adverse impacts" would result from the proposal being developed and has
issued a Deigrmination of Non-Significance ("DNS").
The "DNS" was circulated to eight other agencies of jurisdiction and other
agencies/departments affected by the future development for review and
comment. The "DNS" comment pcriod ends August 31, 1988 and was
advertised 15 calendar days before said datc in the newspaper, by letter to
adjacent property owners within 400 feet of the proposal, and by notice on
a sign posted on the proposal site. The Hearing Examiner may consider
additional environmental related testimony and the "DNS" at the public
hearing.
V. PL.ANNINC SUMMARY
The proposed rezone from Agricultural to Regional Business (B-3) Zone
could be approved for the following reasons:
a. While the Urban designation of thc Comprehensive Plan does not
support major commercial development, it does recognize that certain

non-residcntial devclopmcnt (such as ncighborhood commcrcial or
light industrial) should be locatcd along major arterials. Additionally,
the Urban Category suggests that dccision makers take into
consideration the character of a neighborhood when considering new
land use actions. This neighborhood is bounded by Industrial categorics
to the north and east and Major Commercial to the west; all within a
short distance of the proposed rezone.
b. The land use and zoning pattern for this area indicates that the
character along the north side of Apple Way, east of Barker Rbad, is
commercial in nature. Zoning approved in 1981 (subsequent to thc
adoption of the Comprehensive Plan and the urban designation of this
area) has led to the situation whcre the present proposal is situated with
commercial zoning on either side of it.
c. The buffering standards of the Zoning Code will require a significant
-amount of landscaping along the north and east property lines which
are located adjacent to property that is currentiy, or will in the future
be, zoned residential unless changed in the interim. d. The reservation of an additional . seven (7) feet of land for future
acquisition along Apple Way will help to implement the Arterial Road
Plan Section of the Generalized Comprehensive Plan.
VI.(_ONDITION'S OF APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner
Committee shall be binding on the "Applicant", which term
shall include the owner or owners of the property, heirs,
assigns, and successors.)
a ) CnjjNTY PLANNING DEPARTMENT
Standard:
1. All current standards of the Rcgional Business (B-3) Zone, as
amended, shall be complied with in the development of this site.
2. That the project is subject to Section 7.06, the Aquifer Sensitive Area
Overlay Zone of the ZONING CODE FOR SPOKANE COUNTY, which sets
forth various measures. for Aquifer protection; specifically,
measures dealing with wastewater disposal, spill protection
measures, and stormwater runoff.
3. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay Zone)
of the ZONING CODE FOR SPOKANE COUNTY. Accordingly, as a
condition of approval, the sponsor/appticant shall be required to filc
with the Spokane County Auditor, within thirty (30) days of the

the applicant, for a future acquisition area for road right of way and
utilities to run with the land and said future acquisition area
reservation shall not be removed without prior approval by the
Spokane County Planning Department. Said notice shall be recorded
prior to the issuance of a building permit and shali provide the
following:
a. Seven (7) feet of future acquisition area for road right of way and
utilities, in addition to the existing right of way, along Apple Way.
b. That building and other setbacks required by the Spokane County
Zoning Code shall be measured from the northerly edge of the
seven (7) foot wide future acquisition area reserve for road righc
of way and utilities.
c. The seven (7) foot wide future acquisition area, until acquired by
Spokane County, shall be private property and may be used as
allowed in the zone except any improvements (such as
landscaping, parking, surface drainage, drainfields, signs, or
others) shall be considered "interim" uses.
The property owner shall be responsible for relocating such
"interim" improvements at thc time Spokane County makes
roadway improvements after acquiring said future acquisition
area.
d. This "title notice" shall be signed by the applicant to serve as
official notice and acknowledgment of said future acquisition
arca for road right of way and utilities.

Standard:
1. Access 'permits for approachcs to the County Road System shall be
obiained from the County Engincer.
2. The applicant shall submit for approval by the Spokane County
Engineer and the Spokanc County Health District a detailcd combined
on-site sewage systern plan and surface water disposal plan for the
entire project or portion thereof if thc development is phased.
3. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County' Engineer. The design, location and
arrangement of parking stalls shall be in accordance with standard .
engineering practices. Paving or surfacing as approved by the
County Engineer will be required for any portion of the project
which is to be occupied or traveled by vehicles.
4. The construction of the roadway improvements stated herein shall
be accomplished as approved by the Spokane County Engineer.
5. All required ii~iprovements shall conform to the current State of
Washingtoa Standard Specifications for Road and Bridge
Construction and other applicable County standards and/or adopted
resolutions pertaining to road standards and stormwater
management in effect at the date of construction, unless otherwise _
approved by the County Engineer.
6. Roadway standards, typical roadway sections and draiaage plan
requirements are found in Spokane Board of County Commissioners
resolution 80-1592 as amended and are applicable to this proposal.
Special:
7. To construct the roadway improvements stated herein, the applicant
may, with the approval of the County Engineer, join in and be
willing to participate in any petition or resolution which purpose is
the formation of a Road Improvement District (RID) for said
improvement pursuant to RCW 36.88, as amended. Spokane County
will not participate in the cost of these improvements.
8. As an alternative method of constructing the road improvements
stated herein, the applicant may, with the approval of the County
Engineer, accomplish the road improvements stated herein by
joining and participating in a County Road Project (CRP) to the
extent of thc required improvement. Spokanc County will not
participate in the cost of thesc improvements.

9. The County Engineer has designated Typical Roadway Section
Number Two, Major Arterial Standard for the improvement of
Appleway which is adjacent to the proposed development. This will
require the addition of approximately 12 to 14 feet of asphalt along
the frontage of the development. Curbing and sidewalk must also be
constructed.
c ) C.OLINTY UTILITIES DEPARTMENT

Standard:
1. Pursuant to the Board of County Commissioners Resolution No. 80-
0418, the use of on-site sewer disposal systems is hereby authorized.
This authorization is conditioned on compliance with all rules and
regulations of the Spokane County Health District and is further
conditioned and subject to specific application approval and issuance
of permits by the Health District.
2. The Owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of a
ULID by petition method pursuant to RCW 36.94 which the petition
includes the Owner(s) property and further not to object by the
signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the
Owner(s) property. PROVIDED, this condition shall not prohibit the
Owner(s) or Successor(s) from objection to any assessment(s) on the
property as a result of improvements called for in conjunction with
the formation of a ULID by either petition or resolution method
under RCW Chapter 36.94.
3. Any water service for this project sball be provided in accordance
with the Coordinated Water System Plan for Spokane County, as
amended.
4. Each new unit shall be double plumbed for connection to future
area-wide collection systems.
d ) ('OCINTY HEALTH DISTRICT
Standard:
1. A combined surface water and scwage disposal detailed plan shall be
approved by the Spokane County Engineer and Spokane County
Health District prior to the issuance of any on-site sewage disposal
permit or building permit for this project.
2. Scwagc disposal method shall bc as authorized by thc Director of
Utilities, Snokanc County. .

1. Water Purveyor is Consolidated Irrigation District and they will
supply the site with adequate water for domestic, fire and irrigation
uses.
g) SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
All air pollution regulations must be met. This inGludes but is not
limiied to the followine:
Standard:
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled. This
may require use of water sprays, tarps, sprinklers, or suspension of
activity during certain weather conditions. Haul roads should be
treated and emissions from the transfer of earthen material must be
controlled as well as emissions from all other construction related
activities.

2. Measures must be taken to avoid the deposition of dirt and mud from
unpaved surfaces onto paved surfaces. If tracking or spills occur on
paved surfaces, measures must be taken immediately to clean these
surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access roads)
must be paved and kept clean.
4. SCAPCA Regulation I, Article V requires that a Notice of Construction
and Application for Approval be submitted to and approved by our
Agency prior to the construction, installation or establishment of an
air pollution source.
5. SCAPCA Regulation I, Article VI and SCAPCA Regulation II, Article IV
addresses emission siandards. All emission standards must be met.
6. Demolition and renovation projects must comply with the
requirements of CFR 40 Part 61, Subpart M. Intent to Demolish and
Reoovate forms are available at the SCAPCA office.

industrial uses. The more dense residential developments and intense

encouragcd along the fringe arcas of a ncighborhood or near major
arterials. The Urban Category is not intcnded to support major
commercial uses. However, the Comprehensive Plan suggests that the
character and development pattern of a neighborhood be considered in
review of any land use action. The site is located in close proximity to
Industrial categories of the Comprehensive Plan; approximately 1,000
feet east and less than a quartcr mile north.
Arterial Road Plan:
Apple Way, which adjoins the site to the south, is designated a Principal
Arterial without controlled access by the Comprehensive Plan's Arterial
Road Plan Section. To the south of Apple Way is the Milwaukee Road
Transportation Corridor which is designated a Principal Arterial with
controlled aeeess. To implement the Arterial Road Plan policies along
Apple Way, an additional seven (7) feet of area along this site's frontage
should be reserved for future right of way acquisition.

side of Apple Way extending easterly from Barker Road. In 1981,

current proposal at the northwest corner of Apple Way and Michigan
Road. This site, therefore, is located between two (2) areas of

- The site plan submitted with the rezone application simply indicates
. the location of existing improvements (such as buildings, asphalt,
residence, barn and shed) on the subject property. There is no
indication of future development options. Detailed review to

of approval is recommended to be administrative and to occur at the
Building Permit stage.
III.SITE DEVELOPMENT RECOMMENDATIONS
Buffering: If approved to the Regional Business (B-3) Zone, development
of the site will require the installation of twenty (20) foot wide landscape
strips, consisting of a Type I landscape treatment (screen), along the north
and east property lines.
L a n d s e e p i n g: In addition to the buffering mentioned above, an
approximate three (3) to five (5) foot wide landscape area will be required
along the frontage of Apple Way. Additionaily, landscaping within
required parking areas will be necessary.
Circulation/Access: Tbe Spokane County Engineer requires the
improvement of Apple Way adjacent to the property which will consist of
an additional twelve (12) to fouReen (14) feet of asphalt, curbs and
sidewalk along the site's frontage. However, those road improvements can
be deferred to a future Road Improvement District (RID) or a County Road
Project (CRP).

III.SITE DEVELQPMENT RECOMMENUATI_QNS Z E- 2 6- 8 8 Circulation/Access:
To implement the Arterial Road Plan's long range goal designating Applc
Way as a Principal Arterial without controlled access, the applicant should
be required to reserve an additional seven ('7) feet of property adjacent to
Apple Way for future right of way acquisition. The reservation will be
accomplished by the applicant's acknowledgment and recordation of a
notice regarding the reservation. The notice states that the reservation
area is private property and may be used for certain improvements but that
such improvements within that area are considered interim uses and must
be relocated when and if the road is improved. Setbacks will be measured
from the northerly most edge of the reservation strip; this will basically
add an additional seven (7) foot setback over that which would be normally required. Critical Materials/Use Activity: When specific development plans are
proposed, the project will be reviewed for use of critical materials. If such
materials are found to be part of the project, then compliance with the
Aquifer Sensitive Area Overlay standards related to protection of the
. Aquifer and spill containment will be necessary.
IV.SEPA .NVIRONMENTAL. REVIEW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning DepartmeDt. The review considered che
specifics of the proposal, other available information, County ordinances, '
other regulations and laws, possible standard Conditions of Approval, the
Generalized Comprehensive Plan, and other County policies and guidelines.
The Zoning Administrator has determined that "No probable significant
adverse impacts" would result from the proposal being developed and has
issued a DeXenminaLion of Non-Significance ("DNS").
The "DNS" was circulated to eight other agencies of jurisdiction and other
agencies/departments affected by thc future development for review and
comment. The "DNS" comment period ends August 31, 1988 and was ~
advertised 15 calendar days before said date in the newspaper, by letter to
adjacent property owners within 400 feet of the proposal, and by notice on
a sign posted on the proposal site. The Hearing Examiner may consider
additional environmental relatcd testimony and the "DNS" at the public
hearing.
V. PLANNINC SUMMARY
The proposed rezone from Agricultural to Regional Business (B-3) Zone
could be approved for the following reasons:
a. While the Urban designation of the Comprehensive Plan does not
support major commercial development, it does recognize that certain

. non-residential development (such as neighborhood commercial or
light industrial) should bc locatcd along major artcrials. Additionally,
thc Urban Category suggcsts that decision makers take into
consideration the character of a neighborhood when considering new
land use actions. This neighborhood is bounded by Industrial categorics
to the north and east and Major Commcrcial to the west; all within a
short distance of the proposed rezone.
b. Thc land use and zoning pattern for this area indicates that the
character along the north side of Apple Way, east of Barker Road, is
commercial in nature. Zoning approved in 1981 (subsequent to the
adoption of the Comprehensivc Plan and the urban designation of this
area) has led to the situation whcre the present proposal is situated with
commercial zoning on either side of it.
c. The buffering standards of the Zoning Code will require a significant
amount of landscaping along the north and east property lines which
are located adjacent to property that is currently, or will in the future
be, zoned residential unless changed in the interim.
d. The reservation of an additional seven (7) feet of land for future
acquisition along Apple Way will help to implement the Arterial Road
- Plan Section of the Generalized Comprehensive Plan.
VI.('QNDITIONS OF APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner
Committee shall be binding on the "Applicant", which term
shall include the owner or owners of the property, heirs,
assigns, and successors.)
a ) ('.OLINTY PLANNINC DEPARTMEIYT
Standard:
1. All current standards of the Regional Business (B-3) Zone, as
amended, shall be complied with in the development of this site.
2. That the project is subject to Section 7.06, the Aquifer Sensitive Area
Overlay Zone of che ZONING CODE FOR SPOKANE COUNTY, which sets
forth various measures for Aquifer protection; specifically,
measures dealing with wastewater disposal, spill protection
measures, and stormwater runoff.
3. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay Zone)
of the ZONING CODE FOR SPOKANE COUNTY. Accordingly, as a
condition of approval, t6e sponsor/applicant shall be required to filc
with the Spokane County Auditor, within thirty (30) days of the

signing of Findings and Order of the final decision in this matter, a
"Notice to the Public" which shall provide in material as follows:

4. Any division of land for the purpose of sale, lease or transfer, shall
comply with RCW 58-17 and the Spokane County Platting Ordinances
prior to issuance of building permits.
Special:
5. That Spokane County Planning Department be required to record
with the County Auditor a"Title Notice", as prcpared and signed by
the applicant, for a future acquisition area for road right of way and
utilities to run with the land and said future acquisition area -
reservation shall not be removed without prior approval by the
Spokane County Planning Department. Said notice shall be recorded
prior to the issuance of a building permit and shall provide the '
following:
a. Seven (7) feet of future acquisition area for road right of way and
utilities, in addition to the existing right of way., along Apple Way.
b. That building and other setbacks required by the Spokane County
Zoning Code shall be measured from tbe northerly edge of the
seven (7) foot wide future acquisition area reserve for road right
of way and utilities.
c. The seven (7) foot wide future acquisition area, until acquired by
Spokane County, shall be private property and may be used as
allowed in the: zone except any improvements (such as
landscaping, parking, surface drainage, drainficlds, signs, or
others) shall be considcrcd "interim" uses.
The property owner shall bc responsible for relocating such
"interim" improvemcnts at the time Spokane County makes
roadway improvements after acquiring said future acquisition
area.
d. This "title notice" shall be signed by the applicant to serve as
official noticc and acknowlcdgmcnt of said futurc acquisition
arca for road right of way and utilitics.

Prior To The Issuance Of A Buildine Permit Or Use Of Thc Pronertv As
Pronosed:
Standard:
1. Access permits for approaches to the County Road System shall be
obtained from the County Engineer.
2. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed combincd
on-site sewage system plan and surface water disposal plan for the
entire project or portion thcreof if thc dcvelopment is phascd.
3. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location and
arrangement of parking stalls shall be in accordance with standard . engineering practices. Paving or surfacing as approved by the
County Engineer will be required for any portion of the project
which is to be occupied or traveled by vehicles.
4. The construction of the roadway improvements stated herein shall
be accomplished as approved by the Spokane County Engineer.
5. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction and other applicable County standards and/or adopted
resolutions pertaining to road standards and stormwater
management in effect at the date of construction, unless otherwise
approved by the County Engineer.
6. Roadway standards, typical roadway scctions and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 80-1592 as amended and are applicable to this proposal.
Special:
7. To construct the roadway improvements stated herein, the applicant
may, with the approval of the County Engineer, join in and be
willing to participate in any petition or resolution which purpose is
the formation of a Road Improvement District (RID) for said
improvement pursuant to RCW 36.88, as amended. Spokane County
will not participate in the cost of these improvements.
8. As an alternative method of constructing the road improvements
stated herein, the applicant may, with the approval of the County
Engineer, accomplish the road improvements stated herein by
joining and participating in a County Road Project (CRP) to the
extent of the required improvemcnt. Spokane County will not
participate in the cost of these improvements.

b) COUNTY ENGINEERING DEPARTMENT
9. The County Engineer has designated Typical Roadway Section
Number Two, Major Arterial Standard for the improvement of
Appleway which is adjacent to the proposed development. This will
require the addition of approximately 12 to 14 feet of asphalt along
the frontage of the development. Curbing and sidewalk must also be
constructed.
c ) COUNTY UTILITIES DEPARTMENT
Standard:
1. Pursuant to the Board of County Commissioners Resolution No. 80-
0418, the use of on-site sewer disposal systems is hereby authorized.
This authorization is conditioned on compliance with all rules and
regulations of the Spokane County Health District and is further
conditioned and subject to specific application approval and issuance
of permits by the Health District.
2. The Owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of a
ULID by petition method pursuant to RCW 36.94 which the petition
includes the Owner(s) property and further not to object by the
signing of a protest petitioo against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the
Owner(s) or Successor(s) from objection to any assessment(s) on the
property as a result of improvements called for in conjunction with
the formation of a ULID by either petition or resolution method
under RCW Chapter 36.94.
3. Any water service for this project shall be provided in accordance
with the Coordinated Water System Plan for Spokane County, as
amended. 4. Each new unit shall be double plumbed for connection to future
area-wide collection systems.
d ) COUNTY HEALTH DISTRICT
Standard:
1. A combined surface water and sewage disposal detailed plan shall be
approved by the Spokane County Engineer and Spokane County
Health District prior to the issuance of any on-site sewage disposal
permit or building permit for this project.
2. Sewage disposal method shall bc as authorized by thc Director of
Utilities, Spokane County.

3. Water scrvice shall be coordinatcd through thc Director of Utilitics,
Spokane County.
4. Water service shall be by an existing public water supply when

Social and Health Services.
5. Disposal of sewage effluent bencath paved surfaces is currently
prohibited.
6. Subject to specific application approval and issuance of permits by
the Health Of€icer, the use of an individual on-site sewage disposal
system may be authorized.
7. Use of private wells and watcr systems is prohibited.
e)('OUNTY BUILDING AND SAFETY DEPARTMENT
Standard:
- 1. The site is located in Fire District # 1.
2. The Department of Building and Safety has discussed Code
requirements with the anplicant's agent.
f ) WATER PURVEYOR
Standard: 1. Water Purveyor is Consolidated Irrigation District and they will
supply the site with adequate water for domestic, fire and irrigation
uses.
g) SPOKANE CQUNTY AIR POLLUTION 110NTROL AUTHORITY
All air oollution reeulations must be mel. This includes but is not
limited to the followi=
Standard:
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled. This
may require use of water sprays, tarps, sprinklers, or suspension of
activity during certain weather conditions. Haul roads should be
treated and emissions from the transfer of earthen material must be
controlled as well as emissions from all other construction related
activities.

g) SPOKANE _OCINTY AIR POLLUTION CONTROL ALITHORITY
2. Measures must be taken to avoid the deposition of dirt and mud from
unpaved surfaces onto paved surfaces. If tracking or spills occur on
paved surfaces, measures must be taken immediately to clean these
surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access roads)
must be paved and kept clean.
4. SCAPCA Regulation I, Article V requires that a Notice of Construction
and Application for Approval be submitted to and approved by our
Agency prior to the construction, installation or establishment of an
air pollution source.
5. SCAPCA Regulation I, Article VI and SCAPCA Regulation II, Article IV
addresses emission standards. All emission standards must be met.
6. Demolition and renovation projects must comply with the
requirements of CFR 40 Part 61, Subpart M. Intent to Demolish and
Renovate forms are available at the SCAPCA office.
