The members of the Comnlittee present are: Jan Reuter, Chair, Jane Myers and Frank Yu se. PROPOSAL The sponsor, Gene Cohen requests approval of a Zone Reclassification, ZE-22-94, from Regional Business (B-3) to Regional Business (B-3) and Light Industrial (I-2) for food product manufacturing, retail sales and those uses allowed in the proposed Regional Business (B-3) and Light Industrial (I-2) zones. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located north of Broadway Avenue, south of Interstate 90, approximately 2,000 feet east of Barker Road in Section 17, Township 25 North, Range 45 EWM, Spokane County, Washington. 2. The Committee adopts the Planning Department Report as a part of this record. 3. The exisring land uses in the area include industrial and commercial uses to the north of the site with a mixture of vacant land, small to large lot residential uses and small commercial uses along arterials. 4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan designates tlus site as Urban. The Urban category provides for development of a"city-like" environment which includes various land uses including intensive residenrial development. The Urban category considers a variety of land uses to be appropriate, however, major commercial and heavy industrial uses are considered as noncompatible uses in the Urban category. However, given previous land use acrions, the location of the site adjacent to Interstate 90, and considering the transition policy of the Comprehensive Plan, the zone reclassif'icadon is appropriate. 6. The proposed zoning does implement and conform to the Comprehensive Plan. 7. The Arterial Road Plan designates Broadway Avenue as a Local Access Street, with a recommended right of way width of 60 feet. 8. The existing zoning of the property described in the application is Regional Business (B-3) previously established as Freeway Commercial zoning in 1976 and redesignated to Regional Business on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. The proposal does conform to the requirements of the proposed zone. • ~ . . 1 r . 9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance (DNS) was issued. The Committee, after independent review, hereby adopts the DNS. 10. The legal requirements for public notice have been fulfilled. 11. The owners of adjacent properties expressed neither approval nor disapproval of the proposal. 12. The applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed zone reclassification is justified. Specifically, changed conditions include the transitioning of the area away from urban residential to commercial and light industrial. 13. The proposed use will not be detrimental to the public health, safety, morals or welfare especially in light of the conditions recommended by the reviewing agencies. 14. Potential impacts to traffic from future unspecified uses allowed in the Regional Business (B-3) zone may require off-site mitigating measures as deterniined by traff'ic analysis. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL 1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns, and successors-in-interest. 2. The following Conditions of Approval apply to the real property described below: . The Regional Business (B-3) zone reclassification applies to the following real property: Lot 8, Block 3, "CORBIN ADDTTION to GREENACRES", as per plat thereof recorded in Volume "S" of Plats, Page 30, Spokane County, Washington. EXCEPT the east 180 feet thereof, AND EXCEPT Broadway Avenue The Light Industrial (I-2) zone reclassification applies to the following real property: The east 180 feet of Lot 8, Block 3, "CORBIN ADDTI'ION to GREENACRES', as per plat recorded in Volume "S" of Plats, page 30, Spokane County, Washington. EXCEPT Broadway Avenue. TOGETHER WITH that portion of 20 foot vacated strip lying easterly of said Lot 8 and Northerly of Broadway Avenue. HEC Order for ZE-22-94 Page 2 . , , . • , • SPOKANE COUNTY PLANNING DEPARTMENT 1. The proposal shall comply with the Regional Business (B-3) zone, the Light Industrial (I-2) zone, and the Aquifer Sensitive Area (ASA) overlay zone, as amended. 2. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Body. Variations, when approved by the Planning Director/designee, may be pernutted, including, but not limited to building locarion, landscape plans and general allowable uses of the pennitted zone. All variarions must conform to regulations set forth in the Spokane County Zoning Code, and the original intent of the development plans shall be maintained. 3. Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any building pernuts. 4. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 5. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 6. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special cond.irions imposed as a result of approval of a land use action. This Title Notice shall serve as public norice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and sha11 only be released, in full or in part, by the Planning Department. The Title Notice shall generally provide as follows: The parcel of property legally described as [ ] is the subject of a land use action by a Spokane County Hearing Body or Administrative Official on [ imposing a variety of special development conditions. File No. [ ] is available for inspection and copying in the Spokane County Planning Department. 7. The Planning Department shall file with the Spokane County Auditor, within the same time frame as allowed for an appeal from the final disposition, including lapsing of appeal period, a Title Notice, which shall generally provide as follows: "Prior to the issuance of any building permit for any building or any use on the property described herein, the applicant shall be responsible for complying with the provisions of the Zoning Code for Spokane County, Section 14.706 (Aquifer Sensitive Area Overlay Zone). The property which is the subject of this notice is more particularly described as follows: . . . " 8. Any subdivision of the subject property shall be consistent with state and county subdivision regulations. Applicant shall dedicate 60 feet on Hodges Road for right-of-way, from Broadway south to Sprague Avenue. 2. The applicant shall dedicate an applicable radius on Broadway Avenue and Hodges Road. Prior to ispance of 4 building-pernut or use of nropertV as nronosqA, 3. Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer. , 4. The applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. 5. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project, or portion thereof, if the development is to be phased. 6. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 7. To construct the roadway improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be willing to participate in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement, pursuant to RCW 36.88, as amended. Spokane County will not parricipate in the cost of these improvements. Th1S IS provision is applicable to that portion of Broadway Avenue to be realigned to and including Barker Road. 8. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required improvement. Spokane County will not participate in the cost of these improvements. This is provision is applicable to that portion of Broadway Avenue to be realigned to and including Barker Road. 9. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 10. The County Engineer has designated Typical Roadway Section Number One, Local Access standard for the improvement of Hodges Road, which is adjacent to the proposed development. This will require the addition of approximately 32 feet of HEC Order for ZE-22-94 Page 4 . • , asphalt along the frontage of the development. 1'he construcrion of curbing and sidewalk is also required. 11. The County Engineer has designated Typical Roadway Section Number One, Local Access standard for the improvement of Broadway Avenue, which is adjacent to the proposed developmenL This will require the addition of varying amounts of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 12. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construcrion and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 13. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. 14. No construction work shall be performed within the existing or proposed public right-of-way until a pernut has been issued by the County Engineer. All work within the public road right-of-way is subject to inspection and approval by t11e County Engineer. 15. All required construction within the existing or proposed public right-of-way is to be completed prior to the release of a building permit, or a bond in an amount estimated by the Counry Engineer to cover the cost of construction of improvements shall be filed with the County Engineer. 16. There may exist utilities, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisirion. . Spokane County assumes no financial obligation for adjustments or relocation regarding these utiliries. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the utility is responsible for adjustment or relocarion costs and to make arrangements for any necessary work. 17. At the rime of printing of these conditions, Broadway Avenue is a state facility under control of the State Department of Transportation. DOT, Spokane County Engineering and various property owners have been working together to realign Broadway Avenue, and in the process Broadway Avenue will be turned back to Spokane County. Without the realignment of Broadway Avenue, potenrially only right-in and right-out turning movements would be allowed from Barker Road. 18. Applicant shall sign and record Spokane County Notice to the Public No. 6 which specif'ies the following: The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) properry, and further not to object, by the signing of a ballot, the formation of a RID by the resolution method pursuant to Chapter 36.88 RCW, HEC Order for ZE-22-94 Page 5 • , . , which resolution includes the owner(s) property. If an RID is formed by either the petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement or construcrion contemplated within the proposed RID is . feasible; (b) that the benefits to be derived from the formarion of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment on the property as a result of the improvements called for in conjunction with the formation of the RID by either petition or resolurion method under Chapter 36.88 RCW. This requirement applies to that portion of Broadway Avenue to be realigned to and including Barker Road. 19. Spokane County requires that a traffic analysis be done prior to any building permits being issued on that portion of the proposed zone change that shows no specific uses. This analysis shall be coordinated with the Washington State Department of Transportation. SPOKANE COUNTY DIVISION OF UTILITIES 1. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 2. The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formarion of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecring to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution under RCW Chapter 36.94. 3. Applicant will make connection to Public Sewer System. Sewer Connection Permit is required. 4. Applicant is required to sign a Sewer Connection Agreement. HEC Order for ZE-22-94 Page 6 . . , , SPOKANE COUNTY HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Urilides, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. A public sewer system will be made available for the project, and individual service will be provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be authorized." 5. Use of private wells and water systems is prohibited. SPOKANE COUNTY DIVISION OF BUILDINGS 1. The applicant shall contact the Division of Buildings at the earliest possible stage in order to be informed of code requirements administeredlenforced as authorized by the State Buildings Code Act. Design/development concerns include: FIRE APPARATUS ACCESS ROADS; FIRE HYDRANT/FLOW; APPROVED WATER SYSTEMS; BUILDING ACCESSIBII.ITY; CONSTRUCTION TYPE; OCCUPANCY CLASSIFICATION; EXITING; EXTERIOR WALL PROTECTTON; AND ENERGY CODE REGULATIONS. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. This includes but is not limited to the following: 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather condirions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construcbon-related activiries. 3. SCAPCA strongly recommends that all traveled surfaces (ingress, egress, parlcing areas, access roads) must be paved and kept clean to minimize dust emissions. 4. SCAPCA Regulation I, Article V Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If traclang or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. SCAPCA Regulation I, Article, V requires that a Notice of Construction and Application for Approval be submitted to and approved by our Agency prior to the construction, installation or establishment of air pollution source. This includes fue41 fired equipment (oil, natural gas, etc...) that has an input rating greater that HEC Order for ZE-22-94 Page 7 • . 400,000 BTLT/hour and many other industnal/commercial activities. Because the Notice of Construction approval process can be lengthy, if any such equipment is being installed, the applicant should file the Notice of Construction as early as possible to avoid potential delays to the project. 6. SCAPCA Regulation I, Article IV requires registration 'with this agency. 7. Debris generated as a result of this project must be disposed of by means other than burning (i.e., construction waste, etc.). WASHINGTON STATE DEPARTMENT OF TRANSPORTATION 1. Due to the undefined uses proposed in this Regional Business (B-3) rezone request and the potential traff'ic impacts on the Barker Road/I-90 Interchange, WSDOT in conjunction with Spokane County Engineers requires that development, beyond the presently proposed nut factory and related maze, address traffic impacts once a proposed use is defined. This would necessitate that the applicant prepare a traffic analysis to document that adequate capacity is available at the interchange to accommodate the proposed development. If after review of this analysis it is deternzined that adequate capacity does exist WSDOT will certify this in writing to the County. If adequate capacity does not exist it will be the responsibility of the applicant to create the needed capacity before the proposed project moves forward. In either case adequate capacity must be available before any building permits are issued for this property (excluding the nut packing factory and the related maze). 2. T'hat the applicant enter into the proposed Road Improvement District (RID)/County Road Project (CRP) which is being formed by Spokane County Engineers in conjunction with WSDOT to provide for the improvement of Broadway Avenue and the realignment of Broadway Avenue at Barker Road. To construct the roadway improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be willing to participate in any petition or resolurion which purpose is the formation of a Road Improvement District (RID) for said improvement, pursuant to RCW 36.88, as amended. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the Counry Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required improvement. Spokane Counry will not participate in the cost of these improvements. This is provision is applicable to that portion of Broadway Avenue to be realigned to and including Barker Road. 9. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 10. The County Engineer has designated Typical Roadway Section Number One, Local Access standard for the improvement of Hodges Road, which is adjacent to the proposed development. This will require the addition of approximately 32 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. The County Engineer has designated Typical Roadway Section Number One, Local Access standard for the irnprovement of Broadway Avenue, which is adjacent to the proposed development. This will require the addition of varying amounts of asphalt along the frontage of the development. The construction of curbing and . sidewalk is also required. 12. All required 'unprovements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction and other apphcable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 13. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolurion No. 80-1592 as amended and are applicable to this proposal. 14. No construction work shall be performed within the existing or proposed public right-of-way until a pernut has been issued by the County Engineer. All work within the public road right-of-way is subject to inspection and approval by the County Engineer. 15. All required construction within the existing or proposed public right-of-way is to be completed prior to the release of a building permit, or a bond in an amount estimated by the County Engineer to cover the cost of construction of improvements shall be filed with the County Engineer. 16. There may exist uriliries, either underground or overhead, affecting the subject property, including property to be dedicated or set aside for future acquisition. Spokane County assumes no financial obligation for adjustments or relocation regarding these utiliries. Applicant(s) should check with the applicable utility purveyor and the Spokane County Engineer to determine whether applicant(s) or the utility is responsible for adjustment or relocarion costs and to make arrangements for any necessary work. 17. At the time of printing of these conditions, Broadway Avenue is a state facility under control of the State Department of Transportation. DOT, Spokane County Engineering and various property owners have been worlang together to realign Broadway Avenue, and in the process Broadway Avenue will be turned back to Spokane County. Without the realignment of Broadway Avenue, potentially only right-in and right-out turning movements would be allowed from Barker Road. 18. Applicant sha11 sign and record Spokane County Norice to the Public No. 6 which specifies the following: The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s) property, and further not to object, by the signing of a ballot, the formation of a RID by the resolurion method pursuant to Chapter 36.88 RCW, which resolurion includes the owner(s) property. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment on the property as a result of the improvements called for in conjuncrion with the formation of the RID by either petition or resolution method under Chapter 36.88 RCW. This requirement applies to that portion of Broadway Avenue to be realigned to and including Barker Road. 19. Spokane County requires that a traffic analysis be done prior to any building permits being issued on that portion of the proposed zone change that shows no specific uses. This analysis shall be coordinated with the Washington State Department of Transportation. SPOKANE COUNTY DIVISION QF UTILITIES 1. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 2. The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, ttus condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution under RCW Chapter 36.94. 3. Applicant will make connection to Public Sewer System. Sewer Connection Permit is required. 4. Applicant is required to sign a Sewer Connection Ageement. SPOKANE COUNTY HEALTH DISTRICT . 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. HEC Qrder for ZE-22-94 Page 6 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. A public sewer system will be made available for the project, and individual service will be provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be authorized." 5. Use of private wells and water systems is prohibited. SPOKANE COUNTY DIVISION OF BUILDINGS 1. The applicant shall contact the Division of Buildings at the earliest possible stage in order to be informed of code requirements administered/enforced as authorized by the State Buildings Code Act. Design/development concerns include: FIRE APPARATUS ACCESS ROADS; FIRE HYDRANT/FLOW; APPROVED WATER SYSTEMS; BUILDING ACCESSIBILITY; CONSTRUCTTON TYPE; OCCUPANCY CLASSIFICATION; EXITING; EXTERIOR WALL PROTECTION; AND ENERGY CODE REGULAT'IONS. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. This includes but is not limited to the following: 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprink.lers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related activiries. 3. SCAPCA strongly recommends that all traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean to minimize dust emissions. 4. SCAPCA Regulation I, Article V Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. SCAPCA Regulation I, Article, V requires that a Notice of Construction and Application for Approval be submitted to and approved by our Agency prior to the construction, installation or establishment of air pollurion source. This includes fue41 fired equipment (oil, natural gas, etc...) that has an input raring greater that 400,000 BTt1/hour and many other industrial/commercial activities. Because the Notice of Construcaon approval process can be lengthy, if any such equipment is being installed, the applicant should file the Notice of Construction as early as possible to avoid potential delays to the project. Debris generated as a result of this project must be disposed of by means other than burning (i.e., construction waste, etc.). WASHINGTON STATE DEPARTMENT OF TRANSPORTATION 1. Due to the undefined uses proposed in this Regional Business (B-3) rezone request and the potential traff'ic impacts on the Barker Road/I-90 Interchange, WSDOT in conjunction with Spokane County Engineers requires that development, beyond the presently proposed nut factory and related maze, address traffic impacts once a proposed use is defined. This would necessitate that the applicant prepare a traff'ic analysis to document that adequate capacity is available at the interchange to accommodate the proposed development. The Washington State Department of Transportation (WSDOT) has the following comments: • WSDOT requires a traffic analysis be conducted for the intersections of Broadway Avenue/Barker Road and I-90Barker Road to show this development can be safely accommodated prior to this zone change being placed on the public hearing schedule. This traffic study will need to take into account the already approved developments in this area. This traffic analysis will need to be included with the SEPA documents prepared for this zone change. Please contact WSDOT and Spokane County on this matter. . • If direct access to Broadway Avenue is deemed necessary, it must be approved by WSDOT, as our records show this section of Broadway Avenue is still on the State system. A valid WSDOT road approach permit must be obtained for direct access to Broadway Avenue prior to the issuance of any building pernuts for this project. Please be advised, WSDOT does not permit access to State facilities without prior knowledge of the future use of the property. • Due to the future need to widen I-90 in the Spokane Valley, WSDOT requests that this development maintain normal setbacks to I-90. No variances should be permitted which would allow less that normal required setback. • Broadway Avenue will need to be reconstructed to County Road Standards. In this area, the road will need to be built to the appropriate Spokane County Road Standards, Typical Roadway Standards Section #1,.Loca1 Access Roadway. The applicant will be re9uired to dedicate the necessary right of way, and to construct the roadway across the site's frontage. • WSDOT has recognized the eventual need to realign Broadway Avenue at Barker Road to line up with the existing Barker Road on the west side. Re: Premier Packing B-3 Zone Change Request Dear Mr. Davenport: In regard to the above developmeni the applicant is asking for a B-3 rezone to accommodate a nut packing facility and other unknown uses which the B-3 zoning would allow. Due to the limited ability of the present Barker Roadll-90 Intetchange to accommodate additional traffic and the traffic generation potential of the unknown B-3 uses WSDOT and the County Engineet's working in conjunction with the applicant requasts that the following conditions be applied to this zone change. 1. Due to the undefined uses proposed in this B-3 rezone request and the potential tratTic impacts on the Barker Road/I-90 Interchange, WSDOT in conjunction with Spokane County Engineers requires that development, beyond the presentty proposed nut factory and related maze, address traffic impacts once a proposed use is defined. This would necessitate that the applicant prepare a traffic analysis to document that adequate capacity is avaitable at the interchange to accommodate the proposed development. If after tev;ew of this analysis it is determined that adequate capacity does exist, WSDOT will certify this in wtiting to the County. If adequate capacity does not exist it will be the responsibility of the applicant to create the needed capacity before the proposed project moves forward. In either case adoquate capacity must be available before any building permits are issued for this property (excluding the nut packing factory and the related maze). 2. That the applicant enter into the proposed Road Jmprovement District (RID)/County Road Project (CRP) which is being formed by Spokane County Engineers in conjunction with WSDOT to provide for the improvement of Broadway Ave. and the realignment of Broadway Ave. at Barker Road. Change of Conditions Requiring Rezoning Background The area is about ten miles from the center of Spokane. it is approximately 1-1/2 miles east of the Sullivan exit and has aiways been perceived as "far out" by people living in Spokane. Since Barker Road is only approximately 4 miles from Idaho, it was often easier for a business to "go the extra mile" and move over to Idaho. At ihe same time the Interstate was built in the mid 1960's and this opened the area to changing uses. About ten years after it opened Gordon Curry decided he wanted to operate a motel, restaurant, and truck stop at this exit and in 1976 he went in for a zone change to Freeway Commercial. The project failed for lack of financing and the land sat dormant designated Freeway Commercial. Meanwhile the character of the neighborhood changed from rural orchards and small lanes to a haven for trailers and people looking for country lifestyles. While they never moved close to this area, the entire part of the 1981 Comprehensive Plan reflected this rural lifesfyle with urban as the designation. The planners failed to notice the mistake that they had placed both sides of the freeway in industrial but had omitted this piece which was already zoned Freeway Commerciaf. Across the Freeway United Paint, Capp Homes, Evergreen Lumber, Georgia Pacific, GTX Truck Stop, Alpine Motel, KOA Kampground, Sonderen Box, and several other commercial businesses had located. On ihe south side of the freeway a commercial saddle shop had located at the interchange. - All up and down the freeway commercial development was happening. Sulfivan Road announced three shopping centers and Sullivan has developed into a major commercial street. At the same time the next interchange and the last freeway cloverleaf before Idaho intended to build a shopping center with Cafaro, but the project felt through. The land is still constantly offered as a site for future commercial expansion. Across the street a new zip trip came in and succeeded along Harvard Road, and recently a 50,000 sq ft Albertsons opened and four more businesses totalling 60,000 square feet are being planned for opening next year adjacent to the Albertsons. Across the State Line ihe development has been explosive during the 18 years. The Greyhound track is well established since 1988. The Factory Outlet stores were meadowland in 1987 and today they are announcing their third phase in just 6 years. The Jacklin Riverbend Industrial Park has built seven buildings over the last five years and continues to expand. And across the highway theWatson interests have announced a new Fred Meyer store on 600 acres of park with a huge complex of businesses. All up and down the fdaho I-90 corridor the land is disappearing with consiruction and projects. In fact, the only area not yet built on is the last meadows for the four miles from 6arker to the Idaho border. Some land lacks sewer and some has poor roads. Some have unwilling sellers and hesitant buyers. Water districts serving the area are not taking on new accounts. So the • , meadowland is there because government has not found an easy way to allow simple development. Appleway At the same time Appieway has been in a state of transition. From Suliivan Road to the entry to the Freeway things are rapidfy changing. Businesses are buying up the remaining open land and prices are skyrocketing. The rural fifestyle is disappearing and all the acreage is going commercial. The land between Barker, Appleway, and interstate 90 is a prime triangie of useable land. It serves no purpose as urban which is the designation on the comprehensive pfan. In fact, ihere is little housing in the area and the transition is definitely to commercial use. In the last few years with bus transportation available, sewer adjacent to Appleway, and all services readiiy available, the area has become ripe for change. A new post office at Barker and Appleway, and a new convenience store on both opposite corners signals the start of commercial uses. Appleway has Staley Oil, a new fire station, and Olympic Boat Marine as a few of their users in this triangle. An upholstery shop, insulation company, and other smaller businesses dot the area and the predominant characteristic of the neighborhood has changed to a commercial use. Broadway This specific area has been held back because the ownership has been predominantly in the hands of two parties - neither wanting to sell. Gordon Currie owned over 30 acres adjoining the freeway for 1/2 mile and fronting on Appleway for 1,000 feet. The adjacent 1,400 feet on the freeway are owned by Inland Empire Paper who also fronts for 1,400 feet on Appleway. They also do not intend selling their land. Therefore the land has sat fallow for many decades. In the past two years has the land in this area has become dear. Dramatic growth and a lack of good commercial sites has forced more and more businesses to look out farther from the city borders. Frankly, there is little {and left that adjoins the freeway and has services available and this piece of (and may be one of the few (if not the last piece) that meets all the criteria for commercial use along the freeway. It has good service roads, fire, water, and sewer. It is large enough to plan its use well and landscape liberally. The Changing Conditions . In 1981 when the Comprehensive Plan was implemented this land was already known to be a commercial site since it had been rezoned five years prior. In 1991 the land was changed to read - B-3 without the owner's input. That may or may not have been a good choice. Whatever the case, the urban designation did not fit this area. Housing along the freeway is the poorest choice for land use. This area is far removed from those days when urban housing would have made sense. Businesses that rely on the freeway and ihe business they can support are a proper use for this area. The land was zoned Freeway Commercial for 16 years which meant that the predominant use was gas station, motel, restaurants, retail, novelty stores, and chocolate/confectionery stores. These are tourist orientated retail businesses. Our use is similar. We intend to attract people from the neighborhood and freeway. Otherwise if we were really a food plant we could have located in an obscure location on low priced land. / 1 4 The proof of our sincerity is that we have paid a lot for very visible land. We want to build a Factory Store and Viewing Piant where the public can see product made and packaged. Restaurants do that to a limited degree. This activity is orientated to the pubiic. We will be retailing to the public many products. Some we wiii make and some we simply resell like any siore. The Spokane County Planning Department has administratively ruled that our use is less of a candy/confectionery business. They are labeling us a Food Products Manufacturing (Not Otherwise Indicated). The zoning for a candy/confectionery business parallels that zoning for restaurants. They prepare and se11 of food to the public - even though they make the products they sell. The category of a Food Products Manufacture - Not Otherwise Indicated falls in the Industrial-2 Zoning. Rather than appeal their administrative decision it was agreed that a request for rezoning under a portion of the land as I-2 would be a better solution. It keeps the issue in accordance with both parties wishes. Rezoning is usually a process that has a negative impression. In this case we adjoin an industriai piece of land on both the north and west. Therefore, this is a transition zone. Ours is more a need to comply with a situation that has no right answer. The plan does not speak to roasting and selling nuts. Therefore we must be fit into some category which may be open to interpretation. We are asking for a new B-3 designation for the other part of the land to keep in compiiance with the reasonable use of this type of land as a tourist and retail use area adjacent to the freeway. This part of our land adjoins a B-3 on the other two sides and is compatible with the surrounding zoning. We only have four neighbors near us and two of them are across the freeway. Nobody has expressed any negatives and I think we are a fine addition to the mixture of businesses in the area. Summation This area will continue to move to a business orientation. Our business is a clean activity with little impact on ihe neighborhood. We offer an unusual food activity and a lot of fun for those who want fun in their life. The need for an industrial zone classification is an anomaly of the zoning code and the result of an interpretation by the people who make those decisions.
